doing today I'm good is this okay yep this around 1:10 a.m. on May 6 2024 officer Matthew Torah with the oakair police department was on patrol on Kirk Street and Esmond Road watching the Regency Hotel he observed a 2,000 for Chevrolet pickup truck failing to stop at a stop sign and making an improper turn he activated his emergency lights to initiate a traffic stop and the driver pulled over on vmont Avenue between s Hastings way and Fairfax Street he made contact with the driver who was identified as 21-year-old Thea and he asked her where she was coming from Thea told officer Torah that she was coming from the 5:00 club and she also claimed to have been at The Alibi Lounge she would later state that she had left work at the Smith Town PB as well this is perfect so I'm Matthew with oair police depart the reason why I stopped you is that stop sign right off Kirk as you were coming out of out of the Regency you just went right through it there's a stop sign right there that three-way stop wait what that so when you pulled left out of the Regency parking lot that's a three-way stop so there's a stop sign going in the direction you were traveling where you make a left or right you chose to make a left and then turn left onto Hastings that little street right there there's a three-way stops sign right there okay I guess I'm not understanding so when you you know you were in the Regency parking you know you were at the Regency right okay you know how you I wasn't at the Regency I was probably going I don't know okay okay where where were you coming from today 5:00 I was picking up my ey you were what I was picking my up my aunt okay you picking up your aunt what were you doing at the 5:00 um I guess I wasn't actually picking up up my aunt but I was going I was actually at the 5:00 okay what were you doing at the 5:00 I was just waiting there for her okay did you have any drinks there what did you have anything to drink there no no okay well like I said when you pulled left out of that Regency parking lot there's a stop sign right there and you went right through it okay so and then I also observed when you making I didn't stop you did not stop no and then when you're making a left on the Hastings you made an improper left turn when you're turning left you have to stay in that lane that left lane and you drifted off into the right okay so not the end of the world but like I said you you were coming from the 5:00 bar okay you were coming from the 5:00 bar I'm not sure at the point I'm not sure where you were at no no that's okay I'm yeah I'm just C so you said you were at the 5:00 bar yeah I was I was at both but I was waiting for my aunt what other bar were you at I was just waiting for her at The Alibi okay you were at The Alibi waiting for yourt Swit to um 5:00 but then I never had to her okay gotcha so you were just hanging out there you went from The Alibi to the 5:00 right you didn't have a single drink cuz I'll be honest it kind believe it's Edmond or Esmond blew that stop sign where I was sitting I can't really tell if she actually blew it or not but like she there was no signs of she like slowed down she just accelerated through it9 stopped at the Regency was pulling out of the Regency on Kirk Street um blew that stop sign and then made a left on a Hastings improper left turn um stopped her here um she's sling her words said she was coming from the 5:00 and was at the Alba at some point I asked her if she was drinking anything and Point she said no initially and then I was like well it kind of sounds like you can drink cuz she's saring her words a little bit and then she was like yeah okay I did have something to drink she said she had Tios so I'm going to check her out check the plate on this but then we're doing Fields sounds good appreciate you stepping out you found what you're looking for right so where you trying to go so draw from here I never okay I guess I'm just I'm super confused because you said you drove from St here I came to O to pick up my then I was and then I left to get drever as he was speaking with Thea officer Torah detected the odor of alcohol and observed other indicators of impairment he asked Thea how much she had to drink antha initially denied having consumed any alcohol before admitting to consuming one Tios she contradicted herself multiple times when trying to explain where she was coming from around this time officer Noah Bal Garden from the neighboring Altuna Police Department arrived on scene to assist and officer Tor returned to his patrol car to run her information through the system officer Margaret Anderson also arrived on scene to assist based on his suspicion of impairment Theo was asked to exit the vehicle and perform field sobriety exercises okay all righty well if you want to help out my partner is going to talk to you a little bit more and uh we'll kind of go yeah so he's conducting an an investigation right now okay so he's getting some signs of intoxication um I'm also getting the same signs that he's telling me about so he just wants to do some test with you make sure that you're use your phone if you want to put that in the car thank you yep I appreciate you let me use it so like my partner said to um um based on your driving behavior and the fact that you're coming from bars and you said you had how many drinks did you have uh none none but I was here to pick up my aunt okay you told me you had a uh i' never told you mios okay well I have that on thought I came recorded show flashlight yeah absolutely you said Bush light flashlight okay okay so okay now I'm getting mixed stories you said you didn't have anything to drink but earlier you told me you did have something to drink right so did you or did you not have some um I was at 5:00 and she was having bus light with her uh I don't know what it was but okay what did you have I I don't it was at the I don't know what it's called Alby yeah what did you have to drink none you didn't have anything to drink at the AL did you have anything to drink at 5:00 bar no okay so you're at both bars doing what exactly I was just waiting for my aunt to I was just gotcha so like I said based off of the driving habits you seem like you're kind of slaying your words and I'm not kind of getting a good story I'd like to do a field sobriety test with you if you be you're not getting complete story huh you're not getting complete story y the story just keeps kind of changing on me and I'm just not understanding so based on that I don't think you're fit to drive and I'd like to be able to do field Sprat test with you okay so that maybe maybe you are fit to drive and you can just prove to me otherwise okay if that's all right with you okay okay that's okay all you have to do is follow this to my fing it might be brighter okay okay okay do you have any other medical conditions that no just it makes it the first field sobriety exercise involved the