Okay. >> Please. In your statement on March 1st >> Right. I said that about ironically the fire. >> Yeah. >> But like I don't >> And then ironically 2 hours later >> I >> life imitates art and it happens to you guys. So EJ had the blueprint on how to take care of you and Wally. >> On March 21st, 2017 in Guilford, New York, Heather Franklin was brought in for questioning in connection with the death of her adoptive son Jeffrey Franklin, who had died as a result of actions prior to a house fire that was set to conceal evidence. Spoiler details are in the video description and the full results of all charges in the case are laid out at the end of the video. >> You had it right there. And then you did. >> So I'm not sure if this >> Looks like you were though. That's the problem. >> You're running all around town at an unusual hour without a license. And then you do say after you leave Walmart in Norwich the second time, you go back toward the fire. I went back and found there was a fire. I went back toward the fire. Like towards the fire. >> Right. >> Like I don't know what you mean by that. The slipper not it was said. >> My opinion is that my >> I had no >> Sure. >> way of knowing there was a fire at that point. >> Well, it Can I tell you also what I think and I could be wrong. Tell me if I am. Is that when you came back from Walmart the first time over the hill? The the house wasn't fully going with the fire. Therefore, you went to Price Chopper. Then you went back around to Walmart. And and and you're going to these places and buying these things to give yourself an alibi. That that and that's my conclusion and I could be wrong. But I have nothing else to go on other than what we have in my own experience as an officer to draw a conclusion. Because you're not you're not giving us anything. >> [clears throat] >> In your shoes, I would not roll the dice. I wouldn't go to jail pregnant. >> Help yourself. >> I'm trying the best I can to help you. >> Keep your baby out of DSS care. Cuz like I said before, this doesn't go away today. This is just the beginning. Okay? And it's going to get out there. And I don't know if maybe you you're concerned about what other people are going to think or say or you know, the people that have been donating money or whatever it may be, but that's not worth rolling the dice to go to jail. >> It can all go back. I don't care anymore. I just don't care anymore. >> Can you explain to me why you haven't shed a tear since he told you that K.J.'s being charged with murder? >> Cuz I just don't care anymore. Why do you need me going to? >> That, too. Help us help you. >> Help you with your baby fake cry? I mean No. >> No. No. I want you to help us help you. And in order to do that, we need to know everything about that night. >> Sorry. Sometimes I get emotional. >> But we still need to know everything about that night. >> I told you everything I know. >> You are going to roll the dice? >> I don't know what dice I'm rolling. >> You're rolling the Right. >> baby's future. I can do this. >> easy. No, it doesn't involve me. >> Because it's not I'm going to tell you what I know. I can't tell you something >> EJ saying to you in any way, shape, or form? Or he has a change of heart. And he's not going to take care of his family. He's going to take care of himself. >> This is If it hasn't happened, and it's not happening presently, it will happen. Well, there's nothing >> It's nothing wrong. >> There's nothing for him to I mean, you're saying if he turns and doesn't take care of me, that like >> All he's going to do is turn and point the finger at you. It happens all the time. >> All I did is burn the house down. Heather's the one that that killed JR. >> That's That's what his story's going to turn into. >> Once he get in that cell, the door slams. >> Cuz once he get in that cell, the door slams, it makes it real. And nobody wants to look at that. So, then the story starts changing. They start looking out for themselves. That's why you need to look out for yourself now. >> I am looking out for myself. >> We We have this >> If he turned and said something like that, it would be >> [snorts] >> a lie. So, I mean, I don't >> Well, how do we know? >> I mean >> You're not saying anything different. So, how do we know what's a lie? >> I am telling him. >> You're saying that he's gone most of the day, you're with JR. >> Until you leave and the fire is started. And you think no one sees not breathing. >> Unless you tell us the truth, we don't know what's a lie and what isn't. >> I am telling you the truth. >> Was there an accident? You left some stuff out of the truth. Let's put it >> he leave out of the truth? >> What happened to JR? How he ended up dead before the fire. >> Was there an accident that you're not telling us about? >> He told me about taking a nap. >> So, you could cool off. >> I didn't He didn't take a nap during the