Based on her suspicion of impairment, Roxanne was asked to perform field sobriety exercises. Tell me he's okay. I don't know, they're checking him out now. Officer Iacono started with the walk and turn test. Roxanne was unable to follow instructions, so this test was terminated. The second exercise was the one-leg stand test. During the one-leg stand test, Roxanne failed to raise her foot in the proper fashion and put her foot down before the test was complete. All right, first test is going to be It's Put your hands by your sides. First test is going to be a walk and turn test. What's that? A walk and turn test. So, I'm going to place you in the starting position. I want your right foot in front of your left foot, heel touching your toe, just like this, keeping your hands down by your side. So, go ahead and get in that starting position now. Bless me. I can't do it. All right. I can't do it. Well, we'll just give it We'll give it one more shot, all right? Like I said, starting position, have your right foot in front of your left >> do this right now. I can't do this right now. Roxanne, just freeze for me. >> Please, God. Please, God. Put your hands down by your side. We're going to try this test one more time, all right? Get in the starting position, put your right foot in front of your left foot, heel touching your toe on the line. Just get in that starting position for me. Yeah. Oop, I didn't tell you to begin. Just go back. Oh my god, just let it happen. This is going to happen. Are you refusing to do these tests? No? Okay. Then let's Like Like I said, get in the starting position for me. Right foot >> do have a bad Okay. That's fine. And that will be That will be noted. But I need you to get in the be Get in the starting position for me. Right foot in front of your left foot, heel touching your toe, hands down by your side, and don't move once you get in that position. I can't. Oop, I said don't move. Just get in that starting position for me and don't move. Right Right on that line. Left foot right foot in front, heel touching your toe, hands down by your side, and just stay there. Yep. Stay in that position. Wait. Oh my god. I need this. Please. Just keep your hands down by your side and remain in that position until I'm done explaining the remainder of this test, okay? All right. This test is called the walk and turn test. You're going to take nine heel-to-toe steps, counting out loud, keeping your hands down by your side. It's going to look something like this. One, two, three, and Just get back Just get back in the starting position. This is so unfair. Oop, not yet. Just stay in that starting position until I'm done explaining the remainder of this test. If that one's not working for you, we can do the one-leg stand, all right? Do me a favor, get in the starting position. I'm going to place you. Not right now. We're doing some tests. All right? I don't, but right now this is what I'm focused on. So, just put your feet together, hands by your side. Are you doing Are you refusing this test? Okay. Then keep your hands down by your side, keeping your feet together. This is called the one-leg stand. So, just remain in that position until I'm done explaining the test. You're going to raise a foot of your choosing 6 in off the ground, keeping your foot parallel, staring at your foot, you're going to count out 1 1,000, 2 1,000, 3 1,000. It's going to look like this. 1 1,000, 2 1,000. Let me start over. And that's a good example. If you place your foot down at any point, you can pick it back up and restart and just continue on. So, 3 1,000, 4 1,000, 5 1,000, 6 1,000, 7 1,000 until I tell you to stop. Do you have any questions? No? Okay. Go ahead. Keep going. I'm sorry? Whatever I told you, whatever foot of your choosing. Based on the motor vehicle accident, the odor of alcohol, and her inability to satisfactorily perform the field sobriety exercises, Roxanne was placed under arrest for operating under the influence. She was initially transported to the Wildwood Crest Police Department for the administration of the breath test. I'm going to conclude the remainder of this test just for safety reasons.
