Ay, record them touching me. >> Record them [ __ ] touching me again. >> Within a few minutes, officer now Sergeant John Ward arrived on scene. As he was speaking with Andrea, he observed signs of impairment. Andrea displayed a lack of balance, refused to follow lawful orders, and attempted to walk away from the officers multiple times. While Andrea was asked to perform field sobriety exercises, she was ultimately placed under arrest to her uncooperative nature and a suspicion of impairment. As officer Wart placed Andrea under arrest, her boyfriend recorded the officers and attempted to interfere with her arrest. Andrea began to resist by tensing her arms and body. She also kicked an officer as she was being placed in the patrol car. Her vehicle was impounded for a mandatory 12-hour hold under John's law, and she was eventually transported to the Ridgewood Police Department for further processing >> again. Look again. >> Let's go. >> See, back. >> Yo yo yo yo yo. >> What is >> What are you doing? Because I don't want to be arrested. Ay, they're hurting me. >> Yes, you are. >> Get the [ __ ] off of me. You're being filmed right now. >> I'M NOT I WASN'T resisting you. I told you to stop getting your hands off of me. >> Don't walk this way. >> Stop pushing me, not pushing me. Come on. When you're ready to go, we'll go. Come on. Just Come on, >> dude. I'm bleeding on my [ __ ] wrist. >> Come on. You're not cuz you're fighting it. >> I'm not fighting it. >> You're not bleeding. Okay. >> Ay, >> just check that practice. >> Ay, you got her. >> Yep. >> Yeah. You're videoing and and >> I'm calling my lawyer. >> Okay. Good for you. >> See this [ __ ] pot. >> Come on. >> See anything any and a bruise is all over me right now. >> You're resisting. Stop. >> I'm not resisting. >> You want to prove you're not resisting? Step in the car without us having to pull you. >> And what are you going to do? >> We're going to sit you in the car. >> What are you going to do? >> We're sitting you in the car. You're being detained. >> Come on. You're being detained. Sit in the car. Sit in the car. >> Detained for what? You did not read me my remainder rights. >> Your Miranda rights. >> Excuse me. Can you record this? They did not read me my Randa rights. because they have a bug up at their ass. They're they're cussing me. Put it all over. Call up. Call up. >> When you stop yelling, I will explain to you why you're being >> Oh, I wasn't yelling in the beginning. >> You're speaking over >> for Exactly. They won't say it because >> No, I'm not. >> See, he always has SOMETHING TO SEE. OW. YOU'RE HURTING ME. I'M BLEEDING. >> I'M BLEEDING. >> YES, YOU ARE. >> WHY are you detaining? >> It's none of your business. >> EXACTLY. NO, THERE ISN'T. There is no There is no right. That car has no You're hurting me. YOU'RE HURTING ME. SIT IN THE CAR. SIT IN THE CAR. >> YOU'RE HURTING ME. Get in the car. I'm bleeding. >> Babes, >> I'm not bleeding. >> Sit in the car. >> Babe, I have the car. Sit in the car. I'm calling my What's that going to do? >> They have We can [ __ ] fire. >> Come on. Get in the car. >> Okay. More manhandling. Away. Away. They just pushed me in here. >> Sit down. >> And they're DOING IT EVEN WORSE. [ __ ] YOU. WHY ARE YOU DOING THAT? >> THAT'S IT. >> DON'T KICK ME. >> WHY DID YOU PUSH ME? >> Now she's under arrest for aggravated assault against the police officer. >> And you got it on film. >> She was detained. >> All right. So, you're going to send that video to us because now you're a material witness. Okay. >> Okay. And I'm going to call my lawyer. >> Can I have your bag? >> I 143. >> Can I see? >> What's your ID? Give your ID. >> 143. What's your ID, buddy? >> Let's see your ID. Officer 242 in. >> There you go. >> And now your cell phone is a material witness. >> Okay. >> All right. Do you have ID on you? >> Yes. Okay. >> So, just so you know, if you if you eliminate that video, you could be charged with destruction of evidence. >> Well, >> because you just filmed a crime. >> A crime? She just kicked me off on your camera. >> Kicked you. >> Yeah, it was on your camera. >> No. >> Yeah. >> No. >> So, now you're a material in you guys literally [ __ ] grabbed her and dragged her reason. Don't >> Why would you even arrest her? >> Sir, let me explain something to you. Detain, sir. >> We don't have to explain anything to you, but I will give you the courtesy of that. Okay. I have reason to believe that she is under the influence of some kind of drugs or alcohol. Whether that may be true or not, that is my suspicion. She resisted, kicked me to do that. She was found in the law order. We were detaining her. She assaulted officer Ward. You have any other questions, come down to the police department. You need to speak with our