okay I don't know I don't know here's my um all right listen let take a around 1206 a.m. on August 28 2022 officers Arthur dant Edward rho Brianna mariti and Sergeant Kyle berura with the Point Pleasant Beach Police Department were dispatched to the scene of a three car crash on Route 35 South near the intersection with mle Avenue the three vehicles included a 2009 Toyota Camry 200 6 Audi and 20177 Volkswagen Jetta officer Gant first made contact with the driver of the Audi while officer marchetti spoke with the driver of the Volkswagen the driver of the Audi told officer Gant that she was feeling pain as a result of the Collision she was evaluated by First Responders at the scene But ultimately decided to not go to the hospital Breath Right want take a seat in the car relax do you want me to call first aid for you to get out I think I should it's up to you I don't know you let me know they're volunteered they don't have to they not they don't charge you nothing like that they come out they check you out for free and then if you if they think and you feel that you want to go to the hospital you go get check out want you out there as well okay if you want to take a minute driver of the Toyota Camry who was later identified as Julia as he was speaking with Julia he detected the odor of alcohol and observed indicators of impairment when officer Gant spoke with Julia she told him that she had left her aunt's house at Rumson and that she was headed over to Lavalette when Julia was asked if she had consumed any alcohol earlier that evening she admitted to consuming three beers earlier that evening around 6: p.m based on their suspicion of impairment Julia was asked to perform field sobriety exercises e [Music] okay all right so leave your ant's house in Rumson having a barbecue go on a lavel that come to the intersection and look down for a second slam right in to the back C okay all right mhm um so I tiet unfortunately and you work at the Care Center on the final exercise which was the horizontal gaze nous hgm test and he told officer Gant that he detected 66 indicators of impairment the stand feet together arms at your sides okay I can hold he'll Pleasant Beach Police Department for further processing at the station she was read the standard statement for motor vehicle operators and refuse to submit breath samples put your hands behind your operating Under the Influence refusal to submit to chemical breath testing reckless driving careless driving and failure to possess driver registration step forth hang on a second SP spots here sh to blood or urine doing this I'm not doing this I I still have to read them to you I'll read that number again after you are provided samples of your breath for testing you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath blood or urine for independent testing if you refuse to provide samples of your breath you'll be issued a separate summons for the refusal a court may find you guilty of both refusal and driving while intoxicated if a court finds you guilty of the refusal you'll be subject to various penalties including licens revocation of up to 20 years a fine of up to $2,000 installation of a ignition interlock and referral to an intoxicated driver Resource Center can I just like pay please let me finish these penalties may be in addition to penalties imposed by the court for any other offense of which you were found guilty you have no legal right to have an attorney physician or anyone else present for the purpose of taking the breath samples you have no legal right to refuse to give or delay giving samples your breath any response from you that is ambiguous or conditional in any respect to my request that you provide breath samples will be treated as a refusal to submit to breath testing even if you agree to take the test but then do not follow my instructions do not properly perform the test or do not provide sufficient breath samples I will charge you with refusal to submit breath testing I repeat the law requires you to submit samples of your breath for testing will you submit to driving with a suspended license in Brick Township lavala at Tom's River and Brielle after this DWI arrest in Point Pleasant Beach all right if nobody calls or shows up like an hour we'll call again
