now was it you that rented it around 8:52 p.m on August 4th 2023 officer Victor Gonzalez with the Essex Fels Police Department observed a 2021 hindai sedan being driven without headlights he initiated contact with the driver and she was identified as Patricia he initiated contact with the driver and she was identified as Patricia as officer Gonzalez was speaking with Patricia he detected the odor of alcohol and noticed other indicators of impairment my insurance three Insurance yeah okay uh do you have your email on your phone your insurance company might have just sent you an email about it I mean mainstream sucks I've been trying to get in touch with him but no I did not get an email from them okay all right did the vehicle come with a registration at all like the documentation I [Applause] mean right there there it is thank Beau I was driving with no lights on yeah oh my I'm sorry where you coming from man' I live in espie in espie in cble mhm okay have you been drinking tonight no no okay where are you heading to I was going to my boyfriend's house your boyfriend's house mhm okay here hold on to that I just got to check your lights ride with you all right yeah go Ahad all stop all right ma'am uh can you just do me a favor and step out the vehicle for me for a second um I'm just getting a strong odor of an alcoholic beverage and your words are a little start I just want to make sure that you're not impaired to drive okay okay Patricia informed officer Gonzalez said she was driving a rental car she provided him with her driver's license and he returned to his patrol car to check her information based on his suspicion of impairment Patricia was asked to exit the vehicle and perform field sobriety exercises you can leave that there and then we're just going to walk right here's a flat uh walkway right there okay yes thank stay right there Perfect all right um do you have any head injuries or anything like that do you wear just glasses all the time all right um have you ever hurt your neck or your back or anything like that before okay no problem so the first test I'm going to do is just a horizontal gaze my stagis test is just check in your eyes that's all it is all right Officer Gonzalez started with the horizontal gaze nness hgm test the second exercise was the one leg stand test during the one leg stand test Patricia failed to raise her foot in the proper fashion while putting her foot down before the test was complete the final exercise was the walk and turn test during the walk and turn test Patricia did not touch Heel To Toe on each step turned improperly and failed to keep her arms at her sides uh let me know is that too bright for you is that like that's with your eyes all right so I'll just stand here is that better to consuming alcohol and her inability to satisfactory complete the field sobriety exercises officer galz placed Patricia under arrest for driving them to the influence after she was placed under arrest her vehicle was impounded by panic's Towing for a mandatory 12-hour hold under John's law officer Gonzalez transported Patricia to the Essex Fels Police Department for further processing please I have to you can't you're going to ruin my career I'm a social work okay ma'am but you're going to ruin my career ma' I'm not going to sit here and have on side of the road you're you're ma' listen we're going to go in we're going to do one more test all right is that going to go on my record it's a it's a motor vehicle sub it's a motor vehicle violation all right it's not criminal can I get in finished with processing her Patricia was released to her neighbor after she signed the potential liability warning form on Patricia's behalf Patricia was issued the following traffic itations operating Under the Influence refusal to submit to chemical test and refusal to use lighted lamps thank you're welcome watch we got to step right here oh and then we're going to go right up the stairs I said then we'll let you make phone calls okay there going to be no phone call okay we still have procedure that we have to go through if you want to um deny the test or refuse it okay but again we cuz this is New Jersey I don't like you okay this is the New Jersey attorney general standard statement for motor vehicle operators all right I just have to read this to you and then you can answer it all right you have been arrested for driving while intoxicated njsa 39450 the law requires you to submit samples of your breath for the purpose of testing to determine alcohol content a record of the taking of the breath samples including the test results will be made upon your request a copy of that record will be made available to you after you have provided samples of your breath for testing you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath blood or urine for independent testing if you've refused to provide samples of your breath you will be issued a separate summons for the refusal a court may find you guilty of both refusal and driving while intoxicated if a court finds you guilty of the refusal you will be subject to various penalties including licensed revocation of up to 20 years a fine of up to $2,000 installation of an ignition interlock and referral to an intoxicated driver Resource Center these penalties may be in addition to penalties imposed by the court for any other offense of which you are found guilty you have no legal right to have an attorney physician or anyone present for the purpose of taking the breath samples you have no legal right to refuse to give or delay giving samples of your breath any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal to submit to breath testing even if you agree to take the test but do not follow my instructions do not properly perform the test or do not provide sufficient breath samples I will charge you with refusal to submit breath testing I repeat the law requires you to submit samples of your breath for testing will you submit the samples of your breath no all right let me go print out a refusal I have to still put it through the system just so you know okay do that now you got the sheet all right for matter my career is gone my whole career is gone you understand do you understand yeah that's not necessarily true I work with children I know but like I said you're not a criminal it's not like you were charged with a 2C charge a criminal charge what's going to happen um well now uh you're probably going to have to go to court okay and then you uh you go through the court process and see you know what the judge or you anybody like that nobody so then you would have to uh stay in our uh cell for how long um I would have to get back to you on that cuz I'm going to have to pull the policy and see what the policy says cuz we don't have a number to base it off of usually we would have a breath lier to base it off of so I don't want to give you the wrong um the wrong information but I I'll can't home you live down so unfortunately uh unfortunately you can't because there's a law that was passed called John's law um that's the reason why the car had to be impounded um and pretty much what that states is anytime that you're in our custody Under the Influence then you have to be held based off of the numbers not cuz I didn't it yeah it doesn't work like that though you know what I mean so you you would still here in the morning after 9:00 a.m. to get the release first okay so I guess I can drop her in the morning yeah and then they um it's a rental vehicle after after oh good because somebody's coming to me for me at 8 yeah she's my neighbor upst last name but that's it's a a rental vehicle yeah so she needs she may need to copy of the rental agreement she couldn't find it but she has one she has one um so I told her that um so this is just this is the John's law in the state of New Jersey we are not allowed to just release anybody after we suspect them of driving Under the Influence somebody that comes to pick them up is acknowledging that they are responsible for them for 12 hours 12 hours not letting them drive for 12 hours so that's good okay and plus I'll kill her then you can come and arrest me for homicide all right um so I just need you to print your name your street address M and then just sign here stating that you're acknowledging that you're taking the individual under your care for the next 12 hours and by that I mean not letting her dry for 12 hours right you know I was getting the police station mhm mixed up with the little Post St oh the one down the road that way the I said the fire departments there I I never thought about where the police department a lot of people you want know what's funny when I was applying to become a police officer here like 10 years ago um I drove past this building four times before I realized it was the actual police department oh gosh and I lived here like going my I said wait a minute wait a minute I better check where this
