Around 3:11 p.m. on September 3, 2022, patrolman Troy Hartsgroveve with the Highlands Police Department heard from dispatch that an officer with the neighboring Seabbrite Police Department had called in about a poss a possibly intoxicated driver. The driver was reported to be traveling northbound on Highway 36 in a black Tesla. He stationed himself at Highway 36 and Miller Street before turning onto the highway. Since patrolman Osak was further ahead on the road, he initiated the traffic stop on Highway 36 near Lynden Avenue. After the driver pulled over, patrolman Hartsgrove contact with the driver who was identified as Tinamari Yahert. You >> sure? As soon as you let me see the insurance, I'll explain to you. Here you go. All right. So, the reason we stopped you was we received a call at a Sebrite um for a possible topic driver operating a black Tesla heading northbound with a female driver and a child in the back. Do you have anything to drink today while you're down there? No. >> Okay. Nothing to drink at all? for registration so you can get away with it >> from this side. >> Does she have registration? >> Uh, yes. >> All right. >> Excuse me. Do you have your registration handy? County, a New York State DL. >> Where are we coming from today? >> Which one? Hope. >> How long you been there? All >> day. We got up and watched the sunrise and then we slept. >> All right. Where's home? >> Uh, >> Harrison. Wow, you got a long ride. >> 45 minutes. Yeah. Yeah. All right. All right. Hang tight. >> As she was speaking with Tinamari, he observed indicators of impairment. Tinamari's 10-year-old son was seated in the back seat of the vehicle and she told the officer and she told the officer that they were coming from the beach in Seabbrite to based on the officer's suspicion of impairment. Tinamari was eventually asked to exit the vehicle and perform field sobriety exercises. Her poor performance on the field sobriety exercises confirmed the officer's suspicion of impairment. I don't know like I I don't know if it's her I smell or she said she'd been here since she got up and saw the sunrise and now they're on their way home. So they've been here all day. Sebrite beach. >> Yeah. There's like a weird like I don't know what the odor is. I don't know if it's her body odor or but I kind of stuck my head into here and I got a whiff. But >> it's like we somehow >> she's kind of I don't know if that's just her demeanor or whose car is it. She's New York. >> It's hers. Is it Ma'am, I'm just going to have you step out real quick. I want to talk to you in the back. Okay. Get it over on the grass. So, like I said, I don't know who called it in, what their reasoning behind it was. Um, you're saying you didn't have anything to drink at all? >> No. >> Okay. >> Last time they did, not today. >> Okay. There's like a little bit of like a fruity type smell or something. I just wanted to get you away from the car. See if I smell anything on you. Um, can you recite your alphabet for me? A to Z. >> A B C D E. >> Can you not Can you not sing, please? >> A B C D E F G H I J K L M N O P >> C R S T U V W X >> Y Z. >> Okay, you just put your feet together like this and keep your hands at your side. Do you have any problems with your eyes? Okay. Can you tip your head up a little bit? Great. >> All right. See the tip of my pen. Mhm. >> Okay. You're going to keep your head still and you're going to follow the tip of my pen with your eyes and your eyes only. Okay. >> Okay. You haven't had anything to drink, but I have your pupils are like jumping around a little bit. >> No, last night I did nothing. >> Okay. We got up very very early for the sunrise. I'm very tired. >> But >> just back your car up 10 ft or so. >> Okay. Um, what time did you stop drinking last night? >> Midnightish. We got up at 5:30. We watched and then I'm just really tired right now. >> Okay. I have you do another test just make sure you're okay. Okay. Can you just stand right here for me? And um yo, you're going to be walking. So, if you want to take your shoes off, you can take your shoes off to do this test. Um if you want to leave them on, you can leave them on. Okay. What? >> I'm just going to have you walk in a straight line and walk back. So, if you want to take them out, if you want to take your shoes off, some people like to take their shoes off. Okay. Could you put your left foot in front of your right foot like this in a heel to toe fashion? Put your arms down at your side. Put that. Let's not start until I tell you to. Okay. So, left foot in front of your right foot like I'm standing now. Feet heel to toe in a straight line. Hands at your side. Can you get in that position? Just like that. Sure. Um, when I tell you to begin, you're going to take a series of nine steps heel to toe out in front of you in a straight line. You're going to count each step aloud. When you get to your ninth step, you're going to turn in the semicircle and you're going to go back. Nine heel to toe steps. It's going to look like this. Don't start. So, you're starting left foot in front of your right. One, two, three, all the way up to nine. Pivot. Turn the semicircle. Go back nine steps. One, two, three. I only did three steps. Like I said, you're going to do nine. Um, can you slide over actually closer to the curb? And you can begin whenever you're ready. >> Now I'm nervous. >> Okay. Well, >> we're trying to make sure you're not intoxicated. >> 1 2 3 >> Hands down. 5 6 7 8 9 10 11 >> You heard me say um >> heel to toe, correct? you aren't touching