when I so when I the onlyon I'm Sor only I was trying okay yeah so so the two places that I saw you um I'm not sure if you're familiar with town or not um okay by the CVS around 1204 am. on April 30th 2023 patrolman Dominic vanderbrook with the Ocean Township Police Department observed a y 2014 Chevy Equinox swerving towards the fog line on Route 9 in the vicinity of Bryant Road as followed the vehicle he observed the vehicle being driven with its passenger side tires in the shoulder he activated his emergency lights to initiate a traffic stop and the driver pulled over in the area of St Stevens Episcopal Church he notified dispatch about the traffic stop and made contact with the driver who was identified as 26-year-old Nika so it's a little Bend you went around when you went through the light you like your whole car was in the shoulder like you were like driving in the shoulder and then back here um just past the sonoko or right near the sonoko you were driving in the shoulder again like half your car was about oh you live in Trey nice I literally was again not saying it's not your right I'm just saying I was trying to put Myck listen I get it I it happens right um do you have your license registration Insurance on you okay just got to let you know you record on body cam all right um my registration insurance though I literally only bought the car two three days ago so I um only have the do you have the temporary yeah that's fine you where are you guys coming from trade WIS my house trade Wis okay going to the gas station oh all right thank you going to the waa down in B to get here y all right cool what are you guys getting anything good food sandwich all right see salad any good plans for the night just hanging out okay are you still in Seaside Heights I am want Kill the Lights 3 30 in 10 Jersey as he was speaking with Nika and her passenger he detected the odor of alcohol as well as another substance that they had probably smoked based on his suspicion of impairment Nika was eventually asked exit the vehicle and perform field sobriety exercises C we're going to be portable with her are you Michaela yes all right can you me a fa can you talk to the outside the car for a minute appreciate it you're not in trouble or anything I just want to talk to you a little bit okay so normally I'd have to go to the front but we're going to go back here off out of the roadway so we don't get hit by a car okay you want to do just right there thank you oh no over here this way this way we're all out of the roadway people like to uh migrate towards our lights for some reason I get that time rubber neck after the call yeah so um the reason I have you out here is I can smell alcohol in the car and when you first roll down the window it smell like we in the car okay um sln your words a little bit and you're over in the shoulder a lot right we and we we do I'm not mad at you yeah we do it we do this a lot right um what I want to do is I want through a couple tests make sure you're okay to drive all right if you're if you're good to drive I R you the tickets I'll let you go get your food go home the whole night okay um how much have we had to drink tonight though um I drank earlier I haven't drank in about it's I don't know I'm not even going to lie to you it's prob like 11 something at night or whatever I probably last shank 9 something n all right what did how many did you havep shots I'm not going to lie to you a couple shots I've been at her house all night we've been there since like I've been at her house since about 5:00 we have a couple shots together and the only time we' came out is right now cuz we want to go get food what were you drinking tell me it was at least something good okay it wasn't something good it was called 19 crimes and it wasn't good I'm not going to lie you isn't that wine yes you're taking you weren't taking shots of wine I wasn't taking shots of wine I Wasing bottles of wine we got two okay it's been while have I understand have uh how much did we smoke when did we smoke I didn't smoke smoke since easily 3 4:00 3 or 4:00 been quite some time at 5 six hours I got you just questions I have to ask right I'm not I'm at all so all right 3 4:00 what did you smoke I know you smoke did you smoke weed but what like what did you smoke out of a bong a joint I smoke I was just saying out of take just passing it around or okay all right he's going to R through an eye test and then I'm going to run you through two more tests we'll go from there okay okay so do you have any have I stopped toown like a year and a half ago so I don't think so but I had d Le you probably just resemble someone I might have stop how how much does she had tonight she she already told she had a little bit but how much she actually had I'm going to say like probably like a truly can like probably not a lot all right were you guys drinking wine um yes we were red wine all right how many glasses of wine she have um I couldn't two three um four it's my it's my apartment so I'm going to say if I could be completely honest with you and that's all I want I want the honest no no I'm going to be completely honest with you my dad's a cop like my uncle's a sheriff I'm not trying to lie to you or be like dishonest with you I don't I did not keep track of anyone's drinks tonight it is my cousin's birthday she's not driving at all that's fine you know what I mean she's back she's obviously understood I just want to make sure you guys work get where you're going stage I would say like a glass of wine if tight patrolman Russell mer started with the horizontal gaze nagus hgn test the second exercise was the walk and turn test and Nika did not touch Heel To Toe on each step while turning improperly and taking an incorrect number of steps the final exerise was the oneel leg stand test mikaa exhibited a slight Sway and did not count in the perfect sequence yeah it's from don't move your head from here okay cuz you're kind of like falling with your head a little bit and you're moving your eyes at the same time and it's going to P the P okay so keep your hands together I'm going to do it all over again okay good so keep your head straight like I told her if um if her tests are good and everything