God chist you were you were were you L officer I apologize I tried I moved here a while ago but I'm just trying to find one of my um anyway I apologize I just trying to find my house I was over at um where's your I'm but I was just trying to find my house I this okay anyway we you like yeah that that was my next uh my next step on January 2nd 2024 at approximately 10:42 p.m. officer coaster with the Crystal Lake Police Department was dispatched to a report of a suspicious incident involving a white SUV parked in a driveway on Bingham Lane he arrived unseen and initially did not observe a matching vehicle but he later observed a female behind the wheel of a white 2019 Volvo XC90 driving erratically in the vicinity of Bingham Lane and Village Road he followed the vehicle and initiated a traffic stop in the vicinity of Louisville Lane and Nashville Lane after he initiated a traffic stop he made contact with the driver who was identified as Daniel how long you been in living in so I've been say one time I'm a woman so I've been there for 10 months but it says on my directions it's late what what does having what does being a woman have to do with where you live we are more of land landom we yes recognition we don't do well with geographical trying to find it on our own so I don't have my phone connected so I don't have much what you don't have your phone connected sorry I'm you're losing me you're losing me so where are you coming from let's start over that I am coming so I'm just kind of counter brain I I was trying to avoid saying that okay anyway um just miracle oh to my ma name turn that makes sense okay I have a passport I don't need your passport okay listen as officer coair was speaking with Danielle he detected a strong odor of cannabis inside the vehicle as he was speaking with Danielle she appeared distraught and she informed the officer that she was arguing with her husband earlier that evening based on his suspicion of impairment officer coaster called for backup and officer Flores arrived on scene shortly afterwards based on their suspicion of impairment Danielle was asked to exit the vehicle and perform field sobriety exercises like can I see it I mean huh yeah I here's my rub okay for my Ines oh my she scared the [ __ ] out of me yeah we it's we're the police we always have back up that's okay you guys need back stuff in the backpack up right here the first field sobriety exercise was the horizontal gaze nagus hgn test the second exercise was the walk and turn test during the walk and turn test Danielle did not touch Heel To Toe on each step while raising her arms for balance the third exercise was the one leg stand test during the one leg stand test Danielle failed to raise her foot in the proper fashion and put her foot down before the test was complete the fourth exercise was modified Romberg balance test and Daniel estimated the passage of 30 seconds in 25 seconds the final exercise was the lack of convergence test and officer coair observed indicators of impairment listen to him I'm not the one I'm I was like are you guing no no it's going to be me okay all right do you have any like abnormalities with your eyes you can face me you have any abnormalities with your eyes can you go in front I'm so I just in case you know I just any abnormalities with your eyes anything like that no no okay do you wear cannabis okay um how do you however officer cair believed that she was under the in fluence of cannabis so she was still placed under arrest for driving Under the Influence after she was handcuffed Danielle was searched by officer flues and placed in the patrol car from the from the from the test um from my doesn't have to be that that's alcohol um so from from the test that we did from my initial observation coming up to the car with you and speaking with you um so at this time you're going to be placed under arrest okay okay turn around place oh man [Applause] do you need anything from the car y when me get to the police department but you need anything from the car though like cell phone cellone and okay where's your wallet okay what place is it front seat want to shine a asked to submit blood and urine samples a warrant was approved but Danielle ultimately refused to comply however the officers also found additional prohibited substance is inside her vehicle so they had adequate grounds to charge her this officer's going to you can come this way walk in there I'm going to turn on my car real quick all right Daniel 20 minutes the 20 minute right huh or no 20 minute observation you guys can give us like five minutes we got do a couple CP I'm explain it right now to you want to just want to fix your feet or now no okay Daniel so this is your uh this is why you arrested okay um because we we believe you're under the influence of intoxic compound possibly drugs okay um so that is the your citation okay Yep this is going to be a copy believe that it's very warning rers as provided in section 11500 of the Illinois bical code you are a first offender unless within the last 5 years of this arrest or DUI or leaving the scene you've had a