it's 02 yeah okay on August 27th 2021 at approximately to 37 a.m. Deputy Cory aler of the Whitman county sheriff's office observed a 2013 Honda Accord making improper turn in the vicinity of Monroe Street and Stadium way he proceeded to initiate a traffic stop and the vehicle pulled into the parking lot of the Willow Place Apartments the driver was identified as 19-year-old Ashley Hollinger hello hi stops being recorded do you have your license registration proof insurance registration all right um that's all I have do you have your driver's license it's right around the corner so like it's at home oh it's at home okay all right what's your last name Hollinger HL okay first name Ashley M name soup all right date of birth uh 9301 31 and through Washington state Washington State okay all right do you know why I'm stopping you today um I don't know no you don't know I was a little fast I will give you that all right yeah you you were huling a little bit all right so as you were making that right hand turn okay you rather than turning in the outside Lane which was closest to you you turn into the inside Lane which is furthest from you which is what I got marked down on so you okay I'll be out doing FST Ashley you want to hop out real quick Ashley was only able to provide Deputy alander with her registration but she was not in possession of her license or proof of insurance she also informed the deputy that her father was a police officer with the Port of Seattle Police Department M Deputy aler noticed that Ashley's eyes were bloodshot and watery and he detected the odor of alcohol coming from her breath he proceeded to ask Ashley how much she had been drinking and she admitted to consuming three white claws in the hours prior all right yeah just come back here all right hey how old are you I'm 19 and a half 19 yeah okay how much alcohol you have have tonight not a lot and I'm like really nervous I get very but um like not a lot at all not a lot not no okay so like how many how many beers or shots you like a beer and like maybe a couple like white claws couple white claws so how many white cloths two two one and a half okay when was your last one a couple hours ago couple hours so two hours ago I thought yeah maybe even 3: it was like early today at 10:00 at 10: not early at all okay so your last drink was at 10 or like around 10 yeah 10 okay all right here's what I'd like to do okay I do smell it coming from your breath still okay um would you like to do some voluntary field sobriety test um sure it's up to you I don't know what that means so it's voluntary is what I'm saying um sure okay so let's go over here where where it's a little bit more level okay do you have a jacket by chance I do not okay why just it's starting to rain a little bit I just don't want you getting cold all right so here's what I'm going to do I'm going to have you stand with your feet together arms down to your side like you're in the military I want you remain in that position I give you the instructions for this test do you understand yes all right so do you have any problems walking standing or turning no all right do you have any problems uh do you wear contacts or do you wear glasses all right is there anything that I should know about you just so I can understand you a little bit better uh no no you don't get like any quirks or anything like that I need be of okay sounds good all right so based on the indicators of impairment Deputy oaner told Ashley that she would be afforded an opportunity to perform voluntary field sobriety exercises the first exercise involved the horizontal gaze nystagmus hgn where Deputy alander observed the lack of smooth pursuit in both eyes the second exercise was the walk and turn test and Ashley did not walk Heel To Toe in a straight line as instructed the final exercise was the one leg stand test during the one leg stand test Ashley did not raise her foot in the proper fashion and did not in the manner that she was instructed to do so first thing okay so it's important for you to understand okay your ability to follow my instructions are just as important as the test themselves okay do not start any of the tests until I finished explaining demonstrating anding you begin the test do you understand yes all right so go ahead head and what I'm going to do for this first one look at the top of my pen and follow it with your eyes only do you understand yeah all right see the top of my pen yep all right TR sh [Music] okay and go up all right all right so for this next one okay like you do is imagine a straight line out in front of you okay I want you to place your left foot on that imaginary line with your right foot in front touching heel the toe just like I am okay go ahead and get in that starting position now this way yeah this one yeah Left withot Right Foot In Front there you go nope don't start the test all right so when I tell you begin you're going to look down your feet you're going take nine heel toe steps out while touching each step with your foot together Heel To Toe okay you're going to look down at your feet and you're going to count nine steps it's going to look like this one two three once again I did three you'll do nine once you reach the end of your nin step take Serious small steps around your lead foot and return the same fashion you can back one two 3 once again I did three you'll do nine okay it's important to keep in mind while doing this test look down your feet count your steps out loud keep your arms down to your side once you start the test do not stop until you finished do you understand yeah all right so nine steps forward n steps back Heel To Toe arm to my side count it out loud yes do you understand the directions yeah ready are you ready yes all right