and she's good to go I'm not going to write any guys of tickets to get your ass going wherever you got to go and home all right um so what is the case cuz I'm not sure it happens if what like if nothing's okay don't if she fails if she fails she'll probably be arrested and then um you guys can get a ride home if you have to get an Uber or it's just a two of us I would offer to to drive you guys back but it's just two of us right now so uh it's a little difficult we had a third guy and say we could drive you back the car is this your car or her car it's she just bought this car like two days ago so if it's her car and sounds like all you guys had a couple drinks and whatnot I'm not going to let you guys drive the car so it has to be to if she's arrested it has to be toad okay um and then we'll go from there but that's that's one thing at a time right yeah we'll handle the situation as right go ahead and do that now put your right foot in front of your left with your right heel touching your left toe just like this okay arms at your sides all right stay in this position and don't start the test until I tell you to do so okay if you step off to the side just get right back into position for me okay do you understand the instructions so far all right when I tell you to begin you're going to take nine Heel To Toe steps you're going to turn and then you're going to take nine Heel To Toe steps back okay when you turn I want you to keep your front foot on the ground and turn around using a series of small steps with your other foot okay while you're walking you're going to look down at your feet you're going to count each step out loud and you're going to keep your arms at your sides okay don't raise your arms for balance keep them right at your sides okay um once you start the test you can't stop at all so what that means is like if you step off you just have to continue okay you can't stop and restart the test or anything like that okay just get back into position for all right you want this one in Fr of the yep perfect all right this is good that's good I'm going to to be fair just so you know before if you feel my toes I got like at least an inch and a half of feet so just so you know like in this um these shoes I have to buy them a little big okay I'll proper 10 I did 10 I guess yep go back make sure you count your steps heel to one off on three off on six off 10 steps okay next one is the oneel leg stand okay um what I want you to do for the oneel leg stand the start position is going to look like this your feet together okay put your Fe together for me touching perfect okay all the way together yeah you can fix it no that's no problem you can either leg approximately 6 in off the ground keeping your foot parallel to the ground okay so what that means is your foot is going to stay parallel like that okay got while your foot's in the air I want you to look down at the raised toe and keep your arms at your sides okay while you're doing that count out loud in the following manner 1,1 1,2 13 and so on okay while you're doing the test just make sure both legs are straight your arms are at your sides and you're looking down at that raised foot and count out like I said okay if you put your foot down off to the side for any reason just pick it back up and start where you left off okay it's going to look like this out of this start position you're going to raise either leg approximately 6 in off the ground keeping your foot parallel to the ground okay look it down at your raised foot both legs straight arm your sides you're going to count out loud in the following manner 1,1 1,2 13 and so on until I tell you to stop okay do you understand the instructions I understand all right do you have any questions I okay uh together for me all the way do you want to fix that lace before you start yeah why don't you retie that shoe consuming alcohol and her inability to satisfactorily complete the field sobriety exercises Nika was placed under arrest after she was placed under arrest a search of her vehicle incident to arrest revealed an open container of tequila her vehicle was later impounded for a 12-hour hold according to John's law okay here's the deal okay um I think personally you shouldn't be driving I think you've had too much to drink you smoked earlier you mixed it two right um I think even without the smoking that you've had too much to drink okay with that being said you're already to placed under arrest for driving W toxc Okay so at this point you're under arrest okay you understand that do you have anything on you that you want us to get to your don't all right with that being said I need need you to turn around for me put your hands on your back okay Jen um so they're resting me Kayla so what happens next need to get in the driver seat no no no no no no listen listen listen we're going to explain it to you okay what happens next is uh you come back to the station with us we process you and then you go back home in a little bit okay you're not going to jail or anything like that all right uh we do have have tow the car by w we don't have a choice my for 12 hours it has to be towed yes we don't have a choice okay um I wish we could do something else with it but I can't I'll get in trouble all right um why can't somebody because you're the registered you registered on the car and your other two passengers also admitted to drinking okay but there's not somebody that could come that drinking and leave there's not unfortunately it's the law we don't have a choice in it unnecessary I have can you give me a little light but listen I I don't make the law all right don't okay can step out patrolman vanderbrook transported Nika to the Ocean Township Police Department for further processing at the station she was red standard statement for motor vehicle operators and she agreed to submit breath samples the trowman merer administered the ALCO test machine her Alco test results indicated a back of 0.11% which was over the legal limit of 0.08% step back here a little bit so I can close the door we're going to walk right up here you're going to see a blue door on your right go right to it when we go in this door there's going to be a bench at the end of the hallway