previous conviction or Court assigned supervision for DUI or similar provision of a local ordinance or a conviction in any other state for DUI or a similar offense where the cause of action is the same or substantially similar to the illo vehicle code or a driver's license suspension revocation for violating section 11-511 of the Illinois vehicle code except in cases where you are submitted to a chemical test disclosing an alcohol concentration of 8 or more or more or any amount of drug substance or intoxicating compound resulting from the unlawful use or consumption of cannabis as listed in the Cannabis Control Act for a dii prior 20729 2096 or a Delta 9 tetr hydr Cano all concentration of either 5 nanog or more of whole blood or 10 nogs or more of other bodily substance for DUI rest on or after 729 2016 a control substance as listed in the Illinois control substance act or an intoxicating compound as listen in the use of intoxicating compounds act or Methamphetamine as listed in the methamphetamine control and Community protection act and were subsequently found not guilty of the associated UI charge considering the above you are warned if you refuse or fail to complete all chemical tests requested and if you're a first offender your driving privileges will be suspended for a minimum of 12 months or if you're not a first offender your driving privileges will will be suspended for a minimum of 3 years or if you were involved in a motor vehicle accident that caused personal injury or death to another your driving privileges will be revoked for a minim minimum of 12 months personal injury means a type A injury that requires immediate professional attention in the doctor's office or medical facility including severely bleeding wounds disorted extremities and injuries that require the the injured party to be carried from the scene if you submit to a chemical test disclosing alcohol concentration of 8 or more a Delta 9 THC concentration of either 5 nanograms or more of whole blood or 10 nanograms or more of other bodily substance or any amount of of a control substance as listed in the control substance act a toxic compound as listed in the use of intoxic compounds act or methampetamine as listen in the methampetamine control and Community protections act and if you're not a offender your driving privileges will be suspended for a minimum of 6 months or if you're not a first offender your driving privileges will be suspended for a minimum of one year you are further warned that if you're a commercial driver's licensed CDL holder your CDL privileges will be disqualified for the following time period if you refuseed to submit to or fail to complete all chemical tests requested or submit to a chemical test disclosing an alcohol concentration of 8 or more or any amount of drug substance or intoxicating compound resulting from the unlawful use or con consumption of cannabis as listed in the Cannabis Control Act it controls substance as listed in the Illinois control substance act or intoxicating compound as listed in the use use of intoxicating compounds act or Metheny as listed in the Metheny control and Community protections act if you have not had a prior 12-month disqualification of your CDL privileges your CDL privileges will be disqualified for a for 12 months if you've had a prior 12-month disqualification of your CDL privileges your CDL privileges will be disqualified for life motorist under 21 you further warn that as a motorist under 21 if you submit to under 21 if you submit to a chemical test disclos an alcohol concentration of more than 0 or less than 8 your driving privileges will be suspended as provided in section 6-28 point2 and 11-50 1.8 of the Illinois vehicle code AS provided in section 6-28 point2 you are a first offender unless you've had a previous suspension under Section 11-50 1.8 for refusing for refusing or family to complete a IAL test or for submitting to a chemical test is closing of alcohol concentration of 0 if you're a first offender your driving privileges will be suspended for minimum of three months or if you're not a first offender your driving privileges will will be suspended for a minimum of one year school Bush driver you further warn that is a school bus driver operating a school bus in accordance with section 61061 A of the Illinois vehicle code if you submit to a cical test as closing of an alcohol concentration of more than 0 you privileged to possess a SCH bus permit will be canceled for 3 years as provided under Section 6-16 A and 6-16 pointb of the Illinois vehicle code okay Danielle um do you have any questions regarding that law so so what that means what that means is I'm going to ask you for a um for a blood draw um blood and urine blood and urine and if you do not if you do not so you're refusing where well no it's a yes or no it's it's you're going to refuse so yes I'm pretty sure I want my word okay so that's peace officer 7 to o l CS5 31st 21A possession 625 to 51s to 500 to15 a and possession 720 I CS 646 60th a I'm going to go grab that stuff and then I'll start at the call yep you you'll get a call
