It really helps us do original reporting like this. 🔍 Episode Overview: Officer Matthew Toro of the Eau Claire Police was watching the Regency Hotel. It was around 1:10 AM on May 6, 2024. He saw a 2004 Chevrolet pickup truck break the law. The driver failed to stop at a stop sign. She also made a bad turn at Kirk Street and Esmond Road. Officer Toro turned on his lights to stop her. She pulled over on Valmont Avenue, between S Hastings Way and Fairfax Street. The officer talked to the driver, Thea, who was 21. He asked where she had been. Thea said she was at the 5 O’Clock Club. She also said she had been at the Alibi Lounge. Later, she added that she had left work at the Smithtowne Pub. Officer Toro spoke with Thea, noticing a smell of alcohol. He saw other signs of her being impaired. "How much did you drink?" he asked. At first, Thea said she had nothing to drink. Then she said she had one Tito’s. Her story about where she came from didn't make sense. Officer Noah Baumgarten arrived to help. He was from the Altoona Police Department. Toro went back to his car to check Thea's information. Officer Margaret Andersen also arrived to assist. Toro suspected Thea was impaired. He asked her to get out of the car. She needed to do some sobriety tests. Officer Toro started with the Horizontal Gaze Nystagmus test. He watched Thea's eyes. They did not move smoothly. Her eyes jerked at the extreme edge. The jerking started before her gaze hit 45 degrees. He saw no vertical jerking. Next, Thea tried the Walk and Turn. She did not walk heel-to-toe each time. Her steps were off. Her turn was bad. She used her arms to keep her balance. Finally, Thea did the One Leg Stand. She did not lift her foot right. She put her foot down too many times. She could not finish the test. The field sobriety exercises ended. Thea refused the breath test. Her driving was bad. She showed signs of drunkness. Thea admitted to drinking. She failed the sobriety tests. So, officers arrested Thea for OWI. Before being led to Officer Andersen’s car, Toro searched Thea. They moved Thea’s car to the AutoZone lot. It was not towed. As Andersen finished her forms, Thea threw up. Most of it landed in the patrol car. Andersen read Thea the Informing the Accused form. Thea then refused to give breath samples. Thea was on probation, so Officer Anderson placed a hold on her. She would be booked into jail. Then, Officer Anderson took Thea to the Eau Claire County Jail. At 2:51 AM, Thea gave a PBT sample for the jail staff. Her BAC level was 0.225%.
