The reason I stopped you is you got a headlight out and two brake lights out. >> Oh, I am so sorry. This is my friend's car. >> Okay. >> I'm just like borrowing it. Um, I can literally call her right now. >> Uh, what's your friend's name? >> Alex Logos. >> Alex Logos. >> Yes. >> Okay. And what's your name? >> Carly Bashel. Do you have your license registration for insurance? >> I don't. I was like >> on June 18th, 2025 at approximately 1:51 a.m. Officer Tayana Mcnane with the Pullman Police Department observed a westbound BMW driving without headlights on any stadium way. She made a Uturn and activated her emergency lights to initiate a traffic stop. The driver pulled over in the parking lot of Evergreen Tire and Auto Repair at 300 Ne Stadium Way. She exited her patrol car and initiated contact with the driver, later identified as 21-year-old Carly Bashim. >> I don't. I'm sorry. Um, but I can call her though. >> That's okay. Do you have your license with you? >> Um, no I don't. I was just driving home. I'm sorry. I don't drive. Where's home for you? >> Um, it was at the retreat. I was just driving back there. >> So, the the retreat's that way. Where were you going? >> Yeah, but I picked him up and then I was just going to like head back there. >> Okay. Um, and how much have you had to drink tonight? >> I haven't drank tonight. >> Okay. Do you mind stepping out of the car for me? >> Yeah. >> Carly told officer McNane that she was headed back home. As she was speaking with Carly, Officer Mcnan detected the odor of alcohol and observed other indicators of impairment. Carly denied consuming any alcohol, but she would later admit to consuming alcohol at the cug earlier that evening. >> Okay, so let's head over to that little parking lot over there. I'm going to shut this door for you. >> Okay. So, are you willing to do some voluntary field sobriety tests for me? >> Um, what does that mean? But like, >> so it's just some tests to determine uh what effect, if any, alcohol has had on your ability to drive. >> Okay. >> Cuz I can tell now that you have drank tonight. Um, and that your statement of not drinking is dishonest. Um, but these tests will let me know what effect, if any, the alcohol has had to do on your ability to drive. >> Okay. >> Does that make sense? >> Mhm. >> Okay. Um, so the first test, um, just go ahead and put your feet together, touch them like that, >> and then take your hands out of your pocket and just put them down at your side. >> So the first test, I'm just going to check your eyes. Do you have any? >> Based on her suspicion of impairment, Officer Mcnane asked Carly perform field sobriety exercises. Officer Mcnane strided with the horizontal gaze nice HGN test. The second exercise was the walk and turn test. During the walk and turn test, Carly did not touch heel to toe on each step and turned improperly. The final exercise was the one leg stand test, but Carly did not want to attempt that test. >> Issues with your eyes? Do you wear contacts or glasses? >> Um, I do wear glasses, but I'm not wearing them right now. >> Okay. Do you have any contacts in right now? >> No. >> Um, so can you see the tip of my pen here? >> Yes. >> Okay. So, I want you to follow it with your eyes and your eyes only. I don't want you to move your head at all. Does that make sense? Okay. Okay. And then I'm going to just go up this time. So, tilt your chin down and then try to follow it as high up as you can. Okay. Okay. And one more time. Okay. So, the next next test, sorry, my language is a little messed up. Um, it's called a walk and turn test. So, I'm going to put you in a starting position and I want you to position until I tell you to begin the test. Do you understand that? >> Can you repeat it one more time? >> Sure. So, I'm going to put you in a starting position. >> Um, and then I want you to stay in that position until I tell you to start the test. So the the position. So I want you to imagine a straight line coming out right in front of you. >> Okay. Can I go on like the white line? >> So um or no? >> No. So we're just going to imagine a line in front of you. >> So I want you to put your left foot on that line. >> Okay. >> And then put your right foot in front of your left foot touching heel to toe. >> Okay. >> So don't start just yet. So >> sorry. >> No, you're okay. So left foot on that line. >> Okay. >> And then right foot in front of your left foot. Okay. And then stay there. And then keep your arms down at your side. >> Okay? >> And stay in that position until I tell you to begin. Do you understand that? Okay. >> So, when I tell you to begin the test, I want you to take nine heel totoe steps down that line, turn around, and take nine heel to toe steps back. Um, so just one second for me. So, you're in this position, and when I tell you to begin the test, you're going to take one, two, three. I'm doing three for demonstration. You're going to take nine. Once you get to your last step, I want you to leave your lead foot planted and take a series of small steps around your front foot like this until you turn back the way you came. Then I want you to take one, two, three heel to toe steps back down that line. Do you Does that make sense? >> Yes. >> Okay. Uh once you start the test, I want you to look at your feet the whole time. Count your steps out loud. Keep your arms down at your side and don't stop the test at any point until I uh until you finish the test. Do you have any questions? No. >> Okay. So, go ahead and begin the test whenever you're ready. Okay. And the next test is called a one leg stand test. Do you have any injuries to your legs at all? >> Um, my hips. I'm supposed to have surgery on them, but I haven't yet. >> That's not good. What kind of surgery are you getting? >> Um, so like my hipbone. I play volleyball, so like it's supposed to be like this, but mine's like this a bit. >> Gotcha. Does it affect your ability to balance at all? >> Kind of. Yeah. To be honest. >> Do you want to try this next test or would you rather