When >> when did you have a DUI? >> When I was 21. >> Okay. >> About to turn 27. 21. >> I was going through a period. >> Okay. >> I have mental pain. >> Okay. >> I have diagnosed anxiety. >> Mhm. >> Which explains my shaking. >> Look at you. >> Yes, sir. >> I understand that. But I also don't think you're being very truthful with me about how much you've had to drink. I'm being very truthful. >> Okay. >> Around 1:30 a.m. on December 3rd, 2023, officer Noah Cavam with the Athens Clark County Police observed a 2018 Ford Fiesta and another vehicle run through a stop sign in the vicinity of Wro Street and Old EPS Bridge Road. The vehicle later ran a red light at another intersection as the [clears throat] driver continued to follow the other vehicle in front. The officer initially thought it may be a road rage incident, but he later learned that the driver [clears throat] was following the vehicle in front. The driver, later identified as 26-year-old Anna, pulled into a parking lot and officer Cavam made contact with her. I'm going to be real with you real quick. That was some of the shittiest driving I've seen in a while. You ran that stop sign. You failed to maintain your lane. I don't know what you're doing with that car in front of you. And then you blatantly go right through a red light. How How much How much have you had to drink tonight? >> Just be real with me. How much? >> Two. >> Two. >> Three. >> Three. Three. What? >> 9:00. >> Since 9:00. Okay. What'd you drink at 9:00? >> Traa. >> I don't know. I can't pronounce it. >> Tropa. Is it Oh, or is it beer? >> No. Selzer. >> Selzer. Okay. No. Rum. Anything hard like that? Okay. Gotcha. Got your ID on you. All right. Um, so now for a second though, I thought you were about to get a road rage accident with them. That's it. Did >> I'm sorry. I was That's my roommate. I was following her. >> Okay. Makes a little Makes a little bit more sense. >> That's my roommate. I was I was trying to follow him. >> And I'm not trying to sound angry. I'm not. We've just been having a lot of issues between people like fighting and then getting in cars and then they drive crazy after each other. Um >> Oh dear. No, I was just trying to make sure he was safe. >> I get you get your ID real quick. Of >> course. >> Okay. Um >> Yeah. No, that's my roommate. I was just where I'm just trying to make sure he was safe. >> I get you. All right. So, um I see all I want to do is since you said that you've had some drinks, I'd like to do some field sobriety test cuz after seeing your driving, I want to make sure that you actually are safe to drive. All right. All right. So, if you could just step out for me. 10 for 27. Ready? Officer Cavam told Anna that he observed multiple traffic violations. As he was speaking with her, he detected the odor of alcohol. Anna admitted to consuming three drinks earlier that evening. Based on his suspicion of impairment, Officer Kavam asked Anna to exit the vehicle and perform field sobriety exercises in the parking lot. >> Give me just one sec. We need to step over here where it's a little bit more flatter ground. Clear log signal one checked. Okay. Um, so so you had three selters around 9:00. >> One per hour. Yes, sir. >> One per hour. Um, did you >> I drink water? >> And you drink water? Okay. I can take all that into consideration. Uh, these tests I'm going to run you through. You're okay doing them? >> Yes, sir. >> Okay. So, they're scientifically proven to be pretty accurate. Um, you can look up the actual statistics behind that. It's not the uh say your ABC's backwards or none of that. It's all done through the National Highway, uh, traffic safety standards. Oh, not me this time. So, um, all very accurate tests. Um, we're going to conduct four of them. We're going to start the eyes and we'll do a walking turn and one leg stand. Is that all going to be fine with you? Okay. Um, next question. Did you have anything to eat in between your drinks or while you're drinking? Okay. What did you eat? >> A burger. >> A burger. What time did you eat your burger at? >> Chicken burger around 9:00. >> Okay, I got you. Do you wear contacts, glasses, or anything? >> I wear contacts. >> Contacts. Do you have your contacts in? Okay. They shouldn't affect your test, but I'll take that in consideration at all. You have any injuries, head injuries lately. Any leg injuries, back injuries, anything that will uh keep you from performing these tests? >> Okay, I got you. So, first I'm going to check your eyes. Uh what I want you to do is we got a nice line right here. Um very flat ground. Would you agree? Officer Cavam started with the horizontal gaze nestagmas HGN test and he observed the lack of smooth pursuit and distinct and sustained nestagmas at maximum deviation. He also observed a lack of convergence. The second exercise was the walk and turn test. During the walk and turn test, Anna did not touch heel to toe on each step and turned improperly. The third exercise was the one leg stand test and Anna failed to raise her foot in the proper fashion while using her arms for balance. Officer Kavam repeated the HGN test once again before determining that she was not safe to drive. >> Okay. So, what I want you to do is treat together, hands down your side. All right. So, what I'm going to do just check your eyes. What I want you to do is follow the tip of my fin right here with your eyes. Your eyes only without moving your head. Do you understand these instructions? Yes, sir. Okay. >> Okay. And during this you can relax. You can blink your eyes. >> I do have a stigmatism. >> You get You do? >> Yes, sir. >> Okay. Um, if you don't mind me asking, what what causes it? >> Genetics. >> Genetics. Okay. This