Ridge with Police Department responded to a report of a motor vehicle accident near the tire and performance center on 500 Route 17 South as officer kudon arrived on scene he initially made contact with the driver of the truck who told him they observed the other vehicle swerving on Route 17 South all the way from MAA he then made contact with the driver of the 2006 Pontiac G6 identified as Andrea Andrea told officer Knudson that the truck driver had struck her vehicle on the passenger side as she was driving you don't know who it was you were driving where you guys coming from were you driving all right give us a minute okay no he wasn't driving I was driving I own my two businesses I was trying to get start tomorrow had to do few things over here in J start came up here no matter of here [ __ ] [ __ ] where you going too now yeah where you like where are you on your way what time time what time do you think it is I want to say is you think it's around 8:00 8 he's asking me a signs of impairment Andrea displayed a lack of balance refused to follow lawful orders and attempted to walk away from the officers multiple times while Andrea was asked to perform field sobriety exercises she was ultimately placed under arrest to her uncooperative nature and the suspicion of impairment as officer Ward placed Andrea under arrest her boyfriend recorded the officers in attempted to interfere with her arrest Andrea began to resist by tensing her arms and body she also kicked an officer as she was being placed in the patrol car her vehicle was impounded for a mandatory 12-hour hold under John's law and she was eventually transported to the Ridgewood Police Department for further processing okay look again let's go see you back yo yo yo yo yo what is this what are you doing resisted K she refused to do that she was found to comply with a lawful order we were detaining her she assaulted officer Ward you have any other questions come down to the police department you can operation and her statements that we had probably was her cor company and also to uh her uh obstruction interfering with our ability run our last if she's also refusing for the um the field Surety test that's a factor with all of this so yeah you have PL the and then um so she resisted arrest M um and uh she kicked me she kicked me okay yeah so yeah those are all more charges and then uh this guy he was filming us I told him that he actually got a good view of the kick on his camera so I told him not to delete the tape that we might have take him as a ter winess to get the tape yeah do that so yeah he's allowed to film us that's problem you have your camera I mine but yeah he might have a better view of her cuz he was like right on so okay if we were going to do that how do how do we do it do we have give him the option to email us the video email the video to us right now otherwise we can seize the phone can't search it until we get a search for it but we can seize it because there's evidence of an assault on yeah um so he can email us the video he did right now if he wants to if he doesn't want to he just has to we're going to take the phone and then we're going to get a search warrant for okay so that way he's going to be out of his phone for a while but hey I don't know I'm not going to say nothing bad but I mean look for crap that there on he had a bag a little greenish bluish colored bag when he came out of the car could Bailey walk and he was putting it in a Lu W off they rolling it up and stuff in between the seats so they were F and open so when this started he barely get out of car he started getting L with me like he rolled a what color was the bag it's like a dark greenish Brown the bluish color bag but there was a Reese's rapper that they just dumped on the ground that he yelled at him for the other guy yelled at him for littering I guess he picked up shoved it in between the seats of the pass hey Doug you just check yeah uh before I do um hold on uh passenger side in between the seat there's a Rec's container yes did you look inside of it not yet they stuffed a uh a package in there okay the truck driver saw it hey Doug have step back we might have something me's that might have something else where are you guys head where you guys from watch uh yeah maybe so he said that he stuffed it in a Rec I have a I saw her reading it when we pulled up I actually us new pants up right my [Music] L I'll get the light for you [Applause] West 17 so truck driver said that he saw her drop that and then they picked it up and stuck like a blue W like wrapper in there that they George head the did you check that Reese's did you check it already yeah God knows she could have ingested some she's definitely High that's my that's my that's my gut feeling there's the way she was standing just the way she was SW it was hard it it didn't I saw it and she didn't do it once we got her like you know stabil like standing but walking to here and walking around here she was she was staggering a lot that she doesn't know how this happened and that's the she still doesn't know how it happened yeah and he's you know and that's yeah the officer that one time like you guad he just assaulted one of us or just no we're not we're not going to go that way we're going to the car yeah what did she do kick someone she KCK this offic that's where to report us but the angle that you had when she kicked it it was actually better than our cameras probably have so that's why I asked what happened cuz I couldn't see I'm just telling you that your camera was was facing that way so I just talk to the lieutenant we're going to give you two options okay remember I talked about being a material witness all right the first option is that you voluntarily email that video to one of us so that we can take it in as evidence you still get to keep the video for your own usage number two is if you refuse to then we then we would seize the cell phone and get a war okay no problem I yeah I'll give you guys the video because I in I couldn't even see your pi and I understand that not you're not supposed to put hands on the officer and nothing but I I understand frustrated if if she would have just I know but I understand that but she was very lost and confused because he literally swiped us and then you guys show up and pull her out of the eventually released to a sober adult pending her court appearance after they signed the potential shery warning form on Andrea's behalf since Andrea had resisted arrest and assaulted a law enforcement officer she was issued to criminal summonses for allegedly violating to see 29 to2 a resisting arrest and to see 29 to 1A obstruction of justice officer kudon isssued her the following traffic semences as well operating Under the Influence consent to take samples of breath and failure to possess driver insurance card um yes you know why because she be yeah yeah it's co what's that phone oh yeah um okay I'm not taking this one off I will loosen it for you but I'm not taking it completely off okay iang how was organizing you're insulting my housekeeping here I'm insulting all right that's requires you to submit the samples of your breath for the purpose of testing to determine alcohol content a record of the taking of the breath sample including the test results will be made upon your request a copy of that record will be made available to you after you have provided samples of your breath for testing you have the right at your own expense to have a person or position of your own selection take the independent samples of your breath blood or urine for independent testing driving if you refuse to provide samples of your breath you will be issued a separate summons for the refusal a court may find you guilty of both refusal and driving while intoxicating want I don't even know what if a court finds you guilty of the refusal you will be subject to various penalties including license revocation for up to 20 years a fine of 20 $2,000 installation of ignition interlock and referral to an intoxicated driver Resource Center these penalties have been may be in addition to penalties imposed by the court for any other offense which you are found guilty you have no right no legal right to have an attorney position or anyone else present for the purpose of taking breath samples you have no legal right to refuse to give delay giving samples of your breath any respon you that is ambiguous or conditional respect that one to my request that you provide bread samples will be treated as a refusal to submit to breath testing even if you agree to take the test but then do not follow my instructions do not properly perform the test do not provide sufficient breath samples I will charge you with refusal to submit to breath testing I repeat the law requires you to submit samples of your breath for testing will you submit samples of your breath I'm so all of that of okay your answer is not acceptable La requires you to submit the samples of your breath for breath testing if you're not answer or answering anything other than yes you'll be charged with refusal you will be charged with the refusal now I ask you again will you submit to breath testing I said no okay no you should have the rightone you still need to running machine yeah a condition of her guilty plea Andrea was required to use an ignition interlock device for 3 months and spend 12 hours at an intoxicated driver Resource Center the citation for failure to possessed