go ahead one two Miss to three four five six s step up one two three four five six s all right so for this next one okay stand with your feet together arms on your side like you're in the military what you're going to do is pick either leg you be choosing whatever foot you decide to pick you lift it approximately 6 in off the ground like so with your foot parallel to the ground and point it out it's going to look like this while looking down at your foot you're going to count it l by 1000s 1,001 1,002 1,003 1,4 and so on until I tell you stop okay important to keep in mind while doing this test okay down your feet count out allow by 1000s keep your arms down your side once you start the test do not stop until I say finished okay all right what foot will you be lifting up since it's an angle probably this one that one no probably this one I guess the right one all right wait a second it's like a low angle okay all right I'll do my all right sounds good all right you may begin I'll do left or right 1 1 2 1 3 1 pick your foot up 5 1 6 1 7 1 8 1 9 1 10 I'm working out too much 11 12 1 13 1 14 15 16 17 18 go ahead and stop 18 and 30 seconds okay following the field sobriety exercises Ashley was asked to voluntarily take a PBT test and the results indicated a back of 0.051% so I'm going to offer you another test okay it's completely voluntary not louid evidentiary breath test okay you said your last rink was at yeah okay all right you got to blow okay go go go go go go go go go go go go stop all right so you know what the legal limit in the state of of her PBT test for motorists under 21 Deputy alcander plac Ashley under arrest for driving Under the Influence Ashley was subsequently transported to the pulman police department nearby to be processed her passenger was transported along with Ashley and she was permitted to wait in the lobby so you're over the legal liit okay so go ahead and turn around put your hands behind your back okay and agreed to answer questions during the interview process Ashley admitted to driving the vehicle Under the Influence Deputy Alena read the implied consent warnings to Ashley and she completed the observation period she agreed to take a breathalizer test all right there's a restroom right here okay and then just wait right here we'll be come out once we're done okay okay wait for me on the BR chair all [Music] right all right so this is the bread test I'm going to be reading okay on the date my time and location of this arrest I had Authority to rest pursuant to my agency's jurisdiction RCW 1093 constitutional rights you have the right to remain silent you have the right at this time to an attorney anything you say can and will be used against you in a court of law if you are under the age of 18 anything you say can be used against you in a juvenile court prosecution for a juvenile offense can also be used against you in adult Court criminal prosecution if the Juvenile Court decides that You' be tried as an adult you have the right to talk to an attorney before answering any questions you have the right to have an attorney present during The Question you can afford an right to refuse this breath test and that if you refuse your driver's license permit or privilege the drive will be revoked or denied by the Department of Licensing for at least one year and your refusal to submit to this test may be used in a criminal trial your further advised that if you submit to the breath test and the test is administered your driver's license permit or privilege to drive will be suspended revoked or denied by the department license for at least 90 days if you are age 21 or over and test indicates an alcoh concentration your breath or 08 or more or you're in violation of RCW 46 6152 driving Under the Influence RCW 46 6154 physical control physical control of a vehicle Under the Influence or under the age of 21 and the test indicates an alcohol concentration of your breath as 02 or more or you're in violation of RCW 4661 502 driving Under the Influence RCW 46 6154 physical control of a vehicle Under the Influence if your driver's license permit or privilege to drive is suspended revoke or or denied you may be eligible to immediately apply for ignition ignition interlock driver's license you have the right to additional test administered by any qualified person of your own choosing for those not driving a commercial motor vehicle at the time of rest if your driver's license is suspended or revoked your commercial driver's license if any will be disqualified for those drive a commercial motor vehicle at the time of arrest if you either refuse this test or submit to this test and test indicates an alcoh alcohol concentration of 04 or more more you'll be disqualified by the department LIC from driving a commercial motor vehicle I have read the of statement to the subject sorry again all right it's asking for down stay positive you still got a lot of good things going in your life like college okay her Alco test results indicated a back of 0.039% which was nearly double the legal limit of 0.02% for motorists under the age of 21 after the breathalyzer test Ashley was released pending her first court appearance in the Whitman County District Court and her and her roommate were given a courtesy transport back to their residents she was cited under RCW 46.6 5003 for driving under the INF uence DUI under the age of 21 on October 28th 2021 Ashley pleaded guilty to an amended charge under 64. for four 272 minor in possession exhibiting effects of liquor she was sentenced to 3 hours of community service and ordered to pay a fine of $500 a $300 probation fee and a $43 criminal conviction fee all right how far up is it all the way okay through the stops sign okay yeah there's oh okay