eye has a stigmatism >> stigmatism. Okay. So, there's a bunch of different types of nestagmus. Um there's like 70 or 80. Uh what we look for is a certain one horizontal and vertical nestagmus. Um those ones are what are to be proven to be what happens when you're under like depressants um and some other types of drugs and stuff. So, that shouldn't affect it. Like I said, I will take that into consideration. You said that's your left eye. >> Yes. >> Okay. Gotcha. So once again um just step tip of my pen with your eyes your eyes only without moving your head. Do you understand? >> Yes sir. Keep your head still. Heat. Heat. Heat. Heat. Heat. Heat. Heat. Heat. Okay. So, for this one, I'm going just go down and then up. Once again, with your eyes, your eyes only without moving your head. Just follow the tip of my pen. Do you understand? That's it. >> Okay. Feet together, hands out your side. Feet together. Yep. Just like that. Once more. Okay. So, for this one, uh, just stay just like that. I'm going to make two circles. Once again, follow the tip of my pen with your eyes only without moving your head. I'm going to do two circles. I'm going to come in towards the bridge of your nose. I'm not going to touch your nose. It's okay to cross your eyes. Just keep focusing at the tip of the fence. You're fine. Okay. Okay. Um All right. So, we'll move on to the next one. I like that one more. That looks a little bit flatter than what we're on. Would you agree? This is pretty flat, but that's very flat. >> Yeah. >> Or is right here fine with you? >> Honestly, that looks more sloped than this does. >> Does it to you? Okay, that's fine. So, I want you to just come down to this end right here. So, for this exercise, it's lucky that we do have these lines cuz they can represent an actual straight line for us. to usually have someone imagine a straight line. So, this works very good for us. Once again, you don't have any leg issues, balance issues, or anything of the sort. Yes, sir. >> Okay. So, what I want you to do is place your left foot on that line. Taking your right foot, place that heel toe in front of your left foot. Just like that. I'm going to move out so I can demonstrate for you. All right. Put your hands out your side and stay in this position until I tell you to begin. And do not start until I tell you to begin. Do you understand? Yes, sir. >> Okay. You're going to take nine heel to toe steps counting your steps out loud. I'm going to demonstrate. One, two, three. On your ninth step, keeping your lead foot planted, you'll take a series of small steps around your lead foot. They're going to look like this. You're going to take nine heel to toe steps back, counting them out loud. One, two, three. So, until nine. I did three for the demonstration. You're going to do nine. While doing this test, you're going to keep your hands down at your side. You're going to count your steps out loud. You're going to be looking at your feet while you're doing this. >> Yes, sir. >> On your ninth step, once again, you're gonna take a series of small steps. Take nine heel toe steps back. Once you start the exercise, do not stop until you complete it. >> Okay? >> Do you understand all these instructions I told you? >> Okay. Whenever you are ready, you can go ahead and begin. 1 2 3 4 5 6 7 8 9 1 2 3 1 2 3 4 5 6 7 8 9 >> Okay, >> I do the two steps. >> You what? >> The two missteps. Yes. >> Okay. All right. So, we're going to do one more exercise. >> Okay. >> Um, this one you're going to choose whichever foot is best for you. All right. So, what I want you to do, keep your hands down at your side, feet together. You're going to choose whichever foot you choose. You're going to raise it approximately 6 in off the ground. It's about the width of a dollar bill. You're going to bring that foot up. Keep your toe pointed forward. And you're going to stare at the tip of your toe. Count your steps. Wait for that car to pass so I can actually tell you the instructions. All right. Once again, you raise that foot approximately 6 in off the ground, keeping your leg straight, toe pointed forward. You're going to the tip of your toe, and you're going to count out 1,00 1, 1,002, 1,003 until I tell you to stop. Do you understand these instructions? Yes, sir. >> Okay. Give me just one second. All right. Ready to begin? >> Yes, sir. >> All right. You can begin when you're ready. 2001 20002. >> Up a little bit higher. 2003 2004 2005 2006 2007 2008 2009 2010 2011 2014 2014 135 2016 >> Go ahead. Stop and put the foot down. >> Okay. I I want you to be real with me. You've had a little bit more than three, right? >> Right. >> You've had a little bit more than three drinks. >> No, sir. >> You've not? >> No. >> Okay. So, there be any reason I would have seen anything different during your test? >> Anxiety. >> Anxiety. Okay. >> What What are you anxious about? I have diagnosis. >> Okay, I get you. Okay. Um, I'm going be real with you for what I saw in your test. I don't think you just had three. I think you had a little bit more than that. And if it was just three, you had it a lot more recent than what you're telling me. >> No, sir. >> Okay. because I'm seeing clues that indicate that you've had a little bit more than what you're telling me. Yes, sir. >> You have not. Yes, sir. >> Okay. So, go tell me one more what you had the tree tropa. I don't know the name of them. It's tropa. It's Trop I don't And I did this when I ordered them, too. I don't know the name of it. It's a selzer. It's a hard selzer. And I had three of them. >> Mhm. You had three of them? >> Yes. >> Okay. And you had them at 9:00. All >> 9 to 11. I was at the Georgia theater from 9 to 9 to 11. I had