started do you want to help me well you're stuck yeah did you want to help me what happened well I can't on February 18th 2023 approximately 7:35 p.m. Deputy Randy Miller with the Whitman county sheriff's office observed a vehicle 2008 Dodge Caliber that had driven onto the train tracks near the kfax gra fuel pumps he watched the vehicle for about 3 minutes and did not see anyone attempting to exit but he later observed a female run to the car from the area of in Morton Street and Tyler Street after she got into the car seat Deputy Miller could see what appeared to be exhaust coming from the vehicle as if the driver was attempting to leave get it started sir well it is started it's running you need to shut it off there you go yeah no you can try and start it and try and get it going okay great where are you coming from me Oro okay where you headed to h no I'm here do you know where you're at right now let's start there where you at uh no I'm here in my place where I should be where do you know help me understand cuz I don't think you understand where you're at right now do you know what town you're in yeah what town Deputy Miller drove near the vehicle but did not activate his emergency lights before approaching it he made contact with a female in the driver's seat who was identified as Shannon the front of the vehicle was centered on the railroad tracks and the passenger front tire was over over the rail Shannon told Deputy Miller that she was coming from Idaho and that she was headed to yakal Washington when she was asked where she was she claimed that she was in Clear Water V though she was in cfax yeah I'm in clearw no you're not you're in Washington state right now you're in you're in kfax Washington right now cax was so good so I'm just trying to figure out how you ended up in here cuz there's a whole bunch of Co out here that prevent you from driving up here yeah no I was just trying to get it started well you're all crashed you've wrecked the front of your car have you seen this what been happening have you seen all this yeah of course oh my gosh yeah it's really wrecked like you drove up over the railroad tracks how much you had to drink tonight oh not much not much yeah I know this is like this is fine I'm just like so worried that I have cops in front of me well I'm just trying to figure out how I can help you that's cuz I'm my issue this to stuff I know but so I left the office and I came and went to the bank and I saw this car over here with its lights on so I watched it for a minute and she ran from in that direction General vicinity I just saw her mid Street Run to the vehicle and then started again which is why I came over to contact her so okay I I get where you're going with DIY my problem is is you're looking for tracks I she was never on the roadway I never saw her drive so I have no DUI I have physical control but to be fair physical control is going to fail because the vehicle's stuck yeah so I don't think you're going to get to DUI here I mean her tracks are right here she can't oh right here well she backed over that she drove over that I bet you that's what hooked her front bumper pull it out back up here so she hit this so she's here here's her front end damage right there there's all of her front end damage right there so that's her entire front got tracks down got track go this way as well I've got tracks that go up here did she go around the back side well I know I've got tracks right here that go all the way around two she tried to drive right there and [Applause] stopped step yakal she came up Empire disposal came all the way up the bank hit the tracks come down along the tracks here tried to go out there she backs up she tries to go down right here she can't so then she flips a U-turn the front right here well no no that's on my way in we come in we hit that we back up we try to go down that one from there we can't go out that way we won't fit so we back up spin a donut we do the doughnut all the way up onto here uh you my life no no I'm trying to figure out how you got up here remember how I said all these bars are here all these fence posts yeah so I was trying to figure out how you got up here oh I'm sorry yeah cuz you shouldn't be up here yeah that's what I was trying to figure out so that's what I was telling him I just walked all along the railroad down here and it looks like you came from Empire from the big white garbage trucks back there oh gosh you I didn't come that yeah she saying she came from more two hours ago Yak had she started drinking 3 hours ago okay how much have you had to drink as he was speaking with Shannon he detected the odor of alcohol and observed other indicators of impairment he was initially confused how her vehicle got on the train tracks because of the fencing around the tracks so he looked at the tire marks to retray her steps kofax police officer Joseph McCollum also spoke with Shannon as Deputy mil tried retracing her steps Shannon was then asked to perform field sobriety exercises and she agreed to do so had guess three drinks about three drinks like straight liquor or mix no it was like uh sorry beer with yeah beer with liquor okay all right hasn't stopped anymore except the off right here right here where you got stuck yeah do you have your ID yeah and I just really don't want to be like an [ __ ] to you guys you're not being you're not being rude at all you're being awesome I appreciate it I just want to be a really good person you are you're being kind I appreciate that any weapons in the vehicle no oh absolutely not all right sorry this is a uh VAP oh you're good okay you do you you guys leave uh you I smoke cigars I be her I'll go back work on I'm going to call Keith I know you have 544 in her outfit [Music] [Music] hey so she's parked up behind the RVs on Tyler Martin Street here stuck on the railroad tracks I didn't see her drive I just see the car stuck up there and she comes running across the street and goes up and gets in it and so I walk over here to I drive over here to contact her and the wheels are spinning she's trying to get unstuck uh obvious impairment for my opinion but well that's my question I I don't know when she drove there's an obvious Collision that occurred uh she hit the emergency stop and the concrete barricade best I can tell from the track she came from Empire disposal all the way up around here yes but she is completely stuck on cacks okay okay like Jo be because Joey showed up and instantly went there even though it's my contact so that's why I'm calling you to make sure I Meet The Elements because she doesn't have access to the roadway where she's at it's all fenced in it's all posts that she can't get out from she has to go clear around the backside of this private property to come out over Empire disposal which to be fair I think that's the site that she came in I see you okay where is she at she's in the car what is he doing he's iding her for me so she's stuck on the road it's not his call huh