Listen, and you're you're allowed to consume alcohol. You're of age. I'm 21, too, right? Um, so once again, how much alcohol? >> I had a drink in last night. Like I had drinks last night. >> How much did you drink last night? You want me to ask? >> Couple glasses of wine. >> Enough that you think you'd still be intoxicated at 4:00 in the afternoon? No. >> Okay. >> All right. So, what I'm going to ask you to do next, your name's Jill, right? You want to call Miss Manx? Miss Miss Manx. Jill. What are you? >> Call me Andre. >> Andre? >> Yes. >> Is that your nickname? >> Miss Jill Andre. >> Miss Jill Andre? >> Yeah. >> Okay. What's the basis on that? Do you remember? >> I'm getting divorced. >> Oh, okay. So, your maiden name is Andre. >> Okay. Mind if I call you Jill then? >> Mhm. Yeah. >> Um, how about this? So, I'm going to ask you if I could do a test of your eyes. Okay. And with that being said, we'll ensure that you're safe to drive and then get you on your way. >> Okay. >> Okay. >> Do you um have a glass eye, Mr. Andre? >> No. >> Okay. I uh any >> That's like an odd question. >> I know, but it's part of it's it's it's make us ask that. Uh any pre-existing head injury? >> Sergeant Lawrenson started with the horizontal gaze nestagmas HGN test. The second exercise was the walk and turn test. During the walk and turn test, Jill failed to touch heel to toe on each step and turn improperly. The final exercise was the one leg stand test. During the one leg stand test, Jill failed to raise her foot in the proper fashion and put her foot down before the test was complete. >> Um, what I'm asking you to do, Jill, Miss Jill Andre, is keep your feet together. Can you put your hands down your side for me real quick? Can you see the tip right there? >> Mhm. With the tip with your eyes and your eyes only, I'm going to ask that you follow the tip of my pen. Do you understand the instructions? >> Yes. Okay. >> With your eyes and your eyes only, I'm requesting that you follow the tip of my pen >> right here. Okay. >> Okay. >> Ready? >> With your eyes and your eyes only. >> Oh, >> okay. You understand the instructions? All right. Let's hit my pen with your eyes and your eyes only. Keep your hands by your side. >> Just like that. Okay. All right. Once again, I'm going to ask you to follow the tip of my pen with your eyes and your eyes only. Do you understand the instructions? >> Yes. >> Okay. >> You're not following the tip of my pen and you keep moving your head. >> Oh, sorry. >> That's okay. >> Do you understand the instructions though that I need you to reexlain any portion of the test? No. >> No. Okay. See, it's in my pen. >> Mhm. >> Okay. Follow it in my pen. Yeah. Do you see the tip my pen? >> Mhm. >> Okay. >> I'm going to pull out one more time. Okay. Follow tip my pen with your eyes and your eyes only. Okay. With your eyes and your eyes only. All right. >> Okay. >> Okay. Do you see the tip of my pen? Mhm. >> Okay. >> Okay. We're going to go up. Okay. Chin down, eye level. Follow the tip of my pen with your eyes and your eyes only. Okay. >> Mhm. [Music] >> Continue. >> All right, Joe. So, I'm going to ask you to uh complete two more tests. Okay. Just to ensure that you're uh able to operate. Okay. >> Okay. >> All right. Uh do you have any issues with your legs? Any existing knee injuries, leg injuries, foot injuries, anything like that? Anything that would prevent you from walking or balancing? >> Nothing. Okay. >> If you don't mind, before we get a test, take a step in front of my vehicle here. Make sure we're in a safe location. >> Okay. >> Yeah. You mind just following him? We'll do it over here. Okay, Mr. Andre, >> we could be in here for the car. It's just a little easier. My concern is somebody comes around the bend, think it's an open spot, and then we're all like pulling in little >> Yeah. No obstructions. Here you go. Okay. All right. I know it's going to be a little bit louder out here. I'll I'll try to raise my voice a little bit so you can hear me and understand. Okay. >> So, what I'm going to >> If if you think that's going to help you, that's fine. >> Okay. You can look. You can face me. All right. Actually, what I'll have you do is I'll have you stand right here, right in the shadow. Right here. Right here, Jill. Yep. Stand there. Just face facing me. Just like that. Yep. Perfect. Keep your hands down at your side. And you're going to keep your legs together. Okay? You understand? Okay. All right. So, what I'm going to do is I'm going to explain the test. I'll demonstrate it. And then I'll ask you to perform the test. Do you understand? Okay. So, for right now, what I want you to do is I just want you to take your right foot, put it directly in front of your left foot, like you're on an imaginary line, like so. Okay? And I want you to stand like that with your hands down by your side while I explain everything. Okay? >> All right. Stay just like that. Nope. I didn't ask you to walk yet. Just stand