I just have to let you know my body camera's on and recording. We're just required to tell you that now. I already know that. Okay. Um Do you have your driver's license? What about your registration and insurance? Around 7:18 p.m. on September 17th, 2023, Officer Conti with the Bridgewater Police Department observed red 2008 Acura being driven in an erratic manner on Route 22 West near Buffalo Wild Wings before nearly striking his patrol car. The driver entered the US 202 206 North exit ramp before taking the right exit lane towards the Bridgewater Commons Mall. The driver eventually pulled over inside the parking lot of the Bridgewater Commons Mall. He informed dispatch and made contact with the driver who was identified as Caitlyn. Uh that's the insurance as well. Looks like just a duplicate copy. Uh you gave me two copies of the insurance. I need the registration as well. Should be a white piece of paper with a little blue card on it. I'm upset right now. There's no reason to be upset. What are you upset about? That you pulled me over for what? Uh so when you were pulling out of the parking lot on 22, I had to swerve into the shoulder to avoid you. I was in the left lane. It's not necessarily a ticket or anything, but especially with the weather, you know, we want to want to avoid an accident. Um do you not have the registration? Okay. All right. Um Let me run your license while we're at it. If you could just find that for me. Where are you heading to? My home. Okay. Uh all right. Just hang tight for me. So, I'm in the left lane westbound. One car pulls out of the Buffalo Wild Wings parking lot in front of me. Enough time and she goes in front of me. I have to swerve into the shoulder to avoid her. Uh and then it took us all the way here to pull over. So, scent of alcohol, glassy eyes, um I actually asked her how she's doing tonight or she asked me how long it however it was. Good. How are you? Oh, I'm good. She said good. How are you twice. Um she said, "I'm just very upset that you pulled me over." I was like, "Why are you upset?" She said, "I don't know why you're pulling me over." So, I explained it to her. She's with me. Um So, I haven't asked her anything further than that. Uh I asked her for the registration. She handed me another insurance and then went to hand me the PNC Bank um business card. All right. And then uh that's pretty much it. But so uh I asked her if she had anything to drink and then parking deck. Yeah, I was going to say yeah, you got to slide over here. So, What do we what do we want to do? Put her in the back to drive over there or Yeah, we'll put her in the back. We'll take her into the parking deck. Just Uh yeah, we'll do that. I I went past here. So, I have the next note here. Okay. [Applause] Yes. Any luck with the uh registration? No. I mean, it's right here. All right. You mentioned that. Okay. Yeah. Uh could you find it for me? I don't Okay. Where are you coming from? Where you coming from? Buffalo Wild Wings. Okay. Did you have anything to drink tonight? Two drinks. Yes. Two drinks. Okay. Um all right. So, I'm going to have you step out. You just have to do a couple tests. Just make sure you're good to drive. If you're good to drive, you'll be on your way. All right? My husband's going to pick me up right now. Okay. If you're good to drive, he can pick you up. He is right now. Okay. Well, I still need you to step out. I don't have to take a test if he's picking me up. So, are you refusing to take a test? Okay. You understand if you refuse to take the test, we would have to arrest you for refusal. If If you're good to drive, we leave, you go home. But if you refuse, we have to take you in and I don't want to do that. All right. This is Officer Flores. We're going to get out of the rain. He asked Caitlyn for her documents, but she was unable to present his registration. Shortly afterwards, Officer Flores arrived on scene to assist. He asked Caitlyn where she was coming from and she stated she had left Buffalo Wild Wings. She admitted to consuming alcohol before operating a motor vehicle. Based on their suspicion of impairment, Caitlyn was transported to the parking garage so that field sobriety exercises could be administered. We're just going to do the tests in the parking deck over there. So, I'm going to put you in the back of my car. You're not under arrest or anything. We're just going to put you in the back of the car, drive over to the parking deck, do the tests. Like I said, if you're good to drive, bring you right back over here and you can go home. All right? So, we're going to step right over here. For You want him to get the keys? Uh is it a push to start and stop? Yes. Okay. Lock it for you? All right. Right over here. Conti from Tac 5. I'm going to have one female transported to the parking deck. Starting this 65 over 3 for testing. Officer 65 over 3 for testing. Ready to leave parking deck. All right, from top five, transport complete ending 65 over four. 65 over four. All right, he's freezing in the area. Three. Three from 1195 from my pattern. Correct. I'm just going to go to the front of the car, okay? Yeah. Do you have a Kaylyn, Katie? Kaylyn. Okay, I have your keys in the front seat. Put them in the front of the car if you don't want to get wet and put them in the front of the car. Is it okay if I put