I was completely driving normally and I probably drove off the road because I couldn't see, which I replaced several tires for. Yeah. And then whoever was behind me, I mean I'm I'm I'm pretty sure this white driver was actually behind me. Yeah. All right, where do you come from today? Oh boy, this is my mom's house. Where is that? Marie declined further medical attention. Patrolman Anderson spoke with two witnesses who claimed that Marie had tailgated behind their vehicle and that they observed the crash. The witnesses also informed Patrolman Anderson that they observed a bottle of wine inside the vehicle. Based on the odor of alcohol and the witness accounts, the officers began their DWI investigation. Marie told the officers that she was coming from her mother's residence and denied consuming alcohol, but she was asked to perform field sobriety exercises. I mean, what town is that? Oh, Radnor? Yeah, I I can smell the odor of an alcoholic beverage on you guys, so Um are you sure you haven't had anything to drink tonight? Okay. All right. No problem. So, in the meantime, obviously, your car is going to have to be towed. The airbags that are deployed, obviously, the entire wheel is off. That's yours. So, yeah, you can hold on to your keys. the key fob to uh fire. He's got that. Okay. Yep. Any medical issues or anything like that? Sergeant Robert Hansberry started with the horizontal gaze nystagmus HGN test. During the HGN test, Sergeant Hansberry observed the lack of smooth pursuit and distinct sustained nystagmus at maximum deviation in both eyes, and the onset of nystagmus prior to 45° in both eyes. The second exercise was the walk and turn test and it was administered by Patrolman Anderson. During the walk and turn test, Marie did not touch heel-to-toe on each step, failed to keep her arms at her sides, and took an incorrect number of steps. First, I'm going to explain the test, then I'm going to demonstrate it, and then I'm going to ask you to demonstrate it, okay? Okay. So, to start each test, there's a starting position, okay? So, the starting position for this test is with your right foot back, put your left foot in front so that your heel and your toe are touching, okay? With your hands at your sides. So, I'm going to ask you to get in this position now, okay? Right here? Correct. Right foot back, left foot in front. Yes. Awesome. We're just heel Heel to toe touching. Ooh. Just like that. Right. Awesome. So, you just stay in that position until we begin the test, okay? What you're going to do is you're going to take nine heel to toe steps forward in a straight line, okay? With your hands at your sides, heel to toe touching every step, okay? On your ninth step, you're going to leave one foot planted, take a few steps to turn around, and you're going to take nine heel to toe steps forward again in a straight line, okay? Okay. So, I'm going to demonstrate it for you, all right? I'm in my starting position, heel to toe touching. One, two, three, four, five, all the way up to nine. One foot planted. Use the small steps to turn around. One, two, three, four, five, all the way up to nine, okay? Yep. Do you have any injuries, anything in your anything that would affect your balance or anything to that effect? No? think so. All right. It's all right. Okay. I could do nine. You feel like you can do it better with nine steps? It's fine. Go ahead. What's up? All right. Next test, okay? Again, this is There's a starting position for this test, okay? The starting position for this test with both feet together, with your hands at your sides, okay? So, I'm going to ask you to get in this position and stay in this position until we begin the test. Okay. What you're going to do is you're going to pick one leg, whichever one whichever leg you're more comfortable with, and you're going to lift it up 2 1,000, 3 1,000, and you're going to keep counting until I tell you to stop. Okay. This is what it's going to look like, all right? I'm going to choose my right leg. Again, you can choose whichever leg you're more comfortable Any questions about that test? Okay. All right. You can begin when you're ready. Ready. I went down. Just keep going. Yep. Keep going until you until you stop. Okay, you can stop. Thank you. You can put your sandals back on. Okay. All right. So, listen. You're saying you haven't had any alcoholic beverage tonight? No. Beverage tonight? Nope. Okay, you haven't had any other substances? No. No prescription medication? No. All right.
