awesome okay you're at a 320 [Applause] okay how much have you had to drink on August 5th 2023 approximately 9:03 p.m. officers Matthew Tommy and pjb with the Highland Park Police Department responded to an accident call near the mutual Ace Hardware Store parking lot the officers made contact with the caller who told the officers that he was driving his 2019 BMW westbound on skoki Valley Road and a 2016 Mercedes wed into the passenger side of his vehicle as he approached the intersection with Half Day Road after the accident the driver of the Mercedes fled the scene while the driver of the BMW followed her as he was following her he noticed the Mercedes skid into a ditch after speaking with the caller the officer Tommy approached the Mercedes which was in a ditch nearby he made contact with the driver later identified as Rachel lashinsky and instructed to access the vehicle 32 that's that's the need to get out right are you hurt no absolutely not um right there she kind of stumbling a little bit Sam have you been drinking tonight no um not yet not yet no are you sure I'm spelling an odor of alcohol do you have any alcohol in the car maybe no no where you coming from I was going to Libertyville to to up some I'm trying to call my parents um I'm why don't you stay right here for me okay okay can you tell me what happen just trying to get off just a bad night and um what road were you driving on so you're going 41 nework where you turn around 60 sure around 60 mhm okay and you're start heading back south this way yeah when did we hit this car here or did they hit you what happened I just wanted to go home okay and here I am um I really want to tell my parents and just all right ma' do you see that curb right there I'm going to have you go take a seat at it okay sure town Rachel began to smoke a cigarette as she exited the vehicle and officer Tommy also detected the odor of alcohol when Rachel was asked where she was coming from she told the officers that she was coming from Libertyville where she had been trying to go on a date officer Tommy noticed that Rachel's eyes were glassy and bloodshot and she was slurring Her speech so he asked her how much she had been drinking Rachel initially denied consuming alcohol based on his suspicion of impairment officer Tommy offered Rachel an opportunity to participate in field sobriety exercises sorry I'm shaking I'm like freaking out like I cannot even believe mhm are you sure you're not injured yes and I just want to like get all right so we're just going to figure things out with the crash and then we'll see if how we can get you home or get you a ride or was going on a date and like that didn't work out and you just got you just you just had the date didn't go good it didn't happen no what [Applause] happened he didn't want to go on the date so just start asking her name um basic questions I said where do you live she was like fig out it like like you said sheble to give you it she wasn't able to tell you what Happ yeah she wasn't able to tell you where she coming from um and how much how much you Dr I can spell the alcohol maybe not even said how much you drink you drink much I kind kind of smell it you knowel I'm a chance to introduce myself Rachel what's your last name how do I spell that l e s h c h i n s a y so I have l at what happened from that car from that perspective can you tell me from your perspective what happened I know we are going to go home I'm like we're in Libertyville um I don't even know I got lost in Libertyville tring trying to go on the state and then um I don't know I got like lost and lost yeah and then just happening restaurants in lville and a whole street down that way no okay didn't stop anywhere cuz I wanted to stop and I couldn't even get to where I wanted to stop so um Rachel how much we had to drink long you been in 8 for 3 years 3 years uh July 1 July 1 this year or July 1 for years ago July 1st this year okay this year this this okay you take any medication or anything like that do you you smoke or anything what's that well I smoke but like I don't I'm not anything I'm just oh my God shaking his like cannot believe it hurts yeah so what I got told is that you got no car acent right on C Road how did we end up over [Applause] here I have no idea idea you don't know how you end up in the ditch well yeah I was trying to get out and then okay might got to hit a car on the way here yeah do you not remember hitting that car of course I remember okay when you said you smoke is it just cigarettes or do do you smoke weed cigarettes cigarettes all right Rachel Hang Time and talk to the sergeant real quick I got to get in touch with my parents is that okay you need to what I need to get inou my friends okay for [Applause] Rachel I just heard that there was a Chevy blue Chevy try to like check on you might have been following you were they with you at all know they didn't swing around and try to talk to you while you're in the ditch see if you're okay you're the first person you saw yeah okay so Rachel I know you said you weren't drinking but we're going to do some buety tests if you're willing just to confirm that just make sure you're safe to drive once we get the car out is this what you want to do for me all right so we're going to stand up right this way you're going to come up in front of this squad car [Music] the first exercise was the horizontal gaze nagus HG and test and officer Tommy observed a lack of smooth Pursuit distinct and sustained nice stagos at maximum deviation and the onset of niist stmas prior to 45° the second exercise was the walk and turn test during the walk and turn test Rachel made attempts but she failed to maintain her balance or walk Heel To Toe so this test was discontinued for her safety the final exercise was the one leg stand test during the one leg stand test Rachel failed to raise her foot in the proper fashion and began to fall to the left after about 5 Seconds this test was also discontinued based on safety concerns if you want Rachel you can set your phone down right here I'm very like did you hit your hat when you crash I don't know I'm just stand right here in the so you're going to fall for the first test we'll be checking your eyes all right do you have any eye conditions some head injy contacts no so what you're going doing is I'm moving my finger around and you're going to be following with your eyes all right you're not going to move your head just your eyes any questions at all I'm very like shaky about the accident so officer Tommy offered Rachel an opportunity to take a preliminary breath test PBT the results of the PBT indicated that Rachel's BAC was at 0.32% which is for times the legal limit of 0.08% based on the indicators of impairment they observed all right Rachel so how this is going to work is you're going to put this in your mouth like a straw and you going to blow until I say stop okay okay wow results of the PBT officer Tommy placed Rachel under arrest for driving Under the Influence after she was handcuffed Rachel was placed in the patrol car a search of her vehicle yielded three cartons of verdant P noio wine in the back your hands behind your back all right Rachel I'm going to lock these so they don't get unexpectedly tied on you can I call my I need to call my parents we're going to make sure you get uh phone calls okay yeah but for sure like I have to call them MH but they weren't answering right we'll try to call them ourselves too yes sir yeah please car 91 yeah you you have a DUI packet I have a full di packet you guys got you all right yeah he's been retired for few years how's he doing all right phone the uh yeah ask if there's anything else she needs from the can the officers initially transported Rachel to the Highland Park Hospital for further evaluation at the hospital she told Hospital staff that she had drank approximately two jugs of wine after the warning to motorist form was read to her Rachel agreed to provide blood and urine samples for testing I want that dog said you want that I don't know I gr b mases 93 1095 back to the station adult they were at police HQ Rachel was advised of her constitutional rights and she agreed to wave them and answer questions during questioning Rachel admitted to consuming whine before the accident after questioning Rachel was photographed and fingerprinted once they finished processing her she was released to another adult on a razin bond pending her court appearance I'll get your B here in a second they're kind of tight I don't know if this one is really tight yeah I can address that for thanks supposed to hurt yeah no it's not supposed to hurt at all sorry about that maybe it should that's not sure you are sober if somebody else is picking it up um you're able to go to the place where we had a tow to which will give the information when we're done with the here maybe we just put the 305 on
