car so I stopped here this is my stuff you got your driver light on October 23rd 2023 around 1:19 a.m. officers with the Union Township Police Department were dispatched from motor vehicle collision involving a 2020 BMW 330 which had struck a park 2016 to Yoda Camry which in turn struck the 2021 Chevrolet Suburban in front when they arrived on scene they noticed the BMW and Toyota had sustained severe damages while the Chevrolet Suburban had also sustained severe damages the driver of the BMW was identified as 28-year-old Justine she informed the officers that she was driving Southbound on Bernett road while a truck in front of her was driving erratically and that caused her to swerve and strike the two-part cars you got ID sir no I don't have anything no all right he's the passenger yeah he's the passenger that's a park [Applause] car all right appreciate that next the next one's Jersey Hotel 7 lima mike Charlie up black [Music] to Jersey Julet 94 Romeo whiskey Sierra it's a black Chevy Suburban yeah it's that one and this car actually smacked into the two Park cars yep driving this way a truck cut her off and she [Applause] had right I'm going call it yeah they're going to that one's on the sidewalk they're going to have to take that one too two you're not hurt or anything I me I just hit my head you need uh an ambulance or you're you're okay you're okay thank you no problem can you start the next up hello you going to drive with this car yeah what happened today a truck he cut me off when I was coming up he cut me off on the Parkway and he turned around and he did like a 360 turn and it made me like lose track of my car where were you coming from that way you're coming from that way yeah so you were coming down this way yeah I was coming down this way cuz I was taking him back on his car okay and he he threw me all the way off because the way he was driving he was driving really Rocky and then he drove onto the parkway like he turned on a 360 turn on the Parkway and he drove onto a a Parkway okay um well unfortunately there's no ramp anywhere close to here except for way up there for turning on to the parkway or8 it's not that far right there the park is right there SE the 78 is over there no I'm talking about turning right here onto aoria the the street that's way back there I mean it's not way back there but that's what he did that so the car turned the car turned onto there and you ended up uh getting here so you going to spin it however you want to spin it it's okay like I'm not I don't want to stay and argue with you um I'm just trying goes 25 down this road I come down this road all the time I work in Berk the heights I work in Union so I come from Berkeley Heights all the way here down here all this time I work officer Kevin mcdna arrived on scene shortly afterwards and as he was speaking with Justine he detected the odor of alcohol and observed other indicators of impairment Justine admitted to consuming alcohol at a friend's house before operating a motor vehicle based on his suspicion of impairment Justine was asked to perform field sobriety exercises I'm a business analyst so I come down this this this street okay all you could you take a step over here for me right here okay just turn around face me all right yes so listen the reason I'm asking these questions and everything okay is I can smell the alcohol coming from you okay I can smell some alcohol coming from you I told you that I had to you know I appreciate you being honest with so like I said you're admitted to you're drinking I can smell the alcohol on you and based on this accident I would like to do some tests with you to make sure that you're okay to drive right like said the purpose ofest going to be okay to drive I'm saying that you were okay to drive that's all it is the purpose of these test is to make sure that you were good to drive that's all for all right so you said do you have any uh medical problems I got to know about or anything like that medical problems yeah any medical problems diabetes anything like that I don't have diabetes no medical issues though that I need to know of my eyes what do you have with your eyes my eyes are issue like that light shining in my my eyes was a issue but officer mcdna started with the horizontal gaze nagus hgn test during the HG and test officer MCD observed the lack of smooth Pursuit distinct and sustained NI stmas at maximum deviation and the onset of nystagmus prior to 45° the second exercise was the walk and turn test during the walk and turn test Justine did not touch Heel To Toe on each step turned improperly and took an incorrect number of steps when returning to the starting position the third exercise was the one leg stand test during the one leg stand test Justine failed to raise her foot in the proper fashion and put her foot down before the test was complete okay do you have any uh pain anywhere any physical problems or anything like that yeah on my back okay my shoulders and you said you didn't want an ambulance right I mean you call an ambulance it's either yes or no if we're going to the hospital or not okay it doesn't change what I'm going to