absolutely um I'm sorry I was looking for my phone everywhere I just dropped my um girl off and I can't find my phone and I can't find my license or anything all right um around 11:25 p.m. on April 7th 2024 patroman Matthew gisi with the mammoth Beach Police Department was on patrol on Ocean Avenue and he observed a 2012 BMW speeding Northbound by going 53 mph in a 40 mph Zone as followed the vehicle he observed the driver swerving and failing to stay in the lane before striking a curb he activated his emergency lights to initiate a traffic stop and the driver pulled over in on Ocean Boulevard near Broadway in Long Branch he notified dispatch about the traffic stop and made contact with the driver who was identified as deer I would say I have a picture of it but I don't can I give you my social possibly okay do you have your registration insurance card um I think so and where you coming from tonight um we were at work I just dropped her off oh where do you guys work at um Colt Golf Club Colt Golf Club oh very cool um what do you do there um we're servers over there oh cool this may be expired where did you drop her off at um we were in the highlands she lived um right off Sandy Hook and we just looked for my phone for about 45 minutes and I'm so sorry I know I went over that curb I've been like literally like searching in between the things for my phone okay um just so you know this uh registration card you gave me is expired yeah I know it's expired um you the insurance card possibly here can I actually see the registration card again I just want to see if you're are are you the no that one right there oh sorry are you the registered owner on the car yes you're uh is it drra okay what's your address uh I just changed it and I just changed it in the DMV vry as well um and uh I have like the print out of the um like whatever they gave me online and they're mailing me the actual license expired all right um is there any way you could show me insurance it's your phone isn't in your bag at all no that we've just spent about 45 minutes looking for it why I've been like I just went over the C my now but like I was and what not for it there's actually three reasons I was stopping you when you went by me and in my town um you were going you were speeding you're going 53 and 40 um when I ran your tag your registration was expired so that's second actually like right yeah it's this is the right one right here it's three of 24 I believe um and then the Third reason was you were swerving yeah I'm sorry I've been looking for my phone how long have you been looking for your phone the whole time you've been driving um probably s for like probably like an hour and a half but physically like 45 minutes okay um any need to drink tonight um not going to lie at the very end of the night we had like a shot of tequila okay is that it but that was probably about like an hour and a half ago an hour and a half like two hours yeah okay anything else like marijuana oh no no no no okay all right hang tight um sorry yeah let let me just go on your license um see if you could find the insurance card in your in your insurance in your uh glove box maybe you got it um looks I really I just moved so it's probably mailed to me okay no worries as he approached Dedra he observed indicators of impairment deer was asked for her documents but she was only able to provide her registration she told patroman glisi that she had left work at the coldsnap Country Club and that she was headed home after dropping off someone else she admitted to consuming alcohol earlier that evening before operating a motor vehicle patrolman Peter farmer arrived on scene to assist as pondu andisi returned to his patrol car to check her registration based on his suspicion of impairment derer was eventually asked to exit the vehicle and perform field sobriety exercises well you keep you keep looking for it and I'll go run your license I'll be right back with you all right I'm sorry what's up I'm gonna take her out for testing I don't smell alcohol but she just admitted to me she took a shot an hour and a half ago but she was speeding when she went by me I ran the tag expired and then I couldn't catch up to her until deep in here cuz I had to do a U-turn and this [ __ ] curb right here on she was swerving when in La Branch um all like basically since I got behind her she [ __ ] hit that ran over that grass median oh like [ __ ] boom over the grass median so I don't know she might be she NOS she hit it but she's I said her I said why why are you like swerving on over the place she's like we're looking for my phone like my phone's been lost me and my girl were just looking for it for like um for uh 45 minutes okay I said so you were just looking for your phone while you were driving and he was like yeah like okay so I don't know but once I saw that I was like [ __ ] she went on the on the grass itself Pete like hit the curb like both left tires her half of her car was on the grass be half of her car like I was what I've been I've been being very selective tonight I haven't been stopping a lot of cars and when I saw her I was like I'm stop this car how fast was she speeding I had her 53 like crazy but I don't know if she sped up after she went by me cuz I was struggling to catch up to her but I had her on radar at 53 things she's what she's got a few things spiling UPS like but after I got to check just oh good know after hour she like I know I hit that curve but you hit that c