supervisor. >> Yep. Okay. >> Where are you taking me? >> Bridgewood Police Department. She's under arrest. Do you have ID on you? >> Yes, I do. >> So, I'm going to ask you again. Have you taken anything tonight? >> No, I have not. >> Then we're going to run you through field and make sure you're okay to drive. >> It's it's uh it's an impact. >> You all right, man? >> Yes. >> Sorry. >> Okay. Uh 131 >> North North >> Maple Avenue. >> Um, where is that? >> Jersey. >> New Jersey. >> Okay. North 131. >> North Maple Avenue. >> North. >> She was. >> Yep. 53 central >> Richmond. >> Yeah. Richmond. >> Yeah. >> New Jersey, right? >> Yep. >> So, here's the deal. The car is getting impounded. >> Why? I drive. >> But it doesn't matter because we believe that she's under the influence of something. So, she's still charged. >> Are you the registered owner? >> She can't take her state law. >> She gives me permission. Nope. It's It's called John's law. They don't let somebody who's been under the influence and gets into an accident. Talking about her. Talking about her. If if her car if she's driving her car, nobody else can take it. We have to by law. >> All right. >> I can drive. >> I know you can, but you can't drive that car. >> All right. >> I don't understand this. This guy [ __ ] literally hit her. >> It doesn't matter. >> And now you're taking her in for what? We already told you, right? >> No. >> And you know, at bare minimum, she just kicked us. So that's one charge right there. >> Yeah. >> What are you doing? >> I want to hear what she said. >> Step away from the car because you know what? You tested my patience. >> I'm not here though. >> Don't go near that patrol car. Then don't go near that patrol car. >> I don't want to argue with you, but I think this is completely wrong with you. >> I agree. It's completely force. >> Then we got to be out here dealing with this right now. But two guys is that much putting back. >> Yeah, that's a chance. So, we're going to search the car until she's back in the She's search instrument to arrest, but she's back in the back of the car already. >> Just just based on operation based on the fact that she told us >> the wingspan. Just the wingspan. >> Okay. So, um operation. >> Watch your back too, Doug. >> Why is he Yeah, he just stayed. Don't let him do it. You want to run this? I ran a fat tire by >> Yeah. All right. So, uh, >> actually, let him stand right there. Stay with him. >> Yeah. >> And then search the car. >> Yeah. So, uh, obviously we have a car accident. >> Yes. >> Um, we get here, she told him that she doesn't remember how the damage got to her car, >> that she might have knotted off. >> Um, she's all over the place, not following instructions, kept trying to walk past us. We were trying to get her to do HGN. She wouldn't do that. Okay. >> And she was getting combative. She started trying to walk past us, told her to stop, stop a bunch of times, wouldn't do it at that point. I feel like one that based on her mental state operation and her statements that we apply >> and also to uh her uh obstruction of our ability to run our >> She's also refusing for the um the field sobriety test. That's a backard with all of this. So yeah, you have 24. And then um so she resisted arrest. >> Mhm. >> Um and uh she kicked me. >> She kicked her. Okay. >> Yeah. But yeah, those are all more charges. >> And then uh this guy, he was filming us. I told him that he actually got a good view of the kick on his camera. So I told him not to delete the tape that we might have take him as a witness to get the tape. >> Yeah. >> So >> yeah, he's allowed to film us. That's why you have your camera. >> But yeah, he might have a better view of her >> cuz he was like right on. Yeah. So, okay. >> If we were going to do that, how do how do we do it? Do we have give him the option to email us the video? >> You can email the video to us right now. Otherwise, we can seize the phone. Can't search it until we can search for it. >> Yeah. >> But we can seize it because there's evidence of and it's all gone. >> Yeah. >> Um so, he can email us the video he did right now if he wants to. If he doesn't want to, he just has to make we're going to take the phone and then we're going to get a search warrant for him. >> Okay. >> So that way he's going to be out of his phone for a while. But hey, >> I don't know. I'm not going to say nothing bad, but I think this crap they're on. He had a bag, a little greenish bluish colored bag. When he came out of the car, he could barely walk and he was putting it in a Reese's wrap up and rolling it up and stuffing in between the seats of the recy. >> When this started, he'd barely get out of the car. >> He started getting loud with me like he rolled a what color was the bag? >> It's