just like this. Okay? >> Do you understand? >> Yes. >> I need I need your right foot directly in front of your left foot. Keeping them in a straight line with your hands down by your side. Stand just like that. I'll explain the test to you. Okay? What I'm going to ask you to do is walk a series of nine steps heel to toe. Every step that you take, your heel is going to touch the front of your front of your toe. I need you to stand in the uh in the starting position. Okay. Yep. Stand just like that. Okay. Let me explain the test and then I'll have you move. Okay. >> All right. So, what I'm gonna ask you to do is complete nine heel totoe steps down in just imaginary straight line. You're going to take a series of small steps to turn around and take nine steps back. Okay. >> Okay. >> The entire time I want you to keep your hands down by your side. I want you to count your steps out loud. And once again, you're going to walk in a heel totoe fashion just like this. Okay. 1 2 3. You're going to go all the way to nine. I only did three, but I want you to go all the way to nine. Once you get to your ninth step, I want you to take a series of small steps, and I want you to take nine steps back down the line. Okay? 1 2 3. Once again, I did three. You're going to do nine. Okay? If at any point you step off the line or lose your balance, just regain your balance. Continue stepping heel to toe. Okay? Do you have any questions for me? >> Do you understand the test as I explained? >> Nine and nine. >> Nine. Heel to toe. Make sure that your heel is touching the front of your other foot. Okay. >> All right. You can begin. >> Just make sure you're counting your steps out loud. Okay. >> Oh, okay. >> Yep. and keeping your hands down by your side. >> 1 2 3 4 5 6 7 8 9. >> Okay. All right. Stand back in the starting position just like I had you before. Right there facing me. Okay. >> All right. All I'm going to ask you to do Nope. Not against the bumper. I need you to stand away from the car. Okay. What I need you to do here is keep your feet together, hands down by your side. Okay. This is going to be a balance test. All right. You can pick either foot of your choosing. Right or left, doesn't matter. But I need you to keep your hands down by your side. Choose the foot of your choosing. >> Yeah, I see. Okay. Choose a foot of either either uh you can choose either foot, right or left. I'm going to use my right foot. Okay. All you're going to do is you're going to lift it approximately 6 in off the ground with your foot pointing out straight in front of you. Okay? The entire time, hands down by your side, staring at your foot. I want you to count out loud. 1,00 1,002 1,00 3 so on and so forth until I tell you to stop. Okay? Do you understand? >> Yes. >> Okay. If at any point once again if you drop your foot, you lose your balance, just to lift your foot back up and continue counting from where you left off. Okay. Any questions for me? Do you do you understand the test as I explained it? >> Yes. >> You can begin when you like. Jill, just remember to count out loud. Okay. >> 1. >> Yep. Keeping your hands down by your side, push straight out in front of you. Approximately 6 in off the ground. Okay. Just right here. >> Okay. >> Based on the motor vehicle crash, her indicators of impairment, and her inability to adequately perform the field sobriety exercises, Jill was placed under arrest for operating under the influence. Her vehicle was impounded for a mandatory 12-hour hold under John's law. >> Do you mind about your face of the car? We're going to do one more test. Okay. >> Okay. >> Nope. Stay away from me. Okay. Right now. I believe you're intoxicated. Okay. 17 of 10150. >> I know you got a couple bracelets on here. I'm going to try to put these on without pinching you. Okay. >> Is that too tight? >> No. >> No, that's okay. All right. I'm just going to lock them real quick. All right. Jill, do you have anything in your pockets? Anything sharp? Anything? Any weapons? Anything? I'm sorry. >> A phone. >> A phone. That's it. Okay. All right. I'm just going to use the back of my hand. Just check the front of your pockets here. Okay. And no, don't reach for me. Okay. What else do you have? >> They're in the car. Okay. We'll we'll get him. Don't worry about that. Okay. You want to take her and I'll Oh, no. Sorry. I'm sorry. You can do it. Okay. We're just going to walk back to my car. You just step over the curb for me? Nope. We're going to go this way to the other car. Okay. You unlock? >> Yeah. >> Yeah, that car is unlocked. >> Okay, thank you. >> Is there a purse in the in in the vehicle or anything that you need or require at the time? >> Fine. >> I need my wallet and my phone. >> Where would that be? >> Oh, the center console. >> Center console. >> And there's a purse. >> Do you mind just rotating a little bit? I'll get your phone out of your back pocket for you. All right. We'll bring that with us. Can you get it? I don't want