three drinks. >> I know one of the security guards there. I had one drink per hour. I drank water. >> I'm very anxious. >> I get you. So, from 11 to now, what were you doing >> at the Georgia theater? >> Okay. What would you What time would you estimate it's at right now? >> 12:45 1. >> Okay. Um, so if you left the theater at 11:00 and if say it's 2:00 now, what were what were you doing for that 3 hours? >> Walking around downtown Athens. >> Walking around downtown Athens. You weren't drinking downtown Athens. >> Just walking around. >> Okay, I get you. >> They have that nachos stand there. One of my friends got nachos. >> Okay, I get you. Um Okay. So, if you don't mind, so I I'd like to check your eyes just one more time. >> Okay. >> Um and that can help me make my decision of where we go going forward. Um so, I'm going to stand over here and just face me. All right. >> All right. Feet together, hands down your side. If I can ever get my pen out. Okay. So, once again, follow the tip of my pen with your eyes. Your eyes only without moving your head. Do you understand? >> Yes, sir. Heat. Heat. Heat. Heat. Okay, once more we're going to go down in up. All right. Yes, sir. Okay. Have you ever had a DUI before? >> Anna was offered the opportunity to submit to a portable breath test, but she refused. Officer Cavam asked her whether she had been arrested for DUI before, and Anna admitted that she had previously gotten a DUI when she was 21. >> When When [clears throat] did you have a DUI? >> When I was 21. >> Okay. >> I'm about to turn 25. >> 21. >> I was going through a period. >> Okay. >> I have mentality. >> Okay. I have diagnosed anxiety. >> Mhm. >> Which explains my shaking. >> I get you. >> Yes, sir. >> I understand that. But I also don't think you're being very truthful with me about how much you've had to drink. >> I'm being very truthful. >> Okay. >> I don't know how to say them. It's toco tropical. >> That that's that's fine. I I believe it's a self and stuff. Um I have a portable breath test. It's sometimes it's hit or miss, but it works. It's not something that's not admissible in court anyways. It just confirms a suspicion or not. Mine for some reason sometimes just doesn't want to work at all. So, uh if you l I can try that. Um and then I'll make a decision going forward. All right. Cuz I I do believe >> is that based is your decision. >> No, it has not. My decision has nothing. is based not off that, especially with how wonky mine is. Um, to be honest, it it's not that it over reads or anything. It just sometimes like it doesn't read at all. >> Officer, what's your name? >> Officerwamiwami. Nice to meet you. >> Nice to meet you, too. Um, so I mean, I've already made a decision, but I would like to give you a a portable breath test. Are you willing to do that? >> Is that your decision that you need that? I would like to use it, but it's has nothing to do with the decision going forward from here. >> Okay. Well, I would like to decline respectfully. >> Okay, that's fine. >> Based on her erratic driving, the odor of alcohol, her admission to consuming alcohol, and her inability to adequately perform the field sobriety exercises. Anna was placed under arrest for DUI. >> That is completely fine. Uh, right now, I do need you to turn around and put your hands behind your back. All right. You are being placed under arrest for DUI. >> That good right there? >> No, sir. May the right one be loosed a little bit or No, >> it's pretty loose. I can fit two fingers in that. Sometimes just the positioning of it, how your wrists are. All right. I'mma double lock them. All right. >> Okay. >> 6 central. We just head over to my car right here. 1095. All right. You can just stay right here for me. Um, do you need have anything on you? drugs, weapons, or anything like that? Nothing. >> No sir. >> Okay. Um, give me one second. See if I do have a female on shift. You can come over here and search you for my car. 6 485. >> Can you be in route to pat a female down, please? >> Dispatch has been updated. >> Okay. I got a female in route who's going to search you. Uh before we go, um is there anything in your car that you'd like to bring with you? >> My cell phone. >> Yeah, I can get that. Where's that at? >> If it's not in my pockets, my purse. >> Okay, I got you. So, I'm going to do you a huge solid. Uh I'm not going to tow your car. Um it's on private property, so I think we can just leave that where it's at. Um and you can come pick it up whenever you get out. >> I appreciate that. Other than that, is there anything in there that needs to be secured or my >> I just need my cell phone and my wallet. >> Okay. Cell phone. >> Valuables or guns or anything in the car? >> No, sir. >> Okay. >> Do you mind if he just goes and grabs that real quick while I read you something? >> I'll get your phone. It's in the car. >> Probably. >> Okay. Um, so if you had if you had a DUI here in Georgia, you probably heard this before. Um, I'm going to read you your implied consent. All right. Yes, sir. The state of Georgia has conditioned your privilege to drive upon the highways of this state upon your submission to state administered chemical tests of your blood, breath, urine, or other bodily substances for the purposes of determining if you are under the influence of alcohol or drugs. If you refuse this testing, your Georgia driver's license or privilege to drive on the highways of this state will be suspended for a minimum period of one year. Your refusal to submit to blood or urine testing may be offered into evidence against you at trial. If you submit to testing and the result indicates an alcohol concentration of 0.08 grams or more, your Georgia driver's