not? >> Um, does it like play like an like effect, you know? Um, if if you can do the test that would be cool, but if you don't want to do the test, that's fine, too. >> I like I don't not want to, but like I'm just like genuinely like not good at balance because my hips genuinely like, you know. >> Okay. Um, we can not do that test then. We can move on to the next test. >> No, that's okay. >> I'm just like normally not good at it. >> Well, we can certainly try it if you'd like. >> I don't know. >> That's okay. We don't have to do it. So, the next test is called a preliminary breath test. It doesn't take its place of any test I may ask you to do in the future. Um it not an evidentiary test. Have you had anything to eat or drink in the last 15 minutes? >> Um no. >> Okay. >> So when you blow into this >> following the field sobriety exercises, Carly was offered the opportunity to submit to a voluntary PBT test, but she ultimately refused. I want you to take a nice deep breath in until your lungs can't really hold any more air. And then I want you to blow a nice hard steady stream through this tube like as if you're blowing up a balloon. Does that make sense? >> Perfect. Also, I may ask, is this voluntary? >> Mhm. >> So, like what So, like what does like that mean exactly? >> Um, so you can say no to the tests and then I will make a decision based on the information that I have right now. >> Okay. So, what does that mean exactly? >> Uh, so would you like to do the test? Yes or no? And it's voluntary. You don't have to. >> Um I would rather not just because like I know that like I genuinely like would not be driving if I couldn't. But I also don't that like play into affect like your you know like >> um so what do you mean? >> Also I do also have like a speech impediment. I I have a stutter if it's my family. You can like ask my mom. I promise you like it just comes out whenever I'm nervous cuz this is like never happened before. >> That's fine. Um so Brock, here's your thing back. >> Not saying that like I won't do it. I'm just, you know, like >> No, that's okay. >> Um I'm not going to force you to do anything you don't feel comfortable doing. Um but based on what I've seen so far, I do believe your ability to drive was affected by the alcohol usage uh tonight. Based on the odor of alcohol and her inability to adequately perform the field sobriety exercises, >> officer McManny placed Carly under arrest for driving under the influence after she was placed in handcuffs. >> Carly was transported to the Pullman Police Department for further processing. >> So, I am placing you under arrest for DUI. So, go ahead and turn around, put your hands behind your back for me. >> Um, >> can I ask you if I do take one second? >> Hold on. Let's get the handle on. We'll answer all the questions one step at a time. >> So, you have the right at this time to remain silent. Anything you say can and will be used against you in the court of law. >> Can I ask you if I do take >> You have the right Hold on. You have the right at this time to have an attorney present before or during any any questioning or the making of any statements. If you cannot afford an attorney, one will be appointed to you at no cost. Um, and you can exercise these rights at any time. Do you have any questions about that? Um, what if I do take the test right now and I'm below? >> It wouldn't change the outcome. >> How? >> She's already made up her mind. >> So, and you are being audio and visually recorded. It is 2:01 in the morning on what day is it? The 18th. June 18th, 2022. What other questions do you have? So that's your friend's car. Is Is your passenger sober? >> Um yes. >> Can he drive that vehicle? >> Um yes, he should be. >> Okay. Um you can go ahead and deal with that. I'm going to put you in my car and then I'm going to talk to your passenger um about the car and how to get the car back to where it belongs. Okay. >> I'm car because So the only like proof that you have is your opinion of me. Mhm. >> So, >> so I'm trained in determining someone's ability to drive. No, that's okay. So, my car is a lot warmer. Let's put you in there. >> I know, but like I genuinely have questions because >> I can answer your questions in the car, >> but I don't want to leave until I make, you know. >> Well, so you don't really have a choice at this point. So, let's make a a jaunt over to my car and then I'm happy to answer any questions. Okay, go ahead and watch your head. >> Okay, there. >> So, I'm just going to reach across you for these seat belts. >> Um, what was your question? Okay. So, I'm going to go talk to your passenger really quick and see about getting that car back to who owns it. Okay. >> Um All right. Can you tell him to call my friends to come get me? >> Sure. Is there a wallet, phone, or anything in the car that's yours that you want me to grab? >> Um, no. Just tell them to take it. Hi, >> how you doing? >> Um, so I placed her under arrest for DUI. Um, she said that you can take the car. Are you sober to drive? >> Yes, ma'am. >> Okay. Um, so do you know whose car this is and where to take it back to? >> Yes. Yes, ma'am. >> Okay. So, she wants you to keep all of her things, her phone, her wallet, whatever. Um, and then just return the car to wherever it's supposed to be. >> Okay. >> You have any questions for me? >> She She said she doesn't want her phone. I'm not sure how she's going to call anybody when she gets out. Um, are you a boyfriend of hers? >> Yeah. >> Okay. So, are you going to be awake for a couple hours? >> Yeah, most likely. >> Okay. So, actually, let me just grab your phone number and then I can call you when she gets released. Um, so she has a ride back. She doesn't. It's It's a little chilly and I think it's going to get a little chillier. So, I doubt she wants to walk home. What's a good phone number for you? >> Okay. And your first name was >> Donovan. D O N O B. Okay. I will give you a call when she gets released. Okay. >> Thank you so much for taking the car. Um, and let whoever