[music] An agent with the Selen County Sheriff's Office Criminal Investigation Division has been arrested on suspicion of DWI following an investigation by Arkansas State Police. Authorities say Christopher Macaulay was taken into custody early Saturday morning after reportedly responding to the investigation into a fatal altercation that claimed the life of boxite teenager Gunnar Frasier. Developing story. Seline County, Arkansas. A Selen County Sheriff's Office detective has resigned after being arrested on a DWI charge while responding to the scene of a deadly fight that claimed the life of 17-year-old Boxside High School student Gunner Frasier. According to Arkansas State Police, Christopher Macaulay was on duty and driving a department vehicle when he responded to North Dante Road early Saturday morning where deputies were investigating a large fight involving an injured juvenile. Deputies were initially called to the 5,300 block of North Dante Road around 12:30 a.m. on September 19th. Frasier was transported to a local hospital where he later died from his injuries. Authorities have said the investigation into the circumstances surrounding the fight remains active. While Macaulay was at the scene, another deputy reportedly detected the odor of alcohol coming from him. He was immediately relieved of duty and the matter was turned over to Arkansas State Police. ASP conducted the DWI investigation at the Bryant Police Department. According to the breath test record, Macaulay registered a.165 blood alcohol concentration on the first test at approximately 4 a.m. A second test 2 minutes later recorded.154. Macaulay was arrested and charged with DWI, first offense. The Selen County Sheriff's Office said Macaulay resigned from the department the following day. The deadly fight involving Frraasier is a separate investigation. Authorities have arrested 19-year-old Cameron Melton and charged him with manslaughter. His bond was set at $70,000 and he has since been released on bond. >> Cuz it'll be like 20 or 30 minutes for get here. Oh, not quite that long. But yeah, cuz I mean wait a little while. Hold The way this uh test works, you'll provide two breath samples to it. Whatever the lowest of your two is your final test. So, it tries to give you the benefit of the doubt. Whatever your lowest score is is your final. Um, in the case that you end up being charged tonight, I I'm going to write the ticket through uh Haskell District Court to kind of keep you away from the sheriff's office and all that [ __ ] We kind of is a terrible situation for obviously it's a terrible situation for you to be in. It's not one that I want to be in either. So, we'll try to like keep it out of, you know, I'm not going to have you go to Ben District Court with all the sheriff's office guys and all that other [ __ ] you know. We'll handle it over here and try to keep it away from them. >> I just [ __ ] me, man. Gosh, man. I just I am 100% floored right now. I mean that this could have been handled a completely different way. >> And [snorts] if we talk if me and you talk tomorrow, you we can go in depth about how I my personal opinions on the sheriff's office, including Dustin, but that's past that right now. You know, >> no, I'm >> I think that, you know, if your name's Chris Webb or your name's Dodson, this situation probably doesn't end up like this. But that's just my personal beliefs on the sheriff's office, you know. >> Mhm. >> How I think agree. >> That's what I've heard or that's that's kind of what I what I put together, but >> I don't know that to be true. So, >> no. Same with me. >> So, I'm not >> That's just that's evidence that I've gathered before talking to you. Hey question though and I'm like I said I'm my DW like I never have been >> um avoided them. I honestly I hate them. >> Yeah. >> Scope mouthwash. >> Mhm. >> All right. >> Yeah. >> So I did do that. >> Depends on So it it could depend on >> I did that before I left the house. Put deodorant on. >> Right. >> And then rinse. depending on the time that could have definitely affect your your PBT results. You know, if that's if you do it right before, you'd show a.35, you know, even though that's all you've had. So, that may be something to play. So, like a part of this test is a 20-minute observation period. We've been sitting here talking for almost an hour. So, obviously, I know you haven't had anything new, drink, you haven't had like none of that stuff. >> Um, so that observation period is part is part of that. Um, and then doing two tests, they have to be within 0.02 002 of each other to be considered accurate anyway. So, there's a bunch of fail safes on this machine to make sure we're getting accurate results and not BS like that. Cuz really, I don't know. >> I I wouldn't say I'm a DWI guy. I hate DWIs. It's a part of the state police's mission. So, obviously