considered innocent until proven guilty thank you all for the support on the evening of January 28th 2023 Fairfield police were called to the site of a motor vehicle accident near the Essex County Airport in Fairfield New Jersey a white 2014 niece on SUV had crashed into the fence surrounding the airport perimeter as officers were responding the color reported that the driver made a u-turn and was heading North onic Avenue hello hello how are you can you just take a seat for me right here sorry what's going on today I just got into [ __ ] acci okay what's going on how'd you get into an accident I hit the [ __ ] guard rail you hit the guard rail where over there I thought it was okay where are you coming from I was coming from um 46 my boyfriend's house your boyfriend's house okay where on 46 um exit 46 46 to um Patterson okay so you the color remained behind the white Nissan until the police arrived the vehicle event became disabled at 350 pic Avenue and Fairfield Police arrived shortly afterwards the police observed the lone occupant of the vehicle exiting and she was later identified as 29-year-old Laura godleski officer sickles suspected that godleski was intoxicated but she initially denied consuming any alcohol prior to the crash you were coming from your boyfriend's house yeah okay gotcha all right and you didn't feel like hdden guard no no I did I was trying to I felt that you Laura are you injured no no I'm okay you can wiggle your toes you could wiggle your hand abolutely do you have your license on you or no where is it get it uh in my car okay we're going to go get it for you okay where in the car is it um in my uh [ __ ] purse in your purse yeah okay where were you trying to go to I mean I was going I was going to pick him up and then going home pick who up my boyfriend where's he at um Patterson no Clifton in Clifton yeah okay what's your first name again I'm sorry Laura Laura why don't you put the phone away okay we're going to worry about the boyfriend in a second Laura where are you coming from right now his house his house yeah and now okay so you're coming from his house and you're going to pick him up yeah I was leaving cuz I had to get um I had to get something for his mother a purse that I was going to bring her back and that was it okay so where do he live um Clifton he lives in Clifton yeah okay thank you how did you get here I drove no no we're in Fairfield if you're going from Clifton to patter how' you get I was going to my house get this which is where I'm sorry um based on their suspicion of intoxication officer sickles afforded godleski an opportunity to perform standardized field sobriety tests during the horizontal gaze nice stus test he observed the lack of smooth Pursuit and NI stmas at maximum deviation in both her left and right eye he also positively noted nystagmus prior to 45 degree onset in her left and right eyes along with six out of six clues of intoxication doleski was unable to walk Heel To Toe on multiple steps during the walk and turn test and she was subsequently unable to maintain a steady balance during the one leg stand test back my wallet is still in there can I we're turn around and Heel To Toe back yeah you're comfortable with doing them on yeah I think so okay so I'm going to explain the test demonstrate it and then I'm going to ask you to perform it okay so so I'm going to first put you in the starting position you see this nice white line that's straight in front of you I want you to take your left foot and put it on that line for me right now can you do that for me yeah now I want you to take your right foot and place it in front of your left foot touching Heel To Toe can you do that for me yeah with your hands down at your side Sor no it's okay with your hands down at your side this is called the starting position do not move from this position unless I instruct you to do so if you fall out of it go ahead and put yourself back into it okay when I say go not now but when I say go you're going to take nine Heel To Toe steps forward on this straight line you're going to touch Heel To Toe hands down at your side looking at your feet and Counting out loud okay it's going to look something like this when I say go you're going to go one 2 3 I did three you're going to do nine on your ninth step whatever foot is out front planted you're going to keep planted and take a series of small choppy steps just as I am to turn yourself back and do nine heel the toe steps back one two three again I did three you're going to do nine key things to remember straight line nine Heel To Toe steps I'm going to try doing my shoes let me finish the test or explaining it hands down at your side nine Heel To Toe steps and Counting out loud okay do you back finish the test as I instructed it please I'm sorry it's okay uh one 2 3 4 5 6 7 8 9 okay the last test I'm going to put you in the starting position you can put do you want to put your shoes back on you're going to lift one of your legs 6 in from the ground yeah you're comfortable doing that and your flip flx just walking yeah okay no problem no problem at all so I'm going to put you in the starting position feet together hands down at your side just like the first one okay don't move from this unless I instruct you to do so if you fall out put yourself back into it when I say go not now but when I say go you're going