1st 2023 patrolman Jacob Paris with the Magnolia Police Department observed the driver of a 1996 Toyota Corolla swerving on White Horse Pike in the vicinity of Cooper Town Road as the vehicle was headed southbound as he followed the vehicle the driver continued to swerve and nearly struck a bus he activated his emergency lights to initiate a traffic stop and the driver pulled over on white hor Pike near Park Avenue in the neighboring town of Summerdale all right what's your first name again GI GA okay hello how are you Hi how are you good I'm Patrol in Paris my night Police Department this 20-year-old Gianna and patrolman Paris told he observed her swerving across PL Gianna told the officer that she did not have a valid driver's license butran Paris detected the odor of alcohol and observed other indicators of impairment she told the officer that they were headed to her boyfriend's mother's house and initially denied consuming any alcohol before operating a motor vehicle however she would later admit to taking shots of bicardi earlier that evening or is he good no he's good I think he's just okay well cuz I kept asking for documents and hand me over his birth certificate and stuff I have it I got one I got his idea he I want to see up all right just sit tight for me okay he's been drinking I don't know she say she has she the reason why I stopped was saring all over the road she doesn't have a driver I have a question for you guys though up so um so I had a permit and I don't have a i it's just out of yeah valid driver's license so what is that going to be is that going to be a point on my license you're going to get you're going to be getting 310 driving without a driver's license so I won't be able to get until when U what do you mean your driver's license there if not you're good to go right what you going drive to any based on the officer suspicion of impairment Gianna was asked to exit the vehicle and perform field subb exercises after patrolman brick wils arrived on scene the first exercise was the horizontal gaze nagus hgn test during the hgn test patrolman wils observed the lack of smooth Pursuit distinct and sustained nystagmus at maximum deviation and the onset of nystagmus prior to 45° the second exercise was the walk and turn test during the walk and turn test Gianna failed to touch he two toe on each step and turned improperly the third exercise was the one leg stand test and Gianna failed to raise her foot in the proper fashion and counted in an incorrect sequence the final exercise was the recitation of the alphabet from C to Y and Gianna failed to complete this test adequately pull with whatever the test staying with your feet together just like this with your hands to your side right first test we're going to do is we're the field sobriety exercises patrolman Paris placed Gianna under arrest for driving under the influence the vehicle that she had been driving was impounded for a mandatory 12-hour hold under John's law she was transported to the Magnolia Police Department for further processing so just put your hands on your back he's going to put you hand cuffs um wait can I tell him first we'll tell him we'll tell him okay we'll tell him cuz we got to search the car so we put your you're literally probably going to be in here for what up you want put your shoes on real quick what's that in your hand dude [Music] 1.1 at the Magnolia Police Department Gianna was read the standard statement for motor vehicle operators and agreed to submit breath samples for testing her Alco test results indicated a back of 0.12% which was above legal limit of 0.08% and 12 times New Jersey's legal limit of 0.01% for drivers under 21 years of age after the officers were finished with their paperwork Gianna eventually released to a sober adult after she signed the potential Shi lady warning form on Gianna's behalf she was issued the following summonses operating under the influence uence operating a motor vehicle after consuming alcohol underage reckless driving careless driving failure to wear seat belt driving without a license failure to have inspection failure to possess driver insurance card traffic on Mark lanes and traffic on Mark Lanes unsafe Lane change all right we're going to go straight to the stairs back there okay okay I'll help you get up so we don't trip all right just stand on this last 106 so 12 hours 106 p.m. today later on in the afternoon you'll be able to pick up the car from Magno Auto at work from 96 yeah um you pick it up whenever but if when you before you release you come here um we'll give you property release form for the vehicle and then you go to mag Auto with all that stuff need a pen I don't know where everything's got ransacked TR to print my name too no no yep just a signature I have all your stuff in here and we'll give you a copy to bring with you court records indicate that on May 14th 2024 Gianna was found guilty of operating Under the Influence and failure to possess driver insurance card as a result of being found guilty Gian has had to use an ignition interlock device for 3 months spend 12 hours at an intoxicated driver resource center and pay a total of $723 in fines the other eight citations were dismissed as part of a plea agreement you got your phone and all that okay is ours [Music] they good yep all right that's it for now all right