like a dark greenish brown, the bluish color bag, >> but there was a Reese's rapper that they just dumped on the ground like he yelled at him. The other guy yelled at him literally, I guess. He picked up and shoved it in between the seats where the house. >> Hey, Doug. >> Yeah. Uh before I do, um >> hold on. Um passenger side in between the seat there's a Reese's container. >> Yes. >> Did you look inside of it? >> Not yet. They stuffed a uh a package in there. Okay. The truck driver. >> Hey Doug, >> have you step back? We might have something with me. >> Might have something else. Where are you guys heading? Oh yeah. Gloves, Jack. Uh, yeah, maybe. So, he said that he stuffed it in a races. I have a new I have a I saw him reheating it when we pulled up. I actually These are new pants. I have to wait a lot. I get the light for you. Central deliver driver said that he saw her drop that >> and then they picked it up and stuffed like a blue wrap like wpper that they did color George headed toward possibly down with the 21 check. Did you check it already? Yeah. No, she could have adjusted something. She's definitely hiding something. That's my That's my That's my gut feeling. Just the way she was standing, >> just the way she was sway. It was hard. It It didn't I saw it and she didn't do it once we got her like, you know, stabiliz like standing. But walking to here and walking around here, she was she was staggering. >> That she doesn't know how this happened. >> That's the She still doesn't know how it happened. >> Yeah. And he's here. That's Yeah. She just assaulted one of us. >> So, we're not we're not going to go that way. We're going to come in. >> Yeah. She kicked someone. >> She kicked this off. >> That's where we're at. >> That's where we're at. I'm just being honest with you. Okay, I understand it. I apologize. And I appreciate her ass. And she's just a little mad. >> So, here here's the thing, bud. So, like we talked about, you have every right to record us, but the angle that you had when she kicked it was actually better than our cameras probably have. So, I didn't. That's why I asked what happened cuz I couldn't see. >> I'm just telling you that your camera was was facing that way. So, I just talked to the lieutenant. We're going to give you two options. Okay? Remember I talked about being a material witness. >> All right. The first option is that you voluntarily email that video to one of us so that we can take it in as evidence. You still get to keep the video for your own usage. Number two is if you refuse to then we would seize the cell phone and get a warrant. >> Okay. No. >> Yeah. I was you guys did video because I I couldn't even see her. I I understand that she not the officer or nothing, but I I understand frustrated >> if if she would have just complied. >> I know, but I understand that. Yeah. But she was very lost and confused because he literally swiped us and then you guys show up and pull her out of the car. So with everything, she's like, "What the hell is happening?" So yes, she got a little she's Italian. She got a little, >> you know how Italian, you know, with women personally there. >> Okay. Listen, so one thing I will say, listen, is that that's all done >> as far as that. So now she gets to start over again with us. >> So there might there's going to be some charges for what happened, >> but if she complies with us, then her situation's not going to get any worse. >> Okay. >> If she keeps assaulting us and, you know, resisting, >> can I talk? You can stand near me. I just We're going to hold off on that. We're going to see how she is because if she's still worked up, we're not going to have >> Which is why I want to ask her if she can please calm down and just collaborate and exit and we'll get this resolved. >> All right. Well, we'll see. We'll see. >> She could have his accent. You saw her eating out of that container when he got here. >> Yeah. >> She could have ingested, but I mean, you know, it >> No, no, no, no. It's just the whole thing that happened front, back, left, right distance, right? >> That way we can put put in the report. Do you have a driver's license? We can have all your information. That way I can I can you know This is officer. >> My eyes check. Yeah, >> sure. We have everything here. >> All right. This is officer Martina. >> She's going to give you a search. We have to run. >> No. Oh. Uh, >> your the other officer has your keys. All right. Come on. >> Oh, he's coming. >> Yeah. >> Took your boyfriend. What's his name? >> Anthony. >> No. He has some of your personal assist. Okay. At the Ridgewood Police Department, Andrea was read the standard statement for motor vehicle operators, but she refused to submit breath samples for testing. She was eventually