considered innocent until proven guilty thank you all for the [Music] support for around the 55 p.m. on October 2nd 2023 patrolman Shan aloy with am mendum Township Police Department was on routine Patrol on Brook Race drive and he observed a gray 2011 Toyota Camry parked in a grassy area by the lake it initially seemed like there were no occupants inside the vehicle but once he got closer he noticed that a female was asleep in the driver's seat the seat was in the reclined position but the female was breathing and her eyes were closed while the engine was running a closer look on the passenger side revealed that there was an open container of tequila on the floor board thank you hi there hi how you doing today you okay yeah all right I just want to let you know my body camera is on right I got to let everybody know when I'm you know interacting with you yeah I she I texted my dad he was um he's coming down here I just wanted to let let him know I was like Hey like I'm like down here like I know that like we're going to have like it's going to be um like body cam type weather over here um body cam type weather yeah cuz I know that every time um we go fishing down here they they it tends to be like body cam so tends to be body cam yeah uh just just they always have like some sort of type of like police body cam who's that uh just every type of person we've ever met has always been have has always been um had their little body cam on okay yeah so all right how much you had to drink today I didn't have anything I no all right what's that bottle over there uh bottle bottle down on the floorboard patroman over soy initiated contact with the driver by knocking on her window to awaken her and she was identified as Alexis she first rolled down the rear window before rolling down the front window on the driver's side as patroman over soy was speaking with Alexis he noticed indicators of imp ment he started by asking Alexis to perform the finger dexterity test followed by the recitation of the alphabet from Ft since Alexis was unable to recite the alphabet satisfactorily he asked her to exit the vehicle and perform field sobriety exercises oh that's from I'm sorry that's from um last week I was I haven't had anything to drink though okay yeah I'm sorry I was doing I just stuff um yeah but no I haven't had anything to drink today okay all right I'm going to have you do some finger dexterity test for me okay sure all right look at my hand all right I want you to do what I do after not right now I'm going to I'm going to do it and then I'm soy started with the Horizon Gaye nagus hgn test during the hgn test patrolman over soy observed the lack of smooth Pursuit distinct and sustained nagus at maximum deviation and the onset of nagus prior to 45° the second exercise was the walk and turn test during the walk and turn test Alexis did not touch Heel To Toe on each step turned improperly and failed to keep her arms at her sides the final exercise was the one leg stand test and Alexis failed to raise her foot in the proper fashion while putting her foot down before the the test was complete all right face me stand right there the right here where this intersection is and and face me okay like I'm over here so that's fine so face me so I'm gonna give you the instructions while I'm giving you the instructions I want you to stand in the starting position for the test this is called the walk and turn test okay all right so here's the starting position your right foot in front of your left with your right heel touching your left toes I want your hands down at your side no more than six inches off the side of your legs at any point okay okay do you have any injuries to your legs uh no okay good all right so again right foot in front of your left right heel touching your left toes got your hands at your side no more than six inches from your side okay okay do you understand yes okay so stand in that position and I'll explain and demonstrate the test for you okay all right so go ahead and stand in that position sorry okay good so this test uh involves taking nine steps down small choppy steps to the left and then nine steps back all right so for demonstration purposes I'm going to take three steps down make small choppy steps to the left and then take three steps back all right you understand that all right that's for demonstration purposes only you're taking nine small choppy steps to the left nine steps back do you understand yes okay very good all right so what I want you to do once you begin is Count out the wheel the open container and her inability to satisfactorily complete the field sobriety exercises patrolman over soy placed Alexis under arrest for driving Under the Influence after she was placed under arrest her vehicle was impounded for a mandatory 12-hour hold under John's law patroman over soy first transported Alexis to the mendum Township Police Department for further processing since the ALCO test machine was not functioning in menum Township she had to be transported to the Chester police department for the administration of the Alo test I can tell you've been drinking in fact you failed those tests all right so right now you're going be placed under arrest okay for DUI please all right so if you would just put your hands behind your back and I want to put handcuffs on you right I'm going to double lock them all right if you want you want to take that watch that way it doesn't get damage from the handcuffs all right you want to just hang on that for a second my parents are going to be so mad all right there's no way to just like the road unfortunately not I got to going to have to put these on you and take you back to headquarters all right is there any way record of taking of the breath samples including the tests will be made on your request a copy of that record made available to you after you provide samples of your record for testing you write at your own expense to have in person or physici of your own selection take independent samples of your breath blood or urine for independent testing if you refuse to provide samples of your breath you will be issued a separate summon for the refusal the court may find you guilty of both refusal and DRX if Court finds you guilty of the refusal you will be subject to various penalties including license replication of up to 20 years a fine of up to $2,000 installation of an IND ignition inlock and referral to an intoxicated driver Resource Center these penalties made in addition to penalties imposed by the court for any other offense of which you are found guilty you have no legal right to have an attorney pH or right to refuse to give or delay giving signals of breath any response for that is ambiguous or in any respect to my request that you provide breath samples will be treated as a refusal to submit the breath test even if you agree to take the test but then do not follow my instructions do not properly perform the test or do not provide submission breath samples I will charge you with refusal to submit your breath testing I repeat the law requires you to submit samples