the car keys in the car there? Okay, it'll be right with your keys. So, I just want you to be relaxed, okay? Need you to put your hands down at your side for me and put your feet together, okay? Officer Flori started with the horizontal nice stagmus HGN test. The second exercise was the walk and turn test. During the walk and turn test, Kaylyn failed to touch heel to toe on each step and counted in the incorrect sequence. The final exercise they attempted was the one leg stand test and Kaylyn failed to raise her foot in the proper fashion and stopped counting before the test was complete. Do you wear contact lenses, glasses, anything like that? No. Now, this test is just going to test your eyes, okay? So, I'm going to hold a stimulus, a pen in front of your eyes. I need you to follow the pen with only your eyes, all right? Don't move your head, nothing like that, okay? Just stare straight ahead. Use your eyes to follow the pen back and forth, okay? Any questions? Okay. Yeah. Yep, relax like that. Now, look at this, look at my pen, all right? Eyes and eyes only, please don't move your head, all right? Don't move your head. Yeah, you can come down. All right, thank you. One minute, are you one with the girl? One minute. Okay. Okay. Next test, need you to I'm going to give you some instructions, okay? Do you have any issues walking? Are those shoes okay or comfortable walking on it or that? All right, and no leg injuries, no ankle injuries, nothing like that? Okay. All right, so I'm going to put you in the starting position, then I'm going to explain the test, okay? When I put you in that position, I want you to hold that position for me until we begin, okay? All right, so I would need you to imagine there's a straight line right in front of us, okay? I want you to put your left foot here and your right foot like this. Hold the starting position, it helps you to balance a little bit. See? And I want you to put your hands down at your side like that. You're in the starting position, please. Okay, heel to toe, okay? Just like that, thank you. Right heel to your left toe, okay? And then See how I have the heel? It's Yeah. Now, right heel left toe, okay? Just Okay. There you go, hold that position for All right, so your legs are going to shake a little bit, that's all right. I just need you to line up your Now, when I instruct you to do so, you're going to take nine heel to toe steps forward, okay? Nine? Yes, nine. And then I just ended that and take a series of four steps to the left and take nine heel to toe steps back. Do you understand that? Yes. Okay, so please Now, hold the starting position No, I know how to Okay. You can take a second. Whenever you're ready. I'm already nervous. Are you okay, Kaylyn? We're trying to give you every opportunity to do this, all right? I need you to hold the starting position, okay? I want you to take a deep breath, all right? And then we're going to get you the test, okay? We're trying to give you every opportunity here to drive yourself We are, man. Take that. You need your pulse to open that. You lock your steps out the first and then we can send you on your way, okay? We don't want to have to take you into the test, all right? So, please, if you come and do the test for us, it'll really help prove your case, okay? Need Need a second? All right, let me know when you're ready. I'll go back, we'll start from the beginning with the walk and turn, okay? Okay. Like I said, imagine there's a line. Your left foot on the line, right foot in front of it. Right heel to left toe, okay? You can keep your feet just like mine, okay? Like I said, your legs are going to shake a little bit, that's all right. When instructed to do so, you're going to take nine heel to toe steps forward, Nine? okay? Take a series of four steps to your left to turn around and then walk back nine heel to toe steps counting out loud, okay? I'm going to demonstrate. Hold the starting position. I'm going to take three, you will take nine, okay? So, I'm going to look like this. One, two, three. One, two, three. Like that. Take nine, I took three. I need your hands down at your side for me, okay? Remember to count your steps out loud and begin whenever you're ready. Three. Three. So, do you One, two, three. One, two, three. One, two, Okay. Now, one more test. All right. Now, do you have a preference on which leg you stand on, which one's stronger? It doesn't matter? No. Okay, so you can stand on whichever leg you choose, all right? So, this is called uh standing test, all right? Yeah. So, what you do is put your hands down at your side again, all right? And what what when I instruct you to do so, you're going to lift your leg up approximately 6 in, put your foot out straight, okay? And you're going to count from there, okay? 1,001, 1,002, 1,003, 1,004, and so on until I instruct you to stop, okay? Yeah. All right, this is the one legged stand, okay? So, give me a second to pull the clock here. [Music] Okay, whenever you're ready. If your leg comes down, you can restart. Yep. 1,001, 1,002, 1,003. Sorry. Let me know when you're ready, I'll start the clock and I'll start, okay? Ready? Ready. 1,001, 1,002, 1,003, 1,004, 1,005, 1,006, 1,007, 1,008, 1,009, 1,010. Go ahead. 