Hey, >> you have a license registration choice? >> Yeah, I have my license right here. >> Where you coming from? >> Um, I'm coming from the bar. I'm coming from Point Pleasant. >> Point Pleasant? >> Yeah, Jen's bar. >> Okay. >> Is your registration? >> Registration insurance. >> This isn't my car. This is my friend's car. >> Whose car is this? This is my friend's registration. >> Who's your friend? >> Should be Kelly Hickey. I'm her son. >> You're her son. >> Yes, sir. >> Okay. >> I'm Where you heading to? >> Around 13 a.m. on August 25th, 2024, Officer Andrew Gargaloney with the Mantaloking Police Department was on patrol on Ocean Avenue and he observed a southbound silver 2006 Toyota Highlander speeding. As followed the vehicle, he observed the driver swerving and failing to stay in the lane. He activated his emergency lights to initiate a traffic stop and the driver pulled over. He notified dispatch about the traffic stop and made contact with the driver who was identified as 22year-old Diona. >> Going to Jackson. >> Jackson. >> Yeah. >> Who lives in Jackson? >> Both of us. >> Okay. All right, you take this back. You can take that. >> Was the >> You were driving erratically all over the road and you were speeding. >> Speeding. >> Okay. And you >> Metro. >> I was c trying to catch up to you. >> I was going 65. >> 65. >> On 65 on what? >> 35. >> 35 on what road? >> This road. >> So you don't need the registry. >> No, I got it. You have two copies. >> Okay. >> So, >> here. This is all good, too. >> Thank you. >> And then I'll be right with you. All right. >> Thank you. >> Thank you, sir. >> No problem. As he approached Diona, he detected the odor of alcohol. Diona was asked for her documents and she provided them without issue. She told officer Gargaloney that she had left Jinx Club in Point Pleasant Beach and that she was headed home based on his suspicion of impairment. Diona was eventually asked to perform field sobriety exercises after another officer arrived on scene to assist. >> My clothes are so inappropriate. >> Should I back up? >> Yeah. >> Yeah. Get her over here. >> Yeah. You want to just go to that officer? All right, Diona. Is that Is that how you say your name? Da. Sorry about that. >> Yeah, that's okay. All right, Dion, I'm going to run you through a series of tests. >> I'm I'm so sorry. I don't mean to be inappropriate. I >> Yeah, >> don't worry about it. Don't worry about it. >> Uh I'm going to run you through a series test. Make sure you're okay to drive, right? >> No, totally. >> Um so the first test, it's going to be >> Officer Gargaloney started with the walk and turn test, and Diona did not touch heel to toe on each step while failing to keep her arms at her sides. The final exercise was the walk and turn test. Diona was unable to raise her foot in the proper fashion and the test was terminated for safety reasons. >> A walk and turn. So we're going to use >> we're going to use this line right here. >> Yeah, that's okay. >> It gives you like a guide. So if you want to stand on that >> Yeah. Yeah. >> Yeah. >> If you want to stand on that line, you want to back up a little to your car. >> Oh, okay. >> So you give yourself more room. >> This actually isn't my car, but >> Oh, well your friend's car. So you're going to stand like this with one foot in front of the other with your hands on your side and I'm going to explain to you the instructions. Okay. >> So if you want to get like that right now, one foot in front of the other. Hands by your side. Okay. So what you're then going to do is you're going to take nine heel totoe steps on this line. So I'm going to demonstrate it. Okay. So it's going to be one, two, three. Not yet. Don't start until I'm sorry. >> All good. All good. So, it's going to be one, two, three heel to toe steps. >> Yeah. >> Okay. On that ninth step, you're going to take a series of small steps. Turn around and go one, two, three, nine steps back. >> So, count to nine and then count to three. >> No, count to nine. Count to nine. I did three. You're then do nine. All right. >> Okay. So, I just did three for demonstration. >> I got you. >> But you then count to nine, count to nine. >> Nine. Nine. >> Heel toe. That was nice. >> Okay. >> Do I? >> No. No. That's it. >> Nope. So the next tasks, put your feet together, hands by your side. Then whatever foot of your choosing, you're going to lift up one foot about 6 in above the above the ground. Okay? And then you then count 1 1,00 2 1,000 3 100. You then you got a question. >> I wish I knew 1,00. >> Okay. You can do 1 100. >> I'm a psychology major. I'm not good at math. >> Okay. >> I can I can b I was a cheerleader though. I was a cheerleader. >> You can pick whatever foot. >> I can I am really good with Alice. >> Okay, let me demonstrate it first. Okay, so you're going to stand right there. Hands by your side. Hands by your side. And you then count 1 1,00 2 100 3 100. You You're then stay at the ball of your foot. Okay, >> listen. I'm >> Hands by your side. Hands by your side. >> I'm going to tell you right now, I am not good at math. I can't count in any sense. But I can give you balance. I >> Okay, perfect. >> I was a cheerleader my entire life. >> I am really I'm always athletic >> and I am very responsible. >> Okay. You don't start yet. >> Right now. >> No, I I'm I'm telling you. I'm telling you. >> Okay. >> I >> Yeah. Yeah. Don't start yet. Ready? >> I give you balance. >> That's perfect. That's what I'm asking for. >> I can give you Can you stand over here for a second? I don't >> I don't want traffic to go. >> So, ready? Yeah. Go ahead. >> Hands by your side. >> Yeah. >> You lift whatever leg whatever leg up of your choosing. >> Do you want me to do left or right? >> Whatever leg you want. Ready? You then stand up until I tell you to stop. So, it's going to be 1 1000 2 1 1000. You're then stare at the ball of your foot right there. >> Okay. >> It's about 6 in above the ground. >> You may begin whenever you want. >> Do you understand? >> I just I don't know what sinks. I don't It just >> is. Okay. It's like a dollar bill or like a soda can. >> Okay. Do you get it? Okay, >> I can do that. >> Okay, you can begin whenever you want. >> I want you to count out loud, too. Okay. >> One, two, three, four. >> All right, we're not doing this again. >> Based on her erratic driving, the odor of alcohol, and [snorts] her inability to satisfactory complete the field sobriety exercises, Diona was placed under arrest. After she was placed under arrest, her vehicle was impounded for a 12-hour hold according to John's law. Officer Gargaloney transported Diona to the Mantalooking Police Department for further processing. At the station, she was read statement for motor vehicle operators and she agreed to submit breath samples. >> Six. >> All right. Seven. >> Put your hands behind your back. >> Yeah. 24. >> You know why you're getting locked up? >> Suspicion of >> DUI.
