insurance thank you registration [Music] on November 23rd 2023 around 12:47 a.m. betr man Jeremy Hackney and Matthew golf with the Magnolia Police Department were dispatched to the scene of a motor vehicle accident involving a silver 2015 Jeep Grand Cheroke that had struck a pole on an War Road near Maryland Avenue as arrived on scene around 12:52 a.m. pman had me noticed that the Jeep had sustained sever front 10 damages and he observed airbag deployment in inside the vehicle he made contact with the driver of the Jeep who was identified as 18-year-old Megan Megan admitted to driving the jeep while 18-year-old Michaela was seated inside the vehicle as her passenger for this is the registration I've never really been pulled over so I don't know what's wrong this is the registration I've never been pulled over so I don't know um yep that's it okay all right and your license um he took it all right so you were driving it's okay take your time it's not okay all right where are you coming from I'm coming from my friend's house all right walk with me over here okay no I've never even really it's okay it's all right take your time so what happened we were driving the phone call from her boyfriend and I looked down at the phone and I and I crashed into the pool okay I didn't even I looked down and I looked back up can I help you ma'am you need help no oh my God okay are you walking no I I just came out to see what happened okay all right so you at your friend's house yes and we left and I went to drop her off and I looked down at the phone cuz her boyfriend called her and I looked down for too long I guess how old are you 18 all right you need to drink or anything like that tonight I haven't had anything drink okay when's the last time you had something to drink no probably like a week ago okay I don't drink and drive I don't I'm just asking if you had anything no my parents are alcoholics and I don't do that you didn't have anything to drink no all right what are we doing at your friend's house we just hanging out just hanging out and are you're not hurt no my lip a little busted but it's nothing bad T your lip Megan told patroman hacky that she was distracted by looking at mela's phone when her boyfriend was calling and as a result she crashed into the pole while driving Northbound on an War Road as he was speaking with Megan he detected the odor of alcohol and noticed other signs of impairment based on his suspicion of impairment Megan was asked to perform field sobriety exercises nothing bad did you hit the airbag or the steering wheel you hit the steering wheel no the airbag air and it was just you and your other friend were in the car yes all right so where were you coming from like what street this way you were coming from that's why you look down at the phone all right what made you look at the phone other than the boyfriend calling nothing just then he was on the phone he was talking and I looked down and I looked back up and we were going and we just crashed okay do you have any um I know you said you're not injured from the motor vehicle crash but do you have any medical conditions anything that would affect your patrolman Hackney started with the horizontal Gaye nagus hgn test during the hgn test patrolman Hackney observed the lack of smooth Pursuit and disin and sustained nice stmas at maximum deviation in both eyes the second exercise was the walk and turn test during the walk and turn test Megan did not touch Heel To Toe on on each step the final exercise was the one leg stand test and Megan displayed sobriety exercises Megan was placed under arrest for driving while intoxicated in order to not embarrass her in front of her friend patroman Hackney decided to not Place handcuffs on her Megan was transported to the Magnolia Police Department for further processing the other officers stayed with the vehicle until it was towed for a mandatory 12-hour impound as required by John's law am I getting arrested yeah at this point arrest for du it's fine okay just have seat inside the car I don't know what to do just try to relax no I can't I'm going to I'm going to lose my job I work I get submit breath samples her Alco test results indicated a back of 0.19% which was more than double the limit of 0.08% for drivers over 21 and 19 times the legal limit of 0.01% for drivers under 21 okay reading is after okay after you have provided samples of your Breer test and you have of the right at your own expense have a person or position of your own selection take independent samples of your breath blood or urine for independent testing number five if you refus to provide samples of your breath you'll be issued a separate summons for the refusal a court might find you guilty of both refusal and dri all intoxicated number six if a court finds you guilty of the refusal You' be subject to various penalties including license rtion up to 20 years a fine up to $2,000 installation of U ignition air loock and referral to it and intoxicated driver Resource Center these penal be addition to penalties imposed by the court for any other feny which were found guilty number seven you have no legal right to have entertaining phys own else present for the purpose of taking breath samples you have no legal right to refuse give or delay given samples of your breath number eight any response to you that is in biguous or conditional in any respect to my request they provide breast samples will be treated as a refusal to submit breast testing even if you agree to take the test but then do not follow my instructions not prop form of test or not provide significant breath samples I will charge or the refusal testing number nine this is important okay I repeat that the law requires you submit samples of your breath for testing will you submit samples of your breath what is it I know I have do 112 all right so let me explain to everything that's going on now okay so now 2023 after she signed the potential shil warning form on her behalf patrolman Hackney issued her the following summonses operating Under the Influence operating Under the Influence under rage reckless driving careless driving and traffic on Mark Lanes e e e e e e e e e e so uh this is going to be a 450 a GUI drum 12 hours a going go nowhere no [Music] yeah they didn't get in this one I say to out some of that big stuff cor records indicate that on March 12th 2024 Megan was found guilty of operating Under the Influence she was required to use an ignition interlock device for 3 months spend 12 hours at an intoxicated driver resource center and pay a total of $640 in fines the the other for citations were dismissed as part of a plea agreement court records also indicate that on April 5th