released to a sober adult, pending her court appearance after they signed the potential Sherlight warning form on Andrea's behalf. Since Andrea had resisted arrest and assaulted a law enforcement officer, she was issued to criminal summones for allegedly violating to see 29 to 2A resisting arrest and to see 29 to 1A obstruction of justice. Officer Kudson issued her the following traffic summones as well. Operating under the influence, consent to take samples of breath and failure to possess driver insurance card. All right. >> Um, yeah. >> You know what? Cuz she would be able to stop. Oh my god. >> Yeah. Yeah. >> What's that? >> Oh, yeah. Um, okay. I'm not taking this one off. I will loosen it for you, but I'm not taking it completely off. Okay. >> Hang on. Hang on. >> Organizing. I was organizing. >> You're insulting my housekeeping here. >> Insulting. >> All right. That's funny. That's funny. plenty loose. Put a whole finger through there. Have a seat. >> No, it's fine. Four. Look, it was all >> I know. I can see that, but I can't help you get your hand out. >> It's fine. Don't worry. >> Have a seat. We're going to go on the far end. Okay. >> Yeah. >> Better. We're going to go in the far seat. >> Have a seat and we can go in the far seat. >> No, far seat. >> Oh, have a seat here. And >> you're right or a lefty? I'm said you didn't have to get the uh like my purse or anything like that. >> You're um I believe uh he has your purse the uh your boyfriend. >> I saw him holding that [clears throat] s investigation. She's going to keep cameras on. >> Uh so she's going to do a full search. >> Oh, you're going to do a full search. >> Do you want her stood back up? >> Yeah. Yeah. So, I got to do a I got to pump out a ticket. I got your ticket number. So, let me actually go take care of that. I'll stay here. >> You want to stay here with her? >> Yeah. >> Camera's good. >> Oh. Um, so these I don't know if >> whatever my car >> trying to think. >> I know you told me but like >> she can't be on camera. >> No, I know you told me but happened and they didn't take the car away from me. >> That was in New York City. So, I don't know if it's what you're doing. >> No, I said like uh when something like that happened like Elise 5 years ago, didn't take my car. >> Okay. >> Nothing magnet. >> You just give me another. All right. So, we have to go to another room. She's just going to quickly uh search to make sure that you're uh you don't have anything on you. Make sure you don't. All right. You have any surgeries? >> No, she's not doing that. So, just stand up, >> but she has to search you cuz you're a female. All right. So, just stand up. I'm being nice by putting the cuffs in the front. So, just uh cooperate with her. All right. >> I still have zero idea where I'm going. >> Go this way. This way. >> Zero idea. >> It's going to be around the corner. So, follow me. >> Zero idea. I hope this faster we can get the reports and the faster the country moves. >> So that's very vague and >> I would say maybe two hours. >> Two hours. [ __ ] that. I'm not I don't have a choice. All right. You good? Be right here. I'm not saying anything Yeah, >> Zach has her Sure. >> We're going to explain all of that to you. We're going to explain to you how to get your car then your car's being 12 hours. All right. >> Okay. So, you could have said that. >> All right. I'm going to read something to you. >> I'll tell you. >> You didn't think I would run. >> All right. I'm going to read something to you. I need you to listen. Okay. >> Okay. The police officer shall read the following. You have You have been arrested for driving while intoxicated. >> NJSA 394-50. The law requires you to submit the samples of your breath for the purpose of testing to determine alcohol content. Uh, >> a record of the taking of the breath samples, including the test results, >> will be made. Upon your request, a copy of that record will be made available to you. After you have provided samples of your breath for testing, you have the right at your own expense. >> To have a person or physician of your own selection take the independent samples of your breath, >> blood or urine for independent testing, >> even driving. >> If you refuse to provide samples of your breath, you will be issued a separate summon for the refusal. A court may find you guilty of both a refusal and driving while intoxicated. >> If a court finds you guilty of the refusal, you will be subject to various penalties, including license revocation for up to 20 years, a fine of 20 of $2,000, installation of ignition interlock, and referral to an intoxicated driver resource center. These penalties have been may be in addition to penalties imposed by the court for any other offense which you have found