where's she coming from uh she said she just dropped off her friend in island but she said that uh she said that they were coming from the Rumson or not uh colite Country Club there servers there okay she said after sh she had shot said that was an hour and a half ago hey Miss so here's your registration card thank you I don't have my other things you don't have what my um license or Insurance okay no worries so listen um because of the driving behavior I witnessed and you're hitting the the curb I just want to make sure you're okay to drive so would you would you mind step out of the car to do a f field test for me what is that just to make sure you're not drunk field what field zety [Applause] test and you can just step over on the curb over there right that's okay so you said you just had the what the one shot you said gosh it was like probably like an hour and a half ago two hours and that that was it all that was oh yeah of course that was like designated to us for a boss so it's fine oh gotcha all right um so um do you have any issues with your eyes um no my eyes are too sensitive that's about it sensitive sensitive to light okay um do you wear glasses no no do you wear contacts no do you have any contact in right now okay great um so since you're a little taller than me I'm going to actually no I'm going to actually have you stand right here and face me this way you could on the on the on the Cur on the uh Street here I'll stand up here cuz for this test I have to be I have to be slightly above your your eye level um this first I got no sleep last night okay so my eyes are red but it's not anything to do with that patrolman deisi started with the horizontal gaze nagus hgn test the second exercise was the walk and turn test during the walk and turn test derer did not touch Heel To Toe on each step turned improperly and failed to count each step the third exercise was the one leg stand test and deer failed to raise her foot in the proper fashion counted incorrectly and her foot down before the test was complete the final exercise was the lack of convergence test okay no worries um like I said because of what I saw I just want to make sure can't drive y all right so the first test is called a horizontal gaze and stagis test basically it's a test of your eyes you already said you have no issues with your eyes I'm going to have you put your feet together just like this and your hands down by your side I just want you to stay in this position until I tell you do something else understand that understood Okay cool so do you have any problems seeing the tip of my pen right here no sir you can see the tip no problem right absolutely okay what I want you to do is I want you to follow the tip of the pen which is right there with your eyes and your eyes only and don't move your head you understand that y okay I'm going to try and keep the light out of your eyes as much as possible but I have to just look at your eyes okay just no I'm like shaking I'm nervous it's okay listen you're you're never I don't get pulled over no it's okay just make sure you keep your feet together okay is this okay yeah just all the way together perfect okay all right remember follow your eyes and your eyes only understand m try to keep your head straight facing me okay I'm sorry no it's okay if my eyes are watering I apologize okay no worries just keep your head straight okay just follow the tip of right Miss thanks Pete okay all right miss this next test is called the walk and turn test do you have any any physical injuries or disabilities that prevent you from doing a balance test uh my hips aren't even my hips aren't even yeah okay I have a bunch of dance injuries but I don't know so now your hips aren't even what do you mean by that so um uh this hip right here on my right one is a dislocated or it has been okay but that shouldn't be necessary for this okay all right I'm just freezing okay um any other injuries or illnesses that would affect the balance test um as of right now no I just hav an e no okay let's see all right so do you have uh are you comfortable in those shoes doing okay okay all right so I'm start by putting the starting position for this test like I said it's called the walk and turn test for this test I just want you to imagine a uh you know what why don't we come back here let's see here H actually this this will work right here I'm going to have you face me because this is more of a flat section of the sidewalk so you'll start right where you're at what I want you to do the starting position is you're going to put your right foot on that imaginary line just like this I'm sorry put your left foot on your mat on the line just like this perfect and put your right foot touching heel of toe just like this yep you're just going to stay there put your hands down by your sides get this is the start position for the walk and turn test I just want you to stay in that position and tell you to do something else you understand that okay so when I tell you to I want you to take a series of nine heel toe steps down that line just get back in start position for Sor no you're right so what I want you to do when you uh start when I tell you to start this test I want you to take a a series of nine he let those steps down that line it's going to look like just like this one 2 3 oh for demonstration purposes I only went till three you're going to go all the way till 9 on your ninth step keep that LE foot planted turn yourself around the