to I don't want to touch you inappropriately. Okay. Can you slide it out of your pocket even though you're in handcuffs? >> There you go. Perfect. All right. Nope. I'll take it. I'm going to put it right in the front. We're going to bring it with us to the headquarters. Okay. >> Okay. >> All right. Scott. >> Yeah. >> Yeah. Do you mind just watching for once? I want to turn the air on before I close the door. It's way too hot. Okay. I'm going to turn the AC on for you. Okay. All right, let me just make sure the AC is on. It'll get a little bit cooler. All right. Do you feel it blowing on you, though? It's a very short ride. We're going right across the street. Okay. >> I know where I'm going. >> Okay. You need me to come sit on the hook? You go. Sorry. All right. You >> get ahead. Sorry. You want to deterg in? >> Yeah. >> It's up to you. >> It's up to you. I don't know if you want to have her sit there. I'll just check the back real quick for you. >> She was drinking this multiple times while sitting there, so I'm not sure what's in here. >> Okay. >> Smells like water to me. >> Okay. Just notating existing damage on the vehicle on the front passenger side. I don't think >> Yeah, it is. >> You take the center console. >> I didn't say her documents or phone is in there. >> No, she had her phone in her back pocket. Oh, >> so her phone is in her purse. >> And here's her purse. Her wallet was right here, which I'm assuming is what she was requesting. >> Okay. I do I do have her documents. >> Okay, perfect. >> All good. >> Yes. >> Where do you want it? >> Front floor. >> Yes. >> Sorry. You do have her key. >> The key is in the center. >> Okay. Are you left-handed or right-handed? >> Right. >> Right-handed. Okay. Perfect. All right. I'm just going to take the handcuff off. We're going to handcuff you to the bench instead. It's going to be a little more comfortable for you. >> Yeah. It's our policy. Everyone that's in here has to be handcuffed. I'm sorry. >> All right. There you go. You can take a seat. All right. Can you call my father? >> We will let you call somebody in a couple minutes. Okay. Somebody's going to have to come pick you up. All right. I know I'm a pain, but what time was the time stamp for the 20? >> Are you talking to me? >> No, I'm sorry. I apologize. Do you think we could call Ramson? >> I'm sorry. >> Call Remson. >> What? Remson police? >> Yes. >> For what? Uh my dad's a longstanding um well long-standing employee of Brunson. >> Okay. >> And like knows all the police. So So maybe we could call them like suddenly we have to >> get rid of whatever this >> Okay. Unfortunately, that's not how that works. >> Okay. This is completely separate. It doesn't matter who you know. Okay. >> The deal is is that we're going to go through some paperwork. All right. If you're willing to, we're going to uh do the alcohol test, which is the breathalyzer. All right. We'll test your breath if if you uh if you'll allow that. And then we'll have somebody come pick you up. You'll be in and out of here in 30 minutes tops. Okay. >> Okay. >> All right. Um and I'll let you call somebody in a few. All right. Once I get through these questions, >> okay? >> Whoever you want. If you want to give your dad, I can give you that. Just somebody that can pick you up but has a license. Okay. >> Okay. >> All right. All right. >> What happened to the car? >> The car got towed? >> No. >> Yeah, it got towed. It's inbounded. It's going to be in central. I'll have all that information at the end. You can pick it up uh after 12 hours. Okay. >> Okay. >> All right. All right. I'm going to do a lot of talking. All right. Let me get through the whole thing and then if you have any specific questions after, then you can ask me. Okay. >> All right. I just have to read you the uh New Jersey Attorney General standard statement for motor vehicle operators. All right. Number one, you have been arrested for driving while intoxicated. NJSA39 uh colon 4-50. Number two, the law requires you to submit samples of your breath for the purpose of testing to determine alcohol content. Number three, a record of the taking of the breath samples, including the test results, will be made. Upon your request, a copy of that record will be made available to you. Number four, after you have provided samples of your breath for testing, you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath, blood, or urine for independent testing. Number five, if you refuse to provide samples of your breath, you will be issued a separate summon for the refusal. A court may find you guilty of both refusal and driving while intoxicated. Number six, if a court finds you guilty of the refusal, you will be subject to various penalties, including license revocation of up to 20 years, a fine up to I'm sorry, a fine of up to $2,000, installation of an ignition interlock, and the referral to an intoxicated driver resource center. These penalties may be in addition to penalties imposed