I'm good at them. Uh >> but it's not like something I just >> really like. Um, but like I don't know if you've seen some of John Collins videos. If you eat a piece of bread right before taking the PBT, just the bread will show a higher BAC level. Not saying that you're impaired at all. Um, so the PBT has a lot of upsides. We're giving you something on the side of the road. I can have a good idea of where you're at, but it's not foolproof, right? It it has a lot of inaccuracies based on >> What's crazy to me is I know that I drank in excess Thursday night >> cuz I wasn't on call, >> right? And I know how much I had. >> Yeah. >> Last night cuz it's 3:30 4. >> I know what I had last night and that's it. >> I mean the you're smelling >> Yeah. >> Thursday. >> You know what I mean? Like more than you are probably. >> Well, and then there you know there may be some of that where I'm smelling on your clothes and I'll be smelling on your breath when we're talking to each other, right? But like some of that could be me smelling on your clothes. You know, there's a lot of factors that come into it. Um, >> but >> and I'm not making any excuses or justifications. I'm not sitting here trying >> right now. We're just talking. >> [ __ ] That is not what I'm doing here. I I know that we haven't met before. I hope that what you've heard about me is good. I try to have I try to hear a good reputation. >> Man, I'm a cop's cop. I'm not trying to get out here and [ __ ] you down. That is not >> I know that. And I I don't believe that for either of you, honestly. Uh, it's just one of those things where it's like the [ __ ] There is no one else. >> I've been there, bro. Not not drinking for a call out, but like I've been there where you get a call where you're not on call, but they've had a shooting and you got to go out. I I've you know, I've bro I've been there. >> I mean, honestly, to be to be quite honest, I feel like I was damned if I did and damned if I didn't. >> You know what I mean? >> 100%. So, >> cuz that's the thing is if you tell them, "No, I can't cuz I maybe I've had too much to drink." Whatever the case is, well then, >> and I didn't think that, >> right? No, no, I'm saying if you did, >> if you didn't, you tell them that, they're not going to be like, "Oh, man, that was a smart decision." They're like, "Man, this dude's [ __ ] us down cuz now I got to work this shooting with Noah." And >> I would just listen to them talk about, "How many drinks have you had? We have a swap call out. Can you operate? Can you drive? Are you Can you safely be here?" >> Right. >> Well, I safely got everywhere I went tonight. You know what I Yeah. >> Like I said, we that's the discussion we can have with a different club. >> Yeah. >> All right. Stand up here, man. The only trick to this test is you cannot stop blowing once you start. So, deep breath in. You don't have to blow super hard. Just a consistent breath. I'll keep I'll give you cues like harder. Whatever the case is while we're doing it. All right. So, really deep breath in and blow harder. A little bit harder. Blow. Just like that. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Blow. Keep going. Almost there. Keep going. Keep going. Keep going. It's going to seem like you're blowing everything. Perfect. All right. Have a seat again. We'll do those test on itself again and then we'll do that that final test. Like I said, dude, I've been around the sheriff's office since I think I started there in 2016 in the jail. The stuff that I have seen, the stuff that I heard is not it's a lot about who you are and who you know and all that other stuff, which is what I >> well >> why I'm getting away. I'm just trying to do >> I was just trying to finish out five years, bro. >> I get it. How long did you do? You did 30 years at Winter Rob. >> No, no, I've been carrying gun for 30 years. I joined the military at 17. Yeah. >> And I've I was an OSI agent >> um in the Air Force. I worked counter intelligence and and counter narcotics. >> Yeah. I was narcotics officer for the big majority of my career at Little Rock FBI task force and then was the supervisor over the gun gun crimes unit at Little Rock. >> You used to stay off Was it you that stay off Load Stone or was that your brother? >> Probably my brother. >> Okay. Cuz he worked at Little Rock, too, didn't he? >> He did. >> Okay. >> Yeah. I think >> this and honestly to be quite honest with you like this is that's what's bothering me the most about this. >> Yeah. >> Is me being associated or me and him being associated with one another at this point. >> Yeah. >> Because of this >> I think cuz he stays off is it Loadstone that he or Stone Hill? Uh Stone Hill stays. >> He's in Benton. I don't like I don't know what the road is but it's behind the school >> off of military. What What is that school? the elementary >> uh Pine. No, not