series of small steps just like this take nine he to steps back down the line just like this one two three again I don't till three you have to go all the way till 9ine can you SK back in the start position yeah just get back in the start position for me perfect okay so um some things to note during this test while you're walking your nine steps keep your hands down by your side make sure you're looking at your feet at all times make sure you're count down yeah you're going to look at your feet pH physically heal the toe right yeah physically yep it'll be physically heal the toe just like this so this is start position okay one two 3 once you reach your ninth step turn around got count one two three out loud demonstrate one more time for you hold on wait one second I got it okay I know I'm just going to make sure I just want to make sure you understand one 2 3 again keep that leaf foot planted turn yourself around one two three yes sir um do you have any questions for me no no okay um just like I said make sure you count your steps out loud um keep your hands down by your sides touching Heel To Toe each time don't stop the test until you fully complete the test you have any questions on the turn the turn can be confusing sometimes yeah it's literally just turning your around the series of small steps just like that okay give me one second let me grab my clipboard thanks P appreciate it okay you can just get back in the start position for me perfect okay are you ready oh tell me when to go yep you can begin just look down at your feet kind your steps out loud too that's okay was a bad pivot did it count your step loud okay you can stop sorry that was a terrible do you want me to do it again no it's all right not lie I am shaking like I said okay okay so for this thing next test it's called the one leg stand test are you injured after that test at all no okay just a little shaky okay so we'll use we'll use this block right here I'll have you stand in the middle of this one since it's the most flattest one you're still comfortable in those uh sneakers right yes okay so for this test I'm going to have you go back in the same start position as before Hands by your sides and your feet touching together just like that perfect so when I tell you to you're going to raise one foot of your choice off the ground approximately 6 in look like this yeah just one second I'll tell you when to go so yeah I was just demonstrating no it's all right so I'm going to demonstrate for you you're going to count out loud 1,1 100002 100003 and stop this is what it look like 1 1000 2 1000 3 1000 4 1000 5 1000 6 1000 7 1000 basically you're just going to count until I tell you to stop keeping that foot um level to the ground parallel to the ground approximately 6 in off the ground which is like the height of a Coke can um throughout the test test make sure you keep your hands down by your sides and try to keep both of your knees straight okay okay and it's important to look down at your foot while you're counting so it'll look like look like this 1001 1002 1003 1004 until I tell you to stop you have any questions no okay which foot do you want to raise I'm going to raise your left okay um I know you said you have one of your hips is not aligned right it's this one is that going to affect you balancing on that foot um not necessarily it's just more when I'm standing I I'm kind of cred gotcha but it won't affect your balance h no Sor okay cool me shaking would gotcha I know I just want to make sure because I I didn't I didn't know what my nervous response okay no worries as you could tell you see so you're you're raising your left right raising your left okay okay all right you can get back into the start position give me a second to get an even number and I'll have you begin in a second you can begin yep four five keep your foot P to the ground Sorry Seven 9 10 1 2 3 four 5 6 S 8 9 10 is that okay just pick your foot back up keep going all you can stop now you can stop now okay all right all right I got one more test for you miss it's called a lack of convergence test it's another eye test um it's I'll just have you stand back on that on that street there okay so the start position test is your feet together just like so and your hands down by your sides um basically you're going to follow the tip of the pen again with your eyes and your eyes only this time it's going to go like this it's going to come around your face in a few times it's going to come into the bridgy nose just like this I want you to follow the tip of the pen with your eyes and your eyes only don't move your head you understand that okay if the pen happens to touch you it's a piece of plastic I promise you it will not hurt you okay I just want to let that's I just have to explain to you all right y okay cool hang TI one second all right uh Miss so listen I think you've probably had too much to drink to drive okay um based on your driving behavior and what I saw during the tests um I think you're impaired okay um that's my conclusion um so I'm going tol arrest for D okay does that mean that you're getting arrested for DWI like like arrested arrested yes arrested arrested okay so can you just turn around for me don't I have to blow first no I have to determine imp parent roadside and then you come to the headquarters and then you'll blow into machine and the Machine will then give me a output of your B at headquarters okay that's how New Jersey Works car well your car is