aren on at all around 12:50 a.m. on July 26 2024 Sergeant adalberto PCO with the Highland Park Police Department observed a white 2020 tea serrento driving eastbound without headlights on ritton Avenue he activated his emergency lights to initiate a traffic stop but the vehicle continued heading eastbound before turning onto Woodbridge Avenue and eventually stopping near the intersection of Woodbridge Avenue and vard Street he approached the vehicle from the passenger side and made contact with the driver of the Kia who was identified as Alysa don't do that if I do if I go one more it's a high beam that's high beam nope it's on auto so yeah if I go one more it's high beam turn up Step Up have no break light so if I hit my auto turn the front and the back lights gone IDE it sets I auto I don't know I don't have the Kia I mean ideally it should be okay it's set to Autumn okay all right have a SE all right listen I'm getting this smell of alcohol you have a couple drinks tonight yeah I had one okay all right so this what we're going to do I'm going to call somebody over we're going to run some tests make sure you're safe to drive you okay to drive you'll be on your way all alcohol and observed indicators of impairment Alissa told him that she was headed home after picking based on his susp of impairment Sergeant P officer Alexander Tria to come on scene and administer field sobriety exercises once officer Triana arrived on scene Alissa was asked to exit the vehicle and perform field soety exercises right up the road okay I see you guys right there it's in like a plastic there we go awesome all right just hang out in the car for me for a couple minutes and then uh my partner is going to come and he's going to run the test and then we'll go for thank you very much so um you have no lights on I sto there pass approach odor alcohol but it was like coming from the passenger side which is fun I went on her side I spoke to her I was getting a little bit and I asked her as I step out because she couldn't figure out the lights was work how to work and whatever I got a smell from her ass so she's like I had one drink I'm going to have somebody come do okay just T whatever then um yeah we should use this lot here flatting out of the way I think it's good over there um we could we use CR that's good good evening ma'am um my supervisor I guess pulled you over and uh kind of told you what's going on so I'm just going to take you out of the car I'm going to run you through the standardized fi sobriety test okay okay um I'm going to walk you right over to the lot over there just where it's like well lit and flat so we can make sure we do them right and U that's fine okay perfect yeah I literally live up the road I'm just trying to go okay no problem morning what could we use we're going to use one of these uh parking stalls right here okay Officer trian escorted her to the parking lot of a near by Crushers food store at 93 Woodbridge Avenue to administer the field sobriety exercises officer Triana started with the horizontal gaze nagus hgn test during the hgn test officer Triana observed the lack of smooth Pursuit distinct and sustained nystagmus at maximum deviation and the onset of nagus prior to 45° he did not detect vertical gaze nagus the second exercise was the walk and turn test during the walk and turn test Alysa did not touch Heel To Toe on each step and turn improperly the final exercise was the one leg stand test during the one leg stand test Alyssa failed to raise her foot in the proper fashion and put her foot down before the test was complete okay so two drinks you going be walking pretty well don't have to be nervous or anything like that just going to go okay perfect all right all right so the uh first put you in the starting position okay put your left foot on the line my left foot left foot on the line right and then you're going to put your right foot in front of your left foot with your heel feel like you're doing too much I just don't want you to do my shoelace or my pants I I just don't want you to trip over I understand but which one my shoelace or my pants shoelace or your pant legs test you're going to walk in a straight line with nine heel toe steps down the line turn around and do nine heel toe steps back now going to demonstrate the test for you I'm now in the starting position my left foot's down just like yours my right heels touch my left toes my hands are down on my sides okay for demonstration purposes I'm going to do three steps you will be doing nine my hands remain in my sides I stay looking down at my toes and I count my heel to toe step out loud like so one 2 3 I did three steps you'll be doing nine steps when you get to your final step you're going to turn around on your lead foot plant your lead foot planted with several small steps it's like this and then you're going to take nine returning steps Heel To Toe just like you did steps out so one two three again the entire time hands are at the sides looking down to your toes making sure you touch your heel to your Toe with every step okay do you have any questions nine spin around nine oh nine steps turn around your lead foot nine steps back and then once you begin the test do not stop until you've completed the test