cuz how you doing? I'm officer Pvula with Bloomington. Yeah. So, the reason for the stop is how fast you're going on vets. And then also, you have no registration lights on your vehicle. Is it expired? No, it's not expired. There's no registration lights. Like the lights that shine on the license plate. You don't have those registration lights? Yeah. What do you mean registration lights? Like it doesn't light up on it? Yeah. Oh, okay. Why were you going so fast on vets? I How fast was I going? I I thought I was just going like 50. No, you're going about 68. 60. Yeah, speed limit's 45. I did not realize I was going about that. You got proof of insurance on you? I think it's in my photos with my dad. Okay. I think this one may say it is expired, but the um company is updated. Like if you run the company, it should say it's updated cuz um when they ran it like last year when I got pulled over, they said it just expired and my dad just renewed it. Okay. Like this time last year. So and he just told me I think it's like 6 months expired, but he just told me it renewed. So if you run that company, it is like up to date. It's not expired. Okay. All right. Just hang out for me. Okay. Maybe a slight slur, but also could be a list. Her eyes look pretty normal. Okay, if you turn your forward facing lights off. I got you. [Applause] Good evening. Hello. Hi. My name's Officer Shepard, just so you know. Yeah. I'm going to ask you, can you redirect your spotlight? There you go. All right. Sorry, it's His light was super bright and blinding me. So, hey, my name's Officer Shepard. Just a good body warn camera on too. Okay. Um I think he stopped you for speeding or something like that. Yeah. Okay. Um where are you coming from tonight? Um downtown. Um downtown. It's here. I have the address. Were you at like a friend's house? Were you at the bar? Yeah, my friend's house. Your friend's house. Okay, that's fine. You don't have to get the address if you're going home. It starts with a T. It's like Turkley Drive or something. Turkley. Hold on. All right. I'll get the exact address for you. It starts with T. Okay. Tracy. Tracy. Oh, okay. All right. Can you do me a favor? Can you turn your shoulders so they're like facing me just like I am? I know that sounds like a weird question. You can unbuckle if you have to. All right. And then just bring your shoulders and chin as far this way. Keep coming. Keep coming. Keep coming. Keep coming. Keep coming. Keep coming. Keep coming. There you go. Bring your shoulders all the way forward to me. There you go. All right. You see my finger? Yes. Not my light. My finger. All right. Just look at my finger for a second. Don't move your head. Okay. Okay. All right. Give me just a second. Okay. My partner's going to step back here and talk to you real quick. Maybe find out how Tracy Drive was. Stuff like that. Okay. I'm probably going to have him ask her to step out, too. Okay. At least do HGM. Okay. So, just hanging out with the guys. Yeah. Hey, Schultz, if you want to ask her to step out to to just check her eyes. Okay. So, all right. Just don't step out. I'm just going to check your eyes real fast. Just make sure you're safe to drive. We just go back this way. Do you have any eye problems or abnormalities? No. How would you describe your general health? Besides my mental good. What's what do you mean by that? Like my mental health? Yeah. Um, no. Not nothing like like crazy. No, no, no. We got to ask. You know what I mean? That's my question. How's your in general? Yeah. Yeah. No, no, no. I'm sorry. I'm sorry. I'm good. I'm good. I'm good. All right. All right. Do you have any eye issues or abnormalities at all? No. All right. Your drink helps fine. Yes. Do you have any contacts in right now? No. Okay. So, what I need you to do, just like you are now, put your feet together. Keep your hands down at your sides, though. Keep your head still and follow the movement of my stimulus with your eyes only. Keep following my stimulus with your eyes only until I tell you to stop. You understand the instructions? Yes. Okay. So, my stimulus is going to be my finger here. [Music] [Music] All right, you can go take a break. You can blink a couple times if you [Music] want. All right, you good to continue? Yes. Okay. [Music] Hold it a little longer. Okay. Do you love that? What do you mean? [Music] Right on. Okay. One more [Music] time. All right. See, it's going to be the same. This time we're just going to go vertical. So, I'm going to go up with my fingers horizontal. Okay. Type link right now. Yeah. You can a couple times. You