It really helps us do original reporting like this. 🔍 Episode Overview: On August 9, 2022, at about 8:55 PM, Patrolman Thomas Anderson from the Evesham Township Police Department received a call about a car accident on Taunton Lake Road. He arrived at the scene by 9:00 PM and saw a 2018 Nissan Rogue that had hit the guardrails on both sides of the road. The car was blocking the bridge in front of 199 Taunton Lake Road. Patrolwoman Danielle Torres approached the driver, who was being checked by first responders. The driver was identified as Marie Mendez. Marie decided not to seek more medical help. Patrolman Anderson spoke to two witnesses. They said Marie had been following their car too closely and saw the crash happen. The witnesses also mentioned they spotted a bottle of wine inside her vehicle. Because of the smell of alcohol and their statements, the officers started a DWI investigation. Marie told the officers she had just left her mother's house and denied drinking any alcohol. However, they asked her to do some field sobriety tests. Sergeant Robert Hansbury began by conducting the Horizontal Gaze Nystagmus (HGN) test. He noticed that Marie's eyes did not move smoothly. There was a clear, continuous shaking when her eyes were turned to the side, and the shaking started before reaching a 45-degree angle in both eyes. Next, Patrolman Anderson administered the Walk and Turn test. Marie struggled, failing to place her heel against her toe with each step, keeping her arms down, and taking the wrong number of steps. Finally, she attempted the One Leg Stand test. Marie could not lift her foot correctly and showed poor balance. Marie found herself in serious trouble after a motor vehicle accident. The smell of alcohol was strong, and a witness reported seeing a bottle of wine with her. She struggled to complete the field sobriety tests, leading to her arrest for driving while drunk. Patrolman Anderson took her to the Evesham Township Police Department for processing. Her car was towed and would stay impounded for 12 hours, following the rules set by John’s Law. At the Evesham Township Police Department, Patrolwoman Torres informed her of the Standard Statement for Motor Vehicle Operators. She agreed to provide breath samples. The Alcotest showed her blood alcohol content (BAC) was 0.19%, which is more than double the legal limit of 0.08%. After the processing, Marie was released to a sober adult. He signed the Potential Liability Warning form for her. Patrolman Anderson then issued her several summonses: operating under the influence, careless driving, traffic violations in marked lanes, and having an open container. On November 26, 2022, Marie was arrested for DWI in Evesham Township, New Jersey. By March 16, 2023, she was found guilty of careless driving, which led to a 90-day suspension of her license. The other three citations she received were dismissed as part of a plea deal. On that same day, she was also convicted for the DWI from November 26, 2022. The remaining charges for traffic violations from that incident, including marked lanes and reckless driving, were also dismissed under the same agreement.