day. >> Did JR tell you that he I'm sorry, did EJ tell you that he tried to climb through the window? >> I don't know. He He said something about broken glass. He didn't say anything about breaking or climbing through. >> Right. No. Okay. Supposedly he tried to climb through. He didn't have any cuts on his hands. Didn't have any burns on his hands. >> I seen them. >> Yeah. Doesn't make sense. >> I didn't I haven't talked to him really about it. >> How did he tell you he broke the window out? >> He didn't tell me. >> What was he breaking windows? >> I don't know. >> Was he breaking windows to get JR out or was he breaking windows to help the fire go? Or was he breaking windows >> assume to get JR out, but >> Maybe he broke windows cuz he flipped [ __ ] and got mad at JR and broke windows and then accidentally killed JR, too, or something. Who knows? I mean, I think I do. I think you do. >> I can't see that happening. >> But, one thing we know for sure is he wasn't breathing when the fire happened. We do know that. And we know that you weren't home when the fire happened. So, the question remains did he stop breathing before you leave? Did he stop breathing after you left? >> EJ has not mentioned anything to me about him losing his cool other than after the fire. We've really not talked about things. >> Well, he's What's funny that he's telling you that that, but he's not telling you what he did prior to losing his cool. Don't you find that hard to believe? >> What do you mean prior to? >> Well, what he did. I mean, he left out and he shut the electric off, got the propane tank out. We don't know how or when or even if he did try to get into the house. I mean, the dogs are out. I mean, cats are out. >> Right. >> Why were your cats outside cat? >> What's that? >> Why were your cats outside? I thought they were out. >> they were dead. I thought they were dead. My husband told me the next morning that he found them. >> Yeah. So, how come they were outside if they're indoor cats? >> I was just under the assumption they got out. >> Another lucky coincidence. I I saw your cats. They weren't singed, they weren't uh blackened, they weren't dirty at all. >> Isn't that strange? >> Yeah. So did I. What's that? You haven't never had the nerve to ask? Is that what you said? See, so you've seen some of the same things that we have then. You're just too scared to confront him about it. Is that fair to say? >> I'm too scared. >> To confront EJ about that stuff? What are you too scared about then? >> I'm too scared that my emotions are drawing conclusions that aren't true. >> What what conclusion did your emotions draw for you, Heather? >> Confusion. >> Confusion is not an emotion, it's a mental state. What emotion or conclusion did your emotions draw for you? >> So, that he didn't know what happened. Like I I was just scared cuz of how upset I was that I would come to conclusions that weren't true. >> Okay. Well, I think right now you've come to a conclusion that aren't true. You certainly got enough information now to to reach a conclusion. Let me say this to you. >> Okay. >> If you look out your window last night and you see the brown grass and you go to bed and you look out your window this morning and you see white fluffy stuff on the ground. What's your conclusion? >> It snowed overnight. >> Exactly. So >> Yes. >> this looks one way to you before. Now you got a bunch of facts. What's your conclusion now? Heather, I think you can answer that question. >> I still won't answer. >> You don't want to answer it? I think you need to for yourself. This isn't helping you and Wally any having this internal stress going on, [snorts] fighting this. You want to answer it, don't you? Yes, you do. >> The guilt is tearing you up. >> [snorts] >> This isn't helping either one of you. And I think you've known for a while and you just didn't want to you didn't want to come to realization with yourself about it. Cuz deep down you do know. And you're trying to suppress it. But now given the facts that we presented to you, you can't suppress it anymore. And you and you and you're concerned about saying what your true thoughts are. >> I don't know what my true thoughts >> What's that? >> I don't know what >> what it was, I am sorry. >> You do and that's what's making you cry now. >> [snorts] >> What's the conclusion that you're that you've drawn from the facts? As you've stated to us. >> [gasps] [cough] >> Look, the only thing that's going to stop this internal conflict that you have going on is to let it out. >> And it is right, exactly. Otherwise this this conflict inside you is just going to get worse and worse and worse. There's no way to make this better. It's to get that out there and get it off your conscience. >> I mean, I can say what my mind is thinking right now with emotions, but it's not factually anything. >> No, but it's what we call it you're reaching a