A 911 caller reports a Jeep swerving all over the road. Behind the wheel is Breanna and she still has every chance to make this stop easier on herself. >> It's Sean expired on the 7th. Is that your birthday? >> I >> Is your birthday on the 7th? >> 2 days before. >> Okay. >> I literally just moved here. >> Where from? >> Fort Lauderdale. >> Oh, okay. What brought you here? Where are you coming from tonight? >> 25236 >> I'm going home right now. My boyfriend lives right down there. >> Got you. >> He has my >> driver's license. >> Um I'm sorry, I'm really nervous. I don't know what's going on right now. I don't know what's happening right now. I think I have all this in my email. >> It that's >> it to you, is that okay? >> That's yeah, the mainly the insurance. >> Okay. >> Most people have that on their phones. >> Yeah, okay. >> Are you coming from downtown or just somewhere up McGregor or >> I'm from Fort Myers. >> So I'm going to stay with her. I'm going to shut my headlights off. Breanna, you mind stepping out of the vehicle for me, please? >> I just moved here from Fort Lauderdale. >> Mhm. >> I moved here in April. And I have a house that way. >> Okay. >> And I have him living there and I have all my stuff over here through the other gate. >> Got you. >> Do you want to look at this? I got your driver's license. >> On your phone? You mind stepping out so we can talk? >> No, I'm good here. Thank you. >> Okay. So, the reason why I'm asking is I suspect you to be driving under the influence, okay? So I'm asking if you would like to do field sobriety exercises. >> No, I'm okay. >> So you don't want to do field sobriety exercises. Okay. So if you don't, I'm going to have to make my judgment based off of the things that I've seen so far. Okay? So, you don't You sure you don't want to do exercises with me? Any reason you don't want to do them? >> I have my reasons, too. >> I think that you're driving under the influence. Okay? Based off of your driving pattern, since we're talking to you, I smell alcohol from your mouth and your breath. So, I'm asking if you'd like to. Okay. Can you step out of the vehicle for me? Can you step out of the vehicle for me? You're not going to? Cuz I'm going to pull you out of the vehicle. And I really don't want to do that. Can you please get out? Breanna, I'm not going to ask you again. This is the last time I'm going to ask you. Get out of the car. >> The alcohol gets Breanna into this stop. Her refusal to cooperate makes sure she won't be talking her way out of it. >> Please don't make me do Breanna, I'm not going to ask you again. I'm going to pull you out of the car. Do you really want to make me do that right now? >> information. >> That's irrelevant right now. We're past that. Are you going to get out of the car, yes or no? Okay, come on. >> Yeah. >> Get out of the car. Out of the car. Set your stuff on the hood. Set your stuff on the hood. Hands behind your back. Can you sit on the bumper right here for me? Okay, so you understand what's happening right now? Or do you want me to explain it to you? Okay. So, right now you're being placed under arrest for driving under the influence, okay? Where are the keys to the vehicle? Do you know? Are they in your purse? I didn't see them anywhere. They're in your purse? >> Mhm. >> Okay. So, when we get down to the jail, I'm going to ask you to submit to a lawful test of your breath to determine its alcoholic content. Is that something you'd be willing to do? >> No. >> Okay. So, let me read something to you. >> So, if you refuse to take the lawful test I've requested of you, your driving privilege will be suspended for a period of 1 year for a first refusal, or 18 months if your driving privilege has been previously suspended, or you've been previously fined under subsection 327 35215 for refusing to submit to a lawful test of your breath, urine, or blood. Additionally, if you refuse to take the test I requested of you, and your driving privilege has been previously suspended, or you've been previously fined under that same subsection for refusal to submit to a lawful test of your breath, urine, or blood, you'll be committing a misdemeanor in addition to any other penalties which can be imposed by law. Refusal to submit to the test I requested of you is admissible into evidence in any criminal proceeding. But, this doesn't show the outdated one. As of 13 days ago, for a first refusal, I don't know what your driving record looks like, it's a misdemeanor. Do you have a previous DUI or anything? No? Okay. So, a refusal is a second misdemeanor. >> Okay. >> So, do you still refuse? >> Yeah. >> Okay. Yeah, here we can hang out. I'm going to go talk to him if you're good with her. How are you, sir? I understand you're her boyfriend, correct? >> Correct. >> Okay. Um you can hang on to all that. I ain't worried about all that. Right now, she's going to jail for the UI. Okay? Um the Jeep's going to get towed. Can't let you take it. No, it's registered to her. So, the only person that's allowed to I'm allowed to relinquish ownership of that vehicle to is her. But, obviously, she's not going to be able to do that. Um so, it's going to get towed. She's going to go down to the jail. It's a minimum of 8 hours she'll have to stay there, cuz >> it's a DUI. By the time paperwork and everything gets done and she gets pushed through, she probably won't be able to get picked up until about 8:00 tomorrow morning. By the guess. Uh it's 10:00 now. So. Um. She'll be able to get phone numbers out of her phone once she gets down there, and they'll let her make a phone call. >> Oh, no. It's because you didn't want to get out of the car, and I had to go talk to your boyfriend. So, it's just so that way it's it's safer with more people. >> 5'2" 100 lbs. >> We don't want to yank someone We can do it safely. >> No. No. >> When um white gets here, I'll question there. Um. I don't know when first appearance and all that stuff will be cuz they'll give her like court dates and everything before she leaves. Um. So, she'll just have to give you a call and figure out you bailing her out, picking her up, however that works. So. >> I can't be in the car in the neighborhood. I can't take it. No. >> Or even park it. >> I'm I'm on a on a DUI like this, I have no choice but to >> Totally different. >> So, I actually let somebody pick it up not too long >> While a deputy briefs Breonna's boyfriend, a female officer moves in to search her before placing her in the patrol car. >> Anything on you that could poke >> or hurt me or something? >> Nope. Anything on you at all? >> Mhm. >> I'm just going to search you and then just turn around face the car. Thank you. Spread your feet out for me. Spread out your feet. Thank you. Okay. >> Every chance to cooperate is met with another refusal. By the end of the stop, Breonna is booked on two charges, DUI and unlawful refusal to submit to testing.
