the homo Township Police Department observed a rended 2021 Volkswagen Atlas being driven in an erratic manner on Route 30 for northbound near shank road before a nearly colliding head-on with his patrol car and subsequently striking a guard to the opposite side of the road he activated his emergency lights and made contact with the driver who was later identified as Kayla as he made contact he noticed that the airbags had deployed and he cut the front side airbag with a knife before Kayla exited the vehicle Kayla exited the vehicle and he asked her to explain what happened you okay yeah I'm okay can I open the door yeah okay yeah I don't know how to open this okay just hold on one sec no I'm okay yeah affirmative sorry um just working on getting her out of the car she's saying she's okay informed patroman nokee that he would cancel it because Kayla claimed that she was not injured and declined further medical attention yeah when you're coming down this way oh what happened there was a truck behind me so I was just trying to be on my side of the road okay here take a step towards me yeah yeah yeah yeah let me see your hands are you hurt no no no I'm okay okay cuz you hit the guard rail no I was driving really slow actually I only had you know like one or two drinks I I was driving really slow she's saying she's okay but um just have him uh stop out so she can r or we at uh well okay all right um here come to me sure and just turn and face your car okay all right based on his suspicion of impairment betran no key asked Kayla to perform field sobriety exercises patroman nokee started with the horizontal gaze nagas hgn test the next exercise was the walk and turn test and Kayla failed to walk in a straight line and touch Heel To Toe on each step the final exercise was the one like stand test and Kayla failed to raise her foot in the proper fashion while using her arms for balance uh what's your highest level education uh I have an associates degree and away is English your primary language y okay just put your feet together and put your arms down by your sides you see the tip of this pen mhm I want you to follow the tip of the pen with your eyes and your forward you're going to count each step out loud you're going to keep your arms down by your sides look down in your feet as you do so you're going to walk like you're on an imag an imaginary line okay once you've reached the ninth step you're going to take a series of small turns and take n steps back in the same manner I'm going to demonstrate for you now you're going to be in this position you're going to take one two three I took three but you're going to take nine you're going to take a series of small steps and take nine back one 2 three okay again I took three but you're going to take nine do you understand that test yes you can begin one two 3 4 5 6 7 8 [Applause] 9 1 2 3 4 turn and face me just uh put your feet together keep your arms going by your sides I want you to stay in that position till I tell you do anything else okay um are you injured from doing that last test yeah okay when I tell you to you're going to raise one foot of your choice approximately six inches off the ground keeping that foot parallel uh with the ground and it keeps uh your arms down by your sides look at your raised foot and count alloud by the thousands 1,001 1,002 13 you'll continue to do that until I tell you to stop um I'm going to demonstrate that test for you now so you can see what that looks like you're going to be in this position and I'm going to raise my right foot 1000001 license rication of up to 20 years a fine of up to $2,000 installation of an ignition interlock and referral to an intoxicated driver Resource Center these penalties may be in addition to penalties imposed by the court for any other offense of which you are found guilty you have no legal right to have an attorney physician or anyone else present for the purpose of taking the breast samples you have no legal right to refuse to give or delay giving samples of your breath any response from you that is ambiguous or conditional in any respect to my request that you provide bread samples will be treated as a refusal to submit to breath testing even if you agree even if you agree to take the test but then do not follow my instructions do not properly perform the test or do not provide sufficient breast samples I will charge you with ref refusal to submit to breath testing I repeat the law requires you to submit samples of your breath for testing will you submit samples of your breath no not even sure if I'm suppos to read the second part but I'm going to just read it anyway um if I'm supposed to read this part all right so it a little bit I'll just have you call try to call