decision based on evidence. >> [snorts] >> That's what facts are, the stuff that we've told you about, the stuff that you know about. >> based on what people have told me. >> Honey, you're going to reach a decision and I'll let you know, too. We deal with people all the time. We deal with monsters and people who are remorseful and tell the truth, especially when their children are involved. And at the end of the day, the monster and the person who is remorseful comes through. But only if you tell the truth about [snorts] it. >> I told you I don't know what happened. >> Be a mom for JR. >> I can conclude that you guys are saying that my husband did something. You can't conclude conclude that. And a life without JR is hard enough. >> So then let's get JR justice. >> And tell them I how I wasn't there. I can't >> [snorts] >> I mean, how can I sit here and that he did it? >> No, I'm not. >> Like, I don't I wouldn't I don't I just have what he told me. >> Okay. >> That's all I have, but at the same time, like, I have what you guys are telling me, and it's pointing me in the direction that I fear. >> Yeah, but let's not forget about your actions. Right? So, if if you understand how we reached the conclusion about EJ and what he did, you got to understand how we're reaching a conclusion about you based on what you did. And and driving all over the countryside for almost 3 hours for no real legitimate reason. I mean, that just looks really fishy, too, doesn't it? >> That is, but you can't change the fact that that's what I decided to do that night. Not He told you that decisions I made to do that. It's not >> You know what? It's not even the fact you went out to the store. If you told me that you went to the store at 10:30 at night to the Price Chopper in the city to get a few things, I'd have bought that, for sure. 2 miles from your house. >> I don't get driving around much, like just felt good driving. >> Back and forth. >> It just felt good. Yes. You know, we could drive. It just felt good. >> [snorts] >> Felt good to have those moments with just me and my brain. It just >> You had that anyway. >> What do you mean? >> Well, JR was here dead or asleep in bed, and EJ was outside taking care of animals. You would have that alone anyway. Without driving somewhere. >> I don't know what you mean. >> You said [snorts] you wanted to >> left as far as I know when I left he was perfectly fine. >> Okay, but he was in his bedroom, right? >> He was sleeping, yes. >> Right, so he wasn't there bothering you or or pestering you or you didn't have to take care of him. >> No. >> [snorts] >> And EJ went outside. >> After I left. >> Right. But he was going outside to take care of animals and stuff. So you didn't have to leave to be alone. You were going to be alone inside anyway. >> It's not the same. It's just not the same. Sitting in a house that you're cooped in in all the time it's not the same. As getting out and doing things. >> What's What's going to happen when people find out that EJ is [snorts] being charged and possibly you being charged for the circumstances here? Are we going to have more people coming forward and saying, "You know what? That just didn't seem right." or "You know what? I heard this." or >> I wouldn't think so, no. Because you locked yourself into a situation that leave all [snorts] this stuff makes sense. What you've done and your actions make sense. It doesn't. The facts prove differently. You have a special needs boy [snorts] who has the mentality of what you say is a first or second grader who is small that everyday needs that poor little tiny >> What are you talking about? >> who is left with you two and ends up deceased and then a house fire is set. That's horrific. You are his mother. You claim you are his mother. >> I am. >> So, make it make sense. You are saving yourself. And it's very >> [snorts] >> transparent. No mom does that. >> I'm not saving myself. I don't understand how you say I'm saving myself. >> Because everything else does not make sense. He was dead in that bed. And EJ set that fire. And that's what it looks like. The facts tell us that. And you're out gallivanting as Sydney to go back for a fire. You left him there to burn. >> Maybe he didn't know he was dead. Maybe he knew that EJ had done something to him. Or maybe he knew he was going to do something. >> No, accidents. >> Maybe he was doing something when he left. >> No. Have there been times I left before when EJ was upset? Yes. >> [snorts] >> When would you leave? >> If he was too upset. >> Like what would he be doing for you to leave? >> He'd just be outside mad or something. I'd get JR and we'd just >> So, you had to leave for your safety. >> I wouldn't say for my safety. Just to get away from it. Just >> Would you [snorts] always >> not let JR see him that mad. Just uh >> Would you always take JR? >> Yes. >> Always? >> Yes. >> You never left him