Pine Haven. >> Pine Heaven's Box. >> Yeah. What's that one right there by like the library and everything? >> Yeah, right off. >> Yeah, over there. >> Oh, >> we were just there this summer or last summer. >> I'll just look up. Hey, uh text your wife and tell her just wait in the car when she gets here real quick. Otherwise, if she goes up and hits the call box, dispatch is going to get on the radio and tell us about it. >> Yeah, just tell her she can hang out in the car and as soon as we're done, we'll go. I live down the road from that elementary school. You'd think I would know what the name of it is off the top of my head. >> Power. >> That's right. >> All right. Same thing. Throw it right in. Whenever you're ready, you can start. Keep going. Keep going. Keep going. Perfect. What's it saying? >> Uh, it'll print them off here in a second. It's been a slow month for >> We were out Monday, Tuesday, and all tonight trying to find them. I had one that went across a lane and a half of 30 westbound and I'm like, this got to be a good one. No, he was reaching back in the back seat trying to find his lighter and pet his dog at the same time. Sober as could be. I'm sorry. I just I dropped my lighter, was trying to light a cigarette, then I saw my dog, so I pet it and like, "All right, dude. >> Brother's crazy." >> Maybe we just don't do that while we're driving down the road. All right, I've already done it now. >> Were you talking to me or you talking to her? >> No, I'm talking to you. Like this is done now, so it don't matter. But >> we'll print whenever it'll print off your test results, what your first result was, your second, and whatever the final result is, we'll go over it together. Um, should I done the one draw? Like, I mean, I'll be honest with you >> here. Just so it's already done. >> Yeah, it's done now, but it's already over. >> I think taking a breath I'm going to get it either way. >> I think taking a breath is probably the right decision because you're not catching additional charges. >> That's just my personal opinion. No, that's what I wanted to hear. >> Which is what I deduced. >> Yeah. >> I don't want to whatever. >> So, your first test was a.165. Your second was a 154. So, your final was the 15, >> which I needed to be 08. >> Yeah, you're almost twice the legal. Your first test was twice the legal limit. What's shocking to me is now that we've done [clears throat] this, I know what I drank. You know what I mean? >> Yeah. >> And [ __ ] took a shot. Look at that. >> So, this says that Arkansas law permits an officer to require one or more chemical tests of your breath, urine, or saliva of a person arrested for driving or toxed. Normally what that is is like if uh if you blow all zeros, but I know you're a crackhead and I know it's probably math or whatever, I can make you take a piss test. Uh I'm just gonna sign here saying that none of that's necessary cuz we did the one that I requested for you the first time. Okay. As far as me making you take a second test. >> Mhm. >> I'm not going to make you sign that part cuz all it's saying is that we don't need to do it. Four. All right. Having taken the officer's test, you have the right to an additional test or test to determine the alcohol, controlled substance, or other intoxicant content of your breath or blood. Do you want to take another test at your own expense? >> Where would that that would be going to Seline? >> Going to So that's really it's up to you. So you could go to Seline, you could go to the heart hospital, you could do whatever you decide. You drive to US if that's what you felt like doing. >> Um and then you would pay for your own blood test. >> Okay. And I would just get a blood test. >> Yep. You would just ask. You're like, "Hey, I got I need a second blood test for a DWI." They deal with them enough. They know what they're doing. I can take you up there. Um or >> can my wife take me up there? >> If that's what and I get it. >> Yeah. >> And then where does it go? >> Wherever you put it. So, so like say you take it up there and it's a 03, you know, whatever the hypothetically that's what happens. Well, then you can take it to court. If you go up there and you take it and it's a 0.16 or 0.15 like this is and you're like, "Well, hell, I'm gonna throw this damn thing away and not take it to court." Well, then that's up to you, >> right? >> I have to offer you a test. I have to make it I have to um assist you in obtaining such a test. So, the way that I can assist you tonight is let you go with your wife and then you can assist. That's me assisting you is giving you the responsibility, giving you the freedom. If that's what you want to do, y'all can go up there and do it. That's up to you. Um that's just that's how we've been doing it recently. >> So where do I submit that test or >> they would print all like so they would do