your heel to toe. So, if you do want to take off your shoes so you're not stepping on your flip- flops at all, but you aren't you aren't even coming close on the heel to toe steps. So, start there and then your first step is going to be one. Okay. Heat. Heat. 178 coming her deal valid until 10 of 24 and she's around. >> No, you could have stopped back up there. Um, are you on any types of medication? follow you out a little. >> Okay, you can put your foot flash back on. Have a seat against your car. Um I'm going to be with you in a second. I just got to go back to my car. >> No, ma'am. Just stay out by the um the bumper. Just stay on the outside of the carpet. Did you guys eat today? You eat today? >> I said >> you didn't eat. >> I didn't eat. >> It's a long time with no food. Okay, I understand. >> Now, you left your house when to come down here? >> Sometime like around like 5 in the morning. >> All right. So, you left Harrison at 5 in the morning. >> Yeah. There's nothing wrong with that. That's nice. >> But you didn't eat all day, right? >> I had some I had breakfast, but >> Harrison, that's up by what? Fish House Road. >> It's by New York. >> Yeah. Right. By Belleville and all that. Right. >> New York City. I run a gym. >> Okay. >> In New York City. So I took the PAP train. >> Right. I work in Jersey City, too. >> Yeah. So I You live there and me and his dad aren't together. So um that was our middle ground. >> I hear you. How about your son? How old is he? >> 10. All right. school started for him yet or tomorrow uh Tuesday. >> Where's the gym at? Midtown. >> Yeah. Up in Broadway. >> That's Midtown. >> It's a private space. >> Yeah. I do that and then I'm an educator. So >> educator as what teacher >> like I trainers. >> All right. Sorry about that. She has an ID. Fitness is a 24/7 thing, man. 7 days a week. >> It's good. >> So for me, New York is suspended. Kids, kids need that, especially growing up. >> Yeah. It's hard when you're tired split because >> I've been there. Been there, done that. Yep. I got three kids. >> It's interesting in both ways cuz as a parent you want to do certain things, but for them they also expect certain things. So like sometimes I have to explain. >> Is it that time with you now? My time with you. >> Yeah. That's the hard part. Yeah, I've been there. I know. >> How do you like this Tesla? >> I've had it for a little over a year. I like it. >> I mean, I got it when I was with my recent ex. So, when we split, I was like, "Oo, financial going to actually fast places to stuff." I was like, you remember >> I I just I just traded in my pickup truck for a hybrid Jeep. Didn't go complete electric, but yeah. Hello. Whose car is this? Yours? Do you understand me? Let me just do another test again. Reach out. Touch this with the tip of your finger. Put your hands right down by. All right. What I want you to do, can you just put your hat a little higher on your head? What I want you to do is I want you to follow this with your eyes and don't move your head. Okay? Don't move your head. Okay? Stand by. I'm ass. How many drinks have you had today? >> I didn't have any today. I had some last night. >> Last night? But now I want to drink today. >> Mm-m. >> What time did you start drinking last night? >> About midnight. 5. >> 5 in the morning. >> Okay. Breakfast. >> Where Where were you last night? Home. >> Where's home? New Jersey. >> And you woke up at 5 in the morning and went to the beach. >> Okay. How much did you drink last night? >> Like two glasses of wine or three, but I didn't eat a lot. I've been like I was telling him like I went through a breakup recently and I I struggled to eat. Um it was about a year ago, but still I'm still struggling. >> Struggling to eat. >> Okay. started some medicine. How old your son? Where are you at right now? That's Harrison. Do you have any problems with your license? >> No, I have one. Okay. Okay. All right. Stand on this. I just want this road. Just want to >> Your license wouldn't be suspended for any reason. The only thing I've ever had was a speeding ticket one >> and you paid for it. >> I went to um a fee to pay for it when you pulled the hill. And >> you don't have any you don't have any issues with your eyes. Have you ever went to an eye doctor or anything? >> I do wear glasses. >> Okay. >> But they're not that's not period. >> That's fine. Just >> hang out here. We'll be right with you. So, um, she had such crazy. >> Yeah. >> Um, and I smell booze on her. >> I I smelt it in the car. >> She was drinking the night before. >> Smell in the car. I don't smell it on her. >> I smell it on her. But if you're not Her wife's suspended >> Mhm. So if you're not comfortable, I >> don't think you have enough to line her up. >> Go ahead. >> Spoke with one of the officers over at Sebrite. She said to her knowledge there was no further information, but the officer that gave us this information is currently tied up on a domestic. So we'll have to wait for further information. >> Yeah. We're going to make her We're going to make her get a ride here. >> Do you think that her SMTs were >> good enough where you don't think that she's intoxicated? We have to lock her up for 450. Um >> Yeah, I hear you. >> You know, we we can't her car because she's suspended. She's in a terrible place here. >> Um so you have her car and that's going to in case you're wrong, it gives you a little time. >> Um all right, I'm going to I'm going to have her run the test the uh the other test again. Um, she said she was nervous, but we'll have him