South Kingstown Police Department was headed eastbound on Main Street and he observed a black Toyota Forerunner turned erratically from Robinson Street onto Main Street the vehicle then struck a sign on the double yellow line and drove westbound through empty parking spaces on Main Street after the driver passed his patrol car Sergeant Marlo made a u-turn and activated his emergency lights to initiate a traffic stop the driver stopped on Main Street in front of the Paul Massi Chevrolet dealership the officer made contact with the driver who was identified as [Applause] Donna Hi how are you good you how you do sorry just the dog is fine okay just is it know changes um do you have your license and registration I actually shut your car off okay I was looking for my passport my license um the that's stolen but I have my license number I can give you that do you have anything with your name at all I was looking for my pass but I don't I don't see anything can you find my my license number my name is D let me get a where's your license at of what state what island I'm I grew up in town okay what's your license number and it's d o n n a yes what's your date of birth and where are you coming from right now I am coming from buying pies at Sunset p and then we're going to Right Out Post Road to eat dinner at our okay how much have you had to drink none nothing at all absolutely I'll be right back okay he just my here okay Donna told the officer that she was coming from Sunset Farm but denied consuming any alcohol he noticed that Donna's movements appeared sluggish and her eyelids appeared droopy Donna was unable to provide the officer with a license based upon his suspicion of impairment Donna was asked to perform field sobriety exercises do you have any paperwork for the car cuz nothing's coming back on the tag a registration yeah right here she doesn't I own the car she driving it for me so okay it's just when I when I run it nothing came back that's why I was asking it's I puppy it's okay I don't have any nail tags and the tags yeah but that's what me so when I run the tags nothing came back I have it I just don't my my nails AR growing right now so to gra test during the walk and turn test Donna did not touch Heel To Toe on each step and took an incorrect number of steps the third exercise was the one leg stand test during the one leg stand test DNA failed to raise her foot in the proper fashion and put her foot down after approximately 20 seconds the final field sobriety exercise was a finger count test I'm going to check your eyes okay so what I want you to do can you see the tip of my finger mm I want you to follow my fingertip with just your eyes and don't move your head okay I'm going to turn have you turn this way a little bit cuz that I can't see your eyes turn and face me oh we're going to start again yeah right there Perfect all right ready watch just my fingertip mhm so you you can't walk normal is what you're telling me yeah I actually yeah not a drinker did you smell it at all I didn't I didn't get a big whiff of anything really she alled up she's had some possession of schedule 1 through five her pupils are constricted which is usually an indicator calling samd yeah yeah I I have a feeling I have a feeling it's going to be drugs not alcohol Nara got her in 2017 for drugs they got her in 2012 for a DUI she's been arrested a bunch of times you think they have drugs in the car I don't think so when you were standing at the driver's window what was the passenger doing with the head the um wind visor they were looking for the registration okay cuz it looked like she stuffed something up in the she may have I was watching the other lady she got a lot of shoplet things oops tyi and 2015 from Warwick ton of shopliftings really ton the hell is she doing here she said she grew up here she's from what's your name d overdose in 2022 okay here we go she's probably just yeah she's um there's there's definitely something up once I give her the PBT I'm going to give her a couple different tests to see if maybe it's drug related du3 I hate when car stuff doesn't come back do you want to see if the passenger they usually don't like the police in California yeah Sergeant Marley returned to his patrol car and looked through Donna's information a search of the system yielded multiple prior arrests including at least a prior du is in Rhode Island after checking her information Sergeant maror called for another officer to bring the PBT device so that she could take a portable breathalyzer test Donna was uncooperative and she failed to properly blow into the device p in my just case you want to can I li back yeah I'll give it back to you I have the test are you willing to take it come on now calibrated yes ma'am okay I just want to make test it and calibrated you can just stand over here so you're out of the road I was just calling him cuz I worked for him and he would tell you I don't complete the field sobriety exercises her inability to complete the PBT test and her history of Prior arrests and doers Sergeant maror placed Donna under arrest for driving Under the Influence Donna was secured in the patrol car at for 11:00 p.m. and transported to the South Kingstown Police Department at for 21 p.m. for further processing okay you're under ARR turn around put your hands behind please anying mileage 30673 seven3 at the station Donna was read the implied consent notice and at for 46 p.m. she refused to submit blood samples for testing Donna was presented before Justice of the Peace Tom O Brien and released at 7:10 p.m. pending her court appearance on December 4th 2023 Sergeant maror issued Donna the following citations DUI refusal to submit to chemical test manner of
