a.m. on September 21st 2024 patrolman Shan Brandt with the Summerdale Police Department observed the driver of a 2015 Jeep driving at a high rate of speed on War Road in the vicinity of Preston Avenue the vehicle also appeared to be tailgating the vehicle in front but she was actually following her father's vehicle as they were headed home he began pursuing the vehicle and initiated a traffic stop at War Road and elener Avenue in the neighboring town of traford the driver pulled over and the vehicle she was following stopped in front of that car patrolman Briant contact with the driver who was identified as 20-year-old Leela did you have your registration card your I didn't print it out but I did have it like re I did pay for it ahead of time so I just log in Leela told patroman Bryant that she was coming from a wedding and that she was headed home as he was speaking with Leela he detected the odor of alcohol based on his suspicion of impairment lelu was asked to exit the vehicle and perform field sobriety exercises all right of course yeah turn your hazards off yeah and then if if you find it just put them back on all right yeah hello sir be 31 turns up found it so yes I have this insurance up and then I can p up the insance yeah that's good all right do favor I'm just going to have you step out all right I smell alcohol from your breath I just want to make sure you're get completed the second exercise was the walk and turn test during the walk and turn test Leela failed to touch Heel To Toe on each step took an incorrect number of steps and turned improperly the final exercise was the one leg stand test and Leela failed to raise her foot in the proper fashion while placing her foot down before the test was [Music] [Applause] complete don't move your head just try to consuming to drinks earlier that evening based on her erratic driving the odor of alcohol her admission to consuming alcohol and her in ability to adequately complete the field sobriety exercises patrolman Bryant placed Leela under arrest for driving under the influence the vehicle that she had been driving was impounded for a mandatory 12-hour hold under John's law instead of the Summerdale Police Department leelo was transported to the statford police department for further processing under arrest correct for driving while intoxicated we still have another test to do okay all right we'll go down to the station and we'll go from there right I'll C you in the front since you're I'll go and talk to your dad okay all right we're just going to do one more test that's comfortable you all right I'm going put them on to walk out to my car all right [Applause] are you from Jersey or now no well we live here now but I'm from Fey how long you been in Jersey like 2 years so like 10th In The Box should be no more than 30 minutes 40 minutes um I'll probably take her to straford Police Department to run the test and then she'll get released in 40 minutes you want to meet us down there and about a half hour 45 minutes I can release her to you yeah yeah I'll do that um the car you guys taking it the car's got to be impounded for 12 hours because of John John's law we don't want her driving because we are releasing her so tomorrow around where my watches off 12:00 you'll be able to pick up the vehicle all right but we have to un pound it just because of the scenario all right uh I haven't explained it to her yet but she it's only traffic in New Jersey you guys from PA no I live around the corner actually she she's just growing stud ow yeah but I live right around the purpose of testing to determinate alcohol content a record of taking of breath samples including the test results will be made upon your request a copy of that record will be made available to you after you provided samples of your breath for testing you have the right at your own expense to have a person or physician of your own selection to take independent samples of your breath blood or urine for independent testing if you refuse to provide samples of your breath you'll be issued a separate summon for refusal a court may find you guilty of both refusal and driving law intoxicated if a court finds you guilty of refusal you'll be subject to various P including a license revocation up to 20 years a fine up $2,000 installation of an ignition interlock and refer to intoxicated driver's Resource Center these penalties may be in addition to penalties and opposed by the courts for any other offenses you are found guilty you have no legal right to have attorney physician or anyone else present for the purpose of taking of breath samples you have no legal right to refuse to give or delay giving samples of your breath any response from you that ambiguous or conditional in any respect to my request that you provide samples of your breath will be treated as a will be treated as a refusal to submit the breath testing even if you agree to take the test but then do not follow my instructions do not properly perform test or do not provide sufficient breath samples I will charge you with refusal to submit the breath testing I repeat the law requires you to submit 8th at run and me courts she has three tickets um DWI reckless driving and a failure maintain Lane um as far as the tickets it's one or none it's not like she's going to get all of those tickets it's just one or none and you don't need a lawyer for the first hearing your judge is going to talk to you and ask you how you're going to proceed so you just need to show up so don't think you need to rush and do all that all right uh the car was to to Wayne's Auto tomorrow at noon you can get the vehicle out of Mound do you have any questions um so as far as um her license she's going to get points off before transporting her to the statford police department patrolman Bryant read Leela the standard statement for motor vehicle operators Leela agreed to submit breath samples for testing her Alco test results indicated a back of of 0.15% which was almost double the legal limit of 0.08% for drivers over 21 and 15 times the legal limit of 0.01% for drivers under 21 after Leela was processed patrolman Bryant gave Leela a ride home and released her to her mother after she signed the potential Shar lady warning form on Leela's behalf Leela was issued the following summonses operating Under the Influence reckless driving careless driving and failure to maintain Lane um no points off like like where they like she gets in trouble and if you get a certain amount of points or they uh you so with DWI now they stop doing the she'll hit points on her license if she gets the reckless driving but if she gets DWI they just do an aition in a lock now I think and that's it I don't even think they spend their life anymore they just do the an walk so I don't know it's been a while for me but okay all right thank you all good lat thank you all right take care from