there? [snorts] >> No. That would be stupid. >> What set EJ off that night then? >> Nothing. Nothing set him off. He was fine when I left. >> He was >> No. I left him like a hugged and kissed. Everything was fine. >> [snorts] >> Okay. When I left everything was fine. >> Did >> All I can tell you about after I left is whatever he has told me. >> Has Has EJ talked to you about Jared getting on his nerves lately? Like maybe you know, maybe he he should go and we can raise our new child and not have >> to do with this new child. Nothing to do with him. >> No, but it has a lot to do with the stress of having a newborn and a 16-year-old who >> [snorts] >> pees in the corner and poops in the hamper. >> that is stressful. >> So, has he talked more lately about sending him on his way? >> Like I said, in those moments of frustration we talked >> Okay. >> But it's nothing that we ever act on because we knew it wasn't We knew he needed family. >> But >> I would have done it if I knew it would have been this way. I would have rather had him in residential than this. This is never >> Did you foresee this coming to this point? >> no. No. But looking back, if I did, I would much rather have him in residential than this. >> I would make sure he was safe. >> is Huh? >> What happened? >> I mean, my whole fear through this whole thing is that he didn't >> He didn't what? >> My whole fear through all this was that Jared didn't suffer in the fire. But I guess I know otherwise now. He suffered some other way. >> But it wasn't fire. >> I don't know how. AJ has not said anything to me. >> Do you need something to eat? You want something to snack on? What would you like? >> I don't think I can eat what I was said. >> Oh, I just wanted to make the offer offering to you. If you do need something, I can get you something. >> Yeah, but I need something for the baby though. >> What would you like? I have some natural grain oat bars. >> Sure. >> These? That work? >> Okay. >> All right. So, listen. Before I came back here, I talked to her and the light was on for a guy. >> Yeah. >> Um it turns out he had to go testify this afternoon in court on what he did last week. So, he's not available today. So, we'll get back to you on that at some point. >> All right. >> All right. >> Okay. >> You want a cup? All right. You good there? >> Yes, thank you. >> [snorts] >> If you need something else other than that, I can try to get you some of that too, okay? Pizza or sandwich or something. >> I want to believe everything that you [snorts] say that is true. It just doesn't seem possible. >> I have to agree with her only because of my training and experience. I just I've never seen anything like this. That's all. And I'm being truthful with you and I told you from the start that I wanted to be truthful. >> being truthful and I don't know what else to tell you guys. I mean Unusual for me being out at night? Yes. >> Mhm. >> I'm not covering that fact. Did we have problems with JR? Yes. I've never hidden that. >> But you're 100% 110% >> He was okay then. >> that he was okay when you left. No question. >> No question. Well, I mean at least he was okay at 9:00 when he went to bed. Like I said, I did not check in between that. >> When was the last time that EJ had had to go outside to calm down? Or calm down at all? When was the last time he seemed to have an anger outburst? >> I really don't remember to be honest with you. >> Is there any times that he threw things? >> I mean yes. >> Did at any time did they hit you or did they hit JR? >> No. No. No. >> Or did he apparently [snorts] in an outburst he hit JR or you? >> No. He would go storming past but never hurt. Never. >> Did he ever take anything out on the >> livestock? >> Or the dogs or be too aggressive towards the animals? I think there were the pig once but >> What did he do to the pig? >> There wasn't a He just had trouble getting the pig back in so He was [clears throat] trying to kick it in or something like that. >> Would he ever wake up in the middle of the night with nightmares? >> Yes. That he did. >> He did. Was that often? >> Sometimes. >> Would he ever >> Often. >> Did he ever Did you ever wake up into him grabbing a hold of you or anybody else or sleepwalking or >> up to him scaring out of bed a couple times. >> Okay. Did you ever go check on him? >> Well, yeah. Then he'd be fine to get back into bed. >> Okay. Did he Did um Did JR ever come into your room and >> No, we slept with our door locked. >> Okay. >> [snorts] >> Why is that? >> All these years of foster kids and foster care and everything, you just never know what kids you get in. So, we'd rather them knock on our door than just walk in and >> Got you. >> Cuz that was our marital room, you know, so we like the door locked cuz >> Right. >> That was our intimate time. >> Do you believe the fire happened Do you believe the fire happened to cover something up? >> [snorts] >> Do