worn camera is on okay yeah all right the reason I'm stopping you we got a traffic complaint about your driving and uh when you turned off of this road you made a really wide turn and we're swerving you guys are making it awfully complicated to be out and about in Highland that's that's all it is I'm not anything to drink today me I had a couple but okay like I've I've been here for a bit any medication no where are you coming from around 3:55 p.m. on August 16 2023 patrolman Troy hards grve with the highlands Police Department was working in off duty assignment in the vicinity of Bay Avenue and Jackson Street patrolman Antonio FL was off duty but he radioed into dispatch that he saw a black pickup truck driving erratically on Highway 36 southbound patrolman hards grve located a vehicle matching this description on Bay Avenue as the driver was turning onto K Street the driver subsequently made a wide left turn onto Center Street patrolman Harts Grove initiated a traffic stop in the area of Center Street in Jackson Street and made contact with the driver who is identified as Jamie okay where you heading trying get the trying to get the Washington where you coming from um from off the deck off the hook or on the deck there's two okay you have your insurance and registration how much would you say you had to drink tonight today you all right yeah you have your hand on okay what did you have to drink today I'm not I I promise you I used to be under for investigator my brother's a cop I'm not trying to do anything bad I just want to get home you have a registration Insurance how long have you lived down here for not that long I'm from Pennsyvania it's just like you guys trim me up with everything you're doing on bab it's really like the traffic complaint came from the highway hang on to that this the insurance or the registration registration you have the insurance I promise you like I'm such asleep to dark I don't do anything wrong this is the insurance I may be driving like [ __ ] I'm just like it's just it's really been awful with you guys working on B ass I know but if the alcohol is affecting your driving that's a different story hang on to your insurance turn your vehicle off and I'll be right with you okay as he was speaking with Jamie patrolman hars goov detected the odor of alcohol and observed other indicators of impairment patroling Flores and cio2 Michael Richards arrived on scene to assist shortly afterwards jimy told patrolman harsgrove that she was headed home and admitted to consuming alcohol before driving she also told him that her brother was a cop based on his suspicion of impairment patrolman harsgrove asked Jaimie to exit the vehicle and perform field sobriety exercises please tell me yeah I was waiting for have have him have an experience um odor alcohol said she had a few at off the deck then couldn't tell me which one it was um I called her you did but then when I started asking her how many or what she had to drink she was like almost ready to break down and cry so I'll have her come out have you ever done field spiy test before okay think we're going to have him we have him we run us through I think he should watch a few times where she from she coming around from here she on the other side of town said she hasn't lived there that long I forget what her name is what's that yeah did they did they call me I thought I heard something on the radio I it sounded very muffled crap it's Jamie correct yes can you just step out for me and I have you come to the back of the vehicle and we're going to go through some tests to make sure you're okay to drive step back here with these officers do me a favor just stand on the uh the sidewalk with him oh got you I'm like two seconds to home Jamie can for what you're doing I know you're doing what you should you have any problems with your eyes okay the first exercise was the horizontal gaze nagus hgm test and patrolman Hearts grve observed a lack of smooth pursuit in both eyes however he ended the hgm test early because Jamie failed to follow his instructions the second exercise was the walk and turn test during the walk and turn test Jamie failed to touch Heel To Toe on each step and turned improperly the final exercise was the one-leg stand test and Jamie failed to raise her foot in the proper fashion and put her foot down multiple times so and you keep your head still and you're going to follow the tip of my pen with your eyes and your eyes only do you understand that yes yes you understand okay I need you to look at the pen I'm looking at theen you keep looking at me I am okay pay attention to the tip of the pen keep your head still and you're going to follow with your eyes and your eyes only you understand that correct have any problems with your legs feet ankles knees back no okay so the next test I'm going have you do is a walk and turn so I'm going to put you in the starting position then I'm going to ask you to stay in that position using this yellow line can you put your right foot on the line and then your left foot in front of your right foot heel the toe like this all right your heel and toe touching can you do that and you're going to keep your hands at your side I need you to stay in that position until I finish explaining the test okay when I tell you to begin you're going to take a series of nine steps Heel To Toe out in front of you you're going to count each step aloud when you get to your ninth step you're going to turn in a semicircle and go back nine steps I'm going to demonstrate it to you so you're in the starting position your left foot is in front of your right foot can you get back into the starting position please you're going to take nine Heel To Toe steps one two three all the way up to nine you'll leave your lead foot planted turn in a semicircle go back nine steps Heel To Toe counting each step allow one two 3 all the way to 9 do you have any question any questions you can begin whenever you're ready 85142 count okay 85131 count to okay the next test is going to be a oneel leg stand test still going to put you in the starting position again you're going to stand with your feet together and your hands at your side can you get that position when I tell you to begin you're going to lift either foot of your choice approximately 6 in off the ground keeping your leg straight your toe is your foot is going to be parallel with the ground and you're going to be looking down at your toe so you're going to count allow by 1,000 but by 1,000 it's going to look like this 1,001 1,2 1,3 1004 and so on until I tell you to stop if you put your foot down just pick it up and continue where you left off 1005 1006 1007 until I tell you to to stop you understand okay just get in the starting position and then you can begin whenever you're ready stop real quick so just like I showed you you're going to keep your leg that you're picking up straight and you're going to keep your foot parallel to the ground don't look like this you're going like this it's got to be down like that okay M so if you could do that again whenever you're ready okay you can stop based on her erratic driving the odor of alcohol her admission to consuming alcohol before driving and her inability to adequately complete the field sobriety exercises patrolman hars grve placed Jamie under arrest for driving under the influence her vehicle was impounded for a mandatory 12-hour hold under John's law she was transported to the highlands Police Department for further processing I need to put your hands behind your back face away from me before doing that can you take your fanny pack off please you send a 17 to Center and Jack is it a snap you can un snap it in hand it and if you want to bring that with you you can3 101 and for Center Jackson 16 let me see your hands behind your back other hand you have anything on you do you have pockets just take her you need anything out of your car feel this like a you were drunk driving so that's what you're being placed under arrest for I know but so we're going to take you back to the station and go through the procedures there what's up all right it says you've been arrested for driving while in topc New Jersey statute 39 4- the law requires you to submit samples of your breath for the purpose of testing to determine alcohol content a record of the taking of breath samples including test results will be made upon your request a copy of that record will be made available to you after you have provided samples of your breath for testing you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath blood or urine for urine for independent testing if you refuse to provide samples of your breath you will be issued a separate summon for the refusal a court may find you guilty of both refus refusal and driving while intoxicated if a court finds you guilty of the refusal you will be subject to various penalties including license revocation for up to 20 years a fine of up to $2,000 installation of an ignition interlock device and referral to operating Under the Influence reckless driving and failure to maintain Lane there's no machine everything's to go so you can either just leave the area like say over here how with this stuff rather than uh otherwise you got to take your body cam phone Smartwatch and radio off all right
