The caller explained that he was driving his 2019 BMW west on Skokie Valley Road when a 2016 Mercedes suddenly swerved into the passenger side of his car as he neared the intersection with Half Day Road. Following the collision, the Mercedes driver attempted to flee, prompting the BMW driver to follow her. During the chase, he saw the Mercedes skid off the road and into a ditch. After talking with the caller, Officer Tolmie approached the Mercedes, which was now in the ditch, and asked the driver, identified as Rachel Leshchinsky, to get out of the vehicle. Rachel stepped out of the car and lit a cigarette. Officer Tolmie noticed a strong smell of alcohol. When asked where she had been, Rachel said she was coming from Libertyville, trying to go on a date. Officer Tolmie observed that her eyes were glassy and bloodshot, and her speech was slurred. He questioned her about how much she had been drinking. Rachel first denied having any alcohol. Sensing she might be impaired, Officer Tolmie suggested that Rachel take part in some field sobriety tests. The first test was the Horizontal Gaze Nystagmus (HGN). Officer Tolmie noticed Rachel could not follow smoothly. He observed clear signs of nystagmus when her eyes reached their farthest point and saw it starting before she turned 45 degrees. Next was the Walk and Turn test. Rachel tried this test twice but could not keep her balance or walk heel-to-toe, so Officer Tolmie stopped the test for her safety. The last test was the One Leg Stand. Rachel struggled to lift her foot correctly and began to lean to the left after about five seconds. For safety reasons, this test was also stopped. After the field sobriety tests, Officer Tolmie asked Rachel to take a Preliminary Breath Test (PBT). The PBT showed that Rachel’s blood alcohol concentration (BAC) was 0.32%, which is four times the legal limit of 0.08%. Given Rachel's signs of impairment, her failure to complete the sobriety tests, and the PBT results, Officer Tolmie arrested her for driving under the influence. Once handcuffed, Rachel was placed in the patrol car. A search of her vehicle found three cartons of Verdange Pinot Grigio wine in the back. The officers first took Rachel to Highland Park Hospital for evaluation. At the hospital, she informed the staff that she had consumed about two jugs of wine. After they explained the Warning to Motorist form, Rachel agreed to provide blood and urine samples for testing. Once she was released, the officers drove her to the Highland Park Police Department for further processing. At the station, they informed her of her rights, which she chose to waive so she could answer questions. During the questioning, Rachel confessed to drinking wine before the accident. After being questioned, Rachel had her photo taken and her fingerprints recorded. Once the processing was complete, she was released to another adult on a Recognizance Bond while waiting for her court date. Officer Tolmie charged Rachel with several offenses: driving under the influence, illegally transporting alcohol, ignoring a traffic sign, driving with a revoked registration, leaving the scene of an accident with damage, and failing to slow down to prevent a crash. 2:41 ooooh honey… you can’t REALLY think you look sober? 3:41 I just want to go home.