guilty. You have no right, no legal right to have an attorney, physician, or anyone else present for the purpose of taking breath samples. You have no legal right to refuse to give delay giving samples of your breath. Any response from you that is ambiguous or conditional respect that follow >> to my request that you provide breath samples will be treated as a refusal to submit to breath testing. Even if you agree to take the test but then do not follow my instructions, do not properly perform the test, do not provide sufficient breath samples, I will charge you with refusal to submit the breath testing. I repeat, the law requires you to submit samples of your breath for testing. Will you submit samples of your breath? >> I told you no to all of that. >> Okay, your answer is not acceptable. Law requires you to submit the samples of your breath for breath testing. If you not answer or answer in anything other than yes, you'll be charged with refusal. >> You will be charged with refusal. Wait, wait. >> Okay. Wait, wait, wait. So, can you call a tab to what's the nearest is there a motel nearby here? >> Ramsey, but to be honest with you, >> a motel is going to cost you 70 bucks. >> No, my point is how far we >> 15 minutes. >> Probably the same price. >> No, she said it was like 90. Yeah, but I'm saying Mawa is about the same distance. >> Okay. No. Where's the closest motel? >> It's up in Ramsey >> because I can charge my phone here >> and I can maybe have my phone. >> Oh, you want to go to a motel? >> Just so I could charge my phone and once I charge my phone, >> drop us off at any hotel. >> I We don't have any hotels. There's no hotels in Redwood. All right. I'm sorry. Can you drop us off at the nearest gas station? I'll charge my phone there and I'll have a friend pick me up. >> Please. >> I can't do it. I'm sorry. >> All right. So, how about this? >> Do you want Do you want a taxi to Do you want a taxi to a hotel in Ramsey or a motel? >> The closest. >> No, cuz then that's going to be more money. >> No, it's not. It'll be less than $99. >> $99. >> What's the one on 17 South that I'm your phone on you? Uh, >> it's uh There's no like >> there's no gas station over here. >> Two miles away. Call the taxi. >> But to where? To where? >> Here. And once we're in the cab, we'll tell him where we want to go. >> The nearest gas station. >> Have him uh respond. Um they're still deciding on a destination either closer than that or >> either going to be somewhere. >> Where you going to go? >> I mean about 10 to 12 miles. driver. >> Yeah, he's on he's on his way. >> But I need to charge so that we can >> He might You might be able to charge it in his car. I'll charge my phone and then I'll I'll have him maybe drop us off at the gas station or something and then we can go. What did he say? >> 90 bucks >> and then I'll pay my friend $30 at most. He would do me a favor. 12:45 as I as >> that's all we needed you home. >> Where was your Where was her purse? >> What? >> Where was her purse? >> This. >> Where? No. Where was it? >> She had it on you. >> No, she didn't. You brought it with you. >> I I took it >> and handed it to me. >> Yeah. >> And when she came out, I gave it back. >> Yeah. I thought that was in the car. >> No. No. >> But now, like, I might get fired from my job tomorrow with no [ __ ] phone call. >> What kind of work do you do? >> I bartend myself. Uh 3ish. >> Yeah. >> Yeah, of course. >> I'm down here like 9 down here at 10:00. >> What about my car? >> I know. That's what I'm saying. If you come here, >> you have to get the impound report. Then you can go to get your car back. >> All right. You'll have plenty of time if you go to work 3:00. >> And they're going to charge you what? And it's going to cause figure Hey, you last night. Don't worry. >> No, that's why I want to proceed and bring up the court for the money, the time, everything. Just not right what she's talking about. >> And I don't understand. Did you take the police report about the accident? >> Yeah. Hey, there's an accident report. >> Okay. You have all his information? >> I have all his information. >> Can we get his information? >> Once you get the report, absolutely. >> When I come tomorrow, >> the So, >> how long >> the So, the impound report we usually expedite because it's time sensitive and we don't want to make you guys spend more money by keeping the car there. But other police reports usually take 3 to five days. >> So, a general police report 3 to five business days to to be approved and ready for pickup. Oh, >> they can get it at the end of this week. >> Well, we can get the impound >> by when? >> Tomorrow. >> Tomorrow. >> So, the impound report will be only the impound report will be ready tomorrow. >> Yeah, but I can get my car