by the court for any other offense of which you are found guilty. Number seven, you have no legal right to have an attorney, physician, or anyone else present for the purpose of taking the breath samples. You have no legal right to refuse to give or delay giving samples of your breath. Number eight, any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal to submit the breath testing. Even if you agree to take the test but then do not follow my instructions, do not properly perform the test or do not provide sufficient breath samples, I will charge you with refusal to submit the breath testing. Number nine, I repeat, the law requires you to submit samples of your breath for testing. Will you submit the samples of your breath? >> I think I'm going to talk to a lawyer. >> Okay. I I've read that part already. Uh, you have no legal right to have an attorney present during the breath testing. Okay. >> Okay. >> Um, all right. Your answer that you just gave me is not acceptable. The law requires that you submit samples of your breath for breath testing. If you do not answer or you answer with anything other than yes, I will charge you with refusal. Now, I'll ask you once again, will you submit breath testing? I I I I I'm getting like really overwhelmed by this whole thing. >> I understand. Just to shorten this up a little bit. All right. When you apply for a license, you sign consent to give samples of your breath if you're uh if you're deemed to possibly be under the influence of alcohol or any other substance. Okay. As it states here, you're required to give samples of your breath if you're requested. Okay? If you refuse, you will be charged with a separate additional charge of refusal along with driving while intoxicated. Okay. So, I'm going to give you one more chance to answer yes or no. Will you submit the samples of your birth? >> What? And what happens? What's what's the consequence >> if you what? Well, I already explained what the consequence is. If you say no, you're going to get an additional summon for refusal. All right? And at that point, you will be subject to various penalties that will be imposed on top of the driving while intoxicated. Okay? If you say yes, the next course of action is that we do this the breath samples. All right? You'll come over, you'll give us samples of your breath, we'll do it two or three times, depending on how many times it takes. It'll print it out and we'll be good to go. All right? So, I'll I'll ask one more time. All right. Yes or no? Give me a minute. This is a lot. I mean, like, yes, I had a glass of wine, but like, yeah, like that's it's it seems like a lot, like, you know, and I'm just I All right, Joe, I do need to answer. All right, so >> all right, let's go. >> You are willing to submit samples every breath? >> Yes. >> Yes. Okay. >> All right. It'll be a few minutes. All right. We have to We have a time period that we have to abide by. All right. I think we have about 10 minutes left. All right. In the meantime, I'm just going to read you one more thing. It's called a memoranda warning. All right. You have the right to remain silent and refuse to answer any questions. Anything you say may be used against you in a court of law. You have the right to consult with an attorney at any time and have him present before and during questioning. If you cannot afford an attorney, one will be derived if you so desire. A decision to wave these rights is not final and you may withdraw your waiver whenever you wish, either before or during questioning. All right. Do you acknowledge that you've been advised of each of your constitutional rights? >> Yes. >> Okay. That is the case you're right-handed, correct? >> Yes. >> Okay. So, just sign here for me. That's just uh agreeing that you understand what everything I just read to you. All right. And the second one, having the rights in mind, do you wish to have or give up these rights and answer any questions voluntarily? If you do, you can sign there. If not, you don't have to sign the house, right? That doesn't make sense. >> Signing right here. So, having those rights in mind that I just read to you, do you wish to wave them and give them up and make voluntary statements and answer any questions I might have? No. >> No. Okay. Thank you. >> All right. And just to um just to reiterate what you told me before, you had one glass of wine today. >> Okay. Do you know approximately what time that was? >> Right before I went to go to the nail salon. >> Okay. Do you know approximately what time it was before like when that happened? >> Uh like a 4:00 appointment. So 3:30. >> Okay. >> Did you eat anything today? >> Yes. >> All right. What did you have? >> A salad. >> Approximately what time is it? >> Um 2:30. >> Okay. Like just regular salad, salad or chicken? Any kind? >> No, like a big salad like from Whole Foods like a whole like salad bar. >> Okay. [Music] And you said you consumed alcohol last night while we were outside.