ready to continue? Yes. Okay. [Music] [Music] All right. You want to go through all of them? Mhm. Okay. All right. So, we're just going to do the next one, which is the walk and turn test. So, if I can tell you step back a little bit further, closer to your car there. All right. So, now we're going to do walk and turn test. Uh, do you have any physical problems or disabilities that would prevent you from walking in a straight line at all? No. Okay. So, what I need you to do is place your left foot on the line. So, imagine that there's a line between you and that squad car there. And the line's the width of your foot. So, what I need you to do is place your left foot on that line now. And place your right foot on the line ahead of your left foot with the heel of your right foot against the toe of your left foot. Place your arms down at your sides. So, left foot, right foot, arms down at your sides like so. Maintain this position until I have completed the instructions. Do not start the walk until I tell you to. Do you do you understand the instructions so far? Yes. Okay. When I say begin, take nine heel totoe steps on the line. Turn around and take nine hillto toe steps back on the line. Make your turn by keeping your front foot on the line and turn by taking a series of small steps with the other foot. So be like this. One, two, three. One, two, three. All right. Sorry. I'm just like I'm cold. So like that's why I just right now. Okay. So what I need you to do is keep your arms at your sides at all times. Watch your feet at all times and count your steps out loud. Once you start walking, don't stop until you have completed the test. Do you understand the instructions? Yes. Okay, you may begin the test. 1 2 3 4 5 6 7 8 9 1 2 3 4 5 6 7 8 I want my show. Huh? Turn around. Yeah, you can. All righty. So, the last one I got for you is going to be the one leg stand. So, what I need you to do is place your heels and toes together and arms down at your sides. So, yep. Just like [Music] that. Do not start the test until I tell you to. Do you understand the instructions so far? Yes. Okay. When I tell you to raise either foot approximately 6 in off the ground, keeping your raised foot parallel to the ground, you must keep both legs straight and arms at your sides. Hold that position while you count out loud in the following manner. 1,00 1,002 1003 and so on until I tell you to stop. So, be here like so. 100,00 1,002 1003 and so on. Keep your arms at your sides at all times and watch your feet or watch your raised foot. Do you understand the instructions? Yes. All right. You may begin the test. I start with my right foot. It doesn't matter what foot. You can choose either one. Just make sure it's parallel to the ground. Can you keep that left leg straight instead of bent? Oh, like my knee straight. 100,002 100,005 1006 1007 1008 you watch your raised foot and point that toe straight towards my squad car 1001002 1003 1004 1006 Okay, you could stop. Yes. Do you take any medication? No, I'm like really cold right now, so I'm like shaking right now. But I got you. Yeah. No, I don't take any medication. Okay. The reason I asked was you said your mental health and that's why I was asking. Okay. That was a joke. Okay. All right. That was a joke. That's fair. That's fair. Um, how much have you had to drink tonight? I've only had a little bit to drink. What's that mean? Like uh a Monaco? One Monaco? Yes. Did you have more than one Monaco? No. Okay. How long ago did you have a Monaco? At 9:00. At 9:00. When was the last time you had something to eat? 7:00. 7:00. And And I know weed's legal to smoke in your home, right? Did you Did you use any cannabis this evening? No. No. Okay. And you said you don't use any prescription drug. You're not prescribed any prescription drugs or anything like that. Okay. Um, so our big thing is keeping safe drivers on the road, right? And I assume you're pretty close to home. My partner's about to show up with a device called a preliminary breath test. Okay. And we'd like to ask you to provide a voluntary breath sample on that. Would that be okay? Yeah. I mean I mean I don't Cool. He's he's like right he's right there. If you want to walk up to the car, put your hands on the hood so it's you're warmer or even lean against it. Absolutely do that. So, for this, all I'm going to ask is that you take a big deep breath in, seal your lips around the tube. Thank you, sir. Seal your lips around the tube, and blow slow and steady like you're blowing up a balloon until I tell you to stop. Okay. Okay. Just so you don't think I'm playing any games with you. All right. So, I'm going to turn this on. I'm going turn my flashlight on so you can see it. That's the ambient temperature. Okay. All right. So, it says blow. Right. All right. Big deep breath in. Seal your lips around the tube and blow. Blow. Blow. Blow. Blow. Harder. Harder. Harder. Harder. Harder. Harder. Harder. Harder. Harder. Harder. Go. Go. Go. Go. Go. Go. Go. Go. Go. Go. Go. Go. Go. Stop. All right. Do you know what the per se limit in the state of Illinois is? 021. No. 08. 