it's not his call to give away all Came Upon it so I'm I'm going to take it I'm just trying to all the way around the back she comes down she hits right here there's right side left side call dude she's got obvious damage to the front of the car and plastic all broken right here she backs up she tries to go out by the sign right there doesn't fit so then does a you she turns and she when she makes this turn she gets stuck on the tracks as I'm walking up the tire the vehicle's running she's in the driver's seat door closed wheels are spinning yeah go yeah I as I just want to make sure I got my elements I asked how she got all right Shannon okay what's going on okay so here's where I'm at okay I think you you you've admitted to having some consumed some alcohol right yeah I've had a couple drinks how long ago was was that probably about 3 hours ago okay all right would you be exercise was the horizontal gaze nice stagos hgn test during the hgn test Shannon kept turning her head and failed to follow instructions so the test could not be completed around this time he observed blood coming from her right pinky finger so he retrieved his first aid kit and gave her a gauze pad to clean the blood the next exercise was to walk and turn test during the walk and turn test Shannon did not touch Heel To Toe on each step and took an incorrect number of steps do you have another jacket in there yeah I do but let's just do this okay all right we're going to come stand over here where there's good light okay okay we're going to stop right here okay I want to stop right here I want to turn and face this direction okay so I want you to stand right here perfect okay so these are all voluntary okay you can stop them at any time no I understand I want you to put your feet together and I want you to put your hands at your side just like I am right now okay do you have any medical conditions I should be aware of just depression just depression do you take medication for depression okay what do you take okay and when was the last dose that you took uh adm. okay did thing it is you think you can stand there yep okay I want you to stay like that while I explain and demonstrate this okay I want you to take nine Heel To Toe steps out in front of you okay show me it's going to look like this 1 2 3 and so on until you get to nine you're going to take a series of small steps around your foot and take nine Heel To Toe steps back one two 3 and so on until you get to nine okay can you go back to that starting position I had you in yeah right here put your left on the line yep right foot in front and stand sorry can you stand in that starting position during this one I want you to look down at your toes count each step out loud you ready yeah once you look down at your toes count each step out loud keep your hands at your side okay once you begin the test don't stop until you're completed sorry I'm just going to raise is up gosh aren't you cold a little bit this is horrible do you think you can do this one yep okay you may begin when you're ready ready can I look at you you got to walk that line look at your toes down look at you is that okay I want you to do as I instructed yes sir can you do that yep am I amazing or what for safety reasons Deputy Miller terminated the field sobriety exercises and placed Shannon under arrest since her finger was bleeding again he called for M to arrive on scene and take care of the bleeding I after M addressed her wound Shannon was transported to the Whitman county jail for further processing all right here's the deal right now put your hands behind your back you're going to be under arrest for Di okay you're you you show obvious signs of impairment and you're struggling to do my test and I don't want to hurt you while attempting to do these okay be a bother you're not being a bother stop to Paul 161 a custy DUI also you good yep okay can you send me Ems for cuts and abrasions on hands okay so right now Shannon first name Shannon right yes okay right now you're under arrest for DUI you have the right to remain silent anything you say can be used against you in the court of law you have the right to the present of an attorney during questioning and if you cannot afford an attorney one will be appointed for you prior to questioning if you so desire you can decide at any time to exercise these rights not make any statements or answer any questions do you understand these rights yeah you in the court of law yeah if you under the age of 18 anything you say can be used against you in a juvenile court prosecution for a juvenile offense and can also be used against you in an adult Court criminal prosecution if the Juvenile Court decides that you're to be tried as an adult you have the right to talk to an attorney before answering any questions you have the right to have an attorney present during the question if you cannot afford an attorney one will be appointed for you without cost if you so desire about to freak out if you don't just keep going you can exercise these evidence of a crime to wit driving Under the Influence RCW 46 6152 to any peace officer in the state of Washington whereas upon the sworn complaint here to4 made and filed and or the testimonial evidence given in the above entitled court and Incorporated herein by this reference it appears to the undersigned judge of the above entitled court that there is probable cause to believe that evidence of intoxicating liquor marijuana and any drug as defined by RCW 4661 54 in violation of the laws of the state of Washington evidence of the crimes of driving while Under the Influence RCW toxicology laboratory to determine whether any intoxicating liquor marijuana or any drug as defined in RCW 46 61540 can be detected and or Quantified a copy of said warrant shall be served upon the person from whom the blood is to be extracted and upon the person who extracted the sample of blood together with a receipt for the blood that was extracted given my under my hand this 18th day of February 2023 John eh Hart uh signed February 18th 2023 at 10:14 p.m. okay I know I know how much Deputy Miller applied for a search warrant to compel Shannon to submit to a blood draw and Whitman County District Court Judge John Hart granted the warrant at approximately 10:20 p.m. the warrant was read to Shannon and Jim Thompson with volunteer fireman Inc came on scene and attempted to draw blood from her Deputy Miller then transported Shannon to the Whitman community hospital for a blood raw but they were still unable to obtain blood after five attempts while being transported to the hospital Shannon told Deputy Miller that she had been kicked out from a friend's house after drinking there and then she decided to drive even though she probably should not have done so e e e e e e e through Department of Licensing uh you can request a if they are going to suspend your license they'll send you a piece of paper to the address on file on your driver's license this is the form of how
