On October 25, 2024, at 3:58 AM, law enforcement responded to a mobile gas station regarding a theft investigation. Upon arrival, the officer met with the complainant, a store clerk, who reported that he was outside in the parking lot when a dark-colored Toyota Camry entered and circled the area several times. The clerk described a dark-skinned male exiting the driver’s seat, appearing to be intoxicated and dancing. The clerk then returned inside the store behind the register. The individual, later identified as Michael, claimed someone had stolen his cell phone and became increasingly irate, making threats to shoot up the establishment. The clerk provided a sworn statement indicating that Michael took two large cans of alcohol from the store and placed them in his vehicle before fleeing southbound. While continuing the investigation in the parking lot, the clerk pointed out a black male at the east end of the lot, identifying him as the alleged thief. The officer approached the individual, identified himself, but Michael began to walk away, disregarding commands to stop. He then walked into the roadway and refused to comply. When the officer attempted to detain him, Michael pulled away, leading to the officer forcing him to the ground and placing him in handcuffs. Another deputy arrived to assist, as Michael continued to resist while being escorted to the police cruiser. A show-up was conducted at the scene, and the store clerk positively identified Michael as the person who stole the alcohol.