11, 12, 13, 14. Okay. One more test. You just hang out by the bumper right there. Keep your eyes down for example, for example, if they were 3,000, so 5,000, so that would be turn one legged stand test right here. All right. All right. Should I give her a chance to call her husband? Is he coming over here or where is she from? I just want to make it a heck where she is. Let's just get started. Okay. Okay, Kaylyn, I need you to put your hands on your back for me. It's all right, we'll get you home, all right? We'll try to walk out of here. Kaylyn, I'm sorry we have to take you. Kaylyn. No, no, I need to go. It's It's not No, I need to go home. Kaylyn. I need to go home. We're going to get you home. Kaylyn, you have some paperwork. I need to go home. I need to go home. Look, these things happen. You didn't hurt anybody, okay? You still have another chance to prove that you're below the legal limit when we go back to headquarters, all right? We're going to put you on a machine, all right? Then that machine will measure your blood alcohol content, okay? The police Do me a favor. Put your hands behind your back. After she was placed under arrest, her vehicle was impounded for a 12-hour hold according to John's Law. Officer Conny transported Caitlin to the Bridgewater Police Department for further processing. [Music] You can close the door and put her purse and wallet in there. Going clear. Hello. Hi. Hi. Are you here for Caitlyn? Yes. Okay. Um So, well, first off, I just say my body camera's on and recording. We're just required to tell you that now. Yeah. Uh I would imagine you're parents. Well, yeah, we're her in-laws. In-laws? Yes. Okay. All right. So, let me explain a little bit. So, she was arrested for driving while intoxicated. Do Do you have any questions before I explain anything? Go ahead. Okay. All right. So, first things first, uh we do need a responsible party, which you are. Um what this is, if we could just go right over here so I could read this to you and then I'll explain the rest of it and if you have any questions, uh we'll go over that. So, this is a potential liability form stating that you're essentially taking custody of her. Um Caitlyn. She can't drive. Um so on and so forth. Uh So, I'll read it really quickly. How long is that for the rest of it? Uh 12 hours from the time of stop, so. Okay. Um Okay. Yeah. Do you know where her car is? So, I'll I'll get to that next. Okay. So, um So, she cannot operate a vehicle for 12 hours. Yes, from Okay. Does she have to wait to operate a vehicle until the law tickets there to laugh at? What was the blood Uh I'm not comfortable answering that at this time. Uh she would have to tell you. Okay. Um and then uh we'll go from there. Okay. But she can drive like After I'll get you the exact time. Okay. Uh so, um if you are willing after Yes. We know that if you are willing to take responsibility for um all I need is somebody's name, so print name. Uh one second, I'm sorry. It's a copy so it's messed up. Street address? Uh mine? Yes. Okay, that should be it. All right. It's acknowledgement of receipt of potential potential liability warning. I your signature Uh sorry. Okay. Yes. Your signature there. My signature? Yes. Uh sorry. Yep, I'm out here. Give me two minutes. Actually, I'll come back. Okay. So, then right here, you're going to get a copy of this as well. So, then you're just going to print your name. [Music] Okay, Okay, should be it. That's going to be my signature. Sorry, I got to get a new coffee, but um I'll have her on the way just so we can get out of here. Now, I want to explain this to you just in case um you know, she's a little stressed out, so Yeah. Um She's got some good anxiety. She She's calm now. Um very polite, so um that goes a long way, too, and my report will read that way. Um she was issued three summonses, 39:450, that's the driving while intoxicated. Um 39:4-96 would be uh reckless driving, which is mandatory summons in driving while intoxicated cases. And then 39:4-97 would be careless. She only got She got the bare minimum, the three, like I said, she's polite. Um so you know, we're going to try try our best to work with her. DUIs the bare minimum is Uh these three are the bare minimum of what, you know, I could have given her some more tickets, but I I don't want to do that. Um This is This is where So, under John's Law, um there's a mandatory hold on the vehicle for that 12 hours. Um it's registered to her, so she would have to pick it up. Uh license, registration, and insurance. Um it would be at Rich's offer towing. Okay. Uh all this is going to go to her, but I just want to explain it to you right now. And then this is uh all her property uh that's being given back to her. She already signed for it, but just in case she's wondering what these forms are. Uh so, just let me get a fresh copy of this, and then uh we'll have her back. Also, I just need your driver's license. Okay. I have my driver's licenses. I did the procedure. Perfect, thank you so much. All right, give me like 2 minutes. Uh did you have any questions? Okay. Okay. Okay. Um there's your driver's license back. Here is a copy of that potential liability warning warning we talked about and that you signed. Uh this right here uh I just wasn't supposed to have you sign there, so that's just my sergeant's initials saying that that was a mistake. We crossed it out. Um so, that's that. Uh this is going to be a 12 So, 12 hours? 