license or privilege to drive on the highways of this state may be suspended for a minimum period of one year. After first submitting to the requested state test, you are entitled to additional chemical test of your blood, breath, urine, or other bodily substances at your own expense and from qualified personnel of your own choosing. Will you submit to the state administered chemical test of your blood? No. Okay, I got you. So, real quick, I'm going to read this one more time. All right. Yes, sir. >> The state of Georgia has conditioned your privilege to drive upon the highways of the state upon your submission to state administered chemical tests of your blood, breath, urine, or other bodily substances for the purposes of determining if you're under the influence of alcohol or drugs. Will you submit to the state administered chemical test of your breath? >> No. >> Okay, that's all right. >> Thank you. >> Yeah. Got just one more thing to read to you. All right. And she should be here any moment and then we can just get to get on the road. That's fine. You have the right to remain silent. Anything you say can or will be used against you in a court of law. You have the right to talk to a lawyer. You cannot afford to hire a lawyer. One will be appointed to represent you before any questioning if you wish. Even if you don't want a lawyer now and agree to talk with us, you can at any time change your mind and ask for a lawyer or stop talking with us. Do you understand each of these rights I've explained to you? >> Yes. >> Having these rights in mind, do you wish to talk with us now? Okay, that's all right, too. Um, you one second. My other unit got tied up with something. So, I'm just going to have you sit in the car. Um, so it it is a policy with here out of the car county that a male can search you. However, since I have a female on shift, I want to afford you that opportunity. Um, so I'm just going to have you sit in my car. Um, you don't have any weapons on you, though. No, sir. >> I'm trusting you. >> Can I trust you? >> Yes, sir. >> All right. All right. You can just take a seat. All right. your feet in. >> Yes, sir. >> Hey, look, at the end of the day, you know, I'm a person, too. Like I'm not one of those cops say, you know, always get pictures on TV who looks like a robot and stuff. You know, I'm not going to ask you anything else pertaining to the case, but I mean, feel free to have a conversation even though I mean I'm the one taking you to jail. Like I'm pretty chill. I didn't buy like I'm telling you the truth. I had those three tall boys. I got you. >> When am I able to call somebody? >> Uh when we get to the jail. Uh we can. Um you know, you've been very respectful and very chill with me. So, I'll tell you what. Um, is you get you a phone call to jail, but I'll let you call someone before we leave. Is that fine? Okay, I got you. Do you have someone who can come pick up your car so it it doesn't sit here till Well, I guess tomorrow's Sunday. I don't know if this place will be open or not. >> My car my car keys are in my pocket. >> Okay. >> What is the remedy for that? Um, do you have someone who can come pick it up right now? >> Not with a spare key. I have the only key in my pocket right now to the car. >> So, if I let you out >> and you can leave it on the tire. >> I don't want to I don't want to do that. Well, if I let you out to call someone cuz we got to wait for that female anyways. Um, >> call my roommate who I was following home. >> Do you think they'd be able to come back and get it? >> I I hope so. >> Okay, we can do that. Ow. Dang, that hurt. No, you're fine. >> Need help out? >> I'm not sure yet to be honest with you. >> Right. Are you going to be chilled with me if I take you out of a cuff? >> Of course >> you will. >> Yes, sir. >> Okay. Thank you. >> Yeah. Hey. Hey. Can you call my mom to come get me? Yeah. Perfect. Wonderful. That would be wonderful if you could do that. I'll leave. Okay. Thanks. Oh, appreciate it. Thanks. I guess. All right. You can't do [ __ ] No. over 25, right? Is it Clark County over 25 to bail out? >> What do you mean? Like age- wise? >> Yes, sir. >> I mean, I don't work at the jail. I can't tell you, but generally, I mean, you're 18, you should be able to get a bond and pay it. I don't know. >> Tonight, >> timeline I'm looking at, man. >> So, that really all depends because you've had a DUI. >> Yeah. Um, >> yep. >> However, don't quote me on it. They'll have a little bit more information at the jail. Yep. >> It might be within like a certain amount of time, like five years. Um, you have to sit till you see a judge. It might be different. So, when we get to the jail, we can talk to them to see if you were able to get a bond tonight. Um, cuz he said it was you were 21, you had your last DUI, you're 27 now, so that' be 6 years. Um, if that, like I said, don't quote me. >> I know. >> But if that is the case, then you might be able to get a bond. I might be able to get a bond tonight. >> No shot as out of personal recognizance if I have someone to come get me. They're literally across the street. >> What do you mean? Like are they? >> Yeah. >> Can they get your car? >> Yeah. >> Okay. >> Yeah. I have I have people here for me. >> They'll get you? >> Yeah. Less than a minute. I have people here for me if I can be released. >> Can't do that. >> I have people here. >> Nothing. >> I can't I can't release you. It's It's a DUI. People are hurt from it every day. >> All right. You have William's number. You have my mom's number. >> But if they can come get your car, that would be ideal. >> They're going to come get my car. They're right across the street. >> Okay. So, that that'll at least be