had a call that someone was concerned about a male and a female at 10:54 p.m. on July 13th 2023 officer Devon fer with the B Fontan Police Department responded to a report of a potentially intoxicated driver who had left the Village Pantry in a Honda he made contact with the suspect in a parking lot near the intersection of on Detroit Street in w Watson way after he made made contact with the driver and her passenger he noticed signs of impairment while the driver did not have any identification she told the officer that her name was Jade Irwin just left Village Pantry said that they were like falling asleep and then we saw you pull in here so no I'm I'm as wide as awake as ever bud you know okay you guys are okay I was texting my mom back my head was down but okay she might have been in an emotional state fighting with her mom no I'm not saying that you guys necessarily did something wrong I'm just saying that based on the complaint that we got we wanted to make sure that you guys were okay okay that makes sense yeah that's fine okay fine have you guys had anything to drink tonight no using any drugs or anything no no no okay promise all right I'm getting indications is that's not the case why okay you're very slow in lethargic for one I'm slow in lethargic yes your speech is very slurred slurred okay my pronunciation is good I mean when you lethargic is a word used like for slow bodied Movement Like right and I wasn't slow at all getting around to the end of the car or doing anything El was doing okay well I disagree with that all right okay what have you taken today me yeah nothing nothing at all nothing okay do you care if I check your eyes just make sure you're okay yeah you can you're okay with that yeah you can goe all right let's walk in front of your your car here you just put your stuff up there on the hood yeah this is for being well I believe that she is impaired okay at this point I believe that she is impaired so I want to make sure that you're not okay cuz obviously you drove a car right yeah so I just want to make sure that everyone gets home safe at the end of the day right mhm okay so take a step away from your car there okay there we go put your feet together based on his suspicion of impairment the officer Fowler offered Jade an opportunity to participate in field sobriety exercises the first field sobriety exercise involved the horizontal Gaye nagus hgn test and he observed the lack of smooth Pursuit distinct and sustained niist stachmus at maximum deviation and the onset of niist stachmus prior to 45° he did not observe any vertical gaze nagus vgn afterwards he asked her to perform the one like stand test but she claimed that she was unable to complete it the final test was the modified rri test where she was asked to estimate the passage of 30 seconds but officer Fowler had to stop this test after 90 seconds just like mine are see how like my toes are touching here yep sorry you're okay my feet are fuzzy all right just hands down to your side there and maintain that position for me okay intimidating you see the tip my my finger right here all right what I want you to do is follow the tip of my finger with your eyes and your eyes only don't move your head do you understand a quick one but now we're just getting Taco Bell and getting some ice cream and going home man I got we just have to follow on the what it would be a walking turn and a one leg stand a one what what what is that a one leg stand so you just pick one foot up off the ground stare at it and you can out alloud 1001 100002 1003 and so on I know you said you have balance problems so I do have a very bad balance problem you know your leg I can't make you do it I'm just offering them to you if you don't want to do them it's totally up to you yeah I'd rather not cuz balance issue just I just don't yeah with are you willing to do a test where you just stand pretty much like normal um feet together tilch your head back close your eyes and count to 30 count to 30 you will to do that yeah okay just look up and yeah I'll I'll give you the instructions here okay um so go ahead and take a step away from your car there okay and then put your feet together just like they just were sometimes still okay hands down to your side maintain that position for me okay when I tell you to begin I'm going to give you three sets of instructions okay I'm going to tell you to close your eyes I'm going to tell you to tilt your head back and begin okay when I say begin I want you to start thinking about how long 30 seconds is okay once 30 seconds has passed I want you to look back at me and say stop okay okay okay does that make sense yes any questions no all right good and close your eyes tilt your head back just a second here and bad day or you know maybe maybe crying and someone was upset and and someone calls and says oh this person looks drunk I want I okay go and stop okay how long do you think that was about 30 about 30 seconds how did you get there um been about 32 what's that it might have been about 32 yeah I over guessed it a little bit okay how did you get there just were you counting were you just trying to think about it like how I was just trying to think about it okay honestly I was overthinking it okay so I get nervous with these kind of things I got you okay um do you have your ID on you I don't I lost it but I can give you my social that works cuz usually if I count I count one one you know like one mill one and what's your name j you know what I'm saying what's your birthday um it's February 18th 1997 okay