the owner is know that the headlights out and the some brake lights are out. >> Yes, ma'am. >> All right. Pullman 4 can interrupt to the PD Pullman plan. Arrive. So, we'll get you inside and we'll get you out of those handcuffs cuz I know they're probably not very comfortable. All right. So, we're going to go through this door. Okay. And then face the wall to your right. I'll open that second door. Okay. And then we're going to go to that orange cone. Do you have anything on you that's going to poke, stab, or hurt me? >> No. >> Okay. >> At the Pullman Police Department, Carly agreed to submit breath samples after speaking with an attorney. >> So, I'm just going to check your pockets real quick. You don't have anything on you at all? Okay. Okay. So, I'm going to take the cuffs off. Would you like to talk to an attorney before we get started with the process? >> Um, yeah. >> Okay. One second. >> Okay. I'm sorry. >> No, you're okay. >> Okay. So, we're going to go in this room behind you and we'll get you in contact with Turner. >> Thank you. All right, let's go on. Yeah, this is >> Hi, sir. This is officer Mcny Pullman PD. >> Hi. Uh, what was your first name? >> Carly. >> I have Carly here and I've arrested her for DUI and she would like to speak to an attorney. >> All right. Did she do field test? >> Uh, some of them. Yes. Okay, thank you. >> All right. Um, I'm gonna take you off speaker here and then hand her the phone. >> I think that worked. >> I don't know her name or anything yet. Okay. So, you can take a seat in the brown chair. So, let's get your last name. How do you spell your last name? >> B A S H A M. >> B A S H A N. >> Yes. >> And your first name? >> Carly. K A R L Y. and your middle initial >> Rose. >> And your birthday? >> April 24th, 2001. >> Okay. >> And where do you live at in Pullman? >> Um, the virtually it's 2045 Roman Drive, 508A. >> Roman Drive 508. >> Yes. A Okay. and your cell phone number. And what state is your license through? >> Kentucky. >> Kentucky. What are the letters for Kentucky? >> KY. And where were you born? >> Kentucky. >> How do you spell that? L O U I S V I L L E >> and US citizen. >> Yes. >> How tall are you? >> And how much do you weigh? >> 135. Okay. >> So, I'm going to get her going on getting me some of your information. Can you get me her driver's license number, a photo if you can, and uh expiration date on that? >> I got it here. Okay. So, to get this process going, um, I'm going to check your mouth now because I have to be able to say that you didn't put anything in your mouth for 15 minutes. So, go ahead and open your mouth and stick your tongue up. Okay. Um, so for the next 15 minutes, try not to touch your mouth, put anything in your mouth, or make it look like you put anything in your mouth. >> I might shiver cuz I'm cold, but that's okay, though. >> Um, and then if you start to touch your face a lot, I'm going to have to put you back in handcuffs. So, to make it a little more comfortable, I'll try not to do that. Um, so I'm giving you a request for a DUI hearing. This is something that you're going to look at later. Um, this is uh with the DO. It has nothing to do with us, but we're required to give you this information. So, it's going to go within your property. You'll get that when you get released. Just sign there stating that I gave that to you. >> What's 618? Perfect. Okay. So, it's going to get kind of redundant. I'm going to have to read you a bunch of stuff. Um, if you want to read along, I can get you a copy. Uh, so this one is just your constitutional rights. So, you have the right to remain silent. You have the right at this time to an attorney. Anything you say can and will be used against you in the court of law. If you are under the age of 18 and it can be used against you in a juvenile court prosecution for a juvenile offense and you can also be or it can also be used against you in adult court criminal prosecution if the juvenile court decides that you are to be tried as an adult. >> Uh you have the right to talk to an attorney before answering any questions. You have the right to have an attorney present during the questioning. If you cannot afford an attorney, one will be appointed for you without cost if you so desire. You can exercise these rights at any time. Do you understand your rights? >> Yes. Okay. So, say uh sign here saying that I have read or have had read to me the above explanation of my constitutional rights and I understand them. So, right there and then I understand my constitutional rights. I have decided not to exercise these rights at this time. Any statements made by me are made freely, voluntarily, and without threats or promises of any kind. Sweet. Okay. So, this one's kind of long. So, you are under arrest for RCW4661502 or RCW4661504 driving or being in actual physical control of a motor vehicle while under the influence of intoxicating liquor and/or drugs. Further, you are now being asked to submit to a test of your breath, which consists of two separate samples of your breath taken independently to determine alcohol concentration. So, I actually forgot to write the time down, but I checked your mouse. So, I'm just going to check it again. Sorry. And up. Perfect. Oh, 230 230. Sorry about that. Okay. So, further, you are now being asked to submit of your breath, which consists of two separate samples of your breath taken independently to determine alcohol concentration. You are now advised that um No, you're good. >> Sorry, >> I just I have to look at you. >> Yeah, sorry. That was like bugging me that was on my shoulders. You are now advised that you have the right to refuse this breath test and that if you refuse, your driver's license permit or privilege to drive will be revoked or denied by the Department of Licensing for at least one year. And your refusal to submit to this test may be used in a criminal trial. You are further advised that if you submit to this breath test and the test administered, your driver's license permit or privilege to drive