008 08 and you're an 077. Okay. So, Officer Schulz, would you say that there was impairment during her testing that you observed? I would. Okay. So, she's under arrest for DUI. Correct. All right. So, if you'll turn around, put your hands behind your back. I was point below the per se limit, but you showed impairment in your test. Only in the last one, though. And I was No, you showed it in the HGN test also. the HDN test. The first test where he checked your eyes. Okay. Okay. So, real quick, let's put your hands behind your back. Okay. Thank you. Tom 61 [Applause] testy. Can you get the AS5? I'm going to start the 20 minute. Put her in. Is your front seat empty? I can empty it. You empty it and have her sit in the front seat. You guys have the AS5? He's getting it. Okay. So, um, how long am I going to be in helping cell because not very long. I have work at 9:00 a.m. My goal is to have you out of there. It's 3. My goal is to have you out of there. Hear me out. I'm going to have a ask a crazy crazy question. Nope. Instead of No, please please please don't answer this crazy. So, can I answer your first question? Yes. Okay. Your first question. My goal is to have you out of there by 4:30. The faster we get through the process, the faster we can do that. Okay. So, what I need you to do is I need you to open your mouth real wide for me. Lift your tongue up. Nothing in there besides your tongue and teeth. Maybe a filling. Yeah, filling. All right. Don't worry. I got plenty of fillings, too. Okay. 307, right? Okay. You write 307 down. Yeah. Can I ask the craziest question, please? Cuz I literally lived at Arbor's and you can see the Arbor sign right there. Can someone please? We can't take you back to your house. No, no, no. Can like one of you just drive it and like We can't. So, we'll explain all that. Tow my car and I have to pay $600. So, first thing we need you to do is I need you to go sit in the front seat and get warm with Officer Pulka. Okay. Let's crank the heat up for you. Okay. All right. So, he's going to stay in here. He's going to take care of some of your stuff for you real quick. All right. Uh, Officer Schultz is going to go grab some paperwork for you as well to read to you. Okay. Okay. I'll answer all your questions, but my goal is to get you out of here so you can go to work at by 4:30. Okay. Okay. But that's why I said we're going to go as fast as we can for you. Okay. I got the heat turned up in here. Okay. Is there any way you guys could just like just pull it into our hands? Well, unfortunately with our policies, whenever there's a DUI arrest, the vehicle has to be towed. Okay. Have you ever been arrested for DUI before? No. Okay. So, there'll be a 12-hour hold on the vehicle then. Okay. So, roughly 3:10 in the afternoon today, you'll be able to pick it up. And it how much is going to be? Um, so from us, you'll have a $410 fee. I have no idea what Joe's chose cuz you'll have to pay us to give the authorization to release it to Joe's and then Joe's will charge you, but I have no idea what Joe's charges. Okay. So, I'm going to give you a ticket here for the speed. Um, and then they are going to have some paperwork for you as well. Okay. Do you have any other questions right now? Okay. So, I need to get the lights that's like shining on my license plate right above it. Yeah. See how there's no lights above that? Yeah. So, they're probably just out. But so I noticed those were out and then when I tried to get behind you, you were going well above the speed limit. Um, this caught you at for a second at about 68 and then it stopped being able to read it for some reason. Um, but I wrote you for the 65 instead of the 68 cuz anything over 20 over becomes a class A misdemeanor. So I just wrote you for 20 over. And so right now we're essentially going to have to sit and wait. There's a 20-minute observation period. That's why they showed you the time, the uh 307. And then after 20 minutes, they're going to have you do an official breast sample cuz the first one you did is not admissible in court. Um so they'll