you have insurance for the vehicle around 10:20 p.m. on November 7th 2023 officer Zachary Burnside with the Pleasant Prairie Department observed a 2022 Honda speeding 75 miles per hour in the 45 miles hour Zone on Green Bay Road he activated his emergency lights to initiate a traffic stop and the driver pulled over on sherida Road near 104th Street he made contact with the driver who was identified as 21-year-old Madison and asked her where she was coming from Madison told officer Burnside that she was coming from her boyfriend's house she would later state that she was a correctional officer for Milwaukee County okay uh what was that address one more time code for what were you doing at your boyfriend's house hang negative how much you have to drink tonight not much I how much is not much nothing legal huh nothing okay so did you have something though no I mean a long time ago at like what time 600 p.m. okay dude I work for oh what I'm not I apolog this guy was trying to race me and you were the only car when you came around the band no I wasn't I promise okay give me a few minutes I'll be right back with you okay ow right so it's like yeah well then it turned into yes but not since 6 p.m. okay well eyes are glossy but blood shot or anything but not just [Music] her but you know all right so you said you had something to drink around 6 right as he was speaking with Madison officer Burnside detected the odor of alcohol and observed other indicators of impairment he asked Madison how much he had to drink and Madison admitted to a Mike's Hard Lemonade earlier that evening he returned to his patrol car to run her information through the system and another officer arrived on scene to assist based on his suspicion of impairment he asked Madison to perform field sobriety exercise yeah okay so what was it my okay and how many one okay I'm all right this guy was trying to me down sh Road I'm so sorry okay so I just want to make sure you're okay to drive though I'm fine injuries or bumps to the Head anything the first field sobriety exercise involved the horizontal gaze nist ormus hgn test during the hgn test officer Burnside observed a lack of smooth Pursuit and distinct and sustained nagus at maximum deviation he did not observe vertical nagus the second exercise was the walk and turn test and Madison failed to touch Heel To Toe on each step turned improperly and used her arms for balance the final field sobriety exercise was the one leg stand test during the one leg stand test Madison failed to raise her foot in the proper fashion and put her foot down before the test was complete during both attempts yeah okay was it like a work thing or the first one um I had two jobs I got a concussion from a [ __ ] M hit my head on pavement and then the other one I didn't report so want to put your feet together hands right down by your side the guy who hit me was about two months ago and then the one I didn't report was two weeks ago stay just steps like this and then take nine back one two three for demonstration purposes I did three but you'll be doing how many n nine during the testing you down at your feet count out loud keep your hands I called yep so we're going to go feet together hands down at your side when I tell you to you're going to lift one foot either foot if you're choosing approximately six in off the ground do you need me to slow it down no I talk a little fast sometimes you do okay so you're going to lift one foot either foot of you're choosing approximately six inches off the ground with both legs straight it's going to look something like this and you keep that foot parallel to the ground you're going to look down at your foot count out loud on the following fashion 101 1002 1003 and so on until I tell you to stop during the test just like the last one you to look down at your foot keep your hands at your side uh keep both legs straight count out loud and then don't stop until you finish the test until I tell you to do you have any questions for me which foot do you want on the left you'll lift your left all right of course go ahead kicking them into sport mode all right whenever you're ready go you know restart I can let you restart go ahead 11 12 going okay you can stop so this last one it's just a preliminary breath test it's non- evidentiary so we can't use it against you it's just to confirm that what I'm seeing is indeed what I'm seeing would you be willing to do that for me if I don't I know I go to jail anyways so not necessarily no we don't take you to jail just for refusing for every other agency out there but it is non evidentiary for us this is not a piece of evidence Wisconsin and city laws are different I thought the Wisconsin law was if I refuse it I automatically lose my license for six months that is a different breath test that is a whole different thing this is non evidentiary it's a preliminary test that test you're talking about ISX this is just yep yeah the one you're thinking is a whole big desktop machine calibrated by the state of WI this is calibrated by us yes I didn't yep yeah so this is just a tool a roadside thing for me see here's my problem a preliminary breath test PBT and the results indicated a BAC of 0.74% based on their erratic driving or indicators of impairment her admission to consuming alcohol her inability to perform the field sobriety tests adequately and the results of the PBT indicating that she was over the legal limit Madison was placed under arrest for operating while intoxicated oboi you're A4 you're moreal Li arrived on scene to conduct a search and subsequently placed Madison in officer burnside's patrol car after Madison was placed in the patrol car officer Diaz searched her vehicle and found an open and empty 16 FZ container of Mike's Hard Lemonade after the search of her vehicle officer Diaz remained on scene until Madison's mother retrieved her vehicle I don't have your phone is your phone in your car probably I thought it was on the back of my it might be okay I want to make sure it's not on the hood of mine somewhere um I'm going to start cracking up the ow site and the ITA do you mind grabbing her phone either off the back of the car or in the car the car while you're there um toss it while I'm in there yes please just real quick just passenger area I know if you did or not no um been arrested for an offense that involves driving or operating a motor vehicle while under the influence of alcohol or drugs or both or you are the operator of a vehicle that was involved in an accident that caused the death of great bodily harm to or substantial bodily harm to a person or you are suspected of driving or being on duty time with respect to a commercial motor vehicle after consuming an intoxicating beverage this law enforcement agency now wants to test one or more samples of your breath blood or urine to determine the concentration of alcohol or drugs in your system if any Test shows more alcohol in your system than the law permits while driving your operating privilege will be suspended if you refuse to take any test that this agency requests your operating privilege will be revoked and you will be subject to other pen penalties the test results or the fact that you refuse testing can be used against you in court if you take all the requested tests you may choose to take further tests you may take the alternative test that this law enforcement agency provides free of charge you also may have a test conducted by a qualified person of your choice at your expense you however will have to make your own arrangements for that test if you have a commercial driver license or we're operating a commercial motor vehicle other consequences may result from positive test results or from refusing testing such as being placed out of service or disqualified in addition your operating privileges will also be susp suspended if a detectable amount of a restriced controlled substance is in your blood will you submit to an evidentiary chemical test of your breath so how you going read that what do you mean nope so they don't the state doesn't allow me ending 279 open officer Burnside transported Madison to the Pleasant Prairie Police Department for further process her intoximeter results indicated a back of11 g210 L of breath after they finished processing her she was released to her mother pending her court appearance after she took responsibility for her she was issued the following citations operating while intoxicated first operating with prohibited alcohol concentration greater than 08 and exceeding speed zones Etc 30 to 34 miles hour uh how do you burn down a fire station uh pretty pretty skillfully I would assume this is going to be taken over by public works and I think it or something like that
