Description

REAL POLICE BODYCAM footage captures the moment a DUI suspect learns officers may be investigating her for hitting someone with her vehicle. This bodycam video documents the shocking revelation during processing and the suspect's immediate denial despite invoking her right to an attorney.

In this police bodycam footage, an officer appears to reference a hit-and-run incident while speaking with 46-year-old Shawn Mullarkey: "You ran over... you hit a man with her car." This statement, captured on the bodycam, suggests the DUI arrest may have stemmed from or included a more serious vehicular incident involving a pedestrian.

Mullarkey responds with immediate shock and denial: "I hit a man? Who did I... who did I hit?" This reaction, recorded clearly on police bodycam, shows her apparent surprise at the allegation, suggesting she may have been unaware of striking someone or is genuinely confused by the claim.

The officer properly acknowledges her previous invocation of her right to counsel: "Well I can't ask you questions about it because you want to talk to your attorney." This procedural compliance, documented on bodycam, demonstrates proper adherence to Miranda restrictions once a suspect has requested legal representation.

Despite previously demanding an attorney, Mullarkey immediately offers a denial: "I never hit a man with my car." This statement, captured on the bodycam, contradicts her earlier insistence on speaking only with legal representation present and may constitute a spontaneous utterance admissible despite Miranda protections.

The officer provides a measured response suggesting evidence contradicts her denial: "Well that's not the picture that's brought us to meet you today." This carefully worded statement, recorded on bodycam, indicates officers have information or evidence suggesting a vehicular incident occurred without directly questioning her after her attorney request.

According to court records, this 2022 incident in Hinsdale, Illinois ultimately led to Mullarkey pleading guilty to aggravated driving under the influence of alcohol, aggravated assault to a peace officer, and resisting or obstructing a police officer. Her plea agreement required participation in the DuPage County Mental Illness Court Alternative Program.

This police bodycam footage highlights how DUI investigations sometimes involve additional serious allegations, and captures the delicate balance officers must maintain in providing information without violating Miranda protections after a suspect has requested an attorney.
