from tonight um around 7:05 p.m. on March 7th 2024 patrolman Daniel kirkbride with the Magnolia Police Department observe the driver of a 2005 Hyundai Elantra swerving on white horike as they were approaching eam road before running a red light at the intersection based on the traffic infraction he activated his emergency lights to initiate a traffic stop the driver pulled over on W Evergreen Avenue in the neighboring town of Summerdale the town over actually what what's that town um all right you have your L frustration insurance can you make more what's that no I said um that it's actually all good on my car but if I don't have some documents like that's probably going to be a bigger problem right now there were like I I everything is actually okay like um I so okay do you have 29-year-old Alyssa and patrolman kirkbride asked for her documents he detected the odor of alcohol inside the vehicle as he was speaking with her and Alysa was unable to provide her documents based on his suspicion of impairment he called for patrolman brick wheells to come on scene and administer field sobriety exercises what you got all right uh ran the light at e sham and uh the pike ran the light at eam or the Pike and Cooper Town came up smell it it's a it's a she she opened up the door she's slurring um go just do Fields all right how you doing ma'am um you got anything to drink tonight do you know your ABCs I do can you roll the window down all the way for me please yeah thank you do you know your ABCs I do can you tell me the ABCs from C to Y without singing them um are you the alphabet in the correct sequence based on their suspicion of imp parent Alysa was asked toit the vehicle and perform field sobriety exercises despite the officer's request aist ultimately refused the her Maranda read the implied consent firstand if she agrees to you know ask questions or the questionnaire just follow follow that all right by the time I get back you should be close to yeah Department Alysa was read the standard statement for motor vehicle operators and she refused to submit breath samples for testing she also refused to answer questions after the officers were finished with their paperwork Alysa eventually released to a sober adult after he signed the potential Sher warning form on Alyssa's behalf she was issued the following summonses operating Under the Influence refusal to submit to chemical test reckless driving careless driving failure to possess driver license failure to possess driver registration failure to possess driver insurance card traffic on Mark Lanes stop at failed traffic light and open container you just going follow go wish I go to that door over [Music] there just watch the curb and just watch these steps you're going to go straight in and then just make a right here and then go right and then make another right right here right here behind you okay all right you just going s that W you can just stand up going to take this handcuff I'm about to read you is the uh impli consent form you can take a copy and I'll read it off to you all right so number one you have been arrested for drinking while intoxicated the law requires you to samples of your breath for a purpose of testing to determine aloh content a record of the taking of the breast samples include the test results will be made upon your request a copy of the record will be made available to you after you have provided samples of your breath for testing you have the right at your own expense to have a person or a physician of your own selection to take independent samples of your breath blood or urine for independent testing if you refuse to provide samples of your breath you will be issued a separate summon for the refusal a court may find you guilty of both refusal and drinking or and driving while intoxicated if a court finds you guilty of the refusal you will be subject to various penalties including licensed ruction of up to 20 years a fine up to $2,000 installation of an ignition inter loock and a refusal of an inoxia driver recourse Center these penalties may be in addition to penalties imposed by the court for any other offense which you are found guilty you have you have no Regal light you have no legal right to have an attorney physician or anyone else present for the purpose of taking the breath samples you have no legal right to refuse to give or delay giving samples of your breath any response from you that is Amber ambiguous and can help me out here and and conditional or conditional in any respect to May to my request that you provide breath samples will be treated as a refusal to submit to breath testing even if you agree to the the test but then you do not follow my instructions do not properly perform the test or do not provide sufficient breath samples I will charge you with a refusal to to submit a to breath testing can't read I repeat the law requires you to submit samples of your breath for testing will you submit the samples for other your breath does it require me to go to jail I so state New Jersey you don't go to jail for DWI you get some this out yeah like I know I'm going to be [ __ ] but like not like his D I'm get locked up you're not going to jail once we finish the test the breath test will we'll call somebody pick you up call call a Transit no call like a friend or remember we have to I we can't just let you go after somebody's got to come pick you up and sign off for you I'm going to refuse to the breath lier and I can't guarantee somebody's going to come pick me up you got stay here for 12 hour I can't guarantee somebody's going to pick me up but if I do the breathalizer I'll still be stuck here for 12 hours didn't say that where he just read it though it's that's not in that what he read it's John's somebody's got to sign off for you and be and be responsible for you for 12 hours yeah maybe I'm can't guarantee it but I'm not doing the breathalizer but if somebody maybe can come pick me up I can still leave or I they have to sign off and they have to be sober yeah I can maybe find that all right so I repeat the law requires you to submit samples of your breath for testing will you submit for those samples of your breath okay I need a uh a verbal answer no okay your answer is not acceptable the LW requires you to submit samples of your breath for for breath testing if you don't if you do not answer or answer with anything other than yes I will charge you with refusal now I ask you again will you submit for breath testing no did you want to do the fields in here did you want do like the filter right tests in here out out of the street they all could have been the thing but I see what this is and already and don't waste anyone's time okay well you're not was you're actually protecting yourself more by deing stuff the read that yeah all right all right before I ask you any questions is my dude to advise you of your constitutional rights I'll give previously been arrested for DWI in barington New Jersey about a week earlier after causing a car crash her back level following that arrest was 0.16% which was double the legal limit she also has another DWI arrest in Haden Heights NJ from July 15th 2023 station yep do you know the address or you just going to Google it um I'm just going to Google it okay well we'll see you soon then all right
