car park how you doing what are you driving to today my home so where where's home about a mile away around 8:49 p.m. on December 6th 2022 Red Bank police were dispatched to the site of a damaged motor vehicle on asbridge Avenue near the intersection with the Sunset Avenue they made contact with the driver 28-year-old julieana mik Meer the other officer had not administered a field sobriety test in a while so he radioed for another officer to do so but troman Shane Dingle subsequently responded to the scene to administer the field sobriety exercises okay do you wear glasses or anything no no I mean I wear contact okay can you see the tip of my pen here not this the pen yeah you can see the tip of the pen mhm I want you to follow that with your eyes your eyes only you understand my instructions mhm don't move your head just your eyes the first field sobriety exercise was the horizontal gaze nagus hgn test the second exercise was the walk and turn test and Juliana did not walk in a straight line or take the correct number of steps instructed the final exercise was the one like stand test and Julie in was swaying her arms for balance while nearly falling to the ground just lift your head up a little bit just continue St at the tip of the pen you see it mm yeah I wasn't sure to go to the okay all right can you just stand right here right here facing this direction mhm okay I want you to stand with your left foot in front of your right foot and your hands at your side you understand all right just get in the position with your left foot in front of your right foot hands at of pivot steps and turn around and take nine Heel To Toe steps back to this direction I want you to keep your hands at your side and count each step out loud remember try to keep a straight line and breath samples include including the test results will be made upon upon your request a copy of that record will be made available to you after you after you have provided samples of your breath for testing you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath blood or urine for independent testing if you refuse to provide samples of your breath you'll be issued a separate summons for the refusal a court may find you guilty of both refusal and driving wall intoxicated if the court finds you guilty of refusal you will be subject to various penalties including licensed reification of up to 20 years a fine of up to $2,000 installation of ignition interlock and referral to an intoxicated driver Resource Center these penalties may be an addition I to penalties imposed by the court for any other offense of which you are found guilty you have no legal right to an attorney physician or anyone else present for the purpose of taking the breath samples you have no legal right to refuse to give or delay giving samples of your breath any response from you that is ambiguous or conditional in any request to my request that you provide samples breath samples will be treated as a refusal to submit to breath testing even if you agree to the test but then do not follow my instructions do not properly perform 20-minute observation was unsuccessful because mouth alcohol was detected as a result the officers had to to start the 20-minute observation period and administer the test again um but someone could they're like guys came in here boasting lower numbers than you and they look like idiots because they were and you're coming in here like and like I feel like women are much more humble and I was like I want to have a workshop where women are empowered to like whether it's public speaking or confidence building interview preparing like whatever it is that women need to do in the workforce like