I want you go to down to the bench and take a seat okay go ahead go ahead right there and then I'll get those cuffs off and uh ready SC up you go in here uh when we go in here there's going to be a wall to your right I want you to face the white wall okay [Music] want to take your cuffs off when I do that right cuff is going to come off first okay when it comes off I want you to put your arm up on signed a potential Shar Lighty warning on Nika's behalf the troman vanderbrook issued Nika the following citations operating Under the Influence reckless driving failure to maintain Lane an open container lases can stay on thank you just don't anything crazy with him I don't think you not you want to get out of here I was say let me go then there should be no ISS I'll fix it all right the going to read you this form um at the end just need a yes or no answer for you okay you been arrested for driving while intoxicated njsa 39450 law requires you to submit samples of your breath the purpose of testing to determine alcohol content a record of the taking of breath samples including the test results will be made upon your request a copy of that record will be made available to you after you have provided samples of your breath for testing you have the right at your own expense to have a person or physician of your own selection take independent samples of your breath blood or urine for independent testing if you refuse to provide samples of your breath you'll be issued a separate summons for the refusal a court may find you guilty of both refusal and driving while intoxicated if a court find guilty of the refusal you'll be subject to various penalties including license rev votion of up to 20 years a fine of up to $2,000 installation of ignition interlock and referral to an intoxicated driver Resource Center these penalties may be in addition to penalties imposed by the court for any other offense of which you're found guilty you have no legal right to have an attorney physician or anyone else present for the purpose of taking the breath samples you have no legal right to refuse to give or delay giving samples of your breath any response from you that is ambiguous or conditional in any respect to m that you provide samples of your breath will be treated as a refusal to submit to breath testing even if you agree to take the test but then do not follow my instructions do not properly perform the test or do not provide sufficient breath samples I will charge you with refusal to submit to breath testing I repeat the law requires you to submit samples of your breath for testing will you submit the samples of your breath of course okay you have the right to remain silent ref you to answer any questions anything you say may be used against you in a courter law you have the right to consult with an attorney at any time and have the attorney present before and during questioning if you cannot afford an attorney you may apply to the court and one will be provided if you so desire par questioning decision of we these rights is not final may be withdrawn either before or during questioning you wish to answer questions now without a lawyer present you have the right to stop answering questions at any time court records indicate that on April 16th 2024 nio was found guilty of operating Under the Influence as a result of being found guilty the k had to use an ignition interlock device for 7 months spend 12 hours at an intoxicated driver resource center and pay a total of $690 in fines do you understand the rights that have just been recited to you you say yes or no please yes okay understanding these rights are you willing to relinquish them and answer any questions that we might have okay I'm just going to have you sign this and then print your name okay what's up what's the longest you guys going to keep me in here the longest um it's hard to say so depending on what the results are on the breath lizer if you're above an8 you'll be out of here in I don't know an hour and a half two hours there's like a bunch of paper we got to do which takes up a lot of time for us so that's why it takes so long the most time or that's the shortest time um depending on your result on the on the like I said if you're above an 08 and 08 or above we'll uh we'll have you out probably hour and a half two hours I can't promise anything because that's above you said what about under under so there's something called um so under right you admitted this smer earlier I I think Sor I hate to no no I and you're allow to ask questions and I'm sorry that's okay um you men this smoke earlier right so if that's the cause of your impairment then uh we have what's called drug recognition experts they come out they do an evaluation everything but like I said I think you've had too much to drink do I think the marijuana also has a little bit of aspect in it as well I do you know um so we'll go from there okay one thing at a time um and we we'll just go like that there's a lot of wh ifs and it's just how it is sometimes all right who's a good emergency contact for you all right what's her name okay uh how's your health is it good so you do have kids but they're currently being taken care of right okay all right um that other officer will be in a few minutes he has to hang with you for 20 minutes make sure you don't like burp or belch or anything um and then hope put you on the alest breathalyzer that's what it is and we'll go from there okay you're welcome back uh 12:46 you're welcome Nika had previously been arrested in South Toms River on October 21st 2022 Nika was later arrested again in Tom's River on November 7th 2024 she also has received multiple citations for driving with a suspended registration and as of January 10th 2025 it appears that she has an outstanding warrant from Lakewood for allegedly leaving the scene of an accident involving property damage on November 22nd 2024 what time are you supposed to be home you yeah or did you want what time did you want to be home that's a better question home I told my friend I was like I'm not staying out late 2 in the morning I'm tired I to see my babies in the morning yeah we should have be out out of here by two as long as goes as plan so app no problem