once you completed the test then you just stay in the position okay you choose which one it is right or left doesn't matter you're going to raise that foot 6 in off the ground parallel to the ground okay with your toe pointed out so it's like this okay all right so what you're going to do when you when you do that you're going to stay looking down to your toe and you're to count Out Loud by 1000 1001 100002 1003 and you're continue to count until I tell you to stop satisfactorily complete the field sobriety exercises Alysa was placed under arrest for driving under the influence after she was placed under arrest and placed in the patrol car her vehicle was impounded for a 12-hour hold according to John's law officer Triana transported Alysa to the Highland Park Police Department for further processing while officer Samson remained unseen until the vehicle could be towed by Dependable Motors towing company I believe that you may be under influence alcohol so we're going to place you in the r now we have to bring inside and process you for a right now you're under arrest for the suspicion of being toxicated you're [ __ ] for real yes yeah so you're not going to jail this is this is just going to headquarters you blow in the Bots and then read this to you and you'll answer yes or no essentially what it's asking is uh will you submit samples of your breath when you get a driver's license in New Jersey you are getting the license but you are by law required to give sample of your breath you're not required to give sample of urine blood or anything like that but the breath they require you to do um if you for and whatever reason refuse to blow they automatically treat it as if you were found guilty they suspend your license right okay okay so I just have to read it read it to you line by line all right NJ attorney general standard statement for motor vehicle operators under njsa 39 4- 50.2 e revised and effective July 1st 2012 one you have been arrested for driving while intoxicated njsa 39 COL 4-50 two the law requires you to submit samples of your breath for the purpose of testing to determin alcohol Conta three a record of the taking of the breast samples including the test results will be made upon your request a copy of that record will be made available to you four after youve provided samples of your breath for testing you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath blood or urine for independent testing five if you refuse to provide samples of your breath you will be issued a separate summons for the refusal a court may find you guilty of both refusal and driving while intoxicated six if a court finds you guilty of the refusal you'll be subject to various Penal IES including license revocation of up to 20 years a fine of up to $2,000 installation of an ignition interlock and referral to an intoxicated driver Resource Center these penalties may be in addition to penalties imposed by the court for any other offense of which you are found guilty seven you have no legal right to have an attorney position or anyone else present for the purpose of taking the breast samples you have no legal right to refuse to give or delay giving samples of your breath eight any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal to submit to breath testing even if you agree to take the test but then do not follow my instructions do not properly perform the test or do not provide sufficient breath samples I will charge you with refusal to submit to breath testing nine I repeat the law requires you submit the samples of your breath for testing will you submit samples of your breath yes or no sure yes okay I just need [Music] to transport or accompany the defendant from this law enforcement agency the defendant has been arrested in charge with one or both of the motor vehicle violations checked in the Box above pursuant to njsa 39 45022 the warnings to have you that if you accept responsibility to transport or accompany the defendant and you permit or facilitate the operation of a vehicle by the defendant while the defendant is intoxicated or has a BAC at or above that permitted by law then you are potentially subject to criminal penalties and civil liability permitting a person who is intoxicated or has a blood alcohol con at the station Alysa was read the standard statement from motor vehicle operators and she agreed to submit breath samples her Alco test results indicated a back level of 0.76% which was more than double the legal limit of 0.08% after they were finished processing Alysa she was released to her brother pending her court appearance he signed the potential Sherl warning on alysa's behalf Sergeant Pacho issued aissa the following citations operating Under the Influence reckless driving and failure to use lighted lamps at or above that permitted by law to operate m vehicle is violation of njsa 39450 if you are charged and convicted under the statute your driving privilege will be suspended fines and monetary penalties will be imposed essentially if you allow her to it's like you're getting it all right got it so you're going just going to sign right there and just don't let her drive while she while she's drunk and she lense back I'm going to print this out so you have a copy of