will be suspended, revoked, or denied by the Department of Licensing for at least 90 days. If you are a age 21 and over and the test indicates the alcohol concentration of your breath is 08 or 08 or more or you are in violation of RCW 4661502 driving under the influence or RCW 4661504 physical control of the vehicle under the influence or under the age of 21 and the test indicates the alcohol concentration of your breath is 02 or more. You are in violation of 4661502 driving under the influence or RCW4661504 physical control of a vehicle under the influence. It's a lot. If your driver's license permit or priv privilege to drive is suspended, revoked, or denied, you may be eligible to immediately apply for ignition interlock driver's license. You have the right to additional test administered by any qualified person of your choosing. For those not driving a commercial motor vehicle at the time of the arrest, if your driver's license is suspended or revoked, your commercial driver's license, if any, will be disqualified. For those driving a commercial motor vehicle at the time of arrest, if you either a refuse this test or b submit to this test and the test indicates an alcohol concentration of 04 or more, you will be disqualified by the Department of Licensing from driving a commercial motor vehicle. So, just saying that I read you those above statements. Go ahead and sign there. >> Okay. All right. And then will you wipe my mouth or no? >> No, not yet. Sorry. >> It's fine. Oh, >> will you now submit to a breath test? So, check yes or no and then initial next to that. >> Yeah. All right. Okay. >> Have you ever had a DUI before? >> No. No. >> So, that just helps me out um in determining if I can release you tonight or not. So, if you haven't, then you're going to get out of here in just a couple hours. >> Yeah. No, I haven't at all. >> Okay. Do you have any physical impairments? >> No, just besides my head. Okay. That counts as balance test. But >> uh do you have a limp? >> No. >> Are you sick or injured? >> Besides my head, no. >> Okay. >> Are you under the care of a doctor or dentist? >> Are you diabetic or epileptic? >> No. >> Do you take insulin? Some of these questions get really like >> Have you taken any medicines or drugs in the last 24 hours? >> Uh, birth control with that and ironic. >> Uh, any prescription drugs besides the birth control? >> Um, and the irons. Okay. >> Yeah. No, besides that. >> Non-prescription? >> No, besides Yeah. Well, I guess like Advil. >> Advil. And when was your last dose of all of that stuff? Um, >> what time is it now? >> Uh, 2:30. >> Um, was about 900 p.m. >> Okay. Any cocaine? >> No. >> Any marijuana? >> No. >> Do you have impaired vision? >> Um, I do wear glasses at night. >> Okay. Like some reading glasses? >> Yes, because it's like heart with like lights. Okay. >> Uh, were you wearing them when I stopped you? >> No. >> Okay. >> No. >> And where do you work? >> Um, I play volleyball. >> Okay. It's a job. It's a lot of work. >> Yeah. It's a full-time job. >> Uh, did you work or play volleyball today? >> Um, I set up nets. I didn't really play, but I worked out this morning and then I set up nets. >> Okay. But work. >> So, like, yes, kind of. No. >> Okay. And when did you stop working out or? >> Um, around 12:00 p.m. noon, I would say. >> And how many hours of sleep did you get last night? >> Um, oh god, I woke up like 7 a.m. this morning. Say like 5 or 6. >> Okay. >> Like not that many to be honest cuz I had to work out this morning. >> Okay. >> To be our new strength coach. >> And then were you driving the vehicle? >> Yes, I was. >> Anything mechanically wrong with that vehicle minus the headlights? Yeah, there was a lot wrong with that vehicle to be honest. >> Um, one of the tires was super low. >> Okay. >> Um, the man in the car, him and his friends were supposed to actually fix that tire. >> Okay. >> Um, and then a headlight was out, which I was informed. And I think that was it. It was really just the headlight and the tire, I'm pretty sure. >> Okay. Have you been injured or involved in any collisions in the last 24 hours? >> No. Okay. Have you had any alcohol to drink since I stopped you? >> No. >> Where were you going before I stopped you? >> I was going home. >> Okay. >> And then without looking, what time do you think it is? >> Um, I'm at like 2:15 2:20. >> Okay. >> And what street were you on when I stopped you? Um, to be honest, I am not going to know that no matter what because I'm from Louisville and I still have to use Google Maps no matter where I go to be honest. So, >> and then I imagine you won't know the direction of travel you were going. >> I promise you I don't. I can't even tell you my zip code and I mean that for a fact. You can ask any of my roommates. >> And where did you start driving from? >> Um, I started driving from one of my teammates houses. >> Teammate. >> And what time did you start driving? Um, it was round two. You kind of caught me in like the beginning of the drive going home to be honest. >> And what day of the week is it? >> Um, today's Friday. Well, it's a.m. So, it's Saturday technically, but >> And what city and county are you in? >> Um, Pullman, Washington, to be honest. Again, that's all I can give you because I genuinely just like don't know. But >> yeah. And what's the date today? Um, again, I know it's June. Again, I genuinely like would not know this. >> Okay. >> Um, I know it's Yeah. No, I just genuinely like would not know that to be honest. >> You're good. Have you been drinking alcoholic beverages? >> Um, I had one at 700 p.m., but besides that, I have not drank since then. >> Okay. >> Um, and what were you drinking? Um, I was at the coup and I drank one trash can. >> Trash can >> and then my friend drove me home and I was trying to and I was at my friend's house and I was shot. >> Gotcha. And then who were you drinking with? >> Um, just some of my teammates and my friends. >> Okay. And where were you drinking? >> Um, at the CE. >> Okay. And the time