based on the witness report her indicators of impairment and her inability to complete the field sobriety tests the officer concluded that Jade was impaired Jade was placed under arrest for operating a vehicle impaired o and transported to the Logan County jail for further processing so Jade you're under rush for oovi okay put your hands behind your back all right oh okay what the hell bring your hands away from your back okay you get my mom yeah get your mom right now either of those feel too tight no no Okay Jade is there anything illegal in the vehicle that I need to know about no no because we're going to check it for any intoxicants okay okay so is there anything illegal on your person or in the vehicle that we need to know about no nothing at all no okay we hang out n 47 9.3 [Music] 4 go ahead 7951 94 81.2 [Music] female female for [Music] Jade what's your current address okay [Music] for at the jail he read J BMV form 2,255 but she refused to submit a year and Sample for testing as a result of her refusal she was informed that her license would be suspended for 365 days or until the BMV reinstated her [Music] license hello hello how are you not too bad how are you all right one for me yes it's Jade Irwin um she's here for OVI oh um okay so we going to do a test on her yeah you think she'll stay we'll see e e e e e e e e e e e e e okay um you don't have to you're not under ARR for operating a vehicle under the influence of alcohol a drug or a combination of them operating a vehicle while under the influence of ballistic controlled substance or list a metabol of controlled substance operating a vehicle after underage alcohol consumption or having physical control of a vehicle while Under the Influence if you refuse to take any chemical test required by law your highway driving privileges will be suspended immediately and you have to pay a fee to have the Privileges reinstated if you have a prior conviction of OVI or operating a vehicle under the influence of a list of controlled substance or list of metabol of controlled substance stop you right there okay when you said um uh operating vehicle under the influence of Al drug or combination of them operating vehicle while under influence of the listed control substance or the listed um substance officer what is it what do I have to pay what do you mean it says something about paying that's for your driving privileges so if you refuse to take the chemical test that I offer you um then your license will be suspended and then you will have to pay a fee to have the Privileges reinstated and how and do just go to the VMV to do that yes once once the case is finished then you can take care of that okay that's all I need gotcha um let's we'll go back a little bit here hoer any vehicle one of the influence of a list of controlled substance or a list of metabolized controlled substance under state or Municipal law within the proceeding 20 years you're now under ARR for State OVI and if you refuse to take a chemical test you will face increased penalties if you subsequently are convicted of the state Obi if you take a chemical test you may have an independent chemical test taken at your own expense and I'm correct in saying that you've never been con convicted of an OVI before no okay um so with this being your first offense um what I'm going to ask you for is urine okay um I don't believe that you're impaired by alcohol um I believe you're impaired by some sort of drugs okay um so I don't think breath is necessary okay all right I think you're going to blow triple zeros on that um but I'm more interested on what's what you've taken today okay um so are you willing to provide a urine sample no no okay um so your driving privileges will be suspended for a year effective immediately okay okay um and then you'll get a court date I'll fill out some paperwork um you'll get a court date and um be able to contest it spend for a year mhm and I can't you cannot drive at all unless the court grants you driving privileges okay okay okay so so even before that year is up if I go and get it like if they approve it can I still drive like if they approve it if they approve the Privileges yes M that's what it means if the court grants you privileges then okay um I just I I've never done any of this so yep um another thing I'd like to offer you is a um drug recognition experts evaluation um it's basically the same things that we did out there on the scene um but they just look for a couple other things or you willing to do that if I can get a hold of one I would rather just go home rather just go home I've had a long day I got you um so go wherever she tells you to go while I fill out the paperwork um and then you don't have your phone on you how are we going to get a hold of someone to come get you um I I know um you know some phone numbers I know some phone numbers yes okay well if she'll let you call someone then you're more than welcome to do that okay okay all right leave that in there for now cuz we leave that in there okay and then um we can make a couple calls and see if we can get you a ride okay okay okay all right right this way okay I'm going to go fill all this out in my car it'll be easier then not a problem [Music] Jade would go on to be arrested again for OVI only two days later despite her license suspension court records for this particular case indicate that Jade was found guilty in September of 2023 and given a suspended jail sentence of 30 days her license was suspended for 365 days and she was required to pay pay a total of $722 in fines