getting towed okay um do you need anything out of your car yeah what do you need um my purse um I'm I still don't know where my phone is okay um what I'll do is I'll secure you first and I'll get whatever belongings you need from the car and I'll put them in the front seat and we'll bring it to headquarters with us okay what I'm sorry do you mind explaining like the actual process of this to me I just did no no I mean like afterwards like what what do you mean so I I get arrested and then what you're being brought to the headquarters yeah sorry I don't no it's okay you'll be you dis you'll be brought to headquarters there's an alatest machine okay yes the alatest machine you will blow into the alatest machine if you if you choose to provide samples you have the right to refuse but well you actually don't have the right to refuse but I'll I'll get to that inside but um there's a sheet I'm going to read you if you choose to refuse you can refuse if you blow you give me two SE two samples I'll let you know what your BAC is and then you call for a ride to come get you I don't have any numbers or all my phone I don't you don't you don't know any numbers off top of your head I know Ms but uh okay well you can call okay well no that's that's not happen well it's either you call her call a friend or or you wait in headquarters for 12 hours which I'm sure you don't want to do I just don't have anybody it's not your okay so just do me a favor can you turn away can I grab my purse first I will grab your belongings from your car okay everything we'll get we'll get what you need you need your purse right yeah okay I will grab your purse I'll put in the front seat of my car and it doesn't even have my phone in it so well I'll I'll take a look what I observe your driving behavior plus what I observe during the tests um I just I just don't think you're safe to drive okay I know you said it was an hour and a half ago but I don't know if you just had that I don't know if that's the only thing you had or not um do you take any medications based on her erratic driving her admission to consuming alcohol earlier that evening and her inability to satisfactorily complete the field sobriety exercises Dedra was placed under arrest a search of her vehicle incident to arrest revealed an open container of High Noon inside the vehicle after she was placed under arrest her vehicle was impounded for a 12-hour hold according to John's law patrolman gisi transported Dedra to the mammoth Beach Police Department for further processing um I'll ask you more about that inside um when when your dosage was but for now I just have to for now I have to put you in handcuffs okay okay all right so just turn around face away from me again I I do appreciate you being cooperative with me um no don't don't be sorry Miss l listen1 f can you contact the 17 or are these too tight at all they're not hurting right hold on one second I got to double Dedra she was released a sober pending her court appearance after they signed the potential Sherl warning on D's behalf patrolman go andisi issued D the following citations operating Under the Influence reckless driving careless driving speeding and traffic on Mark lanes open container failure to possess driver license and failure to possess driver insurance card just watch your step kit now it's a little bit of a all right we're just going up these steps just be careful going up the steps here sorry oh no worries that's okay all right just take a step inside go to the left you're going to sit right down on that bench there yep I'm going to take those handcuffs off um just cuz it's our policy I have to put one of your AR one of your hands in those cuffs there okay but I do appreciate being cooperative with me um I've had some very uncooperative people in the past so no no don't be sorry you're kind you [Applause] know all right is this is that one comfortable like that motor vehicle violations checked in the Box above um ajsa 39450 22 this warning is to advise you that if you accept responsibility transport or company the defendant and you permit or facilitate the operation or motor vehicle by the defendant while the defendant is intoxicated or has a blood alcohol concentration at or above that permitted by law njsa 39450 then you are potentially subject to criminal penalties and civil liability pering a person who is intoxicated has a blood alcohol concentration at or above that prented by law to operate motor vehicle is a violation of njac 39450 a if you are charged and convicted under that statute your driving pill will be will be suspended uh fines and monetary penalties will be imposed and you may be incarcerated if you permit facilitate the defendant to operate a motor vehicle while the defendant remains intoxicated or has a blood alcohol contition at or above that prented by law and the defendant becomes involved in motor vehicle collision where other person are injured or killed then you may be subject to indictment and criminal prosecution if you are prosecuted and found guilty the court can impose fines and mandatory penalties and a prison sentence in addition to any criminal liability if you permit or facilitate the defendant to operate a more vehicle while the defendant remains intoxicated or has a blood alcohol concentration at or above that pered by law and the defendant becomes involved in motor vehicle collision where there is property damage personal injury or death that you may be held liable for civil
