Her mom's on the way, so. >> Her mom? >> No, owner's mom. She gave her this key to give back to her mom this week cuz she was never She was leaving to go out of town. Never given permission. She was only given this to give back to mom. And then she started using this all weekend coming and going. So, owner's out of town, sees it on the camera, calls us and says, "Hey, she's in there. I want her gone." Like, she doesn't live there. She doesn't have any property there. The house is beat the crap I don't think anybody actually lives in there. >> You been inside? >> I didn't go in and look around, but the windows are busted here. They're boarded up down there on that side. The back windows are all boarded up. Um she said, "So, if she's willing to give up the key, then just trespass her. Uh if she's not, then yeah, we'll press charges." And that's when you like she hit me with the car, so. You got to solve this. >> What are you talking about? >> Dang. >> I had to show her the window was on my arm actually. >> Yeah. >> Told it all. >> Just made it worse and worse. Uh she backed up and hit an officer with her car, so we had to actually drag her out of her car and now she's on her way to jail. I am going to tow this vehicle. Are you want her charged with trespassing? >> No, you don't have to charge her with trespassing. >> Okay. Yeah, I gave I was there with her on Monday. I just got back from out of town. And when I left Monday, I told her to leave Monday >> Yeah. >> and give her the key on Monday. All this is in the text messages. To give give my grandmother her key when she get the chance. And she just never left. I've been looking at the camera. I'm like, well, damn. >> Right. >> And then I seen her today 4:00 in the morning coming in and out and had another stranger in there. So, I'm just like, oh yeah, it's time to go. >> Okay. All right, sounds good. Well, yeah, send me a picture of your ID and uh and we'll get it taken care of. Unless you're okay with her vehicle being here on the property. I mean, I'm going to have to tow it. >> No, no, you can leave the vehicle there. Um >> I wouldn't do that. Have you talked to your dad? >> No. Actually, I'm trying to keep this away from him. Like real That's actually This is actually insane. This is actually so insane, I don't know. Excuse me, what are you trying I mean, what are you charging me with? >> Charging you with resisting. >> Okay, cool. And my And my vehicle's being towed. Wow. I'll tell you what. Y'all just nasty. Oh, child. You said what? I'll be out today? I know, thank you. Y'all got my phone, y'all got my car, y'all left my windows down. Y'all just don't give a Don't be trying to charge me with nothing else cuz it say on your camera. I'mma make sure I get this damn car number too that you only charged me with just an officer. >> The law that governs this encounter turns on a single question. What an officer may lawfully order a person to do? Under Terry versus Ohio, an officer may briefly detain someone on reasonable articulable suspicion of a crime. A named homeowner reporting an identified occupant inside her house clears that threshold easily. Detention, though, is not the same as leverage. Under California versus Hodari D, a seizure begins the moment a person submits to a show of authority. From that moment, the hold must rest on suspicion of a crime, not on the surrender of disputed property. Recovering a key is a civil remedy, and executing a civil remedy is not the lawful execution of a legal duty. That phrase matters because it is an element the state must prove. The charge here was resisting an officer without violence, a first-degree misdemeanor carrying up to 1 year and $1,000 per count. Three counts stacked produce the 3 years and $3,000 on the record. The statute name and that arithmetic both point to Florida statute section 843.02, though no state is ever named on camera. Two more rules explain why the officers never simply walked in and took the key. Under Payton versus New York, a warrantless entry into a home is presumed unreasonable. Under Illinois versus Rodriguez, a third party can consent only with actual or apparent authority over the place. A complainant on a phone line hundreds of miles away has neither. The force itself is measured by Graham versus Connor from the perspective of a reasonable officer on the scene. A minor property offense weighs against force, but a running vehicle in gear weighs heavily the other way. That tension is what separates the lawful part of this arrest from the part a court may never accept. When a neighbor hands over a house key so it can be passed to a relative, that key carries a purpose and nothing more. Holding it past that purpose and using it to enter converts a favor [clears throat] into a trespass the moment permission runs out. Anyone given a key for a single errand should complete the errand the same day and get a text confirming the handoff. Written confirmation is what turned this homeowner's account into evidence. When an officer says that handing over an object ends the encounter, the safest response is to hand it over and object later. Compliance at the scene costs almost nothing and preserves every argument. Refusal costs a night in jail and hands the state a second charge that has nothing to do with the original dispute. Courts undo unlawful orders, but only for people who are still free to file the motion. When a lawful detention begins, a refusal to give a name rarely helps and often creates the offense. Hiibel versus Sixth Judicial District Court of Nevada allows a state to require identification from a person lawfully detained. Giving a name is not a confession and it does not waive a single right. Silence about the facts is protected, while silence about identity is often just another count. When an arrest is announced and the engine is still running, the most dangerous object in the encounter is the car. Officers are trained to read a vehicle in gear as a weapon, and that reading changes what force becomes reasonable. Placing the transmission in park before any argument begins removes the one factor that escalates a misdemeanor into a felony risk. The argument survives, but the escalation does not. When a property owner wants an unauthorized occupant removed, a phone call from another state is the weakest available tool. Officers cannot verify ownership, tenancy, or damage from a doorbell camera, and they cannot enter a home on absent consent. The statutory removal process or an unlawful detainer filing exists precisely for the case where nobody can prove anything at the door. Filing it first prevents an improvised negotiation from becoming somebody's arrest. The key was found on a chair by the door, a few feet from where the argument began. It was recovered after the arrest, not because of it. Whether three counts survive that sequence is a question for a courtroom, where the presumption of innocence still applies.