of your last drink? um 700 p.m. >> And what time did you start drinking? >> That was what was that time? >> Do you do you believe your ability to drive was affected by your alcohol and drug usage? >> No. I believe that I got stopped because the car because of the headlight and that because I think that if my or if her car was fine then I wouldn't have been stopped because if I would not like have felt like I could not have drove then >> you know like I wouldn't know. >> Okay. Um we still have six minutes. So oh we still have these paperworks to go through. Okay. You said your first name was K A R L Y. >> Yes. >> And how do you spell your last name? >> B A S H A N. >> Shane. What was your birthday again? >> April 24th, 2001. >> All right. Um, so go ahead and put your boots in this container here. I'll let you keep your necklace on so we don't have to deal with that. And then your cell phone. and any other property you told me to leave in the car. >> Okay. So, just sign here saying I took your shoes from you. You'll get those back um when you get released from here. We're almost there. Once once we finish the the breath test, you can touch your face. I'll get you some water and a blanket. Okay. >> If I'm below, do I get to go home? >> Uh, so you're going to go home uh either way. But even if you're below, I do believe that you were impaired. Um, so I do smell marijuana on you. Your tongue is green indicating that you smell marijuana. Um, so I do believe that there's probably more in your system causing um your ability to drive be affected. So even if you're below um I still have plenty for DUI. >> What's your middle name? Rose. >> Rose. 20 45 Murman 508A. >> Yes. >> Do you have a CDL endorsement? >> Okay. It's for like a commercial driver's license. You drive like big trucks and stuff. Okay. Okay. We have three minutes. I'm just going to go over here and grab cuz I need your driver's license number to complete the test. So, just try not to touch your mouth. This is your license and stuff at your house. So, what year in school are you then? >> I'm sorry. What did you say? >> What year in school are you? A senior. >> Senior. >> Have you been playing volleyball here the whole time? >> Um, no. I transferred from Texas A&M and I just got here last summer. Gotcha. >> What position are you? >> I'm barrel. >> Nice. It's a sweet position. I always wanted to do that one. Sorry. Always makes me >> You can put it up in a hair tie if you want. God, that's so much better. We have a minute and 49 seconds. And I got your boyfriend's phone number to call him to come pick you up. >> Oh, perfect. >> When we're all done here. >> Thank you so much. >> So, you play a sport here? >> Mhm. >> Football. >> Mhm. We've been dealing with these same >> [ __ ] all night. Really? >> Mhm. >> I'm sorry. That might not be my business. >> No, it's just some local [ __ ] that we honestly haven't dealt with them in a long time. But >> tonight we've had six calls about them >> cuz they just are super drunk. They're screaming and yelling and fighting with each other, their brothers. And my place just go [ __ ] sleep. >> Yeah, I bet. Yeah, I was check >> met quite a few athletes actually cuz I pulled over another football player earlier. >> He's on his way to Etsy. >> Etsy. >> Mhm. >> And not hearing anything right now trying to decide if we should even enter the area. >> And I really hate cops. So it doesn't help that we keep going and bugging them. >> Wait, you hate cops? >> No, the people that we keep dealing with. >> Oh, I was like, but >> I was like this color. >> It's the same color. She just advised there's a second there this time. 45. >> Go ahead. >> When we were there earlier, one of the three males was sleeping in our car. >> Go ahead. >> Every time police drop by, they seem to escalate or get reignited. So, we're just trying to solve the problem. That'd be great. I'm sorry. >> It's It's not It's not close to your mouth, so you're good. >> I generally tell people like not your face cuz it's definitely a good place to have it. And your license is through Kentucky, correct? >> Okay. >> Oh, yes. But I'm also getting a Washington license, though. >> Have you got it yet? >> Um, it's in the mail, but I don't have my mail key until tomorrow cuz my roommate gets here tomorrow and she has the mail key. >> Okay. >> Which is Sorry. >> No, that's fine. Um, >> but >> let's just do your Kentucky one since it it's still current. Correct. Okay. >> Yes. And like and like my fanny pack like I like I have like the paper and stuff for it. >> Okay. >> That like says like the transfer. >> I just don't have it with me cuz they couldn't find it. >> And April 24th, 2001. >> Yes. Correct. All right, sweet. So, once it's done doing its own little checks, get it done. So, it's going to be kind of uh like how I explained in the field. So, you're going to do a nice hard steady blow into the into the machine here. Um, you'll hear a tone and you want to keep that tone going. That's how you know you're giving it enough air. It's going to go as long as you're putting enough air into it. Um, if you're unable to provide good samples, then I'm going to have to call it a refusal. So, because some people get in here and be like, I am blowing, but they're clearly like sucking in or whatever. Oh god. Sorry for shivering. I'm so cold tonight. >> Did you have a coat in the car? >> No, I had it at my house, but I didn't bring it. >> Okay, are we ready? So, nice deep breath in. >> Sorry. Sorry. Sorry. I took that before I did. >> Okay. So, keep that going. Oh. >> Oh. >> So, you got to take a deep breath in and then blow out. >> Okay. So, deep breath in >> there. Blow. Okay. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. You got to get to the little mark and you're still a little bit away from it. Keep going. Keep You're almost there. Okay, you're good. Okay. So, it helps um taking a deep breath in and not letting it out until you blow. At least from that one, it seemed like you took a deep breath in and let it out. Yep. You let it out before you blew. >> Okay. So, it's going to run through some tests. Make sure all the alcohol or whatever is out of the tube and then we'll do my mouth. >> Not yet. One more. >> No, you're good. Once this thing starts printing, that's when we know we can give you a water and you wipe your mouth and stuff. >> That's totally fine. >> So, once the thing prints, like you'll know. We'll know where your alcohol level is at least. >> Do you know what the legal limit in Washington is? >> Uh 08. >> Mhm. >> Yeah. Whatever. I talked to the lawyer. He said um that and then one there. >> Yeah. So, I think the prosecutors will drop it to a neg if it's below a 0.1 or something like that. And then if it's over a 0.1, they'll >> continue to they'll charge it as a >> DUI for my not coming. Um, and then our chief has asked us to contact him every time we arrest an athlete because it usually is like a big deal, I guess. Um, what is your coach's name? >> Um, Jim Green. Do you see do that now even? >> Um, I I'll send an email to my chief or text or something to him tonight. That way he's aware because it's gonna hit the news or hit the media or whatever and then chief is gonna get mad if he's not aware of it beforehand. >> So like say that like this number is below >> Mhm. >> Will still >> Yeah. So it's still going to show that we arrested you for DUI um in the media logs. Okay. >> Unfortunately. And yeah, Pullman Radio News and like the Daily Evergreen or whatever they check our daily logs every day. >> Makes sense. Um, >> what like what will it like say? >> Um, it'll have your name in there. It'll say your name was arrested for DUI at this time at this location. >> Her first breath samples indicated back levels of 0.1 for 5ir and 0.152 EC. Her second breath samples indicated back levels of 0.139 IR and 0.1 for 6 EC, which were almost double the legal limit of 0.08%. Officer McNe also told Carly that she smelled like marijuana. >> Are you serious? >> Yeah. And I just gotten out of the academy. I was like, "Are you [ __ ] kidding me?" >> I was like, "I just got this job." >> That's like too ironic to be honest. >> I know. And his dad was a the chief of Kfax at the time. >> No way. >> So, yeah. And his brother's a cop. Like, he's >> he's from a whole cop family. His >> no that he got a DUI. >> Yeah. >> It's crazy. >> And it happens. It's just how you deal with it afterwards that matters. >> Nice. >> Like he stopped drinking and >> like even if he's had just a beer, he's like I ain't stepping foot near a [ __ ] car cuz >> it's a lot. Like the fines, the court, and all that stuff. It's just a lot. >> So So go ahead and take a nice deep breath in and without letting it out. 467 clear. >> So deep breath in. >> Sorry. Sorry. Sorry. I literally did that. >> It happens. So blow until you hear that tone. There you go. Keep going. Keep going. I'll let you know when you're halfway. Keep going. Okay, you're about halfway. Keep going. Uhoh. Okay, take a deep deep breath. So in. Okay, keep going. Keep going. Keep going. Keep going. You got it. You got it. Threequarters of the way there. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Perfect. >> That was easy. >> Okay. So, once it starts to print, that's when this thing is done. >> Perfect. And that's when we're like we'll let know more about >> at least what happens next. Yep. So, >> so can you like explain like >> So, what happens next? >> So, based on my observations, so part one of the the first test that I did on you was I checked your eyes. >> Alcohol causes >> um the eyes to be jumpy. So, instead of being able to track something smoothly where it's doing this, your eyes are doing this. >> When you're over a 008 is when your eyes are really bad. >> And like to be honest, your eyes were very, very jumpy. And so that's how I knew you were likely over the limit of 0.08 >> um going up. So when I did the up, it's called a vert vertical mistagmus. If >> and you were a little jumpy there, but not a lot, which means that you're used to that amount of alcohol, >> which means you frequently or a couple times a week drink that often or drink that much. So, if you're drinking a trash can every once in a while or drink a couple mixed drinks on the weekend, then your eyes will be accustomed to that amount of alcohol in your system and they won't be jumpy when you're looking up. Um, the walk and turn, um, you missed heel to toe on almost every step and you were almost just walking instead of doing one foot in front of the other. You were kind of like just walking if that makes sense. And so, some of the clues we look for is stepping offline. So this would be the line and then you were stepping like here and here like on the outsides of the imaginary line that you had created for yourself. Um as well as um over an inch between your feet is called missed heel to toe which you had. Um an improper turn was just not doing the turn how I had demonstrated it. Um, I'd have to go back and count the amount of steps on my body cam cuz I don't actually remember counting how many steps you had taken. The going down, it seemed like you took more than nine steps, but I'd have to recount on my body cam how many steps you had taken. Okay, so your first breath sample, so it tested every breath sample that you provide, it tests it twice. >> Okay. Um, so the first sample it tested a 145 and a 152. And then the second sample was a 139 and a 146. >> This tells me that your alcohol concentration is going down, which means you probably didn't drink right before you drive or drove. >> Um, but it is over the legal limit by >> a little less than double. >> Does that make sense? >> So, you're going to get a copy of this for your So, so I'm going to put that in your property. Do you have any questions about like what this means or any of the other steps from here? >> Um, so like what happens next, I guess. >> Um, so I'm going to put you cell. I'll give you a blanket since you're cold. It's not very comfortable in there. Um, it might take me a