have you uh it's a different machine. That one's not certified by the state like the one that they're bringing right now is. But I can get more sober. total technically, right? Yep. Yep. Okay. So, there is a chance that was 0077. There's a chance you blow lower than that. I mean, it doesn't matter. It's still under the limit. So, the way the DUI laws work, right? So, 0.08 is the one everybody knows. If your BAC is over that, you're presumed impaired. So, that means like you're automatically even if you do really well on the fields and don't display signs, you're you're going to be arrested for DUI. Yeah. But then 0.04 to 0.08 uh it's essentially I I can't remember the exact legal terms but you have to like prove impairment. And so whenever officer Schultz did those tests he saw signs of impairment. Okay. Uh and so that's why he made the DUI arrest. Okay. And I'm sure he'll explain all that to you as well. I only get one phone call. No, no, they let you have a couple. And I can have my phone next to me, too. Uh I don't They'll let you get numbers out of your phone, but they won't like let you have it while you're in the jail. But like if you need numbers to call, they'll let you pull them out of the phone and then you can call. Um and then they'll just hold you in the jail until you're sober and then they'll release you on your own. But if someone was to pick me up, I could get out in an hour. Yeah. So if you find you find somebody to give you a ride, then they book you in whenever you're done getting booked in. That person can be waiting in the lobby to pick you up. And you guys can give me like cuz like my wallet and my house keys are connected to my car keys. Yeah, we can take those off. Yeah. And then so what the vehicle is going to get towed. So I'm going to have to do an inventory search of the vehicle. So that's not me trying to find anything bad in the vehicle. It's just making sure any highv value items you may have get listed. It's everything that I have high value because I went to like a Gallentine thing tonight. Okay. And it's all in the back seat. I can't. I thought you were gonna open it. All right, Jack. This is a citation for driving under the influence here. There's that. I know you can't hold it right now. I'll hold it for you. Yeah, don't worry about it. All right. So, I do have to read this form to you and then I'm going to need you to sign it. So, pretty much it's just a warning. motorist saying that we read you the warning to motorist about um DUI. So I'm just going to read from the top portion down at the bottom here. So who can tell an arrest for driving while under the influence of alcohol, other drugs or intoxicating compounds or any combination thereof. Considering the above, you are warned. If you refuse or fail to complete all chemical tests requested if you are a first offender, your driving privileges will be suspended for a minimum of 12 months. Are you under age 21? No, I'm 22. Um, so what does that mean? So I heard like a little like suspension like 6 months a year. So am I suspended? No. So So I'll I'll jump in and help. Okay. Just before I need to check the last box before we do this. So um you obviously weren't driving a school bus, right? No. Okay. So we're not going to read you the motors under age 21 part, right? We're not going to read you the school bus driver part, right? Because you're not driving a school bus. So, at the end of all this, we're going to ask you to sign where it says, "I, the motors, acknowledge, receive this warning to motorists." All that's saying is that he read it to you. Okay. As far as are you a first offender based on what he read to you? Yes. Okay. With that being said, so here there's three things that can come from this form. Okay. The first one is if you refuse or fail to complete all chemical tests requested, which I didn't, right? So, we're about So, bear with me. Okay. If you refuse or fail to complete all chemical tests requested and if you are a first offender, your driving privileges will be suspended for a minimum of 12 months. Okay. If you submit to a chemical test or test disclosing alcohol concentration of 008 or more or all those other things, but we're going to ask for a breath sample. Okay. If you are a first offender, your driving privileges will be suspended for a minimum of 6 months. Okay. Now, if it's 0.08 or greater. Okay. If you submit to a breath sample that's 0.08 008 or below, there will be no administrative sanctions against your license based on this warning to motorist. Okay. Okay. So, remember how I asked you to look at the time on my phone, right? Okay. What time was that? 307. 