all right can I see your license insurance registration I just got a new one in the mail okay all right you said you got a new registration in the mail yeah that's the big one I usually cut them out and around 11:58 p.m. on July 2nd 2024 officer Thomas Gallow with the Bridgewater Police Department observed a gray 2016 Infinity being driven in an erratic manner on Route 22 West near Buffalo Wild Rings he activated his emergency lights to initiate a traffic stop and the driver pulled over near the exit ramp to us 2002 and 206 he informed dis patch and made contact with the driver who was identified as Kelsey put that in here okay from yeah Progressive all right well this is your uh Insurance um you said you have that new registration all right so this is your insurance card insurance card regra so that's the reason why I'm uh pulling you over is you have expired registration hav expired registration it's expired well y Ian I mean obviously that's the answer is expired yeah where to interact with Kelsey he noticed sign signs of impairment he asked Kelsey where she was coming from and she gave him seemingly contradictory accounts of where she was headed she initially denied consuming any alcohol before operating a motor vehicle but she would later admit to having a glass of wine earlier based on their suspicion of impairment Kelsey was asked to exit the vehicle and perform field sobriety exercises officers Noah lot and arur Gonzalez also arrived on scene to assist um the the only reason I asked cuz we had a call someone driving the wrong way on the highway in a car massenger description it wasn't you no if I was dri no I wouldn't drive no all right you said you're coming from home right yes I was coming from suo okay you you weren't coming from work no I'm still in my work clth obviously yeah that's why I'm asking yeah okay no I didn't have a chance to change okay you didn't stop at home or anything like that or you came in from work no I was I I went home and then I left so come there okay all right but you didn't you weren't at Buffalo Wild Wings or anything or no you didn't have anything to drink or anything like that no and there is literally I got stopped at Chipotle one time for some girl that lives in Bridgewater they're like oh you're she's a cheerleader coach or something and they think I looked just like I swear to God I swear it that's why they stopped you cuz you looked like somebody no I swear to God I've gotten stopped at Chipotle I should stop talking but no I did not you like I'm I'm like I'm so tired okay what time did you start work today I started work at 11:00 okay what time did you get off I got off at 7:00 oh wow so that's the overnight uh yeah it it was not it was not an overnight no but it was a late night late night okay all right we didn't have anything to drink today or anything like that no okay you smell anything on a little strange get off to work at 7:00 and then 12:00 a.m. and St home right I barely heard didn't she say she was coming from home a yeah I don't know allet I think they cleared unless they just pulled someone over there they were clear by the time you stopped this car really flippy floppies on all right well I had flip flop on all right am I doing a Feld variety test where we just going just going to talk for a minute do you mind just kind of standing a little bit closer that's okay Officer all it started with the horizontal gazm hgm test the second exercise was the walk and turn test during the walk and turn test Kelsey failed to remain in the starting position and the test was unable to be completed satisfactorily due to her lack of cooperation the final exercise they attempted was the one leg stand test and Kelsey failed to follow instructions once again so I'm just trying to figure out your story here you got off of work at 700 yes and I went home and then I left and I was going to my friend's house because I wanted to leave okay you wanted to leave turn around based on her muratic driving the the odor of alcohol her admission to consuming alcohol earlier and her inability to complete the field sobriety Kelsey was placed under arrest after she was placed under arrest her vehicle was impounded for a 12-hour hold according to John's law officer Gallow transported Kelsey to the Bridgewater Police Department for further processing at the station he read her the standard statement for motor vehicle operators and she agreed to submit breath samples you're fine it's done it's done right do you have anything in your pockets number by that arrested for driving while intoxicated the all requires you to submit samples of your breath for the purpose of testing to determine alcohol content a record of the taking of the breath samples including the test results will be made upon your request a copy of that record will be made available to you after you have provided samples of your breath for texting you have the right at your own expense to have a person or position of your own selection make independent samples of your breath blood or urine for independent testing if you refuse to provide samples of your breath you will be issued a separate summon for the refusal a court may find you guilty of both the refusal and driving well intoxicated if a court finds you guilty of the refusal you will be subject to various penalties including license revocation of up to 20 years a fine of up to $22,000 installation of an ignition interlock and referral to an intoxicated driver Resource Center these penalties may be in addition to penalties imposed by the court for any other offense of which you are found guilty you have no legal right to have an attorney physician or anyone else present for the purpose of taking the breath samples you have no legal right to refuse to give or delay giving samples of your breath any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal to submit breath testing even if you agree to take the test but then do not follow my instructions do not perform properly perform the test or do not provide sufficient breath samples I will charge you with the refusal to submit breath testing I repeat the the law requires you to submit samples of your breath for testing will you submit samples of held liable for any civil damages or anything like that even if she drives someone else's car right yeah so by you signing this form you're accepting uh the liability so if someone else she gets in test results indicated a BAC of 0.30% comma which was almost four times the legal limit of 0.08% after they were finished process in Kelsey she was released to a sober adult pending her court appearance after he signed the potential liability warning on Kelsey's behalf officer Gallow issued Kelsey the following citations operating Under the Influence reckless driving careless driving in driving or parking an unregistered motor vehicle or she gets a ride she cannot drive no you don't you don't sign that line that's the so I wasn't even reading I was just reading yeah okay all right uh
