Description

REAL POLICE BODYCAM footage captures the administration of a breath test during a DUI investigation in Santa Fe, New Mexico. This bodycam video documents the critical evidentiary procedure that can determine whether a driver faces serious impaired driving charges.

In this police bodycam footage from December 28, 2024, an officer instructs Pamela Moreno on how to properly perform a breath test after she was stopped for a stop sign violation at the intersection of W Alameda Street and Entrada. The officer provides clear instructions: "Put your mouth on th- on this mouthpiece and blow in as hard as you can, okay?"

The officer then prepares Moreno for the test with a countdown: "Ready? Go." As Moreno begins to blow into the device, the officer provides continued encouragement and guidance: "Ready? Go, go, go, go, go, go, go, go." This coaching, captured on bodycam, demonstrates the importance of obtaining sufficient breath volume for an accurate reading.

When the device obtains an adequate sample, the officer immediately notifies Moreno: "Right there, you're good. You're good, you're good, you're good." This confirmation, recorded on bodycam, indicates the successful collection of a breath sample that will provide important evidence regarding Moreno's blood alcohol concentration.

The breath test represents a critical juncture in DUI investigations, often serving as primary evidence to establish blood alcohol content (BAC) above legal limits. In New Mexico, driving with a BAC of .08% or higher constitutes per se impairment, while aggravated DUI charges can result from levels of .16% or higher, refusal to submit to testing, causing bodily injury, or having prior DUI convictions.

Prior to this breath test, officers had observed signs of impairment during the initial traffic stop and conducted Standardized Field Sobriety Tests (SFSTs), which provided probable cause for the breath test request. Following this test, Moreno was arrested for aggravated DUI and transported to the Santa Fe Adult Detention Center.

This police bodycam footage highlights the standardized procedures law enforcement officers follow when collecting breath evidence in DUI cases, demonstrating both the technical and human elements of impaired driving investigations.
