over and she ends me her ID card card
not her driver's license and acting kind
of I don't know just very quiet not
saying anything looking down I didn't
really smell anything at first um were
her windows down the whole time or now
like before you stopped her I don't know
and so then uh I see she's ignition
interlock required suspended third she's
been suspended third since 2020 when she
got a previous
DUI and no ignition interlock ever since
then asked her if she's drank she said
she's drank two beers she has two Mike's
Hard Lemonade she just purchased at the
store she had an opena container in the
center console but according to her and
her friend they both had corroborating
stories that that's not
hers yeah now she also did admit to
smoking
marijuana uh earlier in the day as well
and now that last time I talked to her
and I open up the back you can
definitely see smell it now so haven't
asked to do or anything a bit of a
joint yeah how old is
she orn in
96 one if is under 21 no so she so
that's her
Brooklyn so what's her last name
is yeah she's from here in
town but but uh yeah that's it well I've
already mirandized her and everything so
you guys need anything she's right here

vehicle so impaired that part I just
want to make sure nothing is further
impaired uh would you be willing to step
out and do some voluntary field toiy
test I do have my left ankle like 6
months ago I sprained it okay just other
than that no everything's funny okay so
the only thing on that one is um you
said it's your left ankle yeah so if
you'd be comfortable then for the one
leg stand you can raise that left leg
and have the on your right that wouldn't
affect that left ankle but once again I
said it's up to you okay would you be
willing to do those
tests okay go and hop out of the vehicle
for me just so you know I am recording
okay and then we'll get you out of the
handcuffs there as
well okay perfect um I was going to say

then you'll be allowed to begin the test
okay so um with your left foot imagine a
straight line going infinitely out in
front of you you'll goe and put your
right foot on that line heal the toe in
front of your left go ahead and do that
now okay with your hands to your sides
you'll look down to your feet and you'll
take nine Heel To Toe steps forward
counting each step out loud it's going
to look like this one two three you'll
take a series of small steps around your
lead foot off after that ninth step and
I'll take nine heel toes UPS back one
two three okay and go ahead and get back
in that starting position steps or three
steps it'll be nine so I took three for
the demonstration it'll be nine that
you're going to be taking go ahead and
get back in that starting position so
important part is once you begin this
test you cannot stop the test until you
feel you are completely done with it do
you understand okay go and get in that
starting position and let me get out of
your way here and begin whenever you're

two separate samples of your breath
taking inde independently to determine
alcohol concentration you are now
advised that you have the right to
refuse this breath test and and that if
you refuse your driver's license permit
or privilege to drive will be revoked or
denied by the Department of Licensing
for at least one
year okay and will you now submit to a
breath test
yeah okay then for this one um this is a
little bit more touchy than the PBT so
you have to take a really really big
deep breath in and it's a long it's like
a about a good 10 to 12 second steady
stream of air um go ahead and stand
up tightly sealed around the