you either you do or you don't? >> Yeah, I believe the evidence you guys are giving me. I still can't imagine my husband doing that. This is the man that I loved for years. I'm not saying that the evidence you're giving me is wrong. >> Mhm. I I just can't figure out any other way that that something that this plays out any other way than what it states. I mean, like I said, I've been doing this a while. And I I'm being straight when I tell you I I think that your roundabout way stuff, as we've said before, is a little bit it's off. It's it it's concerning. You're adamant. You're You're You're saying no no no, and you know, I I we want to believe you. I just I I don't know what else I'm trying to think of other things that like maybe if we give you some time to write something down a piece of paper about maybe outbursts or anything that you can help remember to >> I mean, there was no outburst that night. >> Okay. Do you want [snorts] to go Do you want to want us to give you some time to go through and write the steps of the night before >> [snorts] >> and what happened the day before to help you remember things? >> I'm bad at writing. >> [snorts] >> Let's start again. You said that that morning, where was EJ when you woke up? And they go to school, right? >> And good. He always wakes up after me when he stays home. >> So, what time do you think you got up? >> Probably around 9:00. >> ish 10:00 ish >> [snorts] >> And 9:00 ish and then I don't remember any of it. Whatever 12 hours of sleep JR had, I set the alarm for. So, that way he didn't sleep too long and I would go in there and wake him up. >> Do you do anything before you go to wake him up? Like that sort of thing, brush your teeth, wash your face. >> I go to the bathroom, of course. I'm probably not. >> [snorts] >> I put a robe over PJs on. I go out there and I get him up before I even get my coffee. >> Okay. And what generally You go in that morning and you wake him up? >> Yeah. >> Does he spring out of bed or >> He always groggily follows. >> Uh-huh. >> And he gets up and All right. Well, he knows his morning routine routine, so he goes and does it. >> And what's this morning routine? >> He'll go to the bathroom. He'll sit down to poop first thing in the morning. You know, brushing his teeth. And then come to breakfast. >> And he doesn't get dressed or anything first. He comes in and eats breakfast. He's kind of lazy about PJs and stuff. Okay. And you weren't sure that morning what you ate, right? >> I don't want to say cereal. That was a typical morning. >> Okay. And he doesn't take any meds or anything like that. >> Cereal was a typical morning. >> Okay. And then what do you do? >> Hm? >> And then what happens? >> That's a specific day. >> Mhm. I'm trying to >> Take your time. >> Everything is very blurred, but >> Did you have >> There was no reason for me to really remember what exactly happened. Like what order we did things. Like I mean >> Well, say what you remember, and then we can have to go back and say what order it was, then we can put the pieces together. >> Maybe I remember him working on his room a little bit that day. >> Mhm. Was it something you just went and did, or did you tell him? >> No. No, it was uh >> It was after breakfast? >> I did that or after school work. >> Okay. >> Much of he did school work, it was very minimal because of the the behaviors and everything. It was sometimes just not worth the fight, to be honest with you. Depending on how that went, it was like I said. >> So, he went to go work on his room. You remember that? >> What time of the day? Yes. I remember. I remember if he had any food in his room that day, or if it was the day before, or what. >> Remember lunch? >> Maybe toast for lunch. Something very simple. >> Who who ate lunch? Do you guys all eat together? >> No. No. >> Why you say it like that? >> Well, EJ's not a morning breakfast and lunch person. >> Okay. >> And me, I just kind of I eat at random times throughout the day. And then which JR eats more than I sit down and sometimes he takes forever to eat. He'll sit there for an hour eating. Sometimes. >> So you think it was just toast? >> It might have been toast. I'm not sure. >> Not at all. What time >> No, it was probably baloney sandwich. >> Okay. >> Okay. But say I remember something with bread, it was probably baloney sandwich. And probably like some chips with it or something weird like that, you know, or nuts. He loved nuts. >> And was he cleaning his room before or after lunch? >> Probably more than after. I would imagine. Cuz if it was before, he was working on school work. >> Okay. >> I don't know. I don't remember. It was an old dot-to-dot she was working on the what? I don't know. I don't remember. Exactly what. >> And then what do you recall? >> I don't know. Just him sitting there and I remember I was still like his hair or whatever. That was day after she was