while depending on how many calls we get between now and when I release you. Um, try not to flood the cell or damage the cell in any way. Otherwise, that's a felony. Um, because you're taking one of our holding facilities out of commission. Um, I had a girl arrested for DUI and then had to charge her with two felonies because she destroyed two of our cells. So, I get that it's going to be hard in there because there's nobody to talk to and it's really quiet. Um, my recommendation is try to take a nap if you can. Um, I'm going to go up, write a citation, get you all the paperwork. Um, and then call your boyfriend and have him come pick you up. I'll try to get that. I'm fairly quick at it, so I can probably get it done. >> What's that? >> Okay. Um, any other questions about the process? >> Is there like a bail fee? >> What's that? >> Is there like a bail fee? >> Nope. So, you're going to get cut loose the second I'm done with the the citation. >> Okay. Then what happens next? >> Um Oh, >> you know, like how do I like handle this going forward? I guess. >> So, on Monday at 300 p.m. you have a court date. >> Okay. So, on June 20th, 2022, you have your first appearance at 3 p.m. If you don't make this uh court date, >> um they'll probably issue a warrant for your arrest. So, make sure you get there. And it's going to be just here in Pullman, >> right across the street from the PD >> or not across, it's across the parking lot. Like, we share our same parking lot here. So, come here. >> Sorry, my eyes are going to be walking. >> No, that's fine. I get it. It's a lot. Um, so on Monday the 20th at 3 p.m. be here for your first appearance. >> Okay. Um, and then >> and they're they're pretty good. They'll probably have Martinick help you out, the attorney that you talk to. >> Okay. So like from there, like what could happen, I guess. Sorry. >> No, you're fine. Um, so depending on, you know, what the, so the prosecutor is going to request all my body cam. They're going to request my report. They're going to request. >> I'm just basically asking I keep my body care over. >> No. Is your other girl's career over? >> No. You'll be fine. No. >> It's going to be hard. Um, >> okay. So, like, sorry, I completely intered. So, what like could happen like just >> um I guess what do you mean? What what could happen as far as >> like from Monday? Like what's like the possibilities of happening, I guess. >> Um, so they'll probably set up another hearing. I don't know if you enter a plea here. I think they just present the case in front of you and tell you, you know, essentially all the facts that I have on all the evidence against you and they let you know that they probably set up another court date where you'll enter a plea. Um, and then you'll work with a prosecutor from there on entering a plea deal or if you want to take it all the way to trial, that would that could be a thing. Um, I think a lot of the time these end in plea deals. Um, >> what does that look like? Um, I do believe most DUIs come with like a fine, maybe some alcohol, um, classes that you'd have to take. Um, and then I don't know about the days in jail. I want to say it's one day in jail if you get found guilty. >> Okay. >> But, >> okay, >> that I'm just speaking from some experience. >> Okay. And I could go home tonight like you're going to call >> within like an hour or two. >> Oh, please call her. >> You want me to call him right now? So you can talk to him. I'm going to put it on speaker just >> Hi, it's Carly. >> What's up? You all right? >> Yeah, I'm fine. Well, no, but >> what's up? >> Oh, no. I'm so scared. >> Good. >> Um, I'm getting arrested for a DUI, but they but they said that you can come get me in like an hour, you said. Is >> Yeah, I'll try to get it all done within an hour. >> Like in like an hour. So, can you like set like an alarm or something, please, and come get me? >> Yeah. Yeah. I got you. Where where you at? You pull me yet? >> Yep. Pullman. The Pullman Police Station, which is on Kamayakin Street. Yeah. The Poland Police Station. >> Yeah. Yeah. I got you. >> It's not WSU PD. It's Pullman PD. >> It's Pullman PD. >> Okay. Yeah. And then you'll call him whenever it's ready and stuff. >> Okay. Yeah. Please just come get Please. >> Mhm. >> All right. Yeah. I'll be there. >> Thank you. >> Okay. Bye. All right. Um, yeah. So, like I said, it's all going to come out to like how you deal with it afterwards, right? So, if you show your team that you're, you know, >> so my coach, like knows, right? >> She doesn't, she doesn't know right now. I don't know what kind of relationship my chief has with her. Um, but I do have to notify my chief that I have arrested an athlete. Um, whether or not he call I doubt he's calling your coach at 3 in the morning. So, you think he's going to call her tomorrow? >> Yeah. Or talk to her, maybe. I don't know. She'll probably find out. Um, if you have her phone number, it might be better coming from you, letting her know. >> Like just kind of owning it right off the right off the bat. Are you close with your coach? >> I don't know. I get kicked off. >> Did the other girl get kicked off? No, >> she was underage, too. >> Yeah, she was. They kind of like let her to like It sounds bad, but like they kind of obvious like look past it. >> Like in a way they could kind of just like let her handle it. But with me, I just don't think they're going to do that. I so my opinion I guess I think they'd be silly to let it go for someone who's not even old enough to drink >> and not let it go for someone who is old enough. >> Yeah. Cuz they honestly like >> like made like a mistake after her like DUI and stuff and they made more like a big deal like about that than her DUI and stuff. But >> I don't know. I feel like they're going to >> Sorry, I was like thinking processing a lot. >> But I can go up and get started on your >> on your process so we can get you out of here >> because the sooner I can get out of here, the better to be honest. >> Um, it'll take >> most