they would complete the test there >> and then >> and then they would give you the results you know >> how long does that take usually? >> So it depends on where you go. So like I've gone to Baptist and they've given them like those results within an hour of getting the of getting the blood. >> Um the heart hospital is pretty quick. I've seen them do second tests pretty quick and like you have results that night. I've seen US where they're like, "Okay, we'll put the test in your my chart shit." And then you're just waiting on them to do that. So, all of that depends on just whatever whatever hospital you go to. >> What is that town what is that in proximity to? >> So, that that's where >> there's no like so the law doesn't say that it has to be done within an hour or 2 hours. Now, I think that just my opinion, if you take the test at 4:00 in the afternoon today, a judge is like, "Well, it's been 12 hours." You know what I mean? I think I think a lot of that just my personal opinion that a judge would say what whatever is reasonable. You know, if you go up there and get a blood draw at 6:00 a.m. say you drive here right now, go straight to the heart hospital. Well, hell, they have a line. You know, they have whatever a DWI blood draw is not their priority. So, if you end up waiting till 6:00, well, the judge could say, "Well, that's kind of reasonable. You know, just just waiting on the hospital staff to get up there." If you have paperwork that you checked in at 4:30, you know, I think that's probably reasonable. Um, I think if you show paperwork that you checked in, you know, noon, they're going to be like, "Well, that's bullshit." You know, he went home and drank water for eight hours and then went take up the test, right? >> I think a lot of that's just what a judge would say is reasonable. >> Mhm. >> Um, that's not a legal opinion. That's just me thinking through the problem. >> Why the [ __ ] would Noah do this, man? >> Dude, I >> like seriously. >> Like I said, dude, I have my own opinions about not only Noah, but the sheriff's office in general. There's a reason that I left. There's a reason I was begging my wife to leave before she did. You know, the sheriff's office is not a great place. You let people like Chris Webb and Rusty Bell and Dodson sexually harass people, do whatever the hell they've been doing for years. >> Trailer for them. >> Oh, hey, two captains sleeping with Lieutenant. Nothing happens to both of them. You know, there's a bunch of questions that I have for how the sheriff's office operates, but you know, that's not something that I have any control over, unfortunately. I feel like I could solve all those problems, but you know, I guess I'm done. >> Do you want to take that other test? >> I mean, >> if you want a sign saying yes, she here. >> Yeah. >> Okay. If you want to sign, saying you want to take one and then you decide not to. It's not like you signing yes is saying you have to. >> But if I sign yes and then go to sleep more and just have them draw my blood. >> Yeah, you could. That doesn't change what happens tonight, right? You'll still be charged with DWI. That'll be your only charge for me. Um, that doesn't change as far as like how tonight operates, but you know, you can use that in court later if you decide you want to. Or if you decide that that doesn't help your case, then you cannot. You know, that's whatever you decide. God, I just I I'm I'm really waiting to hear Dan like shoot my ass for doing what I've done already. You know what I mean? >> Yeah. >> Uh but I don't know the policy and if I refuse. >> So as far as far No. So this is not this has nothing to do with your refusal. So you have done what you're required by law to do. >> If you don't want to take the additional blood test, there's nothing there's no penalties for not doing that. >> So as far as the sheriff's office is concerned, like you're not refusing. You did the test that I wanted you to do. So everything else is this is just a voluntary blood draw that you request. It has nothing to do. You're not obligated by law to to do that. You know, there's no penalties for not doing that. That's all up to you. This should not affect as far as like the refusal stuff with the sheriff. This has no effect on that. got. But if I sign saying I'm going to get a blood test and I don't, it doesn't matter. I'm going to sign doing it. If I do it, I do it. If I don't, I don't. >> All right. That's just that four that third part right here. Just saying, do you want to take another test at your own expense? So, initially, yes. And then sign down there. That's me. That's me. >> Well, I was just fixing my >> Oh, sorry. Can I get this or >> No, I got it, unfortunately. >> Oh, so you're keeping it? >> Yeah. I'll get I'll give you this temporary license. I'll explain this to you. Let's uh let's go back in the other room.