to pick your left or your right foot you're going to raise it approximately 6 in off the ground keeping it parallel to the ground with your I'm going to show it to you with your hands down at your side looking at your raised elevated foot you're going to count out loud in this fashion 1 10001 1 10002 1000 you look at the foot and so forth until I instru it to stop it's going to look something like this you ready I'm going to say go you're going to pick your foot up raise it 6 in off the ground flat to the ground looking at your toe 11 10001 1 10002 110003 driving careless driving delaying traffic obstruction of windshield vehicle in unsafe condition traffic on Mark lanes and illegal u-turn w who Parks a car like this that right everything's in here alcohol content a record of the taking of the breath samples including the test results will be made upon your request a copy of that record will be made available to you after you have provided samples of your breath for testing you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath blood or urine for independent testing if you refuse to provide samples of your breath you will be issued the separate summons for the refusal a court may find you guilty of both refusal and driving while intoxicated if a court finds you guilty of the refusal you will be subject to the various penalties including license revocation of up to 20 years a fine of up to $2,000 installation of an ignition interlock and referral to an intoxicated driver resource enter these penalties May be in addition to penalties imposed by the court for any other offense of which you are found guilty you have no legal right to have an attorney physician or anyone else present for the purpose of taking the breath samples you have no legal right to refuse to give or delay giving samples of your breath any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples you will be treated as a refusal to submit to breath testing even if you agree to take the test but then do not follow my instructions do not properly perform the tests or do not provide sufficient breath samples I will charge you with refusal to submit to breath testing I repeat the law requires you to submit samples of your breath for testing will you submit the samples of your breath yeah can you give me the that's right there is uh there's one in um that room in the uh like drawer that you pull out to so right now we're going to wait 20 minutes and then after the 20 minutes is up we're going to take you over to the Apple test machine that's the machine where you blow into the tube that you agreed that you wanted to do you're going to blow into the tube a series of times we need two good tests which means two sufficient tests of your breath right it does its calculations we plug all those numbers into the computer it gives us an alcohol content to to your breath okay depending on that is whether or not we might have to go for a drug recognition expert which is somebody who is an expert in identifying other drugs in in a person system does that make sense yeah I'm just explain you ask yeah than you and then after that then essentially we finish the paperwork and you call for writing to jail um so listen the only way you go to jail is if we find that there were drugs in the car you endangered somebody's life so severely um or any other charge that I can't think of off the top of my head I'm not saying I'm trying to go that direct route you know what I'm saying but for what a DWI is essentially in in layman's terms it's a traffic ticket it's a very serious traffic ticket so that's all you're charged with today and you you find a ride you go home be able to call actually you can call as many people as you want to be honest it's not like the movies obviously like obviously you guys are going to take my breath but like I didn't think I was um in to to it but I promise like I I had one drink one sh but like I I did no drugs I to get drug test and whatever but like there's of driving while you know while consuming alcohol that's the only reason why I'm saying let's hold off on calling them because if we have to go that route it's longer does that make sense so if I so basic if you blow above theal Li we don't we don't go the the drug recognition expert what what what do I have to blow to see 08 08 or higher 08 legal like illegal above the okay we're not we're not going to take their heart your heart rate then they're going to check your eyes and they're going to put you in a dark room and check your eyes check your blood pressure check your just drug test me because what it you're allowed to drink or you're actually not about the drink on the methodone but with other Le you're taking a whole bunch of legal stuff yeah so that person is uh specifically Tau on how to recognize what a person takes and how it affects that body to say yes you took this and this and that is why you're at this stage right so I am not a drug there's only a few of them in the whole state cuz it's a very long and and uh intricate process I really I I don't even want to but I just so to go through that like8 I don't even feel like G cuz I obviously don't feel toxic but I hope like they can't just but it like don't you okay so a few different scenario might me like let's say you pulled someone over right and they had drugs in the car y uh and you like test them to see