respectful. >> No, you're good. It'll take me just a little bit more time because I have to hand enter all your information instead of scanning it. Um, but I can probably still get it done pretty quick. >> So, do you think like if I like send like my text or like my coic text at least? >> Yeah. Let her know from you and stuff like >> out of here then that would be before the chief calls her. >> Yep. >> Okay. >> I think that would be best because then you're owning it right away and she's not finding out in the news or in on Facebook or whatever. >> Okay. and then Monday and then from there, >> not saying like happened, but do you think like >> best case scenario, it's like a class and me paying a fine >> and it's probably a day in jail >> and like a day in jail. >> Mhm. >> Do you think like on like a weekend or something? >> Yeah, I think they work with you on kind of what day you're >> cuz I have 10. >> Yeah. No, you're good. Like trust me, I would go from 80 a.m. to, you know, like I would do that if like that's what like that meant and stuff, but I was just wondering like if that's what like it took. >> Yeah. I think I think they're pretty good at working with you cuz >> All right. And like does it like go in like the school and stuff? Do you know? >> Uh the school probably find out about it just cuz they also pay attention to our media logs for student names. >> That makes sense. I just like that word. >> But it also is summer so I doubt they're they may not be looking all that hard. I think they get notified every like two weeks in the summer. >> Okay. >> So, >> sorry for all the questions. >> No, you're good. >> I don't mind. >> Um, okay. So, I'm going to go start working on all your paperwork. I'm going to grab you a blanket. >> Thanks. >> I'll get you a cup. >> Okay. So, there's a cup. >> Thanks. Okay. So, >> should I get up? >> Uh, yeah. >> So, here's that. Here's a blanket. I know it sucks. >> Sorry for laughing. It's just >> So, this is how you flush is this button. Cold water is here. >> You know what? >> You do have to push it. >> I'm just going to take it out. No. >> Okay, I'm good. Thanks for showing me that. >> Can you please try to be fast? >> I will. I need uh the owner's information for the car to finish the citation. Uh, the name of the person that owns the car. >> How do you spell the last name? >> L A G O S. >> And how do you spell the first name? >> A L E X. >> Is that a male or a female? >> No. >> Do you know Alex's birthday? >> No. >> Is Alex short for Alexandria? Do you know where Alex lives? >> Uh, she's in California right now at the mall. >> What's her address in Pullman? >> Um, she's going to live with me. >> Okay. >> I'm almost done with the citation. I just needed to know who owned the car. Um, does Alex know that the vehicle is suspended? So, that's another crime. >> No, she has no idea. >> Okay. >> That's why I have no idea. Okay. Um, so just let her know that if anyone gets caught driving the car, they can be arrested. Of >> course it is. >> Um, how old is Alex? Do you have any idea? >> Um, she's 21 about 22. >> Okay. Okay. Thank you. It's just like I'm finding out so much [ __ ] after the fact that it's really frustrating. All right, cool. So, I spelled her name wrong. The vehicle is suspended and something else that I don't remember right now. All right, let's get you out of here. So, go stand in front of that blue screen there. Okay. Got to take your booking photo. Okay. Okay. And keep your body facing me, but turn your head that way. So, keep your body Yep. There you go. Perfect. All right. So, we're going to get your fingerprints done. Oh, I left her form upstairs. Can you give me her booking number again? I left the form upstairs. >> Did you call? >> Yep. He's on his way. One more. Do you have any scars, marks, or tattoos? What's this? >> Butterflies. Okay. And this. Okay. So, right hip. Okay. So, we'll do your right hand first. I'll switch sides here. Um, so we'll do four fingers flat. Okay. right thumb flat and we're going to roll it. So, just try to relax your thumb for me. It took that. Okay. Sorry, I'm shaking. >> No, you're good. One looked pretty damn good to me, but S some spots here. Stick troll scissors back to us if they're not good. Better than some of the other ones. Okay, go ahead and take a seat in that chair. We'll get your stuff back and I'll get some of these forms signed. I'm not sure why it accepted this fingerprint but not so many other ones. So go ahead and find there on that one there. Okay. So this you get to take with you at your court date. Just to remind you, 6:20 at 300 pm at this address, which is Monday. This is your criminal criminal citation. Um, they should fill you in at this. Um, they may send you something in the mail um after that appointment. So, just keep an eye out um in your mail. Um, sign here saying how I'm going to release you and all your property. And then this is your results of the blow. And then just the do request for hearing. Uh if you want to read through that and decide, you can have your shoes back. And then this card, the cell phone number on there is the best way to get a hold of me if you have questions or anything like that. Um, so you're free to wait in our lobby until he gets here. So, it's going to be right through this door. Not the one with the window in it, but this one here. She's going to click a button and then you just push through it. >> What? >> A copy of her notification. >> Did I give one to her? >> A copy of it. >> I already copied it upstairs. Go ahead and push. >> I was trying to create less work for you. I've had people forget it before. >> Oh, yeah. No, I appreciate the reminder. >> Cool. Thank you. >> Nope, not yet. >> Thanks. >> Carly was later fingerprinted and photographed after spending some time inside a cell. She was charged with DUI in violation of RCW46.61 5002. Officer Mcnane returned to her property, advised her of her charges, and released her pending her court appearance in Pullman, Washington on June 20th, 2022 at 300 p.m.