ideal for you that you won't have to come back. >> On the way to come get my car. >> Awesome. >> Yes, sir. >> Let her make a phone call. She can figure out her car and stuff and uh >> my people are be on her way. >> Okay. Okay. You >> like that? Oh, yeah. So, I just hit my head in the car, so I'm not used to the >> I mean, it's fine. >> All right. Bye, man. I real quick. Thank you for your patience. >> You're fine. >> I appreciate it. >> Like I said, you've been real chill and cool with me. There's not a lot of people I'd take out of a cuff, but you've been real chill. >> Thank you. >> Just long as you're chill, you know, I can let you make a phone call. Was that anything down there? Usually we don't get that one ever. >> Yeah, I think that's actually the first time I've heard of one coming out from there. >> Did they actually hit the panagor? >> Yeah, they >> Oh man, that's something else. I'm sorry. One more number. >> Can you stand out here while I do the AVR? >> Thank you. >> They'll let you get numbers. >> They'll let you get numbers on your phone and stuff, too. >> Yeah. >> Yeah. You won't be in there long. It's just DUI. It's my second, but they'll let you get all your stuff out. You can't drive drunk. >> I'm not. Um, I'm not okay. >> I did it right. >> Okay. >> I was following my roommate. He's a reckless driver. >> I I sped past him, past that red light, and of course, y'all got me. No, >> that's all up on him. I'm just here to assist him. But >> we just have too many people getting in wrecks, running people over, driving the wrong way. So we have to do our due diligence. Of course. I'm guessing. Is this them? Maybe. Looks like it. I'm going to put my car keys on the curb right now. Heat. Heat. Hey. >> Hello. Hi. >> Hi. >> I'm Jimmy. >> Okay. Do you have a license on you? >> I do. Do you want to see it? Yes. For sure. >> Let me know if you need me to pull it out. >> And then my insurance and stuff is behind there as well. >> Okay. >> Now, have you been drinking? >> No, ma'am. >> There you go. Give it to this right here. I sent you a bunch of >> the guy picking up the car. >> I don't know if you want to talk to him. He's over here. >> They said I don't know if you want to talk to him. He's over here. >> Well, he's the person who >> he's in front of her. He got called too. So >> he's a he was a passenger in the car. >> Oh, he was going to be fine. Just going to go back in my car. >> Okay. >> I only need my wallet and my keys. >> And your remember your keys are on your the curb. >> Yes, sir. Ma'am, I'm so sorry. Where are her keys? >> Right there on the curb. >> Yep. There they are. >> Yeah. You're going to have to call Bill. >> I already called Bill. Bill didn't pick up. Calling Kimberly now. >> Wait. >> Okay. >> Which number did you call for Bill? 470. >> Yes. >> 847. >> Mhm. >> All right. Well, Kimberly is that's my lawyer. >> That's your lawyer? Okay. I'm going to call Bill one more time and then I'll get in contact with Kimberly and see what we can do. Okay. >> And I texted you a screenshot of the number. >> All right, boss. We're here to take the car. >> Okay. Appreciate it. >> Do you have everything you need? >> Yes, sir. >> Okay. Um Um >> Anna, do you want me to take anything off of you that you don't want to bring down with you? >> Like your scarf or anything like that? It's >> your scarf? >> I know it's my scarf. My >> scarf. Get this back in a while. Thank you. >> Yeah, Bill's not picking up. >> What um after you get her? >> That's going to go with you. >> And there's just no way for a person to recognize since I'm here. You got to take her. >> Absolutely not. Were you in the car that was in front of her? >> Mm-m. >> Okay. So, um, and and here's here's the reality of it. I could be charging you with four different things. All traffic things in Georgia are misdemeanor. I could be charging with running that stop sign, failure to maintain lane, running that red light, and a DUI. That's the reality of it. I'm charging with two things. Running a red light, and DUI. So, here's the here's the thing. I'm a DUI cop. It's one of the main things that I do. DUIs kill people. They kill innocent people. You have a 25% chance of something good actually coming out of DUI or driving drunk. And that's just getting home. 25% you're going to kill somebody. 25% you're going to kill somebody else or yourself. 25% you just get into a wreck or a DUI. So 25% is the only chance you have of something good coming from it. It's not everybody else's fault that you chose to drink and get in a vehicle that can literally kill somebody. And I know I've been to so many people getting hit by cars and stuff lately and losing their lives over stuff that is just make better decisions. >> I did it right. >> I get you. And that that's that's the thing. Sometimes, you know, it's just taking a little bit extra time. Yeah. But sometimes that doesn't always work, >> you know. >> It's what they teach you. >> Yeah. But everybody is different. It's not a set thing like if I have one drink, it's going to last this long. Not to mention, you said that you drank tall boys. That's like almost three drinks in one. And if you had three of that those that's almost six drinks. Six to nine drinks. So your three drinks ended up being six to nine drinks. That is why you're in the position you're in now. Your own decision. And it it's it's just a selfish thing to do to put other innocent people at risk. So no, I cannot release you on on good conscious or what what whatever the term is. It's just we're a little bit beyond that. If it's just traffic citations, I was telling the car. Okay, we could. But it's just in this situation that we can't right now. She's going to