tomorrow. >> And then by the end of the week, there's other. So before I before I write my accident report, do you want to I know I asked you guys on scene and it was very chaotic because there was a lot going on. Would you like to give me a statement as to what happened with the accident? >> I have no idea. This guy just [ __ ] sideswiped the [ __ ] out of me. I don't even know who it is. >> Yeah. Okay. So someone sideswiped you? >> The truck just swiped the mirror. >> Do you remember? Do you remember what lane you were in? You were in the middle, I believe. And he was >> I think I was on the >> Yeah, he took off my side. >> I think I was on the left and when I Yeah, exactly. So, we're going to use the highway. There's three lanes. You have the right lane, the middle lane, and lane. >> And he >> was in which the middle lane or the right lane? >> He He was in >> No, I think we were in the middle. Yeah. And you're saying that he came into your lane. >> Oh yes. >> Oh yeah. He took off her >> and the whole and he continued. Yes. >> And he [ __ ] said >> and I had something like this happen with me before on the George Washington. >> Sorry. >> What? >> I'm so sorry to hear that. >> It's just it's just truckers. No truckers. liquor. Literally I it was five lanes merging, right? I I was really careful of merging really slow and he like kind of came a little bit. Everyone's merging, but he came also a little into me the back of it hooked onto the thing and he continued going. I was beeping beeping. >> You know, those trucks are so big sometimes they don't even realize. But I was beeping and it was not even it was his fault. >> Yeah. >> I've had this happen without without [ __ ] trucks. It's just like I don't know. I drive like a grandma. So it's like when [ __ ] like that happens to me I'm like I don't know. Makes me feel some type of way, you know, cuz I'm I'm careful when I drive. I'm a defensive driver, >> right? >> And it's like >> I don't know. That's why that's why they're called accidents cuz some you know Yeah. Sometimes you don't see it. It's dark. There's a lot of cars on the highway today. >> It wasn't that many cars. >> Did you Did you see how bad that was? >> I saw a lot of cars on the highway. >> No, but did you see how bad my car was? There is no way that he he just like he just nicked it and doesn't real hit him. >> Mhm. >> It would have been less. It's usually the one that gets hit gets more damage. >> Is that how it works? >> Most of the time. I'm going to have to pay out $500 deductible. >> I didn't know that. >> It's a fact. >> And now I'm going to have to pay $500. >> Think about it. When the truck hits, let's say even any vehicle hits, right? The one that gets hit the most and the most damage is the one that gets hit. The one that does the hitting barely gets a scratch. So, it's facts. It's a fact. >> All right. It is. >> I never to be honest with you. I I didn't know that. >> It's common sense. Think about it cuz you're Let's say you ever had a police chase or whatever. Chase someone to hit him. >> I've never hit anyone. >> Okay. But do you watch a video of a pursuit and whatever? They hit the guy. Let's spin out on the tail. So, who gets the most damage? >> I can understand what you're saying. All right. That's it. So, it's like very much common sense that he [ __ ] went right into her. >> She was maybe like on the edge, but still she was in her lane and he >> [ __ ] sprayed the whole side of my car. >> There would have not >> been so much damage if she would have been the one. Even if it is a bigger truck, but it's just >> No, I worked for an auto body shop in Manhattan for over a year and a half and they could tell who did who to what car. >> That's it. The insurance. We'll see. We're going to collision that, too. So, >> that's it. I know he's completely wrong. >> There's no doubt about that. >> What What did he say? Can you say >> Oh, he said Yeah. So he and again like this is this is hearsay. So this is your word versus his word, right? >> He said the opposite. He said you guys swerved into him. >> Yes. >> Again, it's just you know how my report's going to read. It's going to say driver one said one thing and driver two said the other thing and the insurance company's going to look at it. Why don't you look at his car? >> That's what doesn't make sense. >> Look at his car. >> If she swerved into him, how is her whole side and the mirror >> just boom? >> I don't know. cuz he came. >> Yeah, it looked like the tire did a lot of damage. You know, the tire cuz it was all black on your side of the car. >> That's what I'm saying. I mean, it's hard to damage in and literally >> I'm going to go tomorrow to a body shop. >> You need to take pictures. I would you know cuz they're professionals.