run in front of him again. >> Sure. Yeah. >> What is your name? >> Tina. >> Tina, can I just have you stand here again? I know you said you were nervous before. I want to give you the benefit of doubt and have you do those tests again. Okay. So, if you want to pop your shoes off again, you can. And uh so you're going to stand with your left foot in front of your right foot like you were before. Hands at your side. I'm going to explain it again. So don't start until I tell you to. So left foot in front of your right foot. Hands at your side. You can do that now. And then stay in that position. Okay. Um when I tell you to begin, you're going to take a series of nine steps straight out in front of you, counting each step aloud. Each step is going to be heel to toe. It's going to look like this. 1 2 3. When you get to nine, you're going to turn around and semicircle and go back just the way you came. One 2 3 all the way up to nine. So down one time. Uh semicircle. Go back. Okay. Whenever you're ready. What heat? Okay. The next test we're going to do is one leg stand. >> Would you be more comfortable doing the the grass versus ladder? >> Yeah. >> Okay. So, just stand with your feet together, hands at your side like you were doing before. When I tell you to begin, you're going to lift either foot of your choice approximately six uh 6 in off the ground out in front of you. You're going to look down at your toe. Okay? You're going to count aloud by thousands. It's going to look like this. 1,00 1,002 100,004. If you put your foot down, just pick it up and keep going. Okay? Like 1,005 1,006,008 until I tell you to stop. Okay? You can begin whenever you're ready. 1,001 100,0006 1007 1008 1009 1,23 1 >> Okay, you could you could stop. Put your shoes back on. Just hang out there. Okay. >> Um I think that you have >> all the clues for >> Yeah. >> you know to take her. Um again she's she could be close. She, you know, um the safe side would be a taker. She failed the test. >> I hear the kids there on everything. >> I hear you. >> Um your call. We all got like if you choose to do that and she's cooperative. I don't mind cuping her, >> taking the kids with her. Well, we'll figure that part out later. >> Okay. >> But like if you think she's cooperative, she's going to be okay. I don't want to see a kid traumatized with a mom. You know what I'm saying? Avoid that. They stay together obviously. >> Maybe they go with my car. >> Okay. You know, I think that they're both divided, right? >> Uh, both of them are divided. >> So, pull her back here. Maybe you can tell her something along the lines of like, you know, I don't know. >> Yeah. Figure that out. But, ma'am, can you come back here real quick? You want me to tell you? >> Sure. Yeah, sure. >> Okay. Uh, this officer conducted some tests on you. Based on the results of those tests, we believe that you're under you're some kind of consequenc. >> So, as long as you stay calm, there's going to be no handcuffs, okay? We're just going to we're going to keep doing this together. You tell them that there's a problem with the car or something. All right? We'll go to headquarters and we'll do some paperwork and then you'll be released. Okay. >> Can we just go a quick check in to pick you up? >> Well, if you're intoxicated, it doesn't work that way cuz we have body cameras and we gave you two chances to do the tests and you didn't do great on either of them. Now, we want to be respectful as possible, not give your son any kind of any kind of trauma that he doesn't need. But unfortunately, that's that's what has to happen. Okay. My best friend doesn't change. So let's get started. What are you going to do from the car? So normally right now I don't want to do that. So you have to cooperate 100%. >> Would you be okay with us? It has to be on 12 hours. Freddy is going to have to come and pick you up. >> So, right now, you just need to tell us what you need from the car. >> So, what do you need from the car? >> There's not going to be any more debate because we're supposed to be putting handcuffs on you and everything. You don't want to do that in front of your son. Okay? I don't want to I don't want to put that in his head. I don't want to embarrass you in front of him. We don't want to do any of that. We want to make this as painless as possible. So, you have to cooperate with us. Okay. Under arrest at this point. >> Okay. What do you need from the car? Can I sit for a second? 17289. We'll have a female 41. >> Can you send a toe for jungle? >> Please put it just like quick track. >> 41 and a jungle 153. >> Miss, what do you need from the car? I understand you're upset and you got a lot going on through your mind right now. But we do need whatever you need out of the car and then um ma'am, you have to be cooperative right now or you going handcuffed. I'm >> sorry. I just >> It's not a It's not a debate. You have 5 seconds to get up and tell us what you need or you're getting handcuffed. Okay. >> Can I get a bag? >> Just tell us what you need. You're not going in the car. >> Tina, stand up, please. >> This is supposed to be a day of my son and I once a year we go and watch the sunrise. >> Okay, then. >> Okay. Well, then I've explained this to you numerous times. We're done with this. I do not want to do that in front of your son. What do you need from the car? What's your son's name? >> Based on her erratic driving, the odor of alcohol, and her inability to satisfactorily complete the field sobriety exercises. Tinamari was placed under arrest for DWI.
