It really helps us do original reporting like this. 🔍 Episode Overview: At about 2:02 AM on April 8, 2023, Officer Thomas Anzalone saw a 2001 Mercedes swerving on Route 206 in Hillsborough, New Jersey. He turned on his lights and chased the car, which eventually pulled into a QuickChek parking lot. As Officer Anzalone walked to the car, he asked the driver, 23-year-old Mark Kwiatek, where he had been. Mark said he and his girlfriend were at The Club House in Somerville and later admitted to having three drinks. When asked separately, his girlfriend confirmed that he had indeed consumed three drinks at the same location. Another officer soon arrived to help at the scene. Officer Anzalone suspected Mark was impaired and asked him to do field sobriety tests. The first test was the Horizontal Gaze Nystagmus. Next, Mark attempted the Walk and Turn test, but he could not walk heel-to-toe or turn as directed. The last test was the One Leg Stand, which Mark also struggled with; he did not raise his foot correctly or count in the right order. Officer Anzalone arrested Mark for driving under the influence because he could not complete the field sobriety tests. After the arrest, Mark's vehicle was searched and impounded for a mandatory 12 hours according to John’s Law. Officer Anzalone took Mark to the Hillsborough Township Police Headquarters. Once there, Mark was read his Miranda rights and the Standard Statement for Motor Vehicle Operators. He agreed to take breath tests, and the results showed a blood alcohol concentration of 0.07%. After Mark completed the processing, he was released to a sober individual who signed the Potential Liability Warning form for him. Officer Anzalone issued several summonses to him, including charges for operating under the influence, careless driving, not signaling properly, ignoring traffic signs, and violating lane restrictions.