doing what, but >> [snorts] >> Yeah. It was constant with JR coming in with the dogs in the house and everything. They're always tracking in mud. >> [snorts] >> So you were doing housework? >> Yeah, it's my typical day. >> [snorts] >> Nesting, you know, getting ready for baby and I was I think I think for me I was pulling things I'd been working at getting the baby's room cleared out cuz we had everything pulled off the walls, construction. Why is it there? So I remember being in there doing stuff and I don't remember. I might have been going through totes or something. >> Totes of what? >> Um There was a few totes around stuff. Memory stuff, baby stuff, toys, whatever. Whatever kind of stored up in that room that made its way to totes. And some stuffed animals that my mom sent back to get his back with it. It's mostly stuffed animals my mom sent back in the past December to go through. I don't know when he grew up. So, I remember I keep checking in on JR cuz to see what he's doing or what not. I'm sure there was bathroom breaks in between there somewhere. >> What was he doing? >> He was supposed to be cleaning. >> His room? >> Yeah. >> How long was that from start like how long did that go on for? >> I don't know. Every time I walked in he was with a rag going like this or >> [snorts] >> I don't know if he was cleaning a wall or a tote that he peed on or something. >> So, would you say that's a couple hours or >> Maybe. >> Okay. >> And where was Where was EJ? >> I don't know. What was he doing? >> EJ was at his appointment. >> And what time did you say again that was? >> Yeah, I think they It was 1:00 something. And I think it was EJ when he His phone he has trouble getting up in the morning, so it's not unlike him to sleep until the time he has to go. >> Okay. What time How long does it usually take to get to his >> It's just in the morning, so I think I want to say there was something that he did before that as far as pick up something from the store. So, I think I remember him leaving more than I would knew. I don't know that it was a light switch for the baby's room or what it was. >> Okay. >> And then I know he was running around afterwards. >> So, it's just you Um you mentioned that JR did not go for a nap that day. >> No. He didn't go for a nap that day. >> Yeah. >> I don't remember. >> Okay. And you're [snorts] going through totes. You just keep checking on JR and you had to give him some bathroom breaks. >> No, I mean he I remind him, "Hey, it's time to go." Only in the times and in situations where he's doing something he doesn't want to. He >> He says >> Well, he says he's got to go and then he just stands there for half an hour. >> Yeah. >> I thought you had to go. I do. I do. >> Okay. >> My daughter [snorts] does that when she doesn't want to eat. She wants to get down from the table. She tells me I have to go to the bathroom to get away from it. So, >> he was Was he doing that that day? Do you remember? >> He does that every day. >> Okay. >> Unless he's doing something extremely >> And then I guess at what point does he stop be get get away from that? >> I don't know. Do dinner, I think. And that was the night that we went out. >> But you're not sure of that. >> Right. Might be. And then that was the night that he would have gotten dressed. >> Now, do you usually have to lay out an outfit for him or >> I normally just yeah, pick it out. I mean, he can do it himself, but >> [snorts] >> make it a total freak in me. I don't want to wear like work clothes to go out. Like shorts or something. Especially if you're going to dinner or Whole Foods or anything. And So, if that was the night that he did go to dinner it must have gone after EJ got home. >> Oh, yeah. >> Okay. And he doesn't usually do chores before dinner. It's usually later. >> No, EJ or >> Uh EJ with the chores with the animals and >> Oh, yeah. No, it's at night. >> [snorts] >> It's at night depending on the time of year. It's at night. What time did EJ think he went to dinner? It would have been when he got home. I don't remember any time. It was a whole blur. Okay. That was the night and they came back and showered. It was in bed. Now, if it wasn't the night, what what would you have done if you didn't go to dinner? >> I think it was. Because I remember I was going to make stuffed green peppers. I don't know if the meat wasn't thawed out yet or what. So, it might have been that night. >> Okay. Yeah, cuz you did mention you called him up to get peppers, right? >> Right. I don't know if the meat was thawed. >> So, you likely went to dinner on the 20th. >> Likely. So, I can't remember what I made, so I'm assuming. I remember thinking about stuffed green peppers and was planning on making them cuz I remember asking him to pick up rice, too. From EJ's. And then we were out of EJ's breakfast essentials. Which EJ didn't have his breakfast essentials that morning. Okay.