be doing here okay um so like I said so would you be willing to do these tests for me I'll do the test for you okay if you can just stand first test we're going to do just stand with your feet together arms starting position you're going to stay in the starting position with your arms down at your side yep just how I am just how I'm standing going to stand in this position and stay in that position until I tell you to begin the test okay you may get into that starting position now you said the right foot first left foot on the line right foot in front of your left foot okay all right arms down at your side okay so when I tell you to begin you're going to take nine Heel To Toe steps all right nine yep nine Heel To Toe steps make it sure them yep don't worry I'm explain it everything to you and I'm going to demonstrate it to you okay you're going to take nine Heel To Toe steps okay taking nine Heel To Toe steps with your arms down at your side and your eyes are going to be focused on your feet nine okay once you reach your ninth step you're going to take a series of small steps turn around and take nine Heel To Toe steps back counting out loud one I got to take nine here and nine back it's reach your ninth step you're going to turn just like this and nine heila toe steps back one two three all the way to nine okay do you understand the test as demonstrated and okay you can begin the seconds it was in told you stop oh 16 17 18 19 based on the motor vehicle crash the odor of alcohol and her inability to perform the field sobriety exercises satisfactorily Justine was placed under arrest for operating Under the Influence her vehicle was impounded by for a mandatory 12-hour hold under John's law the standard statement for motor vehicle operators was read to her at the scene and she agreed OT submit breath samples before the officers placed her in the patrol car so like said you already gave him your license your registration your insurance and everything like that I gave him everything this okay just put your hands behind your back put some rest of driving under influence okay you don't have anything on you right you don't have anything on you right I my v in my pocket okay where's it at in your pocket pocket 450 so I didn't pass none of the test unfortunately no how not said just move up to the I'm just asking you question no I I'll tell you I'm not trying to argue just want to see what uh pleas I didn't pass any of the test um he told me I didn't but I feel like I did he was the one administering the tests and observing everything so I used train to do that stuff so that's why that's crazy can I fight that you're going to have to go to court anyways for it so um he's going to bring you they're going to do um a test on you just to to determine you process you and you're going to get released you have to wait a couple hours and then yeah he's he's going to just going to S now to see if and um someone's going to have to pick you up cuz you're not going to be able to drive after you get released you just can't after you get you just can't drive all right so I just want you to listen carefully it's everything El on you're here okay so you have an arrest of her driving while Co the law requires you to submit samples of your bre for Content a record of the taking the breast samples including test results we made upon your request a copy of that record will be made available to you after you provided samples of your bre for testing the the right at your own expense they have a personal position of your own selection take independent of your bre test if you refuse to provide samples of you be issued a separate suon for a court may find you guilty of both refusal and driving law o if a court finds you guilty of theas you be subject to various penalties including ration of up 20 years a fine of up to $2,000 installation of interaction referal p and intoxicated Drive res Center these penalties may be in addition to penalties in court for any other offense to account guilty you have no legal right to have attorney position any pres for the purpose of taking of yet have no legal rights are refus to give to given you address and respon you that is ous or conditional in any respect my request Prov of your breath will be treated as a refusal for submit the breath V and if you agree to take the test but then do not follow my instructions do not powerform test or do not provide breast samples I will you with refusal to submit the breast test I repeat the law requires you to submit the samples test I just need I need okay just just go through the process you know the the more you Cate you're cooperating so the more you cooperate the quicker everything will be [ __ ] the uh the more you cooperate the quicker everything transported back to the Union Township Police Department for further processing she was eventually released to her sober adult pending her court appearance after they signed the potential shery warning form on Justine's behalf officer MCD issued her the following citations operating Under the Influence reckless driving careless driving and traffic on Mark [Applause] Lanes there's McDon oh
