Um I'm just going to pat you down and put you in the back of my squad for warmth. Okay. I'm detaining you right now, but you're not under arrest at this point. Okay. You understand? Okay. I need you to be honest with me. Have you been drinking? No. Have you had anything to drink today since 4:00 a.m. when you I had one drink? Yes. Just one drink? Yes. Okay. All right. Come on. That doesn't change what we're doing right now. Is this cold? Okay. Just make sure the door's open. I can't put you in the front. I have to put it in the back. I do. Me, too. Oh my goodness. Oh god. See, now that you're inside the back of my squat, I can smell the alcohol more because I couldn't smell it in there, but I could smell it here. No, in the morning. Yes. Um, yes. I had a little bit to drink this morning. This morning? Yes, this morning. Okay. It shouldn't still be affecting you at like at 6:00 a.m. Girl, yes. Um, okay. What kind of things you going through? A lot. a lot. Um I was just kicked out of my mom's and um So who you staying with over and dogs? Oh, okay. So it's your own place. Yeah, it's my own place. But um yeah, I was just on my way home and you know um my grandma died from drinking and driving, so it's not, you know, my mom's always told me never do that. and um you know well yeah I want you to be safe on the road and I want everybody else to be safe on the road. Um but okay we're just we're going to wait for the other officer to get here. I understand I know I know just hold up. Okay. Oh I don't know how like standing in front of the this must be blocking the wind because it is completely standing here right now standing outside. Holy [ __ ] No, I know. And I respect you. I know you're doing, you know. Um, but I mean, I thought the car was abandoned. I I couldn't see anybody. I was looking around the parking lot because I'm like, did somebody go off wandering? That's a nice ass car. 2019. Shoot. No. But um, yeah. So, I've been I've been going through it honestly. Um, and my mom always told me, you know, never drink and drive. And what happened with your grandma? She got into an accident. Yeah. when my mom was 16. So my mom always showed us, you know, pictures and stuff and she's like, "This is what happens, you know." Yeah. And I was always like, you know, it's bad. Everybody feels like they're okay. I'm okay to drive. I'm okay to drive, right? But it's just not worth the But it wasn't even, you know, this was just I had a holiday party and, you know, I had a few drinks and I didn't eat. know that probably say that's why I'm throwing up and stuff. So, but you know what I mean? I'm not I'm not going to say that I wasn't cuz I was I was drinking this morning. Okay. So, I'm sorry. I mean, I couldn't smell it over there, but like now in close quarters, you kind of can. And yeah, and like I said, your eyes are just And here's the problem for me is that the risk of me saying, "Okay, well, I don't smell anything." But everything kind of is telling me you might be impaired is that if I don't further investigate it and I let you leave here and drive there and you get into an accident, that's on me. I respect I mean like I I love you for that. No, I understand. Make sure I understand what you're saying truthfully. I I understand. You know, I wouldn't say like I'm, you know, I mean, you'll figure it out eventually, but I wouldn't say I was shitfaced. No way. Is that what you're trying to get? No. All right. Hold on a second. Okay. Yeah. Go ahead. Well, the door was open and I couldn't see anybody. So, I'm looking around the parking lot and I drive around and I finally see him pop up. She's like feeling sick and I couldn't smell any alcohol. Like, that's pretty. But I just got this like feeling drink. I just got this feeling like I I just she can talk about a kofond. Why would I do that? So I checked her eyes and I was like I I can't she lives next to um uh what you call docs. Where she Oh, she's in the back of my spot cuz it's freezing on her. She's just I just told her she's I'm putting her back there for war and that she's not under arrest this morning, but she has eventually admitted to drinking. But this morning, I told her it wouldn't still be affecting her. I already did fields. Not good. [Applause] Huh? Oh, sure. My uh hand's frozen. I was trying to open it and my fingers are like It's much warmer over here. Okay. I'm so anxious. So, well, and I understand that. Have you ever been arrested before? No. Okay. No. I'm going to give you the opportunity to provide a breath sample. Okay. Okay. Okay. If you have not drank since 6:00 a.m. this morning and it was a few drinks, which I I'm not buying. Okay. Then you would blow under 008, you'd probably blow zeros. Okay. Your eyes tell me a lot. Your fields tell me a lot. Okay. Even if it's cold out, you know. No, I understand. I respect and I'm cooperating. I know you're going through a rough time. I'm not trying to make things worse for you, but Officer Zorbis then placed Bina inside the back of her patrol car as she waited for another officer to bring the portable breathalyzer. As she was speaking with her inside the patrol car, she detected the odor of alcohol. Bina agreed to submit to APBT and the result showed a back level of 0 to 30%. Which was nearly triple the legal limit of 0.08%. You know, you admit you were driving from Crystal Lake to here. Okay. [ __ ] [ __ ] So, do you want to provide a breath sample? Yes. Okay. Go ahead and blow like you're blowing up a balloon. Deep lung breath. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Keep going. Okay. Okay. step out. Okay. Now, I know I asked you how many drinks you had. You blew a 230 right now. You know how many drinks that is? No. It's a lot of drinks. Okay. Based on the odor of alcohol, her indicators of impairment, her admission to consuming alcohol earlier that day, her inability to adequately perform the field sobriety exercises, and the results of the PBT. Officer Zorbis placed Brina under arrest for driving under the influence. She was handcuffed, placed in the patrol car, and transported to the Wakanda Police Department for further processing. So, I'm going to place you under arrest right now for driving while under the influence. I did not observe any PC of your driving, but you did admit to driving from Crystal Lake to here. Okay. 113 and you wanted me to follow you home, which would have put both of both me and you at risk as well as people on the road. Okay. Relax your hands. Okay, stop here. Relax your hands. Don't link them together. Did you need a second? Negative. We'll get a kid playing with the phone. You got anything in the car? You need my phone? Just your your phone and your purse? I don't even know if it's open, but it would be from Are those perfumes? Okay. Are those what I think they are? I thought I was like, "Oh my god, very sweet." But I was just looking for car keys before we Maybe they're to push to start. Yeah. Here. Yeah. Maybe I did a bad job. Maybe I did. Try again. Yeah. The butter. [Music] Okay, that's why she wanted me to shut the car off. She's got very low fuel. Got bottles. [Music] It's just not really anything in here. Where's the key hiding? Maybe it's underneath the seat. [Music] You know, I was just on my way to get some. That's interesting. Okay. [Applause] It's a It's a weird place to hang them, right? Yeah. Um, can you just Yeah. Give me the She's got a house key on there, I think. I really did not want to be doing this right now. It makes you feel better. I'm going to be here late, too. 230. Her breath samples indicated a back level of 0.197% which was still more than double the legal limit of 0.08%. 350 hit and run delayed from 8:00 p.m. 652 Clover Road, 662 Clover. The victim vehicle is a Nissan Titan black color. They're checking your camera. The offending vehicle. They believe it was the neighbor. Okay, go ahead and stop. All right. Just walk forward there. Honestly, you'll you'll be processed here. You'll get a couple tickets. Okay. You'll have to pay for it. You'll have to go to court. Okay. Um, you can try and plea it down from a DUI to reckless. I'm not sure. I mean, you don't have a prior history. So, if you don't have prior history, then that works in your favor. Okay. Um, so what what do I do? But don't ever ever ever drink and drive again because then you're really going to start getting in trouble. You know what I mean? And it gets very expensive. Well, what do I do like to not get this on my record? I don't want this on my record. Cuz if my mom finds out, I swear to God, when you swear to God, if my mom when you go to court, that's when you'll have to work to see if there's any way to keep it off your record. And what that means is that you will have to work with an attorney to try and get it put down. Okay. So, I'm going to have to see a lawyer, basically. I would recommend it. Yeah. I mean, I can't tell you one way or the other, but do I have to get a lawyer? Not at all. Or should I? And if you can't afford one, you can get a public defender. You know, should I just You can always request a public defender as well. Okay. Um, let's just get through this part. Okay. Okay. You'll have you'll know. I know. I know. You'll have You'll have a while before you have to Someone's taking me home. Well, typically nobody. you have to like find a ride. I would consider bringing you home, but I'm I'm not sure. Literally probably them for sterile, you know, like easy to clean, right? Like the jail cells all metal. If you think about it, people are in here like that have raped people and like killed people, you know? Um Yeah, you were saying my mom was telling me that there were cops that would follow her home. Oh, that was a different time because it was back in the day. Yeah. I mean, I remember my dad who would have been 90 if he was still alive, handed like in his 20s in Chicago, handed somebody a driver's license and a $5 or $20 bill in order to not get ticketed. Like, so yeah, different time for sure. So, she's like there, you know, and I'm like, no, it's not always going to be like that. But the the cop knew her, so he, you know, he followed her home. Yeah, except the problem here, right? Imagine I follow you home and not even by any fault of your own, there's an accident that occurs. You're DUI, so it would still end up being your fault, you know. Yes, you were arrested for DUI, but you still listen to me. Listen, you were you were arrested for DUI. You will have courts. You have not yet been convicted of DUI. Okay? Do you understand me? Do you understand me? Say huh? [Music] I can't. I can't. This I can't. Hold on one second. Okay. [Music] Yeah.