search you. Um do you have any other questions? >> I don't believe I do. Can I go ahead and take her car to go? >> You're going to take the car. Have you had anything to drink? >> No, sir. >> Okay, you can take the car. You're good to go. >> Clark County Jail. >> Yep. Clark County Jail. Can I bail her out tonight? >> Is that going to be just something that I need to deal with at the dinner? >> So, I would give the jail a call before coming down or anything. I'm going to get her uh there. They're going to book her in after she's completely booked in. They will tell her whether she has a bond or not. Um that is really up in the air because she's had a previous DUI. So, it's really just depends on what they say. Um but give them a call and they'll be able to tell you more. All right. >> For sure. Thank you. >> Yep. Have a good night. >> All right. I'm going to pat you down real quick. Okay. Do you have anything else on you? >> All right. Is Do you want me to take your jacket? Do you want me to take anything out of your pockets or anything? >> I don't have anything except for my cell phone. >> You have your cell phone. Do you Does she need her ID on her? >> She He has You have her ID? Wonderful. >> Correct. >> Great. >> All right. >> All right. >> Okay. >> All right. >> I'm going to pet you. >> I'll handle her car. >> Thank you. I'm go right here. Sorry. Excuse me. >> I'm going to go one more spot. Just kidding. All the worries. >> Okay. >> You'll be okay. >> That will let you get more numbers and stuff out at the jail. Um >> I don't think you'll be in there overnight. So >> said yours was in when you're 21. You're 27. Like I said, there might be that 5ear thing. I just can't remember. >> It wasn't a I wasn't even convicted. >> If you weren't convicted, you shouldn't have anything. It might >> you'll probably get a bond. It's really It's really dependent on whether you're convicted. >> Okay. >> Uh all right. Right now, let's just turn around. Um back on you. You can keep your phone on you. I'm not going to take that off here or whatnot. That's the only thing she has. >> I appreciate you uncuffing me. >> Said you've been chilling with me and I appreciate that. >> Of course. I think I'm a very respectable human. >> Give me one second. I got to double lock these guys. Let's bring her back up. Okay. That's all I have. Um, I appreciate you. >> Yep. >> Thank you. >> Mhm. >> Oh, could you help me with just a seat belt? It sucks in my car cuz they're so close. >> How are you How are you supposed to do this? >> What do you mean? >> With the seat belt in the back. Okay. It's a bit uncomfortable, but I don't want you banging your head on this divider. >> We've all seen that. Oh, thank you. Oh, so I come down. I'm coming down here. I'm like, you know, it's about, you know, bar closing time. There's going to be some drunk drivers have hit and runs all night tonight. other >> two are the drunk drivers and as got one and uh I see one car just fly through that stop sign right there on old uh what is that old fraud car was >> um >> it looked just like that u from what I could tell >> I think that they pulled up the road and let him out and he walked through the woods >> yeah they they 100% were cuz they turned right I was hoping to get both of them to be honest um but she flew up like it was a little bit more distinct how she went through that stop sign and then she was like in the road and then uh we got up to that light right there and car went through he pretty much went through on a red but it was clearly red for her and she just completely went through it cuz I was like oh no we're doing this um smells like alcohol said she had three drinks >> and uh didn't do too well on field so we're in the position you could smell alcohol couldn't you >> yeah so and then she spontaneous continously uttered that she had tall boys. >> Yeah. >> Three tall boys. >> I told her I was like, "You can't drink and drive." Like, "I'm nuts." Like, "Yay, >> yeah." Um, and I just don't believe that she was down at downtown and didn't drink. I saw four clues. >> It It's that bad. >> Her six clues it was slight. >> Um, it may or may not have been there. So, I'm going to put four that I saw for sure. >> Yeah. Um but her her walking turning three clues uh lack of convergence man one eye just >> really >> yeah both times I I did a double check so it it is what it is I appreciate you >> what's up >> nothing's phone is I got you. >> May I use my cell phone to call? >> I can't let you do that back there. Who are you trying to call? >> My mom. So, like she said, you'll get a some phone calls at the jail, especially if the jail says that you can bond out. Um, you know, they're going to try to get you bonded out. It's it's a Saturday night after the game. Like, they they don't want you sitting there any longer than you know, you need to, right? Give me one second. 