307. So, at 3:27, we're going to ask you for what's called an evidential chemical breath sample. Okay. My partner over there, he has it in his trunk. So, we'll get you out of here. We'll walk over there. Like I said, we're going to get through this as fast as possible for you. at that 327 mark when the machine's ready to go. We're going to walk you over there, ask you for that sample. So, that's the three options that you have basically based on this form. Does that make sense? Yeah. Okay. Do you have any questions about that? No. Okay. All right. So, because she's handcuffed behind her back and she's been super cooperative, I'm going to have her step out and we're going to move for the handcuffs to the front. Okay. Jack, if you can step out real quick and then if you'll just turn and face off. Hang on. And then that rotated. So, I'm going to put it this way. Make sure that's not too tight. I don't like that. I feel like that's too tight. It's still a little tight. So, that guy behind me, I think Officer Turner, he's going to ask you for that chemical sample when he's ready. Okay. All right. Uh, provoke them. Right. If you want to take a seat right there. So, uh, where'd you put that citation? If you give that citation to Turner so he can set the machine up. Yeah. Where's the DUI21 specifically? Um, do you want to collect her like her current address, phone number? Yeah. All that stuff. So, like I was saying, my goal is to get you through this process as fast as possible. All right. So, there's that. He's going to get that information, which is also going to expedite the process for you. Okay. Okay. All right. So, now that she's also handcuffed in front, you can ask her to sign that form if Pulka can hold down his laptop for her. So, I just need you to sign here on Signature Motors. for you. All right. So, it says 3:27. So, it's been 20 minutes. I'm going to walk her across the roads. So, watch your step cuz the side driveway kind of goes up. Okay. All right. So, we're going to be careful crossing the road so we don't get hit by car. We are good. coming to you, Turner. We're coming to you. Step on this side. So, what he's doing right now cuz remember how that one I just kind of turned on. And is this you or Schultz? What's that? This going to be you or Schultz? Schultz. Uh SC ULTZ 13 14. Oh boy. 297. Oh yeah. Um, so this because it's the evidential one, there's like a memory on it system on this. It's going to print out a receipt. It's we put all of your information, his information, his information in there, and you'll get a copy of that receipt. Okay, [Music] am I saying that right? Yes. All righty. So, this thing is going to do what's called a blank check. Long story short, it's going to make sure that the machine's working correctly and that uh there's no residual alcohol or anything in it. The big thing with these all of our certified machines is if there's an issue with the machine, it won't let you provide a sample. Okay. So, I just passed this blank check, meaning we are ready to rock. Do you intend on providing a breath sample? Yes. Okay. Same thing as the PBT. Um, that machine that he had, you provided breath sample in earlier. I'm going to have you take a big deep breath in for me. See your lips around those and blow just a little bit harder than you did on the PBT. Okay. Big deep breath in and blow. Keep going. Harder, harder, harder, harder, harder. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Perfect. And then it'll tell us what you are right here. 068. Okay. So you are below that 08 that we talked about. So your license will not be administratively suspended based on the DUI. Okay. 068. While he finishes that up, I'm going to go give you a seat in a warm car again. Okay. Okay. I don't think you want to stand out here any longer. Remember, watch the curb. I know that sounds sill evil. You good with me having her sit up here for a minute? Yep. Okay, we're going to go get his paperwork done. Okay. All right. They show you the number. Yep. 68. 68. 0068. Yeah. Yeah. Yeah. Makes more sense. I don't know if you just heard them talking. You're going to get one more citation now. Okay. Uh you had that BB box container. Okay. Uh and it was already open. So Officer Schultz is back there writing you a another citation for open container. Okay. Okay. So it'll be one for the speed, one for the open container, then one for DUI. Okay. Take your phone. You got those in your pockets, right? No. So, I just got to get a seat. Yeah, you only have to I got myself. [Music]