horizontal gaze nagus hgn test during the hgn test officer Torah observed the lack of smooth Pursuit distinct and sustained nice stmas at maximum deviation and the onset of nagus prior to 45° he did not observe vertical nagus the second exercise was the walk and turn test an theia failed to touch Heel To Toe on each step took an incorrect number of steps turned improperly and used her arms for balance the final field sobriety exercise was the one leg stand test during the one leg stand test Thea failed to raise her foot in the proper her fashion and put her foot down multiple times before the test was complete just brighter just brighter what's brighter oh like the light you're going to look okay so like if you're like stopping for a green light it would be like got more lights okay I don't know if you know it anything is it when like you look at something it kind of like the lights kind of like stretch out a little bit kind of Branch out yeah okay yep I know what you're talking about okay okay so perfect I appreciate you tell me that so like I said just look at this if you can just follow the light with your eyes from your face oh okay okay so I'm sorry no that's all right e can I put my together yep you can just bring your arms out to your side like if you could just bring them out to the side of your body you just you can hold them against your body like that I understand it's okay okay awesome thank you so for this next test we're going to it's called the walk and turn test what I'm going to have you do before I explain any instructions or do the test I'm going to give you instructions on a position that I want you to assume before the test begins so what I want you to do take your right foot put it in front of your left foot heel to toe like so okay so if you can do that for me right now this is the position okay can I have a second you need a second all I see is like yellow okay yep okay just let me know when you're ready okay and also if if it's too cold out here this is something that if if you're willing to do we could go to the police department we could do it in the garage where it's not cold outside it be I think I have a jacket together perfect like that arms down at your side and I want you to stay in this position until I tell you to begin the test do you understand right if you could just keep your arms down at your side thank you so like I said I want you to stay in that position for this test what I'm going to have you do is take nine Heel To Toe steps forward turn using a series of small steps and then take nine Heel To Toe steps back I'm going to demonstrate that test by doing three steps you're going to do nine my demonstration will be three okay so if you could just stay in that position for me please I'd really appreciate that so what you're going to do with your lead forward forward you're going to go one 2 3 looking down at your feet counting out your steps and then when you you get to nine I want you to take a series of small steps and do a turn like so take your back foot series of small steps like this bring that back foot in front of your front of your left foot and then series of and then take nine steps back Heel To Toe okay okay do you understand the test right perfect you can just stay in that with your arms down on your side do you need me to explain the test at all again or do you understand it okay okay whenever you're ready you may begin one two three if you could just keep your arms down at your side [Applause] five n 10 you said how many I said do nine but do you do the on against anything so you're going to bring one foot foot raised up like so arms down your side I want you to look at your toes and I want you to count to 30 in this fashion 1 1,000 2 1000 3 1,000 4 1000 and continue out loud yes out loud okay yep while looking at your feet arms down at your side and like I said you can choose whichever foot you want and then I want you to count until I tell you haven't had anything to drink tonight okay so you came from two bars tonight but you didn't have a single drink I started okay I ended my shift at South Town do you know what that is South toown off what is you do um it's just basically it's just a um after the field sobriety exercises were completed Theo was offered an opportunity to blow into a preliminary breath test PBT but she ultimately refused bar mhm it is a bar what do you mean I'm just curious what you do for work you said you were coming from work okay okay um I just serve people drinks and I reack um I don't know what you call it it was my first day today so is it a bar it's a pub Pub okay gotcha but it was my first day today and um I basically restack the um coolers and um bar or what Pub uh what's it called South pal Pub oh okay I I I also work at um corner corner pub in uh Paul Creek gotcha yeah okay so you went from there to then you left work no I worked at uh South toown okay and then you left there correct right and then you I was here I was there basically the gotcha and then you went to The Alibi right okay and then you went to um 5:00 bar on my way yeah okay and then you went towards the Regency and then that's when I I saw you over there does that sound about right I don't remember okay no worries would you be willing to provide a PBT score today a PBT score personal breathalyzer test Bally you'll just blow into the tube and then it'll provide a sample you ever have you ever done um like uh what do you call it um what do you call it need needed uh needed it I guess that's more subjective I mean her indicators of impairment her admission to consuming alcohol and her inability to perform the field sobriety tests adequately Theo was placed under arrest for operating while intoxicated AI so at conducting a search of her vehicle her vehicle was moved into the parking lot of the nearby autoone instead of being towed as officer Anderson was completing her paperwork Thea vomited and nearly all of the liquid landed inside her patrol car Thea indicated to officer Anderson that she was not willing to submit breath samples after the informing the accused form was read to her blew the first stop sign took a left on Hastings and prop a left turn Okay um put my lights on her here in here um quite a ways yeah the story changed multiple times um he said she was at 5:00 okay she was at the 5:00 wait picking up her ant aunt but never picked up her aunt and said she went to the Al I'm thinking that's when she was coming from when I found her the Regency okay but I mean story changed multiple times she told me that she had a Tito drink I don't know if it was a mixed drink or a shot or anything like that she didn't specify okay and then I mean you saw Fields yeah sure slaying award soon as staff at the 51 a.m and the results indicated a back level of 0. to 25% she was issued the following citations operating while intoxicated first 34663 1 improper left turn 346 313 and failure to stop