64 central and route to 600 with one female. Starting mileage 119 232. Go ahead. Yeah, it was at the 102 Brier Cliff Road. Dispatch has been helped. >> Good back there. >> Huh? >> It's all right. Is it warm enough? Cold enough? Look, like I said, I ain't a robo cop. Like, I try to, you know, be as understanding as I can, >> officer. I get it right. >> I understand that. But like I said, it's it's not about, you know, mathematical equations. It's everybody reacts different. And you know, it's just it is what it is tonight. It's not the end of the world. >> It shouldn't be. >> What do you mean? >> I did it right. >> Dispatch has been updated. >> I mean, do you feel like you'd be safe to drive? >> Yes. >> Yes, sir. Cuz let me tell you from what I saw in about a block's distance, you committed three traffic violations that are not just a like a tag light or a tail light. Like you you had three moving violations which are more serious when it comes to traffic. That's how people get hurt. Oh man. 6 485. There's a guy walking down West Broad towards Baxter. He is severely intoxicated. He almost fell into my car as I was driving by. Can you go check on him? West Broad. He was walking towards Baxter Street. He was on the side closer to Rock Springs. May I ask the ETA? >> Yeah, we're almost there. >> Not much farther. >> I take it you've never been to this jail. >> No, sir. So, as a question, it does not pertain anything to this case at all. I want to make that established. Um, cuz I've read your rights and you said you do not want to agree to talk to anything about the case. This just curious, it can help, you know, determine like, you know, if you get a pond, were you jail? Uh, when you got your DUI, was it in Georgia or was it another state? >> I'm I'm sorry. >> When you got your first DUI, was it in Georgia or was it another state? >> I did not get it. >> Well, I'm not saying you were convicted. I'm But you were arrested. That's fine. You don't have to tell me. It's all right. Six for central out at 600. Any mileage is 237. Dispatch, >> tell you what you got. >> One female. >> All right. Come on. >> Thank you. All right, I'm going to get this stuff filled out real quick. Just two citations and then we'll be on our way. All right. me, bro. It's his own. Oh, whatever. I don't give a [ __ ] >> Uh, yeah. So, the DUI will just be for me. It's my It's a stat five and then the accident report is six and seven. Is that how I radio it? >> Um, >> who did the accident? >> I'm going to do it all. >> Okay. So, I'm six and seven. >> Yeah. Yeah. You're six and seven from >> the accident. >> The accident. Yes. And then >> status five for >> status five and seven cuz the DUI and >> seven for the DUI. >> The DUI is a citation. >> I don't know. I How do I put that in the report? Don't I put it in the accident report or no? >> I'll ask. >> You'll put it in the accident report, but that's also your charge. >> Yeah. >> Than your regular report. So, I mean either way, I would just go satisfied. >> I'm just going to say satisfied. >> It really doesn't matter on their end. >> Yeah. I mean, it really doesn't matter on their end, man. I mean, as long as everything's correct in the report. >> And then I gave them all the tickets besides her copy and my copy, right? I don't got to me. Right. >> Her She's in there. >> Yeah. Her copy goes into her property. >> Yeah. Yeah. Okay. >> Yeah. So, all you should really have is um >> I [ __ ] hate you. I haven't done one of these in since last February, so I guess I'm due, >> man. You should get them more often. Like, really? >> You seeing us, man. >> All right. I'll see you. I'll see if it roll. See, I'm just happy you didn't crash your car cuz that's happened tonight. >> No, no, we don't got to be like that. I appreciate you letting my friends come pick it up. >> Yeah, >> I have a lot of friends here. >> I see you have an Atlanta address. >> I moved there. I got a I graduated UG two years ago. Moved there a year ago. >> Okay. What did you uh what did you study? >> Risk management. >> Yep. Fair enough. Fair enough. That's all I'll say. >> All right. Yeah. See, like I said is I try to be fair. You know, you're already in a positions where you >> get it right. >> I know you're saying that, but like I said, some it's not about that. It's everybody's different. You got to just make a little bit more better judgment call. All right. All right. Give me a second. >> All right, I'm going to get you unbuckled. >> Thank you. >> Let me get a flashlight. Uh, grab that. I don't want this to hit you in the face. Nothing. >> Thank you. I appreciate it. >> You're welcome. You want to come out this way or open that door? >> This way is easiest. >> Oh, your phone. Use >> my cell phone. >> Yep. Right here. Is that everything? Let me double check. All right, we just head on over to these doors. Look, this is not the end of the world for you. you you will be okay. I know they make DUIs. They are bad for the fact they said it hurts innocent people. They're very common. That's why you see like, >> you know, billboards about them, you know. You know, see billboards for domestic, you know. Go ahead, set one. >> What's going on, guys? Hey, how's it going? I'm >> living the dream. Oh man, you guys must have a bunch of people coming in. >> Huh? >> You guys must have a bunch of people coming in. >> It's a stack of papers right here. And the other one, >> what about you got 100 on? >> I mean, serious. I'm not playing. I'm missing. Okay. >> Black, too. >> Yes, sir. >> Okay. >> What color? >> Oh, that's not that specific. >> What we said back in the day, peach. >> No, that's the color. What you got, sir? >> Uh, DUI less safe and running a red light. >> Okay. >> You have it. >> She She was arrested for one but wasn't convicted. >> Okay. >> That shows up on a criminal history though. So is there a certain time period? Is it like after is that within 5 years or is that through your period? >> But if she wasn't convicted of it, >> if if you're not convicted, it shouldn't show up. >> If it doesn't show up on the criminal history, but I run my criminal history and I see DUI on there. >> I get you. >> I I've had that situation before. Yeah. >> I didn't agree with it, but >> I get you. >> You feel what I'm saying? >> Yeah. She's been cool. So hopefully for her sake she can >> I hope I hope it don't get out of here soon. >> Get up out of here. >> You know what I'm saying? >> Yeah. >> Yeah. I don't I think it's it needs to have some type of expiration date on it. >> Yeah. I