Hoboken Police Officers Aaron Font and Valentino Salgado watched the Acura. They followed it north on Bloomfield Street. Lights flashed, and the driver pulled over. The stop occurred at Second and Bloomfield Streets. Officer Font approached the driver. He identified the man as David, age 24. David fumbled for his documents. Officer Font smelled alcohol. He saw signs the driver was impaired. David denied drinking any alcohol. Officer Font asked him to exit the car. He needed David to take sobriety tests. First, Officer Font conducted the HGN test. He noticed David's eyes didn't track smoothly. They also jerked and stayed fixed. Nystagmus began before the 45-degree mark. Vertical gaze nystagmus was not present. Next came the Walk and Turn test. David turned incorrectly. He also failed to step heel-to-toe. The final test was the One Leg Stand. David couldn't lift his foot properly. He also counted the seconds wrong. Officer Font told David he smelled alcohol again. David still insisted he hadn't drunk. The alcohol smell and failed tests led to arrest. John's Law dictated a 12-hour hold for the car. It was impounded. Officer Font took David to the police station. There, he refused to provide breath samples. He heard the Standard Statement for Motor Vehicle Operators.
