Description

REAL POLICE BODYCAM footage captures the emotional moment when a mother faces the reality of a DUI arrest and must decide whether to consent to a breath test. This bodycam video documents the critical legal process where implied consent laws are explained and a suspect makes decisions that will impact her case.

In this police bodycam footage from December 28, 2024, Pamela Moreno becomes visibly distressed following her DUI arrest in Santa Fe, New Mexico. Her immediate concern shifts to her children as she repeatedly exclaims: "Oh, my God. My babies' gonna be so fucking—" The officer attempts to redirect her attention: "Pamela. Oh, my God. I don't fucking care. Pamela. No! Are you gonna— It doesn't matter!"

When faced with the crucial breath test decision, Moreno continues expressing anxiety about her family's reaction: "They're gonna be so fucking mad at—" The officer emphasizes the legal importance of this moment: "Listen to me. Look, Pamela, this is really important because it's gonna determine what charge you're gonna get charged with, okay? I want you to understand what's happening." Despite this, Moreno remains focused on her children: "No! Oh, my God. They're gonna be so fucking mad at me... My babies are gonna be so fucking—"

The officer warns about enhanced charges if she doesn't listen: "Okay, if you're not gonna listen to me, you're gonna get charged with aggravated DUI. Okay?" After her continued emotional responses, the officer proceeds with the arrest: "You are under arrest for driving under the influence." Moreno responds with resignation: "Whatever you want, baby."

Following standard protocol, the officer reads the New Mexico Implied Consent Act: "The New Mexico Implied Consent Act requires you to submit to a breath test to determine the alcohol content of your blood. After you take our test, you have the right to choose an additional independent test." The explanation continues with details about independent testing options and who covers the costs.

The officer then seeks explicit consent: "Do you agree to take our breath test, Pamela?" After initial hesitation, Moreno ultimately agrees: "Yes." The officer continues to explain what would have happened upon refusal: "I cannot force you to take our test, but if you refuse, you will lose your New Mexico driver's license or nonresident operating privilege for one year. If you are convicted in court of driving while under the influence, you may also receive a greater sentence because you refused to be tested."

After confirming Moreno understands, the officer explains the next steps: "I just need to look into your mouth real quick, okay? Just to make sure you got nothing else in there. And then we'll get on our way, okay? I'm gonna be super respectful to you the entire time, and I feel like I have been to this point. And if you have any questions, you can always ask me, okay?"

This police bodycam footage highlights the emotional and legal complexities of DUI arrests, especially when suspects have family concerns, and demonstrates the methodical process officers follow to ensure proper consent for chemical testing.