think there should be a reasonable amount of time. Like if you have like two or three in within a 5year period. Okay. Something's wrong. But like, you know, I mean, people make mistakes. >> People make mistakes. >> We had a guy come in here, man. The man had a damn DI back in 1979. >> Like, you really going to >> charge that against him? It's 2023. >> Yeah. It's like 50 years ago. Like, come on. >> I mean, come on, man. >> Like, [snorts] let them bond out and get back out there. >> That was crazy. I didn't appreciate that myself. That's That's been too damn long ago. >> Yeah. >> Yeah. Yeah, I don't think that should show up on a criminal history cuz I know like convictions obviously will. >> Um it it may show up, you know, that they're had an encounter with police and like the narrative of it, but it it shouldn't show up as an actual like hit against her. >> I don't think she's in here. Yep. layoffs. >> Georgia license. >> Yeah. No money, anything, right? >> Yeah. So, I need a couple signatures on these. Um, I see signature deal right here. It's not an admission of guilt. I was going to say that you're going to receive a copy of the citation. >> First one's going to be for DUI less safe. Um, going to charge per se unless you know we have 08. That all comes later. It's done by solicitors and stuff. Second, she's running that red light. I think that is probably the most egregious of the three that I saw within half a block. Um, just let it be a learning lesson, right? You know, that should say something about your driving patterns, right? Then see signature turn on the yellow. Once again, not a mission of guilt. Ain't going to lie to you. At first, man, I thought you were like road raging with those people in front of you and trying to like slam into the back of their car. >> Man, I was trying to make sure he was safe. >> No, I I get you safe. >> I want to make sure he was safe. I get you now. From my perspective, I'm like, "What are you doing?" Like, I legitimately thought you were about to crash into their car. I'm glad it didn't come to that. Write some numbers down. >> Yes, sir. >> Okay. Okay. Here are her copies. All right. Is that >> I wonder it starts off like that uh Star Wars movie a long long time ago. >> There's core and DDS copy. I think we got two more out there, but they say male and female. >> What time is it? Slow down. >> I don't know. >> What time is the bar closed tonight? >> 2:00. >> But I mean, people I almost hit somebody coming in. Dude was so drunk walking on the road. He like started leaning, went like this and almost went into the road. It's a little hectic out there right now. >> Yeah, that baby crying the blues would be at home, but >> I had them fall out. >> You should walking down that hill right there. Uh what's what's that road? You know, >> street right before you get down uh towards the bridge down there. You leaving downtown? >> Uh Eastbride. >> Yeah. when you're going down that hill like they it was a group of on the sidewalk fell right out in the damn street. >> Luckily it wasn't a car on the other side coming this way. I would have ran over there ass >> so drunk >> and they cut they drunk. >> So you know we've had a lot of uh vehicle versus pedestrians lately. It's it's just >> it's bad. >> Yeah. >> Found a guy on the loop not long ago. Was he my homeless guy? >> Yeah. >> Yeah. He was one of ours. Do you remember his name? >> Uh I can't remember. We didn't have a lot of history with him. >> Yeah. >> When y'all found him in the meeting? >> Yeah. Yeah. I was just went to another pedestrian versus a vehicle and uh going through a debris field and road. So I get through it. Stop up past a car, get out. No one's at the car with, you know, big old smash window and stuff. I'm walking down. He's freaking out. He's like, "I think I hit someone. and uh get out there and I dude was >> it was dead on arrival. >> Was a white guy or black guy? >> A white guy. >> So when they told me that happened, we had just released a gentleman. I can't remember his name. Uh he told the swords one day for a long time about a watch. He's like, "Let me get that watch for me. I can pawn that watch." >> Like I'm sure you can, buddy. >> If it was him, sign. >> We haven't had much history with this guy. I think the last thing was a probation violation in like October. >> Mhm. >> I And there's a chance he probably could have sat here since October for a probation violation. U man literally just walking down the road. That's insane. >> Any phone numbers I need to write down just in case cuz I'm not allowed to come back to it, right? >> I don't think so. Your property gets sealed up. However, I mean, I would not imagine that you'd be sitting here very long. Even if you can't bond out tonight, you'll see a judge and a judge will >> have a deciding factor. >> That's just generally how it is. >> One more just in case. Now just remember Anna even when you think that you're okay to drive after drinking most probably about 100% of the people who are drunk and driving think they are okay to drive about 100% of them. After Anna was placed under arrest, officer Cavam read her. The George implied consent notice, but she refused to submit samples of her blood or breath. After a female officer arrived on scene to search Anna, and her friend came to retrieve her vehicle, officer Kav transported Anna to the Clark County Jail for further processing. Anna was issued the following summones. DUI alcohol less safe for 06391A1 and obedience to traffic control device required for 06to. >> Yeah. iPhone at one time. >> Oh, you have to hold both. >> Yeah. And if you're looking shoes and socks, some beautiful orange slides right there. Gorgeous.