12 hours. Uh so, from the initial time of the stop, which was 7:18, uh Rich's opens at 8:00. Uh so, she'd be able to get the car when they open. Yeah. 8:00 a.m. Um is Constantine in the car? Yes. Okay. Um I guess she's a little embarrassed right now, so she just asked if he could come in and uh if he could wait in the car. Obviously, she's appreciative that you came, um but Yeah. I don't know if she is a little embarrassed or whatnot, but she just said he could just be in here. All right. Yeah, I don't know. She's She doesn't want to come out. Okay. Yeah, she Pull uh not right up here, but you could pull it up wherever the closest. Yep. Okay. Okay. We'll We'll go and do that. All right. Thank you. Thank you. Yeah, I'm waiting for her husband. Uh we can talk in here if you don't want to. Uh so, he did a quick rundown on them. Um obviously, as I told you on the front, she was arrested for driving while intoxicated. Um I told her all this as well, but I'm going to tell you she's a little stressed out, so she forgot or something. Um these are the summonses. These are the least that I could have gave her. She was very polite, very cooperative. Um so, the driving while intoxicated, careless, and reckless driving. Uh there is a court date down there. Court is mandatory. If that date doesn't work for her, all the court information is on the back. So, she just has to call to reschedule. Um the car under John's Law, uh it had to be impounded for 12 hours. Uh the time of the stop was 7:18, so they open at 8:00 a.m. I gave the tow company information um to your parents. Once they open at 8:00 a.m., just call. Um He's going to have to come here first to get a tow release. Okay. Have her bring her driver's license, registration, and insurance. Okay. Um so, come here first. Can we come tomorrow 8:00 a.m.? Is that okay? You could come You could come anytime that works for you. You could get the registration. So, she couldn't find the registration when I was out there with her. Um we can work with that. Yeah, just try to get here tomorrow morning. Try to get the Yeah, she Definitely, I have her insurance back there and her driver's license, so yeah. Uh she couldn't find the registration for me when we were out there, so uh shouldn't be an issue. Um just come in and tell them that we spoke. She couldn't find the registration, but it's on It's on here. We know she's a registered owner. We can look that up. So, uh whoever's here tomorrow shouldn't give an issue about that. So, she should be able to get her car back tomorrow morning. Yep, 8:00 a.m. it's good to go. So, uh if you want to come here at even 6:00 a.m., we're here 24/7, so uh whatever time works for you, and then Rich's opens at 8:00 a.m. I I believe just check with that beforehand. Um but you have to come here first to get the tow release. Uh and then this is her property report, just everything we have to inventory everything. She already signed for it that we gave it back to her, but just in case she wakes up and is like, "Well, what are all these papers?" Um so, let me get her back here. One Delta Yankee So, let me get her car. I'm trying to get to Frank. Uh she's good to go. I'm sorry. It's pretty wet outside. Do you want to keep them dry? Uh yeah, I'm going to put them in the glove compartment. Uh yeah, those are hers. Uh Yeah. Did you have any questions for me or No, I mean, this is very unfortunate um circumstances. Um I mean, She was She got three summonses, the um reckless Like I said, I've had DUIs where I've written the people 15 tickets. She She was cooperative. It's her first offense, all of that. I'm not trying to, you know, Yeah. do, you know, you get what I'm saying. But uh Yeah. Also, I'm sorry. Yes. Um she Yeah. Um and obviously, as it goes, one could be appointed to her as well. But um also explained to her she was very upset. Driving while intoxicated is not criminal. It's a traffic offense. She I don't know if she doesn't believe me or she's just upset about it, but make sure she knows this is doesn't go on her criminal record. It's not a criminal offense. It's strictly New Jersey traffic statute. So. Do you If you don't mind me asking, what was the BAC level or is that personal for the case or If she wants to tell you, um, yeah. She said I could share the information with you. I don't even know if my partner told her. But They should be calling her right now, so you could always ask her as well. She was She was over the legal limit. She I'll leave that up to her and Okay. Yeah. Um, any other questions or anything like that? No, I mean I think All all everything's on my end, too. Yeah, I mean want to do your research on things or, you know, that just really hurt and shell-shocked and I just we want to No, I I think the best is I understand and she she was you know, she obviously feels terrible about it, terrible about making y'all come out. Um you know, so She just kept wanting to talk to you throughout it, so and I I apologize that we uh kept you in the dark for so long, but uh you know, when we stopped we had to do the tests and stuff and as soon as we got back here, that's when I called. So, I apologize if you were a little worried that you didn't hear from her. Yeah, no, it's completely understandable the